Les Cahiers noirs de Martin Heidegger ont suscité des réactions si divergentes qu’il n’est pas illégitime de s’interroger sur la cause de cette plurivocité. Est-il possible qu’une série de textes produise des réactions si discordantes – de la minimisation à l’exaspération, du sarcasme à la caricature, du scandale à l’excommunication? Il est opportun de chercher dans les Cahiers noirs les racines de cette fragmentation. Cet article soutenir la thèse selon laquelle la structure et les contenus mêmes des Cahiers noirs porteraient (...) en eux une sorte de double contrainte entre le dessin antimétaphysique et la « rechute » dans une métaphysique puissance deux : une contradiction interne à la trame des Cahiers noirs, qui produit deux figures de pensée incompatibles entre elles mais qui représente le contenu philosophique le plus précieux de ces textes. The controversy over Jacques Derrida's legacy is one of the most effective engines driving the contemporary debate, far beyond the bounds of philosophy. By now, the variety of contesting positions is so wide that it calls for a critical assessment to achieve a unified theoretical scheme. The dyad of deconstruction and reconstruction, to which the title of the volume refers, aims at composing a kind of map of this debate. The three sections of the book include essays that investigate specific (...) aspects of Derrida's reception, from the view of 1. philosophy, 2. literary studies and 3. politics and law. Gianni Vattimo, one of Europe's foremost contemporary philosophers and most famously associated with the concept of weak thought, explores theoretical and practical issues flowing from his fundamental rejection of the traditional Western understanding of Being as an absolute, unchanging, and transcendent reality. The essays in this book move within the surroundings of Being without constructing a systematic, definitive analysis of the topic. In Being and Its Surroundings, Vattimo continues his career-long exploration of the philosophy of Martin Heidegger, in particular his (...) repudiation of metaphysics with its presupposition of the existence of permanent, universal truth, and that of Friedrich Nietzsche, with its promotion of nihilism. One consequence of problematizing the idea of an attainable truth is the relativization of values and cultures. In the face of the death of God – or the absence of a transcendent guarantor of the validity of human judgments – we have the postmodern tendency to see all value systems and assertions of truth as purely subjective, and to suggest that "anything goes," which Nietzsche called passive nihilism. Vattimo advocates a more active response as he challenges all forms of authoritarianism in the world today. He brings his intellectual acumen to bear on such urgent issues as globalization, the clash of civilizations and terrorism, the crisis of democracy, and the relevance of orthodox religion. Rather than endorse dogmatism or indifference and detachment from social engagement in the name of relativism, Vattimo opts for the path of meaningful dialogue and a search for a mediated consensus based on reason, with all its limitations. Some authors argue that it is permissible for clinicians to conscientiously provide abortion services because clinicians are already allowed to conscientiously refuse to provide certain services. Call this the symmetry thesis. We argue that on either of the two main understandings of the aim of the medical profession—what we will call “pathocentric” and “interest‐centric” views—conscientious refusal and conscientious provision are mutually exclusive. On pathocentric views, refusing to provide a service that takes away from a patient's health is professionally justified because (...) there are compelling reasons, based on professional standards, to refuse to provide that service (e.g., it does not heal, and it is contrary to the goals of medicine). However, providing that same service is not professionally justified when providing that service would be contrary to the goals of medicine. Likewise, the thesis turns out false on interest‐centric views. Refusing to provide a service is not professionally justified when that service helps the patient fulfill her autonomous preferences because there are compelling reasons, based on professional standards, to provide that service (e.g., it helps her achieve her autonomous preferences, and it would be contrary to the goals of medicine to deny her that service). However, refusing to provide that same service is not professionally justified when refusing to provide that service would be contrary to the goals of medicine. As a result, on either of the two most plausible views on the goals of medicine, the symmetry thesis turns out false. (shrink)

Cultural evolution studies are characterized by the notion that culture evolves accordingly to broadly Darwinian principles. Yet how far the analogy between cultural and genetic evolution should be pushed is open to debate. Here, we examine a recent disagreement that concerns the extent to which cultural transmission should be considered a preservative mechanism allowing selection among different variants, or a transformative process in which individuals recreate variants each time they are transmitted. The latter is associated with the notion of “cultural (...) attraction”. This issue has generated much misunderstanding and confusion. We first clarify the respective positions, noting that there is in fact no substantive incompatibility between cultural attraction and standard cultural evolution approaches, beyond a difference in focus. Whether cultural transmission should be considered a preservative or reconstructive process is ultimately an empirical question, and we examine how both preservative and reconstructive cultural transmission has been studied in recent experimental research in cultural evolution. Finally, we discuss how the relative importance of preservative and reconstructive processes may depend on the granularity of analysis and the domain being studied. (shrink)

