El artículo aborda de modo breve la extensa producción epistemológica y metodológica de Hugo Zemelman. El esfuerzo está centrado en mostrar su potencialidad no como reemplazo de un modo aceptado de hacer investigación científica, sino más bien en valorizar una forma diferente de hacer el recorte del campo de observación y posterior intervención en el mismo. A partir de este objetivo, se revisan categorías relevantes de la propuesta, procurando conformar un “corpus” de conocimiento coherente y pertinente a los fines de (...) comprender el planteo que realiza el autor estudiado.The article briefly summarizes the extensive epistemological and methodological production of Hugo Zemelman. The effort shows its potentiality not as a replacement of an accepted mode of scientific research, but in give value to a different form to make the frame of the observation field and later its intervention. Later, I review his main categories, trying to create a coherent and pertinent ‘corpus’ of knowledge in order to comprehend the proposal from the author. (shrink)

La Universidad Nacional de la Patagonia Austral (UNPA) es una de las tres universidades nacionales de más reciente creación en Patagonia (luego vinieron Río Negro y Tierra del Fuego). No es objeto de discusión la ampliación de oportunidades en el acceso a la educación superior que ello supuso. Sin embargo, más recientemente, la transformación de la modalidad de enseñanza de presencial a virtual valiéndose de las Tecnologías de la Información y la Comunicación (TIC’s), visualizadas como “democratización de la educación superior”, (...) ha permitido multiplicar el número de inscriptos pero no (en términos porcentuales y a la fecha de cierre del análisis) el de egresados. En el artículo, a partir de cuantificar los diversos comportamientos, se procura dimensionar el impacto que sobre el comportamiento de la matrícula ha tenido la implementación de un modelo de Educación a Distancia sustentado en el empleo de las TIC’s (trasladando todo el proceso educativo a la mediación tecnológica en la plataforma virtual), que ha venido a suplantar la modalidad presencial (que podríamos denominar como “tradicional”, en el sentido de que conserva los rasgos centrales de una escolaridad de cursado cotidiano en el ámbito físico de la universidad).La metodología de indagación aquí utilizada es cuantitativa y se observan las carreras de educación de una de las unidades académicas de la UNPA. Las tablas permiten avanzar en el objetivo de caracterizar la dinámica de la matrícula mientras el cursado fue presencial y luego, cuando se pasó a la modalidad virtual, procurando comprender las trayectorias académicas desarrolladas por los estudiantes y el impacto que el cambio de modalidad pudo haber tenido. Como corolario, exponemos reflexiones que pueden ser útiles para seguir pensando el impacto de las TIC’s en la educación superior. (shrink)

