Explores the link between mathematics and ontology.

It is widely acknowledged that human rights law and international criminal law share core normative features. Yet, the literature has not yet reconstructed this underlying basis in a systematic way. In this contribution, I lay down the basis of such an account. I first identify a similar tension between a “moral” and a “political” approach to the normative foundations of those norms and to the legitimate role of international courts and tribunals adjudicating those norms. With a view to bring the (...) debate forward, I then turn to the practices of HRL and international criminal law to examine which of those approaches best illuminates some salient aspects of the adjudication of ICs. Finally, I argue that the political approach best explains the practice. While each preserves a distinct role, HRL and ICL both establish the basic conditions for the primary subject of international law, namely the state, to legitimately govern its own subjects constructed as free and equal moral agents. Capitalizing on the data presented in the three papers in this issue, the comments and conclusions here elaborate on the concept of transfer of knowledge in the field of materia medica and pharmacy. They evidence different mechanisms in three contexts, the Holy Roman Empire, the Western world and China, and trace the possible ancient roots of the phenomena under consideration. In so doing, they contextualize the processes under study in the three essays, and suggest also a possible new interpretation of (...) the practice of science from the Late Middle Ages to the Scientific Revolution. Le passé comme le futur n’ayant pas la moindre existence, l’itinéraire que nous proposons est celui qui va de la croyance à ce qui en nous et autour de nous serait pure répétition, éternel retour, à la reconnaissance de chaque moment présent comme absolument nouveau, comme inespéré et surprenant.

Sont successivement examinés : la correction des copies, la prise de notes, l’exposé oral, la tenue d’un journal, la lecture, l’écriture et ce que j’appelle la pause critique.

À l’instar de Diderot qui, après sa Lettre sur les aveugles à l’usage de ceux qui voient, a écrit ses Additions à la Lettre sur les aveugles, nous proposons une suite à nos « Nouveaux dialogues entre Hylas et Philonous » (publiés dans L’Enseignement philosophique, 65 e année, n° 2, décembre 2014- février 2015, p. 3-22). Reprenant l’examen du sujet principal (la perception) qu’ils avaient naguère abordé dans ces dialogues (qui étaient au nombre de trois, comme les tout premiers conçus (...) autrefois par Berkeley et dont les nôtres étaient le contre-pied), puis le prolongeant (cet examen) dans d’autres directions, Hylas, interprète de nos pensées, et Philonous, interprète des objections que nous ne cessons de formuler contre elles, réfléchissent, dans le quatrième dialogue, sur la prétendue capacité que nous aurions de penser nos sensations ; dans le cinquième dialogue, sur l’opposition entre être et être un être ; enfin, dans le sixième dialogue, sur les raisons que l’on a de se réjouir non seulement de voir que tout est éphémère, mais également de vieillir et de mourir. Sous l’apparence d’une exégèse du traité aristotélicien des Catégories, Harris, dans ses Philosophical arrangements, cherche à constituer une doctrine des concepts ultimes ou premiers, faisant ainsi endosser à l’aristotélisme un innéisme à rebours de ce qu’un Locke pouvait lui prêter. C’est, au-delà de l’enquête sur les catégories elles-mêmes, une métaphysique de l’esprit qu’insinue Harris, prolongeant ainsi sans le dire les polémiques de Shaftesbury à l’encontre de Locke. Il ne faut donc pas se laisser prendre à l’aspect « exégétique » de (...) ce traité harrisien. C’est une des rares tentatives connues d’étendre la considération des Catégories jusqu’aux confins d’un pré-transcendantalisme. (shrink)