This article builds on the hypothesis that theoretical approaches to philosophy of technology are currently stuck in a false alternative: either embrace the “empirical turn” or jump back into the determinism, pessimism, and general ignorance towards specific technologies that characterized the “humanities philosophy of technology.” A third path is however possible, which consists of articulating an empirical point of view with an interest in the symbolic dimension in which technologies and technological mediations are always already embedded. Bourdieu’s sociology of the (...) symbolic forms represents an important and mostly unexplored resource in this respect. In this article, we introduce the notion of technological capital and its tree states—objectified, institutionalized, and embodied. In the first section, we briefly account of the empirical turn in philosophy of technology. Specific attention is then devoted to postphenomenology. We depict three perspectives in postphenomenology: standard postphenomenology, in which one single human-technology-world relation at a time is considered; the attempt of some technological mediation theorists to articulate postphenomenology and actor-network theory ; the original effort in Ihde, which is currently practiced by a minority of postphenomenologists, to combine an interest for the empirical dimension of technological mediations with an attention to the social and cultural conditions of possibility in which these mediations are embedded. In the second section, we consider some recent critiques of the limits of the empirical turn in philosophy of technology, especially related to postphenomenology. Furthermore, we argue that Pierre Bourdieu’s sociology may benefit the philosophy of technology. One might say that according to a Bourdieusian perspective, technologies are, in their invention, implementation, and use, embedded in symbolically organized interactions among social actors or groups. The notion of technological capital is introduced. A specific attention is given to its embodied state, which is related to the habitus. Such concept suggests that, to rephrase the famous sentence by Heidegger, “the essence of technology is not totally technological.” In the conclusion, we consider three risks related to a Bourdieusian approach to technology: transparency, determinism, and absolutism. In Leibniz’s New Essays stands out, within many important topics, his doctrine of innate ideas, which supposes the division between sense knowledge and innate knowledge and implies the distinction between truths of reason and truths of fact. That doctrine is particularly relevant for Leibniz’s philosophy, but implicitly entails the epistemological difference between belief, on one hand, and certainty, on the other. In this paper I outline, according to my interpretation, how Leibniz explains that humans can have certainty about innate ideas. (...) This topic is important because if Leibniz demonstrates the possibility of having certainty of those ideas, then, it is feasible to believe in its existence. However, if his explanation is unsatisfactory his metaphysical doctrine would be seriously weakened and, at the same time, both skepticism and Locke’s empiricist doctrine would be reinforced. Many theories of racism presuppose that ordinary usage of the term “racism” should be preserved. Rarely is this presupposition—the presumption of conservatism—defended. This paper discusses the work of Lawrence Blum, Joshua Glasgow, Jorge Garcia, Tommie Shelby, and others, in order to develop a critique of the presumption of conservatism. Against this presumption, I defend the following desideratum: If ordinary usage of “racism” prompts significant practical difficulties that can be averted by revising ordinary usage, then this counts as a mark against (...) the normative status of ordinary usage and so counts as a reason for revising it. The significance of this argument is that it clears the way for a rigorous defense of revisionism. My paper provides a prima facie case for revisionism, built on two practical criticisms of the ordinary usage of “racism.” First, ordinary usage reflects incompatible norms that promote conceptual confusion and misunderstanding, among other problems. Second, ordinary usage reflects an individualistic conception of racism that serves the interests of whites. By championing ordinary usage in our philosophical theories, we (unwittingly) promote the interests of whites over nonwhites. (shrink)

The ethics of deceased organ procurement (OP) is supposedly based on individual consent to donate, either explicit (opt-in) or presumed (opt-out). However, in many cases, individuals fail to express any preference regarding donation after death. When this happens, the decision to remove or not to remove their organs depends on the policy’s default option or on family preferences. Several studies show that in most countries the family plays a significant and often decisive role in the process of decision-making for OP. (...) Depending on the country, the family may be allowed to take different kinds of actions in different situations, and this may be granted either by law or by clinical practice only. This adds much complexity to the usual classification of consent policies in two categories: opt-in and opt-out. Here we propose a novel and comprehensive taxonomy of the models of consent for OP according to three variables: (1) the deceased’s wishes, if any, (2) family wishes, if any, and (3) default policies. By analysing these models of consent, we show that they rely on at least three different concepts of autonomy: individual autonomy, relational autonomy, and family autonomy. In light of this analysis, we discuss the ethical debates surrounding two policy approaches: presumed consent and family veto. (shrink)