En este artículo se revisa el impacto que la formación en investigación tiene sobre los modos en que las decisiones metodológicas son asumidas y, más aún, sobre la propia concepción de metodología con la que se piensa y ejecuta una investigación en ciencias sociales. Precisamente, es desde el interior de este campo y desde la mirada sociológica, que se formulan algunas reflexiones en torno al propio habitus de investigador social, valiéndonos para ello de los aportes de Pierre Bourdieu.This article analyses (...) the impact of research training on the methodological decisions in the social sciences. Sexual lust – understood as a feeling of sexual attraction towards another – has traditionally been viewed as a sort of desire or at least as an appetite akin to hunger. I argue here that this view is, at best, significantly incomplete. Further insights can be gained into certain occurrences of lust by noticing how strongly they resemble occurrences of “attitudinal” (“object-directed”) emotion. At least in humans, the analogy between the object-directed appetites and attitudinal emotions goes well beyond their psychological (...) structure to include similar ways in which their occurrence can be introspectively recognized, resulting in similar extensions of their functionality and meaningfulness to the subject. I conclude that although further research is needed, given the strength of the analogy, the ability of lust to satisfy some general requirements for being an emotion, and perhaps certain neurological findings, lust may somewhat uniquely straddle the line between appetite and emotion. This article reconsiders Hannah Arendt’s account of “totalitarianism” in light of the climate catastrophe and the apparent inability of our political-economic system to respond to it adequately. In the last two chapters of The Origins of Totalitarianism, Arendt focuses on the “ideology” of totalitarian regimes: a pathological denial of reality, a privileging of the ideological system over empirical evidence, and a simultaneous feeling of total impotence and total omnipotence—an analysis that maps remarkably well onto the climate zeitgeist. Thus, while Arendt (...) used the concept of “totalitarianism” to foreclose alternatives to liberal capitalist democracy, the climate impasse suggests that the totalitarian label more properly belongs to the prevailing system itself. How can dispute records shed light on the study of dispute settlement processes and their social and political underpinnings? This volume addresses this question by investigating the interplay between record-making, disputing process, and the social and political contexts of conflicts. The authors make use of exceptionally rich charter materials from the Iberian Peninsula, Italy, and Scandinavia, including different types of texts directly and indirectly related to conflicts, in order to contribute to a comparative survey of early medieval dispute records and (...) to a better understanding of the interplay between judicial and other less formal modes of conflict resolution. An ongoing debate in the philosophy of emotion concerns the relationship between two prima facie aspects of emotional states. The first is affective: felt and/or motivational. The second, which I call object-identifying, represents whatever the emotion is about or directed towards. “Componentialists” – such as R. S. Lazarus, Jesse Prinz, and Antonio Damasio – assume that an emotion’s object-identifying aspect can have the same representational content as a non-emotional state’s, and that it is psychologically separable or dissociable from the emotion’s (...) affective aspect. Some further hold that emotions have no object-identifying aspects of their own, and can properly be said to be about things only in virtue of their associations with other mental states (such as beliefs or perceptions). By contrast, “blenderists” – such as Peter Goldie, York Gunther, and Matthew Ratcliffe – insist that the two aspects are indissociable, because the affective aspect “infuses” the object-identifying aspect, altering the subject’s concept or percept of the object. As a result, an emotion’s object-identifying aspect cannot possibly have the same representational content as any non-emotional state’s. I argue that the strongest blenderist arguments fail to rule out plausible componentialist alternatives, and that the blenderists’ broader motivations are orthogonal to structural issues. (shrink)

