Fencing for the blind and visually impaired is an emerging sub-discipline of fencing that creates unusual conditions for meaning-making through interaction between embodied endowments and worldly affordances. With the rules of fencing slightly adjusted to the needs of the blindfolded participants – regardless of their sightedness – the discipline requires the fencers to engage in a duel by relying on other than visual cues. This article explores what an autoethnographic account of experiences of participation in fencing for the blind and (...) visually impaired brings to debates on the embodied, and specifically sensory difference. The discussion of these experiences intersects with debates on affect, affordance, and habit, with all three having important roles in related semiotic processes. Presented vignettes draw upon the author’s lived experiences of participation in fencing for the blind and visually impaired and are analyzed as part of a mixed-method autoethnographic study, accompanied by sensory methodologies, with a focus on an inquiry beyond the visual. The vignettes elucidate how we make sense of our surroundings through a complex engagement with the ecology of sensory and affective processes. In addition to exploring the role of affective and pre-conceptual aspects of our experiences, the article seeks to understand how semiosis occurs through both exposure to as well as the active pursuit of specific environmental signs available to us. The article also derives from biosemiotics to examine the complex relationship between meaning-making processes and habits. Finally, the autoethnographic account provides an insight into how we habituate the world and our embodied differences and thus enable meaning-making processes. (shrink)

ABSTRACT This article aims to analyze the process of mutual understanding from the perspective of Discursive Neurolinguistics. As a methodology, a case study was carried out on a child with a linguistic profile of verbal restriction, which concerns the dimension of utterances involving words and their morphology. Data interpretation was based on the Bakhtinian perspective, which addresses ‘understanding’ as an active-responsive process and meaning as emerging from the relationship between utterances. The results showed that the interlocutors’ common ground allowed the (...) joint construction of meaning even in the face of verbal restrictions, and aspects such as nonverbal elements and the recognition of the child’s active-responsive role also favored mutual understanding. As a conclusion, the attention to different multimodal resources as legitimate modes of expression allows children with verbal restrictions to fulfill the role of “speakers” regardless of their modes of expression. In this study we examined whether parents’ perceptions of students’ anxiety as well as perceived support from both teachers and classmates were predictive of changes in students’ academic motivation during the first wave of COVID-19. To this end, we used a retrospective pretest-posttest design together with a latent change score model to analyze our data. From April to May of 2020, 394 Portuguese parents of students in grades 1–9 participated in this study. Our results showed that students’ anxiety and teachers’ (...) social support, as perceived by parents, were highly significant predictors of academic motivation changes. Specifically, we found a negative effect of anxiety and a positive effect of teachers’ social support on students’ academic motivation. Our results did not show, however, a significant predictive role of classmates’ social support. This study provides an important contribution to further understand the intrapersonal and interpersonal factors that are associated with the decline of students’ academic motivation during the COVID-19 pandemic. The pivotal role of teachers in sustaining students’ academic motivation and other relevant educational implications for the ongoing pandemic are discussed. (shrink)

La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Rigorous attention has been paid to moral distress among healthcare professionals, largely in high-income settings. More obscure is the presence and impact of moral distress in contexts of chronic poverty and structural violence. Intercultural ethics research and dialogue can help reveal how the long-term presence of morally distressing conditions might influence the moral experience and agency of healthcare providers. This article discusses mixed-methods research at one nongovernmental social support agency and clinic in Rio de Janeiro, Brazil. Chronic levels of moral (...) distress and perceptions of moral harm among clinicians in this setting were both violent, following Nancy Scheper-Hughes’ use of that term, and a source of exceptional and innovative care. Rather than glossing over the moral variables of work in such desperate extremes, ethnography in these settings reveals novel skills and strategies for managing moral distress. (shrink)