The main argument of this article is based on a functional disanalogy, between what I will call ‘international humanity-based law’, constituted by human rights and criminal law, and the domestic rule of law. If we adopt a functionalist approach, the attention has to be focused both on Rule of Law’s pragmatical objective – a reasonable stability – and on its means – formalism and legality, for dealing with indeterminacy. Do international key players share such values, embedded in the Rule of (...) Law’s political project? Does humanity-based international law fulfil the requirements of the Rule of Law? The conclusion of this work is that institutions and mechanism to which usually legal scholars refer when stating that a legal order is a Rule of Law, are almost absent in humanity-based international law. That implies that radical indeterminacy is, in humanity issues, a too strong obstacle for achieving the ideal of the Rule of Law. (shrink)

Human-centered explainable AI (HCXAI) advocates for the integration of social aspects into AI explanations. Central to the HCXAI discourse is the Social Transparency (ST) framework, which aims to make the socio-organizational context of AI systems accessible to their users. In this work, we suggest extending the ST framework to address the risks of social misattributions in Large Language Models (LLMs), particularly in sensitive areas like mental health. In fact LLMs, which are remarkably capable of simulating roles and personas, may lead (...) to mismatches between designers' intentions and users' perceptions of social attributes, risking to promote emotional manipulation and dangerous behaviors, cases of epistemic injustice, and unwarranted trust. To address these issues, we propose enhancing the ST framework with a fifth 'W-question' to clarify the specific social attributions assigned to LLMs by its designers and users. This addition aims to bridge the gap between LLM capabilities and user perceptions, promoting the ethically responsible development and use of LLM-based technology. (shrink)

