Die Frage moralischer und/oder rechtlicher Grenzen der Meinungsfreiheit, der Grenzen des Sagbaren und Tolerierbaren, stellt zunehmend eine gesellschaftliche und politische Metadebatte dar, in der Versuche, komplexe Phänomene des Aushandelns von Grenzen des Zulässigen bzw. Notwendigen semantisch zu fixieren, von erheblichem Lagerdenken zeugen. Wer von „Politischer Korrektheit“, „Cancel Culture“, „Meinungsdiktatur“ oder „Kontaktschuld“ spricht, steht klar auf der einen Seite, so scheint es; wer von „Diskriminierung“, „Rassismus“, „Hassrede“ oder „weißen Privilegien“ spricht, auf der anderen. Vor dem Hintergrund solch verfestigter Diskursbahnen stellt die (...) Frage, ob wir alles tolerieren müssen, was andere sagen, eine Erwägungsaufgabe dar, die nur mit einem Schritt zurück überhaupt adressierbar ist, will man nicht mit dem Jargon der einen Seite die Anliegen der anderen ausschließen und damit den ungeprüften Eindruck befördern, es handle sich hier tatsächlich um eine unversöhnliche Polarisierung, der die Philosophie nichts hinzuzufügen habe, außer vielleicht ein Lamento oder eine moralische Geste. Der Umweg, über den ich im Folgenden die von dieser Schwerpunktausgabe gestellte Frage behandeln möchte, führt zunächst zu einer Analyse der Ansprüche, die plurale Demokratien an ihre Mitglieder stellen. Diese sind nicht nur grundsätzlich hoch, sondern mitunter auch in sich konfliktträchtig. Konkret betrifft dies die Anforderung an Mitglieder demokratischer Gemeinwesen, sowohl bürgerliche Toleranz zu üben als auch diskursives Engagement als Vorbedingung qualitätsvoller demokratischer Meinungsbildung und Entscheidungsfindung an den Tag zu legen. Die jeweils ‚richtige Mitte‘ lässt sich dann am besten finden, wenn die Risiken zweier Extreme bewusstgemacht werden, die daran geknüpft sind, dass einerseits ein zu hohes Maß an ziviler Toleranz zulasten diskursiven Engagements geht und andererseits ein Mangel an bürgerlicher Toleranz diskursives Engagement gefährdet. Entlang dieser beiden Formen einer verhängnisvollen Dysbalance des demokratischen Ethos möchte ich Grundzüge einer demokratischen Ethik der freien Rede und freien Widerrede herausarbeiten und Implikationen für Grenzen von Meinungsfreiheit bzw. Johannes Drerup schlägt für normativ-politische Kontroversen ein Kriterium vor, anhand dessen bestimmt werden soll, wann diese Kontroversen legitime Unterrichtsthemen sind und in Folge dem Kontroversitätsgebot unterliegen. Dies ist dann der Fall, wenn für kontroverse Fragen „auf Basis politischer Grundwerte und -prinzipien, die als konstitutiv gelten können für die Ermöglichung eines guten persönlichen und politischen Lebens in liberal-demokratischen Staaten, keine eindeutige Antwort abgeleitet werden kann.“ Zu diesen Grundwerten und -prinzipien zählt Drerup auch „Grund- und Menschenechte“. Mein kurzer Beitrag möchte zeigen, weshalb (...) Drerups an sich fruchtbarer Ansatz die Komplexität des Maßstabes „Grundund Menschenrechte“ tendenziell unterschätzt und insbesondere das Verhältnis von Demokratie und Menschenrechten zu wenig als potenzielles Spannungsverhältnis ernst nimmt. Ich schlage daher weitere Differenzierungen vor, um Drerups Kriterium konzeptionell zu schärfen. Zudem rege ich an, Kontroversen, die Drerups Kriterium nicht genügen, aus didaktischen Gründen dennoch eine gewisse Anfangs-Kontroversität zuzugestehen, um die Bedeutung der betreffenden Grundprinzipien, die als „rote Linien“ fungieren, deutlicher herausarbeiten zu können. According to a libidinally charged slogan, Social Networking Services are meant to give "people the power to share and make the world more open and connected." But does the digital act of sharing personal information – invested in so many of the New Social Media – make such internet domains a public realm? What characterizes actually the public according to classical political theory, and what sort of performances become visible in digital fora under the banners of interactivity, friendship and an (...) alleged dissolution of boundaries? Against the background of increasingly elastic borders between things considered private and spaces declared public as well as of a remarkable spectrum of modes of sharing – ranging from disclosing daily trivia to collectively expressing political dissent – our contribution will examine the ambivalence of sharing in Social Net-working Services, not least in Facebook, in terms of a paradoxical nexus of passions and risks. In our era of globalization, migration increasingly enforces cultural heterogeneity at the level of single societies and countries mirroring the cultural heterogeneity at the macroscopic level, i.e. the planet. Thus, the question of intercultural understanding and coexistence not only is crucial when it comes to states, but is increasingly gaining in importance in terms of