The ancient philosopher Theophrastus described a gemstone called lyngurium, purported to be solidified lynx urine, in his work De lapidibus . Knowledge of the stone passed from him to other classical authors and into the medieval lapidary tradition, but there it was almost always linked to the 'learned master Theophrastus'. Although no physical example of the stone appears to have been seen or touched in ancient, medieval, or early modern times, its physical and medicinal properties were continually reiterated and elaborated (...) as if it did 'exist'. By the seventeenth century, it began to disappear from lapidaries, but with no attempt to explain previous authors' errors since it had never 'existed' anyway. In tracing the career of lyngurium, this study sheds some light on the transmission of knowledge from the classical world to the Renaissance and the changing criteria by which such knowledge was judged. It has long been shown that medieval builders primarily used geometrical constructions to design medieval architecture. The thought processes involved, however, have been considered to be remote from the natural philosophical speculations of the Scholastics, who, following Aristotle, had taken the basis of physics to be the study of dynamics, or change. However, investigations of the Expertises of Chartres, Florence, Milan, and other documents related to medieval building suggest that medieval architects, in speaking of their work, resort to recognizable dynamic (...) arguments, structured similarly to the speculations of Scholastic philosophers. These dynamic explanations of structural behaviour persist at least into the 17th century, but thereafter lost out to the arguments based on statics made by modern scholars attempting to explain the endurance of these structures. This book argues that we can only understand transformations of nature studies in the Scientific Revolution if we take seriously the interaction between practitioners and scholars. These are not in opposition, however. Theory and practice are end points on a continuum, with some participants interested only in the practical, others only in the theoretical, and most in the murky intellectual and material world in between. It is this borderland where influence, appropriation, and collaboration have the potential to lead to new (...) methods, new subjects of enquiry, and new social structures of natural philosophy and science. The case for connection between theory and practice can be most persuasively drawn in the area of mathematics, which is the focus of this book. Practical mathematics was a growing field in early modern Europe and these essays are organised into three parts which contribute to the debate about the role of mathematical practice in the Scientific Revolution. First, they demonstrate the variability of the identity of practical mathematicians, and of the practices involved in their activities in early modern Europe. Second, readers are invited to consider what practical mathematics looked like and that although practical mathematical knowledge was transmitted and circulated in a wide variety of ways, participants were able to recognize them all as practical mathematics. Third, the authors show how differences and nuances in practical mathematics typically depended on the different contexts in which it was practiced: social, cultural, political, and economic particularities matter. Historians of science, especially those interested in the Scientific Revolution period and the history of mathematics will find this book and its ground-breaking approach of particular interest. The nineteenth century compared her to Shakespeare; in our own time, she has been likened most often to Henry James. Both comparisons reflect a basic difficulty in reconciling subject matter with treatment, in squaring Jane Austen's restricted world - "3 or 4 Families in a Country Village" - with her profound impact upon our imaginations. Over the years her admirers have tried to resolve this paradox in various ways, none quite successful, but throughout all the changes in critical method one (...) thing has remained constant: the high level of admiration. As Edmund Wilson once remarked, in various revolutions of taste which have occurred during the last century and a half, "perhaps only two reputations have never been affected by the shifts of fashion: Shakespeare's and Jane Austen's. We still agree with Scott about Jane Austen, just as we agree with Ben Jonson about Shakespeare." Even in the half-century after Jane Austen's death, when her reputation was limited in comparison with those of the great Victorians, the praise of discriminating critics was remarkably consistent; and it seems safe to predict, as we begin to celebrate the two-hundredth anniversary of her birth, that this high estimate will remain unchallenged. The bicentennial year will produce the usual tributes, conferences, and collections of essays, but the call for "revaluation" which is usually a ritual part of such occasions will scarcely be heard. The question will not be one of placing Jane Austen in some hierarchy of value, but of trying once again to explain her accepted excellences. A. In this paper I begin by examining Fogelin’s account of deep disagreement. My contention is that this account is so deeply flawed as to cast doubt on the possibility that such deep disagreements actually happen. Nevertheless, I contend that the notion of deep disagreement itself is a useful theoretical foil for thinking about argumentation. The second part of this paper makes this case by showing how thinking about deep disagreements from the perspective of rhetoric, Walton-style argumentation theory, computation, and (...) normative pragmatics can all yield insights that are useful no matter what one’s orientation within the study of argument. Thus, I conclude that deep disagreement –even if it were to turn out that there are no real-world occurrences of it to which we can point–is useful for theorists of argumentation. In this wise, deep disagreement poses a theoretical challenge for argumentation theory not unlike that posed by radical skepticism for traditional epistemology. (shrink)

A "slippery slope argument" is a type of argument in which a first step is taken and a series of inextricable consequences follow, ultimately leading to a disastrous outcome. Many textbooks on informal logic and critical thinking treat the slippery slope argument as a fallacy. Wigmore thought that there was a science of proof underlying legal reasoning that could be displayed in any given case as a graphic sequence of argumentation from the evidence in the case leading to the ultimate probandum. Argumentation technology has now vindicated this approach by providing useful qualitative methods that can be applied to identifying, analyzing, and evaluating the pro and con arguments put forward by both sides in a trial. In this chapter, it is shown how to apply argumentation (...) schemes, such as argument from witness testimony, using argument diagrams applied to typical sequences of evidence-based legal reasoning in which there is a successive refinement of arguments displayed as the evidence comes into a case. It has been claimed that Massimi’s recent perspectival approach to science sits in tension with a realist stance. I shall argue that this tension can be defused in the quantum context by recasting Massimi’s perspectivalism within a phenomenological framework. I shall begin by indicating how the different but complementary forms of the former are manifested in the distinction between certain so-called ‘-epistemic’ and ‘-ontic’ understandings of quantum mechanics, namely QBism and Relational Quantum Mechanics, respectively. A brief consideration of Dieks’ perspectivism (...) will then lead to a consideration of the much-maligned and typically dismissed role of the observer in the measurement process. This opens the door to London and Bauer’s presentation of a form of ‘phenomenological quantum perspectivalism’ that brings together Massimi’s two forms and explicitly eschews the ‘naïve’ realism that creates the above tension. I shall conclude with some reflections on how intersubjectivity can still be established within this framework, focusing in particular on how Massimi’s idea of ‘interlacing’ scientific perspectives can be accommodated, using the example of a ‘new cosmopolitanism’ that gave rise to Bose-Einstein statistics. Recent work in artificial intelligence has increasingly turned to argumentation as a rich, interdisciplinary area of research that can provide new methods related to evidence and reasoning in the area of law. The well-known criteria for selective treatment proposed by Lorber are shown to be ethically sub-optimal on the grounds that they are based on a general conception of the decision framework that is open to serious criticisms and questioning.We propose a model of joint physician-family decision-making that we think represents a more rational method of balancing patient (...) autonomy with the professional expertise and international moral norms of physicians. This chapter proposes a dialectical approach to legal interpretation, consisting of three dimensions: a formalization of the canons of interpretation in terms of argumentation schemes; a dialectical classification of interpretive schemes; and a logical and computational model for comparing the arguments pro and contra an interpretation. The traditional interpretive maxims or canons used in both common and civil law are translated into defeasible patterns of arguments, which can be evaluated through sets of corresponding critical questions. These interpretive argumentation schemes are (...) classified in general categories and a distinction is drawn between schemes supporting and rebutting an interpretation. This framework allows conceiving statutory interpretation as a dialectical procedure consisting in weighing arguments pro and contra an interpretation.
