During the last decade corporate reputation as one of the central efforts of corporate citizenship behavior has gained increasing attention in scholarly research, as has the way that reputation can serve as an instrument for business purposes. This poses the question of how such reputation will be achieved. To answer these questions this article examines Cicero’s considerations concerning the interrelation of honorableness and beneficialness made in his work ‘On Duties’. Based on Cicero’s understanding of universal natural law and his (...) idea that reputation derives solely from honorable behavior and the orientation in the common good, we show that also corporate reputation is achieved only if it is based primarily on ‘honorableness’, and that reputation is lost if financial interests override the intentions of honesty of a company. The question of the moral status of AI and the extent to which that status ought to be recognised by societal institutions is one that has not yet received a satisfactory answer from lawyers. This paper seeks to provide a solution to the problem by defending a moral foundation for the recognition of legal personhood for AI, requiring the status to be granted should a threshold criterion be reached. The threshold proposed will be bare, noumenal agency in the Kantian sense. (...) Agency has been identified by Alan Gewirth as the source of the rights claims of our own species and, at risk of contradiction, is a foundation that must be expanded to all agents or else we contradict the foundation of our own rights. This is something that ought to be recognised through the granting of legal personhood to all noumenal agents by any system that requires such personhood for the enforcement of rights, or else the rule restricting legal personhood cannot be seen as a valid legal norm. Having laid out the case, the paper will move on to defend this natural law conception against the narrower definition of legal personhood proposed by Bryson et al. with regards to AI. It will argue that bare agency is a sufficient, though not necessary, criterion for the ascription of legal personhood in any system that sees the status as necessary for the ascription of legal rights. The paper will conclude by analysing the proposals currently making their way through the legislatures of the UK and European Union. They will be assessed for their compatibility with the claim that a functioning legal system necessarily must recognise the legal personhood of all noumenal agents regardless of their origins, and whether they are future-proofed for the possibility that AI may meet this threshold. This is a book about the theory of the city or commonwealth, what would come to be called the state, in early modern natural law discourse. Annabel Brett takes a fresh approach by looking at this political entity from the perspective of its boundaries and those who crossed them. She begins with a classic debate from the Spanish sixteenth century over the political treatment of mendicants, showing how cosmopolitan ideals of porous boundaries could simultaneously justify the freedoms of itinerant (...) beggars and the activities of European colonists in the Indies. She goes on to examine the boundaries of the state in multiple senses, including the fundamental barrier between human beings and animals and the limits of the state in the face of the natural lives of its subjects, as well as territorial frontiers. Drawing on a wide range of authors, Brett reveals how early modern political space was constructed from a complex dynamic of inclusion and exclusion. Throughout, she shows that early modern debates about political boundaries displayed unheralded creativity and virtuosity but were nevertheless vulnerable to innumerable paradoxes, contradictions, and loose ends.Changes of State is a major work of intellectual history that resonates with modern debates about globalization and the transformation of the nation-state. Is there a punishment for violating the natural law? This important question has been neglected in the scholarship on Thomistic natural law theory. I show that there is a three-fold punishment proper to the natural law; the remorse of conscience, the inability to be a friend to oneself, and the inability to be a friend to another work in concert to provide a natural penalty for moral wrongdoing. In order to establish these points, I first analyze (...) sources of St. Thomas Aquinas’s natural law theory by discussing St. Augustine’s notion of law and fundamental ideas in Aristotle’s political philosophy. Next, I show how Aquinas unites aspects of Augustinian and Aristotelian thought in his treatment of natural law and thereby provides a framework for answering our question. Finally, I turn to Plato’s Gorgias and to Aristotle’s discussion of self-love in order to integrate these ideas with Aquinas’s natural law theory. (shrink)

When we approach medieval writings on the natural law in terms of our contemporary interpretations of such basic categories as reason, nature, and natural order, these writings are bound to seem confused, incomplete, and unsophisticated. Yet if we allow these writings to speak in their own terms, respecting the integrity of their thought, a different picture emerges. We find there an account of the natural law which is significantly different from any contemporary version. This essay challenges the prevailing presumptions concerning the antithetical relationship between nonviolence and natural law. In conversation with the representative natural law positions offered by J. Daryl Charles and Jean Porter, I turn to the framing of the relationship between the new law and the natural law in Aquinas's "Treatise on Law" and appeal to the writings of John Howard Yoder and Stanley Hauerwas in order to argue that nonviolence can and should affirm natural law in (...) some form if it intends to claim to represent "the grain of the universe.". If nothing else, Strauss and the Thomists were natural allies because they shared the same modern enemies: namely, historicism (the view that all human thought is confined to the immediate historical horizon of the thinker) and positivism (the view that human thought cannot make value judgments, but only judgments about observable matters of fact). Beyond that, Strauss explored very seriously the issues of reason and revelation.and of religion and politics-both of which are crucial for Thomistic political thought. Strauss preferred classical natural right theory to modern natural right theory, and he came to the conclusion that Thomas's teaching on natural right-while certainly ' pre-modern ' 4-introduced novelties into the classical position which weakened it rather than improved it. The goal of this essay is to analyze Strauss's reservations about Thomas's statement of the problem of natural right. Such an analysis will, I hope, contribute to a more fruitful exchange between the students of Leo Strauss and those of Thomas Aquinas. I Perhaps the best way to initiate an explanation of Strauss's view of the differences between classical and Thomistic natural right is to contrast the starting points of the two theories. The classical approach begins with what is said about right, with the everyday opinions that are held about what is just. From such an immediate starting point the classical approach ascends toward true knowledge through the process of dialectics.