identifying preconditions that enable individuals from various cultural backgrounds to share one commonwealth. At present, a growing number of people are convinced that this challenge is (...) not easily met due to what are believed to be fundamental moral disagreements between ‘western’ and ‘non-western’ (in particular, Islamic) culture(s). Against this background, different proposals have been provided to rise to the above-mentioned challenge. One of them is to allow for ‘cultural’ justifications in matters of criminal law. In this article I try to outline the state of discussion on claims for a ‘cultural defense’ by identifying and analysing three distinct rationales: the argument from pluralism; the argument from fairness; and the argument from necessity. Yet the very nature of dehumanization remains relatively poorly understood. A sample of college women and men responded to a survey assessing attitudes, beliefs, experiences, and behaviors relevant to sexual harassment and assault. Men were more tolerant of sexual harassment, more likely to believe that heterosexual relationships were adversarial, more likely to subscribe to rape myths, and more likely to admit that they might sexually assault someone under some circumstances. Data from the present study support the proposition that relevant affective, cognitive, and behavioral indices of hostile sexuality directed against women (...) are linked, supporting the assumption of a continuum of misogyny. Significant positive correlations were predicted and found among men's self-reported tolerance for sexual harassment, adversarial sexual beliefs, rape-myth acceptance, likelihood to rape, and experience as a sexual victimizer. Among women, belief and attitude measures were positively correlated but, as predicted, experience of sexual victimization was not reliably related to any other measure, supporting the conclusion that personal characteristics are not relevant to college women's sexual victimization. Las mujeres desafiaron la condición de "inferiores", "incapaces" o "dependientes" a que las destinaba su esencia femenina. Eligieron la literatura, la ciencia y la filosofía para expresarse. Incluso, en los períodos más adversos por la censura pública, algunas de ellas teorizaron en diarios íntimos o epístolas. Muchas veces se les prohibió el uso de la palabra y de la pluma, o simplemente fueron asesinadas por proseguir sus investigaciones. Durante largos períodos, no les fue permitido firmar con nombre propio sus textos, (...) para no deshonrar a sus familias, figurando su obra como de "autor anónimo". Superada la etapa de anonimato forzado, la mayoría firmaba con su inicial y su apellido paterno o marital, o un seudónimo masculino, desdibujándose así su autoría. Lo cierto es que la mayoría de las filósofas tuvo que esperar hasta el siglo XX para que sus obras fueran rescatadas del anonimato. Las mujeres llevaron a cabo un debate interesante respecto de la no-sexuación del alma. Desde la Antigüedad, la mayoría de los filósofos varones sostuvo una concepción dualista del ser humano, es decir, en términos de cuerpo y alma unidos pero separados o separables. Ellos sostuvieron que la carne o cuerpo material limitaba al alma o la razón. Y como los cuerpos de las mujeres sufren procesos que no controlan -menstruación, embarazo, lactancia-no alcanzan la perfección, son materia imperfecta, haciéndolas esto más débiles, fofas y frágiles. Sin embargo, ellas siempre entendieron al "alma" o "razón" como a-sexuada y al "cuerpo" como portador de las marcas del sexo, de la raza u otras. Es decir, que un mismo argumento les valió para desmontar la jerarquización de los sexos y de las razas impuesto al pensamiento a lo largo de los siglos. Por esto, para conocer las ideas, la obra y los aportes de estas mujeres, Ellas lo pensaron antes. The symposium, “How is gender relevant to comparative philosophy,” focuses on relevance of gender as an analytic and critical tool in comparative philosophical understanding and debate. Nkiru Nzegwu argues that gender as conceived by contemporary Euro-American feminism did not exist in pre-colonial Yorùbá as well as many Native American societies, and that therefore employing gender as a conceptual category in understanding the philosophies of pre-colonial Yorùbá and other non-gendered societies constitutes a profound mistake. What’s more, doing so amounts to a (...) totalizing Euro-American colonial imposition that does violence to nongendered societies that reject gender as an ontological category. Hence, gender is ill-suited as a universal comparative philosophical tool. Nzegwu’s three co-symposiasts, Mary I. Bockover, Maitrayee Chaudhuri, and María Luisa Femenías enrich and complicate this question by bringing to bear both conceptual, ethical and empirical considerations drawn