Ensayo que busca profundizar en conceptos claves de la ética y la moral para dar cuenta de la deformidad en la utilización del principio de autonomía para avalar actos éticamente ilícitos como el aborto. El origen de la reflexión está en la experiencia de la autora en las aulas de clase donde captó el fracaso dialéctico en la enseñanza de la ética médica: muchos conceptos fueron impartidos desde una ideología global que lleva a una práctica clínica basada en convicciones individuales, (...) que distan de la verdad ética y de lo filosóficamente demostrable y obedece a las necesidades «poco éticas» del mundo actual. Se hace una aproximación a lo que es la autonomía; se examina si el aborto puede calificarse como un acto moral, partiendo de la realidad biológica de lo que es un embrión humano. Se concluye que el aborto es una práctica en la que no puede primar el principio de autonomía porque no contiene una acción que sea puramente moral: no es posible afirmar que el aborto sea éticamente lícito. La sociedad actual pretende fundamentar legalmente los actos ilícitos antes de revisar los conceptos que conciernen a la ética y a la filosofía; parte del problema es que no se enseñan adecuadamente esos contenidos en las aulas de clase. In this study, we aim to disentangle pantomime from early signs in a newly-born sign language: Sao Tome and Principe Sign Language. Our results show that within 2 years of their first contact with one another, a community of 100 participants interacting everyday was able to build a shared language. The growth of linguistic systematicity, which included a decrease in use of pantomime, reduction of the amplitude of signs and an increase in articulation economy, showcases a learning, and social interaction (...) process that constitutes a continuum and not a cut-off system. The human cognitive system is endowed with mechanisms for symbolization that allow the process of arbitrariness to unfold and the expansion of linguistic complexity. Our study helps to clarify the role of pantomime in a new sign language and how this role might be linked with language itself, showing implications for language evolution research. (shrink)

In her recent book Gillian Brock argues that states’ legitimacy depends on their being part of a just state system that protects human rights. Here I discuss some practical limitations raised by Brock’s legitimacy framework: mainly, (1) the problematic real-world implications of such an account, and (2) the epistemic challenges that judgements inspired by this account would have to face, were we to proceed solely on the basis of it.

Decisions regarding clinical procedures or research participation typically require the informed consent of individuals. When individuals are unable to give consent, the informed permission of a legally authorized representative or surrogate is required. Although many proposed procedures are aimed primarily at benefiting the individual, some are not. I argue that, particularly when individuals are asked to assume risks primarily or exclusively for the benefit of others, family members ought to be engaged in the informed consent process. Questions concerning the role (or lack thereof) of God in morality are implicitly or explicitly important in Western philosophical ethics. I describe some of the different ways philosophers treat (or ignore) God and the foundations of morality more generally, and I highlight some of the implications of these approaches for bioethics. I demonstrate that the starting points we choose for morality set the course for fundamentally different accounts of what is permissible and impermissible, good and bad, and right and wrong.

Plans to attempt what has been called a head transplant, a body transplant, and a head-to-body transplant in human beings raise numerous ethical, social, and legal questions, including the circumstances, if any, under which it would be ethically permissible to attempt whole-body transplantation (WBT) in human beings, the possible effect of WBT on family relationships, and how families should shape WBT decisions. Our assessment of many of these questions depends partially on how we respond to sometimes centuries-old philosophical thought experiments (...) about personal identity. As with so much in bioethics, it is impossible to escape, or at least inadvisable to try to bypass, the relevant foundational philosophical concerns. (shrink)

Socio-cultural shifts during the 1960s and 1970s included widespread secularization, challenges to authority and tradition, and an emphasis on individual choice. Healthcare and biomedical research advances accompanied these social changes, giving rise to numerous ethical and policy questions. The contemporary bioethics project emerged in this context with (at least) three aims: (1) to offer practical answers to these questions (often) in ways that (2) facilitate or support particular practices or goals (e.g., organ donation or human research) and that (3) appear (...) broadly applicable and legitimately enforceable. Philosophical thinking, which involves investigating and disambiguating concepts and categories, articulating conceptually clear definitions, and mapping arguments to identify premises, detect fallacies, and describe their logical implications, can undermine the practical goals of the bioethics project. This tension between the goals of bioethics and philosophical thinking might help to explain what some scholars see as a disinterest in philosophical thinking in bioethics today. (shrink)

