The standard economic theory of choice is extended to accommodate a particular form of akratic choice. The empirical content of the new theory is fully characterized. A characterization of revealed akratic choice, in terms of observable choice only, is also provided. These results are consistent with the viewpoint that akrasia is a concept that can be empirically substantiated.

For every legal concept X, there are clear instances exemplifying an X and clear instances exemplifying a non-X. The cases that come before courts are those that seem to lie in between, being neither clearly an X nor clearly a non-X. It is tempting to think that, being in-between, they should receive an in-between treatment, that is, to the extent that they are an X they should be treated as an X. If they are sixty percent toward being an X, (...) they should get sixty percent of the treatment due an X. But this presupposes that in-between cases can be rank-ordered at least roughly according to the degree of their X-ness. This Article explains why that generally cannot be done and why courts therefore go for an either/or approach: something gets treated either as an X or as a non-X. The explanation is rooted in the kind of phenomena explored in the theory of social choice and multi-criterial decision-making. (shrink)

This article develops an axiomatic theory of induction that speaks to the recent debate on Bayesian orgulity. It shows the exact principles associated with the belief that data can corroborate universal laws. We identify two types of disbelief about induction: skepticism that the existence of universal laws of nature can be determined empirically, and skepticism that the true law of nature, if it exists, can be successfully identified. We formalize and characterize these two dispositions toward induction by introducing novel axioms (...) for subjective probabilities. We also relate these dispositions to the axiom of σ-additivity. This is a review of Larry Alexander and Kim Ferzan’s _Reflections on Crime and Culpability_, a sequel to the authors’ _Crime and Culpability_. The two books set out a sweeping proposal for reforming our criminal law in ways that are at once commonsensical and mindbogglingly radical. But even if one is not on board with such a radical experiment, simply thinking it through holds many unexpected lessons: startlingly new insights about the current regime and about novel ways of doing legal (...) theory, some of which are explored in this essay. Role morality refers to the special obligations and rights that are associated with occupying certain professional roles—lawyer, doctor, journalist, soldier and others. There are a number of moral puzzles peculiar to this domain. To what extent can someone whose role involves acting in someone else’s behalf avoid being blamed for aiding him in actions he would be blamed for if acting outside that role? What is one to make of situations in which the performance of one’s role seems to call (...) for the actors to engage in conflicting behavior, for example, two lawyers representing two disputing clients? Is it coherent to speak of some roles as involving obligations to institutions rather than to people? In this chapter the problems are spelled out, the current debate surveyed and tentatively different conclusions from the established ones are suggested. (shrink)

We characterize general constraints under which rational choices are characterized by asymmetric revealed preferences. A key feature of our main characterization result is expressed by the leveling axiom. We also consider the special case of a law-abiding decision maker who chooses optimally among legal options. We show that the law does not necessarily satisfy the leveling axiom and, therefore, transitivity adds empirical content to law-abiding choices.

This essay explores the case against strict liability offenses as part of the more general debate about proportional punishment. This debate takes on a very different look in light of a formal result derived by the authors elsewhere, that is briefly summarized and whose implications are pursued here. Traditional objections that consequentialists have mounted against the deontologists’/retributivists’ defense of proportionality fall by the wayside, but a new threat to the proportionality requirement replaces it: the ease with which any such requirement (...) can be circumvented. Ethical veganism is the view that raising animals for food is an immoral practice that must be stopped because of the harm it causes to the animals, the environment, and our health. Carlo Alvaro argues the only way to stop that harm is to acquire the virtues that enable us to act justly and benevolently toward animals.