from the United States, India, and Latin America respectively. This paper examines different kinds of definite descriptions denoting purely contingent, necessary or impossible objects. The discourse about contingent/impossible/necessary objects can be organised in terms of rational questions to ask and answer relative to the modal profile of the entity in question. There are also limits on what it is rational to know about entities with this or that modal profile. We will also examine epistemic modalities; they are the kind of necessity and possibility that is determined by _epistemic_ constraints (...) related to knowledge or rationality. Definite descriptions denote so-called _offices_, roles, or _things to be._ We explicate these α-offices as partial functions from possible worlds to chronologies of objects of type α, where α is mostly the type of individuals. Our starting point is Prior’s distinction between a ‘weak’ and ‘strong’ definite article ‘the’. In both cases, the definite description refers to at most one object; yet, in the case of the weak ‘the’, the referred object can change over time, while in the case of the strong ‘the’, the object referred to by the definite description is the same forever, once the office has been occupied. The main result we present is the way how to obtain a Wh-knowledge about who or what plays a given role presented by a hyper-office, i.e. _procedure_ producing an office. Another no less important result concerns the epistemic necessity of the impossibility of knowing who or what occupies the impossible office presented by a hyper-office. (shrink)

Empowerment in healthcare is becoming increasingly popular, including in obstetrics, because of its benefits for both individual health and health promotion. Many authors and organizations, such as the World Health Organization, advocate it as a means of engaging communities in the adoption of health-promoting behaviors and fostering patient-centered care. It aims to enable patients to assert their decisions and choices while respecting their personal values. This desire to respect the uniqueness and autonomy of each individual echoes a number of ethical (...) principles and theories. In this article, the authors aim to answer the question, How can the concept of empowerment in healthcare contribute to bioethics? They argue that it has important links with feminist bioethics, notably the theory of relational autonomy, as well as with the capability theory of economist and philosopher Amartya Sen. (shrink)

The positive psychology landscape is changing, and its initial identity is being challenged. Moving beyond the “third wave of PP,” two roads for future research and practice in well-being studies are discerned: The first is the state of the art PP trajectory that will continue as a scientific discipline in/next to psychology. The second trajectory links to pointers described as part of the so-called third wave of PP, which will be argued as actually being the beginning of a new domain (...) of inter- or transdisciplinary well-being studies in its own right. It has a broader scope than the state of the art in PP, but is more delineated than in planetary well-being studies. It is in particular suitable to understand the complex nature of bio-psycho-social-ecological well-being, and to promote health and wellness in times of enormous challenges and changes. A unique cohering focus for this post-disciplinary well-being research domain is proposed. In both trajectories, future research will have to increase cognizance of metatheoretical assumptions, develop more encompassing theories to bridge the conceptual fragmentation in the field, and implement methodological reforms, while keeping context and the interwovenness of the various levels of the scientific text in mind. Opportunities are indicated to contribute to the discourse on the identity and development of scientific knowledge in mainstream positive psychology and the evolving post-disciplinary domain of well-being studies. The central theme of the volume is cultural diversity, a vast subject that is highly relevant today. The particular focus here is on the many ways in which this diversity is managed within the framework of State law. The twelve contributors to this book have a special interest in how cultural traditions and their various forms of expression are handled by the law. They were all participants in the 2009 Research Programme of the Centre for Studies and Research of the (...) Hague Academy of International Law. The breadth of the subject is reflected in the wide spectrum of perspectives from which the topic has been explored. Starting in each case from the existing State and international legal frameworks, the contributors explore how the interactions between positive law and other normative