Recent work calls for excluding clinical ethics consultants’ religious ethical commitments from formulating recommendations about particular cases and communicating those recommendations. I demonstrate that three arguments that call for excluding religious ethical commitments from this work logically imply that consultants may not use their secular ethical commitments in their work. The call to sever clinical ethics consultation from the ethical commitments of clinical ethics consultants has implications for the scope of work consultants may do and for the competencies required for (...) such work. In most, if not all, jurisdictions with active organ transplantation programs, there is a persistent desire to increase donation rates because the demand for transplantable organs exceeds the supply. China, in particular, faces an extraordinary gap between the number of organs donated by deceased donors and the number of people seeking one or more transplants. China might look to Western countries with higher donation rates to determine how best to introduce Western practices into the Chinese system. In attempting to increase (...) its organ donation rate, China must not only ensure that its organ donation system reflects different Chinese cultural values, but also that it avoids the ethical problems of the United States and of other Western systems. This article examines four such problems. They concern the family, obtaining permission for organ donation, the definition and diagnosis of “brain death,” and trust. Revisions to the Chinese system should involve a careful look to China and Chinese cultural resources rather than to Western models. (shrink)

The term ‘culture wars’ has been used to describe deep, apparently intractable, disagreements between groups for many years. In contemporary discourse, it refers to disputes regarding significant moral matters carried out in the public square and for which there appears to be no way to achieve consensus or compromise. One set of battle lines is drawn between those who hold traditional Christian commitments and those who do not. Christian bioethics is nested in a set of moral and metaphysical understandings that (...) collide with those of the dominant secular culture. The result is a gulf between a moral life and an approach to bioethics framed in the face of a transcendent God and a final judgment versus a moral life and an approach to bioethics framed as if the world were without ultimate meaning and as if death were the end of personal existence. These approaches are separated by a moral and metaphysical gulf that sustains incompatible life worlds and incompatible understandings of bioethics. Attempts to bridge the gulf with secular reason are ineffective because there is no shared conception of reason or standard of evidence. Efforts to use the state to enforce a particular set of metaphysical and moral commitments, whether secular or religious, lead to public disputes with a war-like character. (shrink)

Issues of institutional identity and integrity in Roman Catholic health care institutions have been addressed at the level of individual institutions as well as by organizations of Catholic health care providers and at various levels in the Church hierarchy. The papers by Carol Taylor, C.S.F.N, Thomas Shannon, Kevin O’Rourke, O.P., Gerard Magill in this volume provide a significant contribution to concerns of Roman Catholic health care institutions as they face the challenges of providing health care in a secular, pluralistic, market-driven (...) economy. One way to understand institutional integrity is as a measure of the coherence between what an institution identifies as its commitments (its stated moral character), what an institution does (its manifest moral character) and an institution’s fundamental moral commitments (its deep moral character). The essays in this volume support this model of integrity. Although it is not their explicit focus, the four essays together provide a vision of institutional integrity for Catholic health care institutions. Each author focuses on one of the three central aspects of integrity: what one identifies as one’s commitments (Taylor), how one's actions reflect one’s values (Shannon and Magill), and what one is or what one values at a deep level (O’Rourke). I will offer a brief overview of the ways in which the integrity of Catholic health care institutions has been addressed. Then I will consider the four essays and show how each offers an analysis of one of the three critical elements of integrity. (shrink)

Refugee protection depends, minimally, on the identification of agents capable of discharging international obligations in this area of international law. Commonly discussed “agents of justice” include states, IOs, and NGOs. This article focuses on a different set of actors: subnational units (cities, states, and provinces in federal States) and the legal mechanisms they may use to discharge international obligations in the area of refugee protection. I advance three distinct theoretical models for understanding subnational units’ responsibilities vis-à-vis international law: (1) derived (...) delegated responsibilities; (2) derived back-up responsibilities; and (3) assumed responsibilities. I conclude by sketching some ways in which subnational units could play an even more salient role in the promotion of international law. (shrink)

Este trabalho tem como principal foco de análise o currículo oficial português relacionado com a componente de História, para o Ensino Básico, em particular as ausências que aí mais sobressaem. Estas podem relacionar-se com os conhecimentos substantivos que se apartam da abordagