States are in the process of creating controversial legislation aimed at subjecting ‘harmful’ online communication on social media and search engines to new regulatory regimes. Critics argue that these measures are serious threats to the right to freedom of expression and freedom from surveillance. This article first draws on elements of systems theory to reframe the right to freedom of expression in democracy as a means of protecting the value of generalised second-order observation. Taking the UK’s Online Safety bill as (...) the paradigm example of the new laws, the article analyses the concept of harmful communication at three levels: society, organisation, and subject. It identifies a shift in the law’s epistemic approach to communication, by which individuals are reconfigured from agential subjects into contingent users, whose capacities are determined by the structure of online communication platforms. In this configuration, norms previously considered indispensible are relegated to second-order effects of the affordances of media. Arguing that it is insufficient to merely reaffirm subjective rights in light of this shift, the article suggests systems theoretical analysis as a means of identifying lines of critique. (shrink)

Company–community agreements are widely considered to be a practical mechanism for recognising the rights, needs and priorities of peoples impacted by mining, for managing impacts and ensuring that mining-derived benefits are shared. The use and application of company–community agreements is increasing globally. Notwithstanding the utility of these agreements, the gender dimensions of agreement processes in mining have rarely been studied. Prior research on women and mining demonstrates that women are often more adversely impacted by mining than men, and face greater (...) challenges in accessing development opportunities that mining can bring. Nonetheless, there is currently little guidance for companies, government or communities in bringing a gender perspective to the fore in mining and agreement processes. It is undisputed in human development literature that investment in women and sensitivity to gender delivers long-term health, education and local development outcomes. In mining and development, a number of key factors remain unexplored. These include: women’s participation in agreement processes, the gendered distribution of agreement benefits, and the extent to which impacts and benefits influence women’s development and economic inclusion. This paper presents the results of the first phase of an applied research project undertaken by the Centre for Social Responsibility in Mining at The University of Queensland and funded by the Minerals Council of Australia and the Department of Foreign Affairs and Trade. The project sought to connect with experienced practitioners who had been directly involved in mining and agreement processes to document and analyse grounded perspectives on gender dynamics and agreements, and connect those experiences with the broader literature. Findings from this study have implications for the role of mining companies and governments in promoting gender equality and empowerment as part of their commitments to sustainable development. They also have implications for community groups and their representatives in terms of how they might engage in agreement processes to maximise women’s participation and influence. In many social contexts, a key challenge will be navigating the territory of cultural norms and gender equality, particularly in cultures where women’s influence in the public sphere is not strong. The authors argue that without consideration of a gender perspective, including gender’s intersection with other factors such as class, race, poverty level, ethnic group and age, mining agreements will not be inclusive, may exacerbate gender inequalities, and fail to contribute to long-term sustainable development. Yet because of its contingent temporality, freedom and "the political" are constantly forgotten. Keenan Middlebury College Salvation history is a Western theological strategy based on biblical ideas about how God acts in history to bring about the salvation/deliverance of God's people. It begins with the scriptural accounts of creation as the inception of God's plan. It moves to describe Israel's deliverance from slavery in (...) Egypt and goes on to depict the guidance the Lord Yahweh provides for his people throughout their journeys and despite their trials and reverses.Israel may be idealized in scripture as God's domain, sovereign among the nations, but in fact it was a small country sandwiched between the two superpowers of the day—Egypt and Assyria (or Babylon), and subject to the rise and fall of those empires. 1 The New Testament goes on to describe God's plan in sending his son Jesus to effect salvation and unite all people in him (Eph. 1:1-16). The passion, death, and resurrection of Jesus comprise the central drama, in which we all are invited to participate. The author of Luke/Acts gives an account of how God moves through the teachings and the life and death of Jesus to establish his Church and how that Church evolves from a small and marginal community to enter and permeate the very heart of the Empire at Rome. The story continues in postscriptural Christian history, from Constantine's vision at Milvian Bridge to the Christianization of Europe, and further to the missionary endeavors to convert all peoples to the path of the Gospel. The first Buddhist histories were written not in India but in Tibet, some thousand years after the birth of the Buddha Sakyamuni. Indian traditions in their focus on the eternal truth (sanatana dharma) turned away from the concrete flow of events and from any recording of their progression. The first part will treat Mahayana philosophy and argue that despite its Indian lack of historical consciousness, it does possess the tools for writing history. Its teaching that all events are empty (sunyata) is coterminous with its teaching that all events arise in dependence upon a host of causes and conditions (pratitya-samutpada). In a word, emptiness itself entails a radical insight into the contingent and conventional historicity of events (dharmas). Beyond this, since all events are seen as empty of any abiding core essence, Mahayana deconstructs the very idea of an eternal world truth over and apart from the everyday world of events. It proclaims, rather, that to an awakened person, all is "worldly convention-only" (samvrti-matra). 2 This focus on the radical conventionality of events can serve, I would argue, as a needed corrective to a literalistic reading of salvation history. Most healthcare providers work from ethical principles based on a Western model of practice that may not adhere to the cultural values intrinsic to Indigenous peoples. Breaking bad news is an important topic of ethical concern in health research. While much has been documented on BBN globally, the ethical implications of receiving bad news, from an Indigenous patient perspective in particular, is an area that requires further inquiry. This article discusses the experiences of Māori lung cancer patients and their families, (...) in order to investigate the ethical implications of receiving bad news. Data collection occurred through 23 semistructured interviews and nine focus groups with Māori lung cancer patients and their families in four districts in the Midland Region of New Zealand: Waikato, Bay of Plenty, Lakes and Tairāwhiti. The findings of this study were categorised into two key themes: communication and context. Avenues for best practice include understanding the centrality of the HCP–patient relationship and family ties in the healthcare journey, and providing patients with the full range of viable treatment options including hope, clear advice and guidance when the situation calls for it. Overall, the findings of this study hold implications for providing culturally safe and humanistic cancer care when BBN to Māori and Indigenous patients. (shrink)