The relationship between emotional arousal and long-term memory is addressed in two experiments in which subjects viewed either a relatively emotionally neutral short story or a closely matched but more emotionally arousing story and were tested for retention of the story 2 weeks later. Experiment 1 provides essential replication of the results of Heuer and Reisberg and illustrates the common interpretive problem posed by the use of different stimuli in the neutral versus emotional stories. In Experiment 2, identical slides were (...) used in both the neutral and arousal stores. Two different stories were created by varying the narration that accompanied each slide. In both experiments, subjects who viewed the arousal story both experienced a greater emotional reaction to the story than did the subjects who viewed the neutral story, and subsequently exhibited enhanced memory for the story. Subjects in Experiment 2 who viewed the arousal story also recalled more slides than did the subjects who viewed the neutral story. This effect was greatest for story phase 2, the phase in which the emotional slide narration occurred. Because this enhanced retention of the story slides cannot be explained by any differences in the slides themselves, the results provide new evidence to support the contention that emotional arousal influences long-term memory in normal human subjects. [This paper will be presented at the APA Eastern Division Conference in New York City, January 2024] -/- Can one reasonably doubt that one is voluntarily making a commitment, even when one is doing so? Given that one voluntarily makes a commitment if and only if one (personally) knows that one is doing so, the answer appears to be “No.” After all, knowing implies justifiably believing, and it seems impossible that one could (synchronically and from a single personal perspective) reasonably (...) doubt what one justifiably believes. Indeed, assuming that one reasonably doubts that P only if one has sufficient evidence to believe that not-P, traditional epistemologists may hold that such “epistemic ambivalence” entails one’s believing a contradiction, while some Bayesians should hold that it entails violating “probabilism” (the norm that credences must conform to the axioms of probability). However, I argue that in at least some cases of romantic commitment-making, such ambivalence may not only be epistemically permissible, but even required, and perhaps best dealt with pragmatically. This article responds to four critics of Democracy in Spite of the Demos and reiterates its central thesis. Christopher Holman and Théophile Pénigaud attempt to maintain the critical value of democracy by invoking different elements of the deliberative tradition, while Benjamin Schupmann answers my charges by appealing to a strong liberal constitutionalism. I argue that these attempts repeat the ambivalence described and criticized in the book: democracy is taken as an end in itself, but with asterisks that introduce conditions and (...) qualifications. As long as democracy is only desirable given certain caveats, the critical weight is placed on these caveats and not on the figure of democracy. Andrew Norris takes a different approach, interrogating the book’s use of ideology critique and the concept of “socially necessary delusion.” This intervention presents difficulties to the concluding suggestion of the book, but I maintain that that these difficulties can be productive and generative rather than limiting or prohibitive. The intelligent-seeming deeds of computers are what occasion philosophical debate about artificial intelligence (AI) in the first place. Since evidence of AI is not bad, arguments against seem called for. John Searle's Chinese Room Argument (1980a, 1984, 1990, 1994) is among the most famous and long-running would-be answers to the call. Surprisingly, both the original thought experiment (1980a) and Searle's later would-be formalizations of the embedding argument (1984, 1990) are quite unavailing against AI proper (claims that computers do or someday (...) will think ). Searle lately even styles it a "misunderstanding" (1994, p. 547) to think the argument was ever so directed! The Chinese room is now advertised to target Computationalism (claims that computation is what thought essentially is ) exclusively. Despite its renown, the Chinese Room Argument is totally ineffective even against this target. (shrink)

In this essay, I attempt to measure various prevailing democratic theories against an argument that Carl Schmitt advances in the first chapter of his ‘Crisis of Parliamentary Democracy’. In practice, he claims there, democratic politics is compelled to introduce a distinction between ‘the will of the people’ and the behaviour of the empirical people, thus justifying the bracketing and unlimited suspension of the latter in the name of the former, even to the point of dictatorship. I argue that no contemporary (...) approach to democracy as a fundamental value is able to mount a compelling response to this critique and that we should therefore reconsider the status of democracy as a normative commitment. I proceed by carefully and closely reading Schmitt’s chapter and then by juxtaposing various currents of democratic theory (including liberal, deliberative, epistemic and various hybrids thereof) with the trajectory of Schmitt’s argument. This essay is therefore less of a contribution to Schmitt scholarship, in the sense that it does not take a panoramic view of his corpus to determine his final stance on democracy, and more of an intervention into contemporary democratic theory using Schmitt’s argument as a kind of lever. Em 2019, o Papa Francisco convocou jovens para refletir sobre como alcançar uma economia mais justa e inclusiva. O livro "Realmar a Economia: a Economia de Francisco e Clara" é resultado dos estudos do Grupo de Reflexão e Trabalho para a Economia de Francisco e Clara (PUC Minas), organizado pelo sociólogo Eduardo Brasileiro. Nesta resenha, iremos apresentar brevemente alguns pontos debatidos na obra, com o intuito de incentivar a leitura desse importante trabalho.

Can one’s belief that one romantically loves another be false? If so, under what conditions may one come to reasonably doubt, or at least suspend belief, that one does so? To begin to answer these questions, I first outline an affective/volitional view of love similar to psychologist R. J. Sternberg’s “triangular theory”, which analyzes types of love in terms of the degrees to which they include states of passion, emotion, and commitment. I then outline two sources of potential bias that (...) may cause one to believe that one romantically loves another when one does not. Partly on the basis of those potential sources of bias and partly on the basis of more specific issues, I then argue that at least to the extent that one is aware of these issues, one may reasonably doubt that one is experiencing romantic love’s emotional feelings, and one may reasonably doubt that one is making romantic love’s commitments. Finally, I order by relative dubitability the propositions that must be true about one’s passions, emotions, and commitments toward another in order for one to romantically love them. (shrink)