The classification of preserved hypothalamic activity in brain death and brainstem death as functional or non-functional has become a subject of debate. While proponents of the neurological criterion claim that these activities lack functional significance (Shemie et al. 2014), Nair-Collins and Joffe (2023) argue for their functional physiological role. However, the interpretation of the term "function" within the medico-legal framework, where death is characterized by the irreversible cessation of all brain functions, remains unclear. -/- My intention here is not to (...) engage in a debate over the validity of different viewpoints regarding the functional significance of preserved activities in the hypothalamus or the heart. Rather, I aim to highlight the critical importance of exploring and defining the concept of function in medicine, which currently lacks clarity. My point is that, whatever our position in the brain death debate, reaching a consensus on this conceptual matter would minimize misunderstandings and establish a robust foundation for further insightful analysis. We experimentally investigated the influence of context-based biases, such as prestige and popularity, on the preferences for quotations. Participants were presented with random quotes associated to famous or unknown authors, or with random quotes presented as popular, i.e. chosen by many previous participants, or unpopular. To exclude effects related to the content of the quotations, all participants were subsequently presented with the same quotations, again associated to famous and unknown authors, or presented as popular or unpopular. Overall, our results showed (...) that context-based biases had no, or limited, effect in determining participants’ choices. Quotations preferred for their content were preferred in general, despite the contextual cues to which they were associated. We conclude discussing how our results fit with the well-known phenomenon of the spread and success of misattributed quotations, and we draw some more general implications for cultural evolution research. En este artículo se discute cómo se construye la imagen idealizada del "profesor de matemáticas deseado" a través de discursos y relaciones de poder. Se considera que el profesor tiene un papel activo en el funcionamiento de la escuela y es responsable de producir individuos matemáticamente competentes y productivos que puedan tener éxito en la sociedad. Además, se analiza cómo el profesor debe adaptarse constantemente a las demandas de la sociedad de control, que está en constante cambio y exige nuevas (...) habilidades y conocimientos. El artículo se basa en los conceptos de Foucault y Deleuze para analizar la construcción del profesor de matemáticas deseado y cómo está regulado por las demandas y las instituciones sociales. A pesar de cuestionar si el profesor puede resistir esta regulación y crear algo diferente, el artículo concluye que el profesor es consumido por el mismo sistema. Por lo tanto, se destaca la importancia de ser crítico y promover un ambiente socialmente efectivo en el que el profesor pueda participar activamente en su desarrollo profesional. En otras palabras, se explora la construcción de la imagen idealizada del profesor de matemáticas deseado, cómo el profesor debe adaptarse constantemente a las demandas cambiantes de la sociedad de control y la importancia de ser crítico y promover un ambiente socialmente efectivo en el que el profesor pueda participar activamente en su desarrollo profesional. A cambio, apela a una escala musical, propendiendo hacia una estética de lo sublime que exalta la sensilbilidad, la cual irrumpe con una nueva racionalidad en conflicto con (...) la logicidad de las palabras. Por esta razón, los artistas son un paso imprescindible, y con ellos la determinación de la naturaleza del fenómeno artístico. A implementação de tecnologias móveis de informação e comunicação no suporte à Saúde Mental tem atraído a atenção das autoridades. Com a ascensão das Inteligências Artificiais, esse movimento pode ser impulsionado de maneira exponencial. Nesse cenário, esta revisão tem como objetivos verificar a aplicabilidade das Inteligências Artificiais (IAs) na Saúde Mental e analisar os aspectos que favorecem a relação entre IAs e usuários. Para tanto, realizou-se uma revisão sistemática nas bases de dados PubMed e Biblioteca Virtual em Saúde, no período (...) de 25 de maio a 23 de junho de 2023. Selecionamos os 100 primeiros artigos mais relevantes com as palavras-chave: “Inteligência Artificial”, “Saúde Mental”, “Chatbots”, “Psicoterapia”, “Psicologia” e suas equivalentes em inglês. Os critérios de inclusão foram: acesso aberto, publicação a partir de 2018, em português ou inglês e menção à atuação de IAs no âmbito da Saúde Mental. Para reduzir o risco de viés, excluímos os estudos que não mensuraram o impacto das intervenções por meio de métodos experimentais ou quase-experimentais. Para a síntese dos dados, delimitaram-se alguns pontos específicos de análise, como “Resultado da intervenção”, “Aspectos que favorecem a relação”, entre outros. Atenderam aos critérios de inclusão 24 estudos, dos quais 17 apresentaram resultados positivos em suas intervenções. O uso de IAs na Saúde Mental possui grande potencial de expansão e os resultados obtidos neste trabalho podem guiar a implementação dessas práticas e futuras pesquisas na área. (shrink)

Na atualidade estamos enfrentando uma forte onda de intolerância e tolerância, potencializando e valorizando a Tolerância como sendo um modelo a seguir, e seria a solução para as fortes condutas violentas, discriminatórias e criminosas que estamos sendo vítimas nas relações interpessoais e nas relações entre culturas e países. Tolerar o desigual, o assimétrico é uma luta desigual, do mais forte contra aquele que pela sua realidade social, tem sido enfraquecido. Como formar uma consciência e uma cultura, não do tolerar-aguentar a (...) partir de minhas condições impostas; mas uma cultura de hospitalidade, de acolhida, de abertura ao distante, ao assimétrico e estranho. A hospitalidade incondicional, ou seja, não coloco nenhuma condição, a única condição para acolher ao estrangeiro que chega do além do horizonte, é não ter condições. Desse modo não acolho uma categoria estrangeiro, mas uma pessoa que tem sua individualidade e sua unicidade. Para uma acolhida com hospitalidade é necessário criar um deslocamento na minha interioridade, me acomodar diferente, o outro que chega sempre provoca um movimento interior e exterior no meu eu; quando não acolho ao assimétrico, colocando condições na sua chegada, nada de novo acontece no eu. Acolher com hospitalidade é a possibilidade de nos experimentar diferente e de inaugurar algo novo em nós, na construção de sermos cada vez melhores, mais humanos, solidários e hospitaleiros. This volume offers an updated analysis of the use, meaning, and scope of the classical notion of aitía. It clarifies philosophical and philological questions about aitia and offers bold and innovative interpretations of this key concept of ancient philosophy. The numerous meanings and nuances of aitia remain difficult to grasp. Ancient philosophers use aitia to explain the existence and activity of substances, bodies, souls, or gods, Paradoxically, its own definition remains difficult to establish. This book reconstructs some of the most (...) important uses, variants, and scopes of the term aitia within different philosophical perspectives in antiquity, including early Greek philosophy, Plato, Aristotle, Stoicism, and Islamic philosophy. The chapters analyze metaphysical aspects, epistemological issues, and logical implications of aitia. They engage with the most relevant critical literature generated in several modern languages. In doing so, they offer an inclusive and overarching re-evaluation of our assumptions about causation and explanation in ancient philosophy. Cause and Explanation in Ancient Philosophy will be of interest to scholars and advanced students working on pre-Socratic philosophy, Plato, Aristotle, Hellenistic philosophy, late antiquity, and medieval philosophy. Husserl places “around 1898” the introduction of the notion of ‘ phenomenon’ in his philosophy. If one of the tasks of the history of philosophy is to circumscribe the problems which originated the creation of a new concept in some doctrine, the purpose of this paper is to investigate what difficulties had roused the invention of the idea of ‘phenomenon” in the husserlian philosophy.

