Moderation and liberalism are different and in some cases antagonistic concepts. In recent years, the view that Sieyès’s idea of constituent power is a moderate and liberal rendering of sovereignty has gained acceptance in intellectual history and constitutional theory literature. This claim is based on the premise that radical and illiberal readers of Rousseau’s idea of sovereignty, such as Robespierre and the Jacobins, were opposed to representing the general will (volonté générale). Thus, constituent power as the exercise of power by (...) extraordinary representatives to draft a constitution would be a liberal attempt at political moderation in the French revolution. In contrast to this liberal reading, my analysis shows that Sieyès’s idea of constituent power is an illiberal attempt at political moderation. Against moderate liberal theories, constituent power demands that the extraordinary representatives of the constituent assembly must will, deliberate, and act as if they were the people themselves. These representatives have absolute powers and the mandate to create a constitution but also the imperative to perceive and mirror the sovereign will. From a political theory approach, I conclude that constituent power is not a liberal idea but a key notion of moderate illiberalism that prevailed during the French Revolution. (shrink)

Carl Schmitt is the most important anti-liberal political theorist of the European interwar period (1918-1939). His theories on the state of exception, dictatorship, and his criticism of parliamentary democracy are very well known. However, what remains unknown to this day is how his ideas had a remarkable influence on the ideologues of the Francoist state between 1939 and 1942. During these years, a debate developed among Francoist jurists about whether Francisco Franco was a “sovereign dictator,” that is, a dictator legitimized (...) by popular consent, or rather a new kind of “monarch” that emerged in the context of the Spanish Civil War (1936-1939). This paper aims to explain how two ideological factions formed in Francoist Spain. The “Decisionist Francoism” of Juan Beneyto Pérez, Francisco Elías de Tejada, and Luis Legaz Lacambra held that Franco emerged as a reaction to the process of “legalization” triggered by liberalism in Spain. The “Weberian Francoism” of Francisco Javier Conde held that Franco was a charismatic and traditional leader whose position emerged in response to the Civil War. I explain how three concepts of Schmitt's anti-iberalism inspired Francoist theorists: political theology, dictatorship, and the rejection of parliamentary democracy. (shrink)

En su ensayo Para una crítica de la violencia, Walter Benjamin reivindica el fenómeno social de la huelga general revolucionaria teorizada por Georges Sorel en su obra Reflexiones sobre la violencia, como una figura ejemplar de lo que sería un “medio puro de la política”, al margen de cualquier forma legitimada de poder. En este marco, pocos comentadores contemporáneos advierten una discordancia conceptual entre ambos filósofos: para Sorel, la huelga revolucionaria es un mito social, mientras que el mito, categoría esencialmente (...) negativa en Benjamin, describe la violencia que aprisiona la vida y que se traduce en una forma de poder político superior. En este artículo quisiéramos demostrar esta discordancia conceptual para examinar en seguida cómo ha sido comentada por otros pensadores contemporáneos. La filosofía de la historia, la posibilidad de una acción política ética y la temporalidad mesiánica aparecen en el horizonte teórico que emparenta a estos filósofos y por el cual podría descifrarse su impasse conceptual. Esto se confirma si se despliega la idea de un “medio puro de la política”, pista que Benjamin ofrece sin profundizar y sobre la cual reenvía al pensamiento de un filósofo poco explorado, Erich Unger. En la última parte de este artículo desarrollaremos las claves dadas por Unger, que entran justamente en sintonía con la mención de la huelga general como medio puro de la política. In his Critique of violence, Walter Benjamin claimed that the social phenomenon of the revolutionary general strike was an example of what would be a “pure political mean”. In this context, not many contemporary commentators note an important conceptual incoherence between those two philosophers: for Sorel the revolutionary general strike is a social myth, while in Benjamin the category of myth, essentially negative, describes the violence that imprisons life and crystallizes it in a higher form of political power. In this article, we demonstrate this conceptual discrepancy in order to examine the way it has been approached by other philosophers. The philosophy of history, the possibility of an ethical political action, and messianic temporality, all appear on the theoretical horizon linking these philosophers, and through these ideas a conceptual impasse can be decoded. Moreover, this horizon can be confirmed if we follow the idea of a “pure political means” that Benjamin proposes and which moves forward to the thought of an unexplored philosopher mentioned by him: Erich Unger. In the last part of this article we will develop the keys given by Unger, which fall right in line with the notion of the general strike as a pure political mean. (shrink)