Retributivism is generally thought to forbid the punishment of the innocent, even if such punishment would produce otherwise good results, such as deterrence. It has recently been argued that because capital punishment always entails the risk of executing an innocent person, instituting capital punishment is tantamount to intentionally taking innocent lives and therefore cannot be justified on retributive grounds. I argue that there are several versions of retributivism, only one of which might categorically forbid risking punishing innocent persons. With the aim of reflecting on a Pedagogy of the Franciscan Schools, the Franciscan Itinerary took place from February to December 2022, with the participation of collaborators and teachers from the schools maintained by the Charitable and Literary Society of St. Francis of Assisi - North Zone (SCALIFRA - ZN). The training consisted of webinars and evaluative activities, with themes extracted from works from the Franciscan writings. In this paper I argue that punishment should be proportional to desert; that desert turns solely on culpability and not on results: that culpability is a function of what the actor perceives are the risks of his act to others’ interests and the reasons he perceives that might justify, excuse, or aggravate taking those risks; that because culpability is a complex function, ordinally ranking acts in terms of culpability is quite difficult; that converting the ordinal ranking into cardinal measures of (...) deserved punishment must perforce be controversial; and that deserved punishment, which is deserved suffering, must somehow deal with the fact that the actor may have already suffered undeservedly. This paper discusses the possibility of an absolute vacuum - a space without any substance. The motivation of this study is the contrast between most philosophers, up to Descartes, who stated that a vacuum was impossible, and the 17th century change of outlook, when the possibility and effective existence of the vacuum was accepted after the experiments of Torricelli and Pascal. This article attempts to show that, contrary to the received opinion, the acceptance of an ether is preferable to the (...) acceptance of a vacuum for several reasons. First: it is impossible to provide an empirical proof of the non-existence of the ether; second, an absolute vacuum is unthinkable; third, the ether concept is useful for the understanding of physical phaenomena; and fourth, the hypothesis of an ether in apparently void spaces is useful for the future development of science. The paper also endeavours to show that no recent advance of science changed those conclusions and that no future development can change them. (shrink)