In this article, we propose some fundamental requirements for the appearance of adaptivity. We argue that a basic metabolic organization, taken in its minimal sense, may provide the conceptual framework for naturalizing the origin of teleology and normative functionality as it appears in living systems. However, adaptivity also requires the emergence of a regulatory subsystem, which implies a certain form of dynamic decoupling within a globally integrated, autonomous system. Thus, we analyze several forms of minimal adaptivity, including the special case (...) of motility. We go on to explain how an open-ended complexity growth of motility-based adaptive agency, namely, behavior, requires the appearance of the nervous system. Finally, we discuss some implications of these ideas for embodied robotics. (shrink)

Dynamicism has provided cognitive science with important tools to understand some aspects of “how cognitive agents work” but the issue of “what makes something cognitive” has not been sufficiently addressed yet and, we argue, the former will never be complete without the latter. Behavioristic characterizations of cognitive properties are criticized in favor of an organizational approach focused on the internal dynamic relationships that constitute cognitive systems. A definition of cognition as adaptive-autonomy in the embodied and situated neurodynamic domain is provided: (...) the compensatory regulation of a web of stability dependencies between sensorimotor structures is created and preserved during a historical/developmental process. We highlight the functional role of emotional embodiment: internal bioregulatory processes coupled to the formation and adaptive regulation of neurodynamic autonomy. Finally, we discuss a “minimally cognitive behavior program” in evolutionary simulation modeling suggesting that much is to be learned from a complementary “minimally cognitive organization program”. Recent research in philosophy of science has shown that scientists rely on a plurality of strategies to develop successful explanations of different types of phenomena. In the case of biology, most of these strategies go far beyond the traditional and reductionistic models of scientific explanation that have proven so successful in the fundamental sciences. Concretely, in the last two decades, philosophers of science have discovered the existence of at least two different types of scientific explanation at work in the biological (...) sciences, namely: mechanistic and structural explanations. Despite the growing evidence about the radically different nature of these two types of explanation, no inquiry has been conducted to date to determine the ontological reasons that might underlie these differences, nor the way in which these types of explanations can be systematically related with each other. Here, we aim to cover this gap by connecting this plurality of research strategies with the existence of emergent levels of reality. We argue that the existence of these different—and apparently incompatible—explanatory strategies to account for biological phenomena derives from the existence of “ontological jumps” in nature, which generate different regimes of causation that in turn demand the development of different explanatory frameworks. We identify two of these strategies—mechanistic modelling and network modelling—and connect them to the existence of two ontological regimes of causation. Finally, we relate them with each other in a systematic way. In this vein, our paper provides an ontological justification for the plurality of explanatory strategies that we see in the life sciences. (shrink)

Human beings are getting fatter and sicker. As we question what we eat and why we eat it, this book argues that living well involves consuming a raw vegan diet. With eating healthfully and eating ethically being simpler said than done, this book argues that the best solution to health, environmental, and ethical problems concerning animals is raw veganism―the human diet. The human diet is what humans are naturally designed to eat, and that is, a raw vegan diet of fruit, (...) tender leafy greens, and occasionally nuts and seeds. While veganism raises challenging questions over the ethics of consuming animal products, while also considering the environmental impact of the agriculture industry, raw veganism goes a step further and argues that consuming cooked food is also detrimental to our health and the environment. Cooking foods allows us to eat food that is not otherwise fit for human consumption and in an age that promotes eating foods in ‘moderation’ and having ‘balanced’ diets, this raises the question of why we are eating foods that should only be consumed in moderation at all, as moderation clearly implies they aren’t good for us. In addition, from an environmental perspective, the use of stoves, ovens and microwaves for cooking contributes significantly to energy consumption and cooking in general generates excessive waste of food and resources. Thus, this book maintains that living well and living a noble life, that is, good physical and moral health, requires consuming a raw vegan diet. Since Darwin, Biology has been framed on the idea of evolution by natural selection, which has profoundly influenced the scientific and philosophical comprehension of biological phenomena and of our place in Nature. This book argues that contemporary biology should progress towards and revolve around an even more fundamental idea, that of autonomy. Biological autonomy describes living organisms as organised systems, which are able to self-produce and self-maintain as integrated entities, to establish their own goals and norms, and to promote the (...) conditions of their existence through their interactions with the environment. Topics covered in this book include organisation and biological emergence, organisms, agency, levels of autonomy, cognition, and a look at the historical dimension of autonomy. The current development of scientific investigations on autonomous organisation calls for a theoretical and philosophical analysis. This can contribute to the elaboration of an original understanding of life - including human life - on Earth, opening new perspectives and enabling fecund interactions with other existing theories and approaches. El llamado “argumento maestro” de Berkeley, por el cual demuestra su principio _esse est percipi_, ha recibido críticas mixtas por parte de los comentaristas: algunos defienden su validez desde sus propias interpretaciones y otros lo acusan de falaz con base en diversas objeciones. El presente artículo defiende al argumento maestro de tres objeciones por parte de Russell, Pitcher y Tipton, las cuales son referidas como _“objeción de la confusión entre el acto perceptivo y el objeto percibido”, “objeción de la confusión (...) entre el concepto del objeto y el objeto mismo” y “objeción del solipsismo del presente”_. El autor propone su propia lectura del argumento maestro para evitar malentendidos y sostiene que dicho argumento cobra su verdadero sentido a partir de los siguientes puntos: la aclaración de los conceptos berkeleyanos de _idea y percepción_; la explicitación de la_ intencionalidad_ de la percepción en el sentido de su _dirección intencional_ hacia objetos intencionales (ideas); y la distinción entre los _dos niveles de dirección intencional de la percepción mediata_ (de una idea _por medio_ de otra), a saber: uno dirigido al _concepto o representación mental como su objeto intencional inmediato_ y el otro dirigido al _objeto representado_ como su _objeto intencional mediato_. Many issues in ethics arise in relation to the contexts in which psychologists work. However, most ethical decision-making models reproduce the way in which psychologists tend to approach ethics by focusing on ethical dilemmas and proposing a step-by-step response to deal with them. Although these models might be useful, their emphasis on reactive approaches and their lack of contextualization constitute significant limitations on their applicability. In this article, an approach to ethical decision making that highlights the importance of the context (...) in developing proactive strategies to solve ethical issues is proposed. This approach is further explained through its application to medical and rural settings. The implications of these suggestions to the training in ethics are finally discussed. (shrink)