Husserlian phenomenology has been interpreted as a method of knowledge that can be applied to different domains and which would compete with other methods to give us a better understanding of the “real”, the “man” or “society”. Moreover, “phenomenological idealism” has been presented as an “ontological” or “metaphysical” thesis, in the pre-critical sense of the term. The goal of this study is to suggest that these two theses imply the tacit identification of the natural attitude and the phenomenological one, avoiding (...) the difference between the objects to which these attitudes relate. Therefore, a phenomenological truth does not anticipate any opinion about the “world”. (shrink)

During the first centuries of our age, the decadence of the Han government contributed to a society receptive to salvific ideas and in turn, favored the advent of millenialist movements. These organizations, with its values well rotted in Daoist cosmology, would develop a new discourse around the ideas of moral and social responsibility, would install a personified source of authority in the figure of the master and would propose a critical alternative to the prevailing Confucian orthodoxy. In this paper I (...) analyze the role of the Taiping Jing « The Scripture on Great Peace » as the textual source of authority for the aforementioned processes and its importance to unite and institutionalize the Daoist movement to allow it become what some authors would label as «religious Daoism». En las últimas décadas hemos asistido a una crisis del islamismo y a diversas respuestas para superar la mencionada crisis. Así, hemos visto como mediante la inclusión de estas organizaciones en el juego político, sus pociones se han ido moderando considerablemente. La realidad es que buena parte de estos movimientos han derivado hacia un nuevo modelo de organización que puede ser denominada como “populismo islámico” cuyas características son propias y singulares, aunque algunas son compartidas con otros movimientos populistas de otra (...) índole. Este trabajo trata de mostrar usando el caso de los Hermanos Musulmanes en Egipto como los movimientos islamistas pueden, bajo determinadas circunstancias, derivar hace un populismo con características islámicas. La tesis principal de este artículo se basa en una disanalogía funcional, entre lo que llamaré «derecho internacional basado en la humanidad», constituido por el derecho penal y los derechos humanos, y el rule of law interno. Si se adopta una perspectiva funcionalista, hay que dirigir la atención, para hacer frente a la indeterminación del derecho, tanto hacia el objetivo pragmático del rule of law – una razonable estabilidad – como hacia sus medios – el formalismo y la legalidad. Los (...) actores internacionales clave ¿comparten tales valores, inseparables del proyecto político del rule of law? El derecho internacional basado en la humanidad ¿satisface las exigencias del rule of law? La conclusión de este trabajo es que las instituciones y los mecanismos a los cuales los juristas se refieren usualmente cuando afirman que un orden jurídico constituye un rule of law, están, por lo general, ausentes en el derecho internacional basado en la humanidad. Esto implica que la indeterminación radical es, en los asuntos relacionados con la protección de la humanidad, un obstáculo demasiado grande al momento de cumplir con el ideal del rule of law. This chapter provides a conceptual analysis of Tommy J. Curry’s anti-ethical stance. In what sense is anti-ethics opposed to, or against, ethics? I argue that, despite appearances, anti-ethics is a kind of ethical theory. Close analysis reveals that the term “ethics” in the term “anti-ethics” does not refer to ethics per se, but to an idealist approach to ethics that frames white people as virtuous. I argue that Leonard Harris’ insurrectionist ethics provides a naturalistically-informed deontological framework that is useful for (...) analyzing the normative dimensions of anti-ethics. In this way, insurrectionist ethics enables us to analyze the positive content of anti-ethics, an ethics founded on a form of ethical hope that abandons the premise of white virtue. (shrink)