This dissertation focuses on psychological and epistemological issues related to our practice of accepting first-person reports of emotional state as knowledgeable. It concerns the epistemic warrant of beliefs having the form "I'm feeling X about Y" and "Y is making me feel X about Z", where X refers to an affective state, and Y and Z refer to situations. On the assumption that such "emotion-based" beliefs are true if and only if they accurately represent the "situation-directed" emotions they are about, (...) much attention is given to the initial issue of what an emotional state is. A feeling-centered, componential view of emotion is defended, one in which occurrent emotions are held to be extrinsically related combinations of affective and cognitive aspects. While the view is held to be consistent with current appraisal theories of emotion, such theories are criticized as being formally incomplete. It is argued that an adequate theory of the emotional system must distinguish between the two independent sub-processes of "affect-causation" and "affect-direction", but that appraisal theory is concerned only with the former. The model of a single emotional system with two sub-processes is defended against the objection that "affect-program" and "higher cognitive" emotions must be produced by different psychological systems. ;A notion of emotional rationality is defended that is consistent both with a feeling-centered, componential view of emotion, and with the modularity of the emotional system. It is argued that both the rationality and modularity of emotion help to facilitate the noninferential production of emotion-based beliefs. A reliabilist approach to the warrant of such beliefs is defended against its main "constitutivist" alternative, and a general entitlement to such beliefs is outlined. In the course of outlining the conditions of noninferential emotion-based knowledge, the notion of an "emotion-based equivalent" is developed: a relevant alternative state of affairs that can defeat a claim to such knowledge even when all other epistemic conditions are satisfied. However, it is argued that there is no convincing reason to think that these defeating conditions are prevalent enough to prevent us from having noninferential emotion-based knowledge in most cases. _The Chinese room argument_ - John Searle's (1980a) thought experiment and associated (1984) derivation - is one of the best known and widely credited counters to claims of artificial intelligence (AI), i.e., to claims that computers _do_ or at least _can_ (someday might) think. According to Searle's original presentation, the argument is based on two truths: _brains cause minds_ , and _syntax doesn't_ _suffice for semantics_ . Its target, Searle dubs "strong AI": "according to strong AI," according to Searle, "the (...) computer is not merely a tool in the study of the mind, rather the appropriately programmed computer really _is_ a mind in the sense that computers given the right programs can be literally said to _understand_ and have other cognitive states" (1980a, p. 417). Thomas Nagel contends that the actual philosophical problem in the meaning of life is the independent world we live in, and only requires a self-transcendent being who glimpses an independent world. I argue that Nagel is mistaken to think that self-transcendence evokes the same anxiety for humans living in the world of Dante as Darwin. Nagel’s view from nowhere is rather a modem version of the world. Secondly, while I concede that there is a common anxiety felt by self-transcendence in (...) glimpsing an independent objective world, we also view that world through a set of beliefs that conditions how we see that world. In connection with John Searle's denial that computers genuinely act, Hauser considers Searle's attempt to distinguish full-blooded acts of agents from mere physical movements on the basis of intent. The difference between me raising my arm and my arm's just going up, on Searle's account, is the causal involvement of my intention to raise my arm in the former, but not the latter, case. Yet, we distinguish a similar difference between a robot's raising its arm and its robot arm just (...) going up. Either robots are rightly credited with intentions, or it is not intention that distinguishes action from mere movement. In either case full-blooded acts under "aspects" are attributable to robots and computers. Since the truth of such attributions depends on "intrinsic" features of the things not on the speaker's "intentional stance," they are not merely figurative "as if" attributions. (shrink)

Hauser replies that performances in question provide prima facie warrant for attributions of mental properties that appeals to consciousness are empirically too vexed and theoretically too ill connected to override.

The apparently intelligent doings of computers occasion philosophical debate about artificial intelligence . Evidence of AI is not bad; arguments against AI are: such is the case for. One argument against AI--currently, perhaps, the most influential--is considered in detail: John Searle's Chinese room argument . This argument and its attendant thought experiment are shown to be unavailing against claims that computers can and even do think. CRA is formally invalid and informally fallacious. CRE's putative experimental result is not robust and (...) fails to generalize from understanding to other mental attributes as claimed. Further, CRE depends for its credibility, in the first place, on a dubious tender of the epistemic privilege of overriding all "external" behavioral evidence to first person disavowals of mental properties like understanding. ;Advertised as effective against AI, Searle's argument is an ignoratio elenchi, feigning to refute AI by disputing a similar claim of "strong AI" or Turing machine functionalism metaphysically identifying minds with programs. AI, however, is warranted independently of FUN: even if CRA disproved FUN this would still fail to refute or seriously disconfirm claims of AI. Searle's contention that everyday predications of mental terms of computers are discountable as equivocal "as-if" predications--impugning independent seeming-evidence of AI if tenable--is unwarranted. Lacking intuitive basis, such accusations of ambiguity require theoretical support. The would-be theoretical differentiation of intrinsic intentionality from as-if intentionality Searle propounds to buttress allegations of ambiguity against mental attributions to computers, however, depends either on dubious doctrines of objective intrinsicality according to which meanings are physically in the head or on even more dubious notions of subjective intrinsicality according to which meanings are phenomenologically "in" consciousness. Neither would such would-be differentiae as these unproblematically rule out seeming instances of AI if granted. The dubiousness of as if dualistic identification of thought with consciousness also undermines the epistemic privileging of the "first person point of view" crucial to Searle's thought experiment. In recent years, scholars have put forth a formidable defense of Kant's views on moral motivation. Their common goal has been to disclose the emotional dimension of his practical philosophy, an aspect of his thought arguably concealed by a couple of centuries of wrongheaded criticism. Yet a systematic study of the subjective factors that underlie moral performance as Kant understood it was missing. This dissertation tries to fill that gap. I reconstruct his theory of moral performance since 1755, and show (...) why he ends up developing views that have aroused so much criticism. I share many of those criticisms and ask: Why do we have to assume that pure reason has driving mechanisms of its own? In order to answer this question, I focus first on what he calls the aesthetic preconcepts that make the mind susceptible to concepts of pure duty, and conclude that he does not succeed in showing a convincing connection between the moral law and the feeling of respect. Moreover, the theory that he puts forth to overcome this difficulty--the fact of reason--proves to be even more unsatisfactory. Problems beset his view of conscience as well. I show that the conception of the self that supports his definition of conscience is vulnerable to the change of self-deception. I finish with an examination of the religious beliefs that keep moral interest alive, but my conclusion is once more not favorable to Kant. Those beliefs seem to have no power for accomplishing the function that he has reserved for them. It could even be argued that they are intrinsic to the process of self-deception. (shrink)