Most foundational texts on theological ethics address the person or the society; the point of departure determines, inevitably, fairly different trajectories. By starting with the experience of grief, this book posits the human as ineluctably social: grief is an epiphany that reveals how the human is inseparable from the collective. Indeed, grief inevitably summons us to grieve socially. Nothing discloses the human more rawly than grief that "it is not good for the human to be alone." Keenan then develops (...) an ethics of vulnerability, following Judith Butler, understanding it not primarily as a compromised state of being but rather as that which establishes the human as capacious for recognizing and responding to others. Mutual recognition, a theme that can be found from Georg Hegel and Sigmund Freud to Axel Honneth, Nancy Frasier and Jessica Benjamin, emerges as the first moral act of the vulnerable human. In light of vulnerability and recognition, Keenan shows how we can now understand conscience as guiding the activity of one who has first vulnerably recognized others. The second half of the book works out a Christian ethics of vulnerability, starting with discipleship, then grace and sin, then the virtues, and finally the communion of saints, the works of mercy, and the beatitudes. The dispute between two of Princeton Theological Seminary's leading Barth scholars concerning theological ontology invites engagement from the contemporary Thomistic tradition. On the one hand, McCormack argues that, in a fully Barthian theological ontology, divine triunity is constituted by the pretemporal election of Jesus Christ. On the other hand, Hunsinger contends that this election is expressive of an antecedent trinity. In the light of scholastic disputes between Dominican and Franciscan theologians, McCormack's proposal is seen to resemble aspects of the Bonaventurean (...) account of triune relationality, particularly the account of procession as constitutive of personal distinction and the affirmation of a primordial ‘primity’ adhering to the Father's innascibility. Whilst McCormack seeks to avoid an undetermined originary plenitude, his treatment of the divine attributes as logically consequent to election risks attributing to pretemporality a status akin to originary primity. Affirming, with Hunsinger, an eternal trinity antecedent to election, the Thomistic tradition nonetheless contains the resources necessary to prevent this antecedence becoming a dissociative antecedence. As such, Thomism preserves divine aseity whilst equally safeguarding against the disconnection of logos asarkos from logos incarnandus that McCormack regards as an unwarranted metaphysical speculation that bypasses the particularity of revelation in Jesus Christ. This essay examines 10 developments that have helped shape the future of bioethics in a time of HIV/AIDS.

Discussions of genetic enhancements often imply deep suspicions about human desires to manipulate or enhance the course of our future. These unspoken assumptions about the arrogance of the quest for perfection are at odds with the normally hopeful resonancy we find in contemporary theology. The author argues that these fears, suspicions and accusations are misplaced. The problem lies not with the question of whether we should pursue perfection, but rather what perfection we are pursuing. The author argues that perfection, properly (...) understood, has an enormously positive function in the Roman Catholic tradition. The author examines three sources: the Scriptures, the scholastic tradition, and ascetical theology. He examines contemporary criticisms of perfectionism and suggests that an adequate virtue theory keeps us from engaging perfectionism as such. Over the past forty years, the administrations of American colleges and universities have developed and expanded the ranks of contingent faculty as an alternative to the tenure line. While acknowledging the gross inequities that divide these two tracks, this essay attempts to awaken tenure-line ethicists through the concept of recognition to the conditions of their colleagues and then argues through the concept of vulnerability that faculty are deeply and unavoidably related, and concludes that through solidarity ethicists from both lines might (...) work together toward the university becoming a more ethical workplace than it presently is. How is a disease contracted, and how does it progress through the body? Answers to these questions are fundamental to understanding both basic biology and medicine. Advances in the biomedical sciences continue to provide more tools to address these fundamental questions and to uncover questions that have not been thought of before. Despite these major advances, we are still facing conceptual and technical challenges when learning about the etiology of disease, especially for genetic diseases. In this review, we illustrate this (...) point by discussing the causal links between molecular mechanisms and systems-level phenotypes in molecular diseases. We begin with an examination of sickle cell anemia, and how mechanisms of the disease have been comprehended over the last century. While sickle cell anemia involves a mutation in a single protein in a single cell type, other diseases involve mutations in networks with many protein interactions and in diverse cell types. We introduce the challenges that result from these differences and illustrate the current obstacles by discussing the RASopathies, a recently discovered class of developmental syndromes that result from mutations in signaling networks. Methods to study mutant genotypes that lead to mutant phenotypes are discussed, particularly the use of model organisms and mutant proteins to study protein interactions that may be important for development of disease. These studies will point toward the future of diagnosing and treating genetic disease. (shrink)

Using the very “logic” of Klossowski’s own reading of the eternal return, Blanchot will call this possibility of redemption into question. Blanchot’s reading of Nietzsche’s eternal return draws attention to that moment when death as possibility _turns into_ death as impossibility. Appreciating Thomas Aquinas' argument that conscience is neither a power or a habit, but rather an act, the essay argues that Aquinas' inclination synderesis, that prompts us to the good and away from evil, functions in a way similar to vulnerability. This work presents the structure, distribution and semantic interpretation of quantificational expressions in languages from diverse language families and typological profiles. The current volume pays special attention to underrepresented languages of different status and endangerment level. Languages covered include American and Russian Sign Languages, and sixteen spoken languages from Africa, Australia, Papua, the Americas, and different parts of Asia. The articles respond to a questionnaire the editors constructed to enable detailed crosslinguistic comparison of numerous features.