In this paper we study the axiomatic system proposed by Bourbaki for the Theory of Sets in the Éléments de Mathématique. We begin by examining the role played by the sign \(\uptau \) in the framework of its formal logical theory and then we show that the system of axioms for set theory is equivalent to Zermelo–Fraenkel system with the axiom of choice but without the axiom of foundation. Moreover, we study Grothendieck’s proposal of adding to Bourbaki’s system the axiom (...) of universes for the purpose of considering the theory of categories. In this regard, we make some historical and epistemological remarks that could explain the conservative attitude of the Group. (shrink)

La infracción al deber objetivo de cuidado (IDOC) es una figura introducida en Ecuador en el 2014 con el COIP, con 4 requisitos concurrentes. Para las actuaciones de los Anestesiólogos es necesario evaluar conjuntamente: la ley y reglamento de la especialidad, las normas mínimas de seguridad de la CLASA y los documentos sobre “cirugía segura” de la OMS. Investigamos en este artículo si existe relación entre estas últimas normas y los requisitos mencionados. El objetivo es encontrar la antes mencionada relación (...) y revisar su realidad procesal. Para ello realizamos análisis documental mediante lógica jurídica. Como resultado obtuvimos una correspondencia entre estas normas y los elementos de la IDOC, así como una ausencia de su consideración dentro de las sentencias evaluadas. Se concluye que, si bien son legalmente exigibles, estas normas no son siempre analizadas cuando se juzga una supuesta IDOC, por lo que es necesaria su incorporación al ámbito judicial. (shrink)

Las denuncias por responsabilidad médica en Ecuador se incrementaron en la última década a raíz de la penalización de la mala práctica profesional establecida en el Código Orgánico Integral Penal; la investigación es compleja y el peritaje médico legal se convierte en una pieza fundamental en el conflicto. Aquí analizamos 10 informes periciales de casos de mala práctica médica en Ecuador, se analiza la legislación ecuatoriana y revisión de la literatura referente al tema. Se identificó la falta de protocolos o (...) guías de procedimientos, los informes no cuentan con estructura y es el resultado de la discrecionalidad del perito designado. Se propone un protocolo de actuación pericial que facilitará la actividad del perito y mayor objetividad en la investigación. (shrink)

In this note, the problem of tracking random references and rejecting random perturbations in a quadrotor, both generated by an auxiliary system named exosystem, is solved by extending the deterministic tracking problem to the area of stochastic processes. Besides, it is considered that only a part of the state vector of the quadrotor is available through measurements. As a consequence, the state vector of the plant must be estimated in order to close the control loop. On this basis, a controller (...) to track random references and to reject random perturbations is developed by combining a Kalman filter to estimate the references and perturbations of an exosystem and an observer to estimate the states of a quadrotor. Besides, to obtain a more practical controller, the analysis is carried out in discrete time. Numerical simulations are used in a quadrotor to confirm the validity and effectiveness of the proposed control. (shrink)

Despite abundant evidence associating CD38 overexpression and CD4 T cell depletion in HIV infection, no causal relation has been investigated. To address this issue, a series of mechanisms are proposed, supported by evidence from different fields, by which CD38 overexpression can facilitate CD4 T cell depletion in HIV infection. According to this model, increased catalytic activity of CD38 may reduce CD4 T cells’ cytoplasmic nicotin‐amide adenine dinucleotide (NAD), leading to a chronic Warburg effect. This will reduce mitochondrial function. Simultaneously, CD38's (...) catalytic products ADPR and cADPR may be transported to the cytoplasm, where they can activate calcium channels and increase cytoplasmic Ca2+ concentrations, further altering mitochondrial integrity. These mechanisms will decrease the viability and regenerative capacity of CD4 T cells. These hypotheses can be tested experimentally, and might reveal novel therapeutic targets. (shrink)

Student performance and its evaluation remain a serious challenge for education systems. Frequently, the recording and processing of students’ scores in a specific curriculum have several flaws for various reasons. In this context, the absence of data from some of the student scores undermines the efficiency of any future analysis carried out in order to reach conclusions. When this is the case, missing data imputation algorithms are needed. These algorithms are capable of substituting, with a high level of accuracy, the (...) missing data for predicted values. This research presents the hybridization of an algorithm previously proposed by the authors called adaptive assignation algorithm, with a well-known technique called multivariate imputation by chained equations. The results show how the suggested methodology outperforms both algorithms. (shrink)

Meeting 5G high bandwidth rates, ultra-low latencies, and high reliabilities requires of network infrastructures that automatically increase/decrease the resources based on their customers’ demand. An autonomous and dynamic management of a 5G network infrastructure represents a challenge, as any solution must account for the radio access network, data plane traffic, wavelength allocation, network slicing, and network functions’ orchestration. Furthermore, federation among administrative domains (ADs) must be considered in the network management. Given the increased dynamicity of 5G networks, artificial intelligence/machine learning (...) (AI/ML) solutions are strong candidates able to learn, and take quick provisioning decisions upon fast changes in network conditions. Therefore, this chapter presents an analysis of the state-of-the-art solutions for 5G networks’ management, where AI/ML solutions are discussed and compared with traditional methods. Additionally, the chapter provides a technology overview of both standards, and existing solutions regarding the 5G network management, and directions toward the integration of AI/ML in 5G networks. Are intelligent machines really intelligent? Is the underlying philosoph- ical concept of intelligence satisfactory for describing how the present systems work? Is understanding a necessary and sufficient condition for intelligence? If a machine could understand, should we attribute subjectivity to it? This paper addresses the problem of deciding whether the so-called ”intelligent machines” are capable of understanding, instead of merely processing signs. It deals with the relationship between syntax and semantics. The main thesis concerns the inevitability of semantics for any (...) discussion about the possibility of building conscious machines, condensed into the following two tenets: ”If a machine is capable of understanding (in the strong sense), then it must be capable of combining rules and intuitions”; “If semantics cannot be reduced to syntax, then a machine cannot understand.” Our conclusion states that it is not necessary to attribute understanding to a machine in order to explain its exhibited “intelligent” behavior; a merely syntactic and mechanistic approach to intelligence as a task-solving tool suffices to justify the range of operations that it can display in the current state of technological development. Resumen: Este trabajo es un estudio de casos preliminar y cualitativo, que considera los intercambios dialógicos argumentativos, ante una tarea de dilema moral, de seis parejas de niños y niñas. El análisis de la información se fundamenta en dos enfoques, Visión General Analítica de la Pragmadialéctica, y el Argumentum Model of Topics de la Escuela de Lugano. El análisis de resultados indicó que todos los grupos son capaces de tomar una postura y defender su posición con al menos un argumento. (...) Sin embargo, a medida que los escolares crecen, van construyendo estructuras de argumentación mucho más elaboradas y aumentan la diversidad de loci utilizados. Se concluye que la VGA y el AMT han resultado ser herramientas útiles para describir el desarrollo argumentativo de los escolares a medida que ellos se hacen mayores. -/- Abstract (EN): This paper presents a preliminary and qualitative case study, which considers the argumentative dialogical exchanges, given in a moral dilemma task, of six pairs of boys and girls. The analysis of the information is based on two approaches, Analytical Overview of the Pragmadialectics, and the Argumentum Model of Topics of Lugano School. The results indicated that all groups are able to defend their position with at least one argument. However, as schoolchildren grow up, they build much more elaborate argumentation structures and increase the diversity of loci used. It is concluded that the AO and the AMT have proved to be useful tools to describe the argumentative development of schoolchildren as they get older. (shrink)

In Ancient Greece, the figure of the hero was identified as a demigod, possessed of altruistic and virtuous deeds. When Pierre de Coubertin reinstated the Olympic Games, the athlete was personified as a modern hero. Its antithesis, the anti-hero, has more virtue that defects, no evil but he does not care on the means to achieve his goals. In the eyes of everyone involved in sports competition, these characters captivate and at the same time, create conflicts of ethics and aesthetics. (...) The purpose of this paper is to perform an ethical reflection linked to principles that contribute for the human growth and accomplishment, as well as the aesthetic on the perception of the sensitive, reverberated by sensations and feelings emerging from athletes. Connecting the ethic with the aesthetic spheres, we could have in the sports a phenomenon walking toward a common point between moral and aesthetic, between the good and the beauty. (shrink)

The aim of this paper is to analyze the idea of general resurrection of the dead at the end of times in the synoptic Gospels. We intend to clarify whether this concept can be interpreted as a transposition of the parallel belief contained in some intertestamental writings, or if the singularity of the religious experience expressed in the synoptic Gospels establishes an inexorable moment of discontinuity with the previous apocalyptic framework, making it impossible to understand this doctrine on the sole (...) basis of its Jewish precedents. In order to accomplish our goal, we shall first study the general resurrection of the dead in the Q source, the references to this notion in the gospel of Mark, and its meaning in both Matthew and Luke. We will exclude from our treatment all the topics related with the resurrection of Jesus, and we will be focused on the explicit mentions of the doctrine of the resurrection of the dead as such. Since implicit beliefs are always difficult to assess, especially in the context of eschatological ideas, in which vagueness and absence of a systematic effort of exposition often prevail, we will not allude to other synoptic passages which have been regarded as potential expressions of the doctrine of the resurrection of the dead at the end of times. Badain Jaran is a desert, more than 19,000 square miles of endless openness, with innumerable sand dunes up to 1,600 feet tall and mysterious salt-water lakes. It is part of the Alashan desert, south-west to the Gobi in the Inner Mogolia province of China. A place that has been discovered by American scientists on satellite images in the 1980s only that miraculously has been kept hidden to most people since. The authors describe the intensity and orientation of the corporate social responsibility reporting in four Spanish industries and explore the relationship that exists between both concepts and an independent measurement of reputation for CSR. The results demonstrate that the CSR reporting is especially relevant and useful in the finance industry. Finance companies report significantly more CSR information than most industries in Spain, and this reporting is more closely linked to their CSRR than the CSR reporting of basic, consumer goods and (...) services industries. Several tasks in artificial intelligence require the ability to find models about knowledge dynamics. They include belief revision, fusion and belief merging, and abduction. In this paper, we exploit the algebraic framework of mathematical morphology in the context of propositional logic and define operations such as dilation or erosion of a set of formulas. We derive concrete operators, based on a semantic approach, that have an intuitive interpretation and that are formally well behaved, to perform revision, fusion and abduction. Esto es tanto más cierto en nuestro país, habitado por (...) una suerte de magdaleniense o pre-Tartessos lleno de cacharritos con iconos, llamadas, avisos, avatares, tamagotchies, móviles y juegos online integrados sin la menor discrepancia sobre una capa de rituales del año de la polka, fetiches, incienso, lágrimas, sangre, joyas, ofrendas, sacrificios, reliquias de miembros de santos y matriarcas fenicio-neolíticas devenidas madres de Cristo al tiempo que supporters del equipo de fútbol local. El ultrarracionalismo se presenta como un nuevo método y movimiento filosófico cuya voluntad es afrontar los desafíos del futuro sin dejar de hacer justicia a esta auténtica marejada de lo grotesco. Este es artículo es una reflexión en torno a la sociedad VUCA y BANI en la que nos hallamos inmersos. Tras caracterizar a una y otra, se describe las dos crisis que han marcado a esta sociedad: la primera, es la crisis económico-financiera del 2008 y, la segunda, es la crisis que generó la COVID-19 (2019). A estas dos, se le unía otra subyacente, en la sociedad, que es la llamada “crisis de valores” que alcanzó a distintas partes de la (...) sociedad. También, se describe cómo en las últimas dos décadas se ha agravado una crisis medio ambiental que se está produciendo a escala mundial. Además, a estas dos crisis, se añade una crisis geopolítica de alcance imprevisibles, para el conjunto, de la población mundial que se refleja en la invasión por parte de Rusia de Ucrania y el agravado conflicto palestino-israelí con las consecuencias que tienen tanto una como la otra en la población mundial. El impacto de esta situación que se refleja en la sociedad lleva al autor a plantearse su impacto en las personas, en las distintas partes implicadas en la tarea de educar y el reflejo/la necesidad de unas voces éticas en la Educación. En los escenarios universitarios cada vez resulta menos extraño toparse con investigaciones que indagan por la escritura filosófica proveniente de centros no hegemónicos de producción de conocimiento. Nosotros, que hemos tenido la oportunidad de acercarnos al pasado del ejercicio de la filosofía en el actual territorio colombiano, quisimos hacer una convocatoria pública de escritos dedicados a identificar temas, preguntas y formas en que la variopinta comunidad de la filosofía local está escribiendo su propia historia.