Nous analysons quelques particularités du traité, en le comparant à d’autres travaux astronomiques du xvie siècle, et nous discutons ses sources probables. Nous soutenons que l’influence du commentaire de Christoph Clavius sur la Sphæra de Sacrobosco ne peut pas être considérée comme son influence unique ou principale. Le traité de (...) Galilée était probablement inspiré par la Sfera del mondo de Piccolomini, un travail qui anticipait plusieurs particularités du Trattato della sfera. The Nature and Origins of Mass Opinion (1992) provided both a powerful framework for analyzing public opinion and a highly influential account of the role of political elites in shaping public opinion. Zaller's subsequent work has focused less on the mechanics of opinion change than on the role of public opinion in the broader political process. This evolution has entailed sustained attention to V. O. Key, Jr.'s concept of ?latent opinion??the opinion politicians are likely to face in the next election, (...) as distinct from what is currently measureable in surveys. It has also entailed a downgrading of the importance attached to Media Politics??the attempt to govern on the basis of words and images that diffuse through the mass media??relative to Party Politics??the substance of party performance.? In recent work, Zaller and his colleagues have emphasized the key role of interest groups and activists in shaping parties' policy choices, largely free of effective constraint by the mass public. This work provides a rather more pessimistic take on ?The Question of Elite Domination of Public Opinion? than does the epilogue to The Nature and Origins of Mass Opinion. (shrink)

This paper considers the radical democratic theory of Chantal Mouffe and Ernesto Laclau with reference to the recent rise of Right-wing populism. I argue that even as Mouffe and Laclau develop a critical political ontology that regards democracy as an end in itself, they simultaneously exclude certain elements of the demos. In other words, they appeal to formal categories but decide the political content in advance, disqualifying Right-wing movements and discourses without justification. This ambivalence between form and content reveals the (...) limits of Mouffe and Laclau’s brand of radical democracy for understanding and critiquing the present political conjuncture. (shrink)

The hallmark of modern liberalism is its embrace of the Millian harm principle and its antipathy to legal moralism. In this article I consider whether aesthetic regulations can be justified under the harm principle as that principle has been elaborated by Joel Feinberg. I conclude that aesthetic and other regulations that most liberals regard as unproblematic are actually instances of legal moralism.

Existing and proposed provisions of the Model Penal Code refer to believing something “recklessly.” In this chapter, we examine the notion of reckless beliefs and determine what that notion cannot be and what it might be.