Para elaborar sua filosofia civil, Thomas Hobbes preliminarmente se dedicou ao exame daquilo que constitui a república: o homem. Em sua análise da dinâmica afetivo-cognitiva humana, tecida a partir dos conceitos de sensação, imagem, linguagem e paixão, o conceito de imaginação é apresentado como um resíduo da experiência sensível no corpo. Como tal, uma imagem estará sujeita a se eclipsar sob a luz de imagens mais fortes ou mais recentes, que podem apagá-la da mente tomando o seu lugar. O ato (...) ou faculdade de imaginar, a imaginação — para Hobbes “sensação em declínio” —, é memória, que exprime no presente a sensação passada. Lançada ao futuro, a imagem mantém-se na expressão do medo ou da esperança, paixões que impelem aos homens serem credores de certo esquema de poder. Se propone dejar de lado indemostrables hipótesis, tanto sobre una escritura independiente, como también con respecto a la supuesta inserción tardía e inorgánica de este texto en las Historias. En cambio, se busca relacionar las Achaica con la situación histórica en Grecia en ca. 150 a.C. a fin de entender la construcción discursiva de una imagen internacional de los aqueos fundada en una fama histórica de pístis y (...) philanthropía como una respuesta del historiador aqueo a una situación amenazante contemporánea sobre la Confederación aquea por parte de Roma. The first form of the inside-outside dichotomy appears as a self-encapsulated system with an active border. These systems are based on two complementary but asymmetric processes: constructive and interactive. The former physically constitute the system as a recursive network of component production, defining an inside. The maintenance of the constructive processes implies that the internal organization also constrains certain flows of matter and energy across the border of the system, generating interactive processes. These interactive processes ensure the maintenance of the (...) constructive processes thus specifying a meaningful outside. Upon this basic form of identity formation, the evolutionary and historical domain is open for the emergence of a whole hierarchy and ecology of insides and outsides. These which mutually subsume and collaborate in the maintenance of the essential inside-outside dichotomy that defines the conditions of possibility of the subjects and the worlds they generate. We attempt to distinguish, in a biological frame, ontogenetical adaptation from learning. Ontogenetical adaptation arises as a second order (sensorimotor) loop on the ground of the operational closure that provides autonomy and reproductive identity to the living system. Adaptation ensures, through perception, the functional correlation between metabolicmotor states and the states of the environment. Learning brings about a qualitative change in regard to adaptation, the most generic and simple form of optimization at an individual scale. It implies the idea of (...) new knowledge, in the sense that the organism links what formerly appeared as an undistinguished whole. In other words, it means the capability to change its own codes of meaning. Finally, we outline some basic ideas for modelling an adaptive sensor embedded in a (partially) autonomous system, which implies the former distinction between adaptation and learning. (shrink)