Recent research has shown that cultural, linguistic, and sociodemographic peculiarities influence the measurement of trait emotional intelligence. Assessing trait EI in different populations fosters cross-cultural research and expands the construct’s nomological network. In mental health, the trait EI of clinical populations has been scarcely researched. Accordingly, the present study examined the relationship between trait EI and key sociodemographic variables on Trait Emotional Intelligence Questionnaire datasets with mental healthcare patients from three different Spanish-speaking countries. Collectively, these datasets comprised 528 participants, 23% (...) from Chile, 28% from Peru, and 49% from Spain. The sociodemographic variables we used for trait EI comparisons were gender, age, educational level, civil status, and occupational status. Analyses involved Multigroup Exploratory Structural Equation Modelling and analysis of covariance. Our results revealed significant between-country differences in trait EI across the studied sociodemographic variables and interactions between these variables. Measurement invariance across the datasets was attained up to the scalar level regarding gender and education, although analyses on age, civil status, and occupation displayed non-invariance. The resultant psychometric evidence supports the suitability of the TEIQue-SF for the accurate cross-cultural assessment of trait EI in mental health settings. It also highlights the importance of incorporating trait EI into extant psychotherapeutic frameworks to enhance non-pharmacological treatment efficacy. (shrink)

Este manuscrito pretende plantear dos ideas: la primera problematiza el origen de la universidad en tanto creación humana en sentido pragmático (Kant, 1800), para luego abordarlo en perspectiva histórica desde tres momentos: Medieval, Clásico y Ancestral, retomando autores como Rashdal (1895), Haskings (1923), Ureña (1919), Ribeiro (1971) y Dussel (2004); posteriormente se plantea el origen de la universidad más allá de su historicidad, en el interior del ser humano como cultivo de la virtud y el conocimiento poiesis en Platón (380 (...) a.C/1999). La segunda idea implica comprender que desde su origen la universidad como politeia desde la apropiación de algunos planteamientos aristotélicos (s,f/1883) y arendtianos (1997), ha posibilitado pensarse como un escenario de movilización social o continuidad del orden social establecido, donde se reflexiona críticamente en la necesidad de actualización de la universidad entre poiesis y politeia como potencia para recuperar su sentido primigenio, en tanto actitud que brota del interior del ser humano. RESUMEN Se suele afirmar, y con razón, que la representación de la historia en el pensamiento de Walter Benjamin es esencialmente antiteleológica. Pese a esto, en sus escritos se encuentran dos importantes menciones del término "teleología" que permiten pensar en un uso excepcional de este concepto: la "teleología sin fin final" y el "momento teleológico del despertar". En el presente artículo examinaremos de qué modo estas pistas casi recónditas sobre la teleología repercuten de lleno en la concepción de la historia (...) de Benjamin, rebatiendo aquella interpretación de su pensamiento, según la cual, la teleología habría sido completamente rechazada de su filosofía. ABSTRACT It has often been rightly said that the representation of history in Walter Benjamin's thought is essentially anti-teleological. However, his writings reveal two important mentions of the term "teleology" that make it possible to think of an exceptional use of this concept: "Teleology without End" and the "teleological moment of awakening". The article examines how these almost hidden clues regarding teleology have full repercussions on Benjamin's conception of history, thus refuting the interpretation according to which teleology would have been completely banished from his philosophy.