Are our rights—to our bodily integrity, to our possessions, to the goods and services promised us, and so on—matters of fact, or are our rights functions of others’ beliefs about how their acts will affect our rights? The conventional view states that subjective oughts—based on what we believe—determine culpability, whereas objective oughts—based on the facts—determine permissibility. After all, the idea that our beliefs about how our acts would affect others’ rights might affect the contours of those rights themselves appears deeply (...) paradoxical. For how can others’ rights be based on our beliefs when those beliefs have as their objects not themselves but others’ rights? Nonetheless, paradoxical as that position may appear, a strong case can be mounted in its defense, not by focusing on the rights themselves, but by focusing on the acts that imperil those rights. It is the burden of this essay to make a case for the belief-relativity rather than the fact-relativity of rights. (shrink)

This work has two objectives. The first is to begin a mathematical formalism appropriate to treating particles which only interact with each otherindirectly due to hypothesized memory effects in a stochastic medium. More specifically we treat a situation in which a sequence of particles consecutively passes through a region (e.g., a measuring apparatus) in such a way that one particle leaves the region before the next one enters. We want to study a situation in which a particle may interact with (...) other particles that previously passed through the system via disturbances made in the region by these previous particles.Second, we apply the type of stochastic process appearing in this context to the stochastic interpretation of quantum mechanics to obtain a modified version of this interpretation. This version is free of many of the criticisms made against the stochastic interpretation of quantum mechanics. (shrink)

The psychology of ownership is rooted in self-ownership. The human brain has an evolved interoceptive sense of owning the body that supports self-ownership and the ownership of external things as extensions of the self-owning self. In this way, evolutionary neuroscience supports a Lockean liberal conception of equal natural rights rooted in natural self-ownership.

This article considers Sartre's perspective on political violence with reference to his 1948 play _Dirty Hands_. Focusing on the concrete political questions that confronted Sartre in his context, it traces the development and result of conversations with Merleau-Ponty, Camus and the Marxist tradition that shaped his thinking on this subject. At the end of this dialectical process, Sartre arrived at a position that refused both bourgeois humanism, with its disavowal of political violence, and what is here termed Official Communism – (...) the prevailing Manichean politics of his day and the institutionalized repression that went along with it. In other words, he affirmed the violence of the political without by that token affirming the politics of violence. It is argued here that these conversations and this conclusion are dramatically illustrated in Dirty Hands. (shrink)

ABSTRACT Relativism and discussions of the relativity of human judgment have played an important role in philosophy since the 1950s. Such claims are regarded by many as the enemy of realism, the view that human judgments can be valid with respect to their objects as those objects obtain independent of the judgments. Most relativisms assert the relativity of human judgment to some trait of the judge, hence are anthropic. But there is another kind: objective relativism. It was espoused by some (...) of the American pragmatists of the early to mid-twentieth century. Their hope was that objective relativism was compatible with realism while avoiding dualism and idealism. It claimed things themselves are relative. The view eventually disappeared. This article examines this neglected doctrine, not to determine its truth, but its nature. What kind of theory was it, what could it claim to accomplish, and what could it not? Some of its proponents regarded it as a naturalistic metaphysics, but this is problematic. This topic is suggestive for the formulation of a naturalism that rejects physicalism yet is compatible with science and realism. (shrink)

Necessity is a notoriously dangerous and slippery concept-dangerous because it contemplates virtually unrestrained killing in warfare and slippery when used in conflicting ways in different areas of international law. Jens David Ohlin and Larry May untangle these confusing strands and perform a descriptive mapping of the ways that necessity operates in legal and philosophical arguments in jus ad bellum, jus in bello, human rights, and criminal law. Although the term "necessity" is ever-present in discussions regarding the law and ethics (...) of killing, its meaning changes subtly depending on the context. It is sometimes an exception, at other times a constraint on government action, and most frequently a broad license in war that countenances the wholesale killing of enemy soldiers in battle. Is this legal status quo in war morally acceptable? Ohlin and May offer a normative and philosophical critique of international law's prevailing notion of jus in bello necessity and suggest ways that killing in warfare could be made more humane-not just against civilians but soldiers as well. Along the way, the authors apply their analysis to modern asymmetric conflicts with non-state actors and the military techniques most likely to be used against them. Presenting a rich tapestry of arguments from both contemporary and historical Just War theory, Necessity in International Law is the first full-length study of necessity as a legal and philosophical concept in international affairs.