orders can be placed at the service of a legal system that is as fair as possible within a plural context. According to rule-consequentialism’s moral criterion, a given action is morally right if and only if it complies with an ideal code of rules, regardless of the consequences of that action. Rules are to be assessed by their consequences, not actions. This being so, one of the many accusations that have been made against rule-consequentialism is that it can turn suboptimal decisions into morally right decisions and optimal decisions into morally wrong decisions. After all, in certain circumstances, a rule that has (...) the best consequences overall can require an action that does less good or forbid an action that does more good. This is the core of the original rule-worship objection. However, recently, different versions of rule-consequentialism have been developed in order to address that challenge. This paper focuses on three of them, those offered by Brad Hooker, Susan Wolf, and David Copp. My claim is that their arguments, however ingenious, are unsuccessful, because they are innocuous if the charge is reformulated as it should be. The purpose of this text is to tell the story of the implementation of the _Act Respecting End-of-Life Care,_ referred to hereafter as _Law 2_ (Gouvernement du Québec, 2014) with an emphasis on the ambiguous role of ethics in the Interdisciplinary Support Groups (ISGs), created by Quebec's _Ministère de la santé et des services sociaux_ (MSSS). As established, ISGs provide “clinical, administrative and ethical support to health care professionals responding to a request for Medical aid in dying (MAiD)” (Gouvernement du (...) Québec, 2015). It is suggested that their composition includes the participation of a person with an expertise in ethics. These ISGs represent an important innovation for stakeholders involved in MAiD. To date, no scientific research has specifically addressed ISGs and little research has been conducted in other jurisdictions on the roles, operations and practices of MAiD support structures, especially the implication of ethics. Several ISGs have certainly developed promising practices that could benefit all stakeholders in the wider field of ethics and end of life. We will explore the development of ISGs in Quebec as a support structure for MAiD by highlighting the role that ethics has played (and should play) in these morally and humanly challenging situations. Quadruple Helix Collaborations (QHCs) is a cooperation model in which industry, government, academia, and the public interact to innovate. This paper analyses the impact of a training intervention to provide specific knowledge, skills, and attitudes to deal with barriers commonly found in the progress of QHCs. We designed, implemented, and evaluated three training programs in Austrian, Colombian, Danish, and Spanish institutions. We analysed trainees’ (n = 66) and trainers’ (n = 9) perceptions to identify the competencies acquired with the intervention (...) and the approach’s limitations. We used online questionnaires (35 trainees; 9 trainers), semi-structured interviews (10 trainees), and a focus group (6 trainers). Trainees answered positively regarding their self-perception about the impact of the course and highlighted the acquisition of inspiration for their practice (score 4.1 out of 5.0) and knowledge (3.7). In contrast, they perceived that a deeper interaction with other participants (2.7) was challenging. After the courses, 74% of respondents indicated that they know more about how QHCs work in practice, and 86% about collaboration or engagement methods. Moreover, participants plan to be more sensitive towards setting common goals (71%) and power imbalances (63%). Trainers’ perceptions align with those expressed by participants, except that they considered that the interaction amongst participants during the course was higher. Qualitative analysis of interviews with participants and the focus group with trainers provides more detail about the strengths and weaknesses of the intervention. Our study shows that the collaborative design and implementation of training impact the participant’s learning competencies, with potential implications in their medium- to long-term practice. The central aim of this article is to specify the ontological nature of constitutive mechanistic phenomena. After identifying three criteria of adequacy that any plausible approach to constitutive mechanistic phenomena must satisfy, we present four different suggestions, found in the mechanistic literature, of what mechanistic phenomena might be. We argue that none of these suggestions meets the criteria of adequacy. According to our analysis, constitutive mechanistic phenomena are best understood as what we will call ‘object-involving occurrents’.
