Catastrophic Diseases draws a powerful and humane portrait of the patients who suffer from these illnesses as well as of the physician-investigators who treat them, and describes the major pressures, conflicts, and decisions which confront all of them. By integrating a discussion of "facts" and "values," the authors highlight (...) the forces which affect new developments in medicine—such as kidney and heart transplants—and the controversial issues they generate. Katz and Capron explore these issues through the use of dual conceptual perspectives. Their study first examines and evaluates the authority which should be vested in each of the chief participants in the catastrophic disease process—the physician-investigator, the patient-subject and his relatives, the professionals, and the state. Challenging questions are raised concerning medical education, informed consent, and professional responsibility. The authors next explore how the roles and capacities of the participants vary not only according to the basic issues they face but also according to the point in decision-making at which these issues arise. The process of investigating and treating catastrophic diseases, the authors believe, can thus usefully be divided into three decision-making stages—the formulation of policy, the administration of research and therapy, and the review of the decisions and their consequences. In conclusion, Katz and Capron demonstrate the need for a variety of individuals and groups with diverse values to be involved in decision-making in a manner which will not unnecessarily impede the scientific investigation of these diseases. Instead of another federal advisory panel to identify ethical principles governing human subjects research, it is time we had a national board with authority to regulate and review such research.

The author offers personal reflections on the development of research ethics in the United States, primarily during the 1960s. He explores the efforts of the pioneers in the field of human experimentation ethics to raise and discuss issues such as the value conflict between the acquisition of knowledge and respect for the autonomy of research subjects and the crucial importance of disclosure in the informed consent process.

The modern history of experimentation with human beings is notable for its ethical lacunae. In 1865, in his great work, An Introduction to the Study of Experimental Medicine, Dr. Claude Bernard, the French physician who first established the use of the scientific method in medicine, echoed the earlier injunctions of physician-moralist Moses Maimonides in counseling his fellow physicians not to treat their patients solely as a means of advancing knowledge. This article analyzes the question of how the size of bribes should impact criminal sanctions. In contrast to the commonly held view that punishment should increase with the size of the bribe, we argue to the contrary: that the punishment of the bribee should decrease with the size of the bribe. Our conclusion is based both on a philosophical argument and an economic argument. We argue that all else being equal, as an agent’s reservation price for selling public interests decreases, (...) the culpability of the agent willing to receive a bribe increases. In addition, from an economic perspective, the expected social harm of an official acting with a low reservation price for bribes is much greater than one acting with a high reservation price: both the susceptibility of being bribed as well as the potential for social harm is much greater when the reservation price is low. In this chapter, Dahan Katz defends relational conceptions of retribution and desert. She clarifies the ways in which such relational conceptions avoid major worries associated with retributive theory, while addressing further worries that arise distinctively with respect to such an approach. In doing so, Dahan Katz provides further defense of the response-retributive theory of punishment that she has proposed elsewhere, while defending a wider set of views within the retributive tradition.

This paper offers a response retributive theory of punishment, taking the role of the punisher as well as the relations between the parties to punishment to be central to retributive justification. It proposes that punishment is justified in terms of the ethics of appropriate response, and more precisely, in terms of the duty agents have to dissociate from the devaluation inherent in the culpable wrongdoing of others. The paper demonstrates that on such account, while the harm and suffering involved in (...) punishment are rightly imposed, they are not good, grounding a further duty to mitigate our retributive practices. The result is a moderate vision of retributive justification, which has the resources to justify, not only criminal punishment, but punishment as imposed across a wide variety of relations: private, institutional and political. In this paper, I address the theory of excuse, or more precisely, exculpatory excuse, and the question of what it is that justifies the category of excuse. I address different potential grounds for the law of excuse, which are often run together in ways that confound rather than clarify, focusing on the role of blamelessness and unfairness of expectations in the theory of excuse.

A study of contemporary philosophical and neuroscientific perspectives on the relation of action, perception, and cognition as it is lived in embodied and socially embedded experience.

We develop an evidence-based theoretical account of how widely shared cultural beliefs about gender, race, and class intersect in interpersonal and other social relational contexts in the United States to create characteristic cultural “binds” and freedoms for actors in those contexts. We treat gender, race, and class as systems of inequality that are culturally constructed as distinct but implicitly overlap through their defining beliefs, which reflect the perspectives of dominant groups in society. We cite evidence for the contextually contingent interactional (...) “binds” and freedoms this creates for people such as Asian men, Black women, and poor whites who are not prototypical of images embedded in cultural gender, race, and class beliefs. All forms of unprototypicality create “binds,” but freedoms result from being unprototypical of disadvantaging rather than advantaging statuses. (shrink)

This book expounds and defends a new conception of the relation between truth and meaning. Atlas argues that the sense of a sense-general sentence radically underdetermines its truth-conditional content. He applies this linguistic analysis to illuminate old and new philosophical problems of meaning, truth, falsity, negation, existence, presupposition, and implicature. In particular, he demonstrates how the concept of ambiguity has been misused and confused with other concepts of meaning, and how the interface between semantics and pragmatics has been misunderstood. In this paper I argue for the Atlas-Kempson Thesis that sentences of the form The A is not B are not ambiguous but rather semantically general (Quine), non-specific (Zwicky and Sadock), or vague (G. Lakoff). This observation refutes the 1970 Davidson-Harman hypothesis that underlying structures, as full semantic representations, are logical forms. It undermines the conception of semantical presupposition, removes a support for the existence of truth-value gaps for presuppositional sentences (the remaining arguments for which are viciously circular), and lifts (...) the Russell-Strawson dispute of 1950–1964 from stalemate to a formulation in which a resolution is possible for the first time. Suggestions of Davidson, Montague, Stalnaker, Kaplan and H. P. Grice are shown to be inadequate semantic descriptions of negative, presuppositional sentences. I briefly discuss the radical Pragmatics view of my 1975 publications and suggest that it too fails to do justice to the linguistic data. I speculate that Semantic Representations should be given the form (more or less) of computer programs, describable in Dana Scott's mathematical semantics for programming languages. (shrink)

This fresh look at the philosophy of language focuses on the interface between a theory of literal meaning and pragmatics--a philosophical examination of the relationship between meaning and language use and its contexts. Here, Atlas develops the contrast between verbal ambiguity and verbal generality, works out a detailed theory of conversational inference using the work of Paul Grice on Implicature as a starting point, and gives an account of their interface as an example of the relationship between Chomsky's Internalist Semantics (...) and Language Performance.
