Weimar: A Jurisprudence of Crisis.Arthur Jacobson & Bernhard Schlink (eds.) - 2000 - University of California Press.
This selection of the major works of constitutional theory during the Weimar period reflects the reactions of legal scholars to a state in permanent crisis, a society in which all bets were off. Yet the Weimar Republic's brief experiment in constitutionalism laid the groundwork for the postwar Federal Republic, and today its lessons can be of use to states throughout the world. Weimar legal theory is a key to understanding the experience of nations turning from traditional, religious, or command-and-control forms (...)

In Good Light.Roger Eberhard, Karen Sinsheimer & Bernhard Schlink - 2011 - Verlag Scheidegger and Spiess.
As an effect of the recent economic and financial crisis in the USA, a vast number of people have suddenly lost their jobs and income and often also their home. Many of them still live in their cars or even just in the streets. In spring 2007, the young.

Truth Without Reconciliation? The Question of Guilt and Forgiveness in Simon Wiesenthal’s The Sunflower_ and Bernhard Schlink’s _The Reader.Stephen M. Finn - 2001 - South African Journal of Philosophy 20 (3):309-320.
Guilt and forgiveness, with their attendant philosophical and religious ramifications, permeate writing on the Holocaust and can also be related to South Africa’s recent history and present situation. Two controversial and provocative books (both possibly autobiographical) which tackle the question of guilt and forgiveness head on are Simon Wiesenthal’s The Sunflower and Bernhard Schlink’s The Reader, both of which have led to much debate. The central event in both texts is the slaughter of innocents, burned to death in (...)

Falsifying Falsificationist Legal Theory.Pascal Felix Meier - 2023 - Archiv für Rechts- und Sozialphilosophie 109 (1):65-81.
A number of attempts have been made to conceptualise legal reasoning along falsificationist lines. This paper criticises a recent one by Bernhard Schlink. After familiarising the reader with falsificationism, I argue that falsificationism is premised on an epistemological asymmetry between singular observation statements and universal hypotheses, and that absent such an asymmetry in the context of statutory interpretation, framing jurisprudence in falsificationist terms is unwarranted and misleading. To get off the ground, legal falsificationism would need to combine with (...)

Narrative Autonomy.Antonio Casado da Rocha - 2014 - Cambridge Quarterly of Healthcare Ethics 23 (2):200-208.
This section welcomes submissions addressing literature as a means to explore ethical issues arising in healthcare. “Literature” will be understood broadly, including fiction and creative nonfiction, illness narratives, drama, and poetry; film studies might be considered if the films are adaptations from a literary work. Topics include in-depth analysis of literary works as well as theoretical contributions, discussions, and commentary about narrative approaches to disease and medicine, the way literature shapes the relationship between patients and healthcare professionals, the role of (...)

Solidarity: The Analysis of a Social Movement: Poland 1980–1.Michael Bernhard & Joseph McCahery - 1984 - Telos: Critical Theory of the Contemporary 1984 (62):231-240.
Solidarity is a complex theoretical and historical investigation of one of the most dynamic social movements in post-World War II Europe. For some time now, Touraine has attempted to develop a comprehensive theory of social movements. In Solidarity, he and fellow researchers François Dubet, Michel Wieviorka, and Jan Strezelecki, apply the theories of action, movement and sociological intervention elaborated in The Voice and The Eye to the situation in Poland 1980-1. Solidarity is one of many attempts by Touraine to combine (...)

    The revolutions Of 1989: twenty years later.Michael Bernhard - 2010 - Angelaki 15 (3):109-122.
What were the causes and consequences of the revolutions of 1989 in Eastern and Central Europe? The causes lie in the exhaustion of the model of Soviet-type economic organization, the failure of reform efforts in the USSR, and the persistence of opposition to Soviet-type rule in Central Europe. The ramifications of the events are examined through the prism of three questions: how do they change our evaluation of the past?; what was the significance of 1989 as a moment in time?; (...)

Responsive Ethics.Bernhard Waldenfels - 2012 - In Dan Zahavi (ed.), The Oxford handbook of contemporary phenomenology. Oxford: Oxford University Press.
This chapter covers the traditional role of responsibility, and the possible connections between response and responsibility. These connections are explored through the advance of trust and the surplus of the extraordinary in relation to the Third Party. The idea of responsibility comes from the sphere of juridical law, and has a theological touch. The classical conception presented suffers from a permanent erosion that is reinforced by systemic constraints. Trust is a natural element of every community that is together applied by (...)