It is often claimed that belief in God is based on faith, while non-belief is grounded in rationality. This claim is inaccurate. Moral philosopher Carlo Alvaro takes the reader through his philosophical journey—a journey taken with the absolute absence of faith. Through reasoning alone, and with an objective assessment of the classical theistic arguments, Deism takes the reader from disbelief to a particular version of deism. Deism discusses such arguments as the Kalam Cosmological, the asymmetry against the evil-god challenge, (...) the anthropic principle, and the moral. Such arguments lead to the undeniable conclusion that there exists a timeless, space-less, wholly good, and infinitely powerful being endowed with freedom of the will, who brought the universe into existence a finite time ago. An objective appraisal of such arguments leads to the conclusions that atheism is an irrational philosophical position, that God does not interact with humans, at least not during our physical existence on earth, and that God is the best explanation of the objectivity of moral value and duty. Der englische Erkenntnis- und Wissenschaftstheoretiker William Whewell (1794-1866) geht davon aus, daß das Phänomen der Entdeckung, Entstehung, Formulierung, Verbesserung und Verwerfung wissenschaftlicher Theorien weder mit dem Instrumentarium des Empirismus noch mit dem des Rationalismus erklärbar ist. Mit der Annahme eines kritischen Realismus, im Anschluß an Kants theoretische Philosophie und manche Aspekte des kritischen Rationalismus von Popper vorwegnehmend, stellt Whewell erneut die Frage nach der Möglichkeit nicht-analytischer, allgemeiner und doch notwendig geltender Aussagen über die Welt auf. Whewell lehnt aber die Lösung (...) Kants einer transzendentalen Deduktion der Verstandesbegriffe ab und bietet eine moderne Antwort an, ohne die historizistischen Züge des Nachkantischen Idealismus anzunehmen. (shrink)

En este artículo se pretende realizar un análisis del origen filosófico de uno de los puntos clave que cambiaron los cimientos de la metafísica moderna a partir de la aportación de la noción de filosofía de naturaleza de Schelling, que conlleva a abrir desde el idealismo alemán una concepción alternativa de las relaciones entre la finitud y el Absoluto a las llevadas a cabo por Fichte y Hegel. Su filosofía de la naturaleza inaugurará toda una corriente de pensamiento que incluirá (...) tanto gran parte de la filosofía de Spinoza como el discurrir estético del Sturm und Drang alemán. Posteriormente, y previa enorme reflexión del tótem ineludible de la filosofía crítica kantiana y ruptura con la fichteana, la importancia de su legado filosófico no hará más que crecer, ya que de la influencia sus escritos participarán, de manera más o menos explícita, pensadores como Schopenhauer, Nietzsche, Freud o Heidegger, e incluso llegará hasta el siglo XXI de la mano de gran parte de los autores de la denominada época posmoderna, como Deleuze o Zizek entre otros. Una idea central del presente trabajo es que la unidad del mito con el logos debe comprenderse en la unidad dramática del diálogo platónico. Pero esto no impide distinguir la existencia de dos clases diferentes de discurso: racional y mítico. La escatología no puede abordarse racionalmente por la incertidumbre que hace imposible en este caso el conocimiento del futuro que le está reservado al alma. Esto determina una situación retórica que hace necesaria la clase de persuasión que transmite el mito (...) escatológico. (shrink)

Automatic public malware analysis services provide controlled, isolated and virtual environments to analyse malicious software samples. Unfortunately, malware is currently incorporating techniques to recognize execution onto a virtual or sandbox environment; when an analysis environment is detected, malware behaves as a benign application or even shows no activity. In this work, we present an empirical study and characterization of automatic PMAS, considering 26 different services. We also show a set of features that allow to easily fingerprint these services as analysis (...) environments; the lower the unlikeability of these features, the easier for us to fingerprint the analysis service they belong to. Finally, we propose a method for these analysis services to counter or at least mitigate our proposal. (shrink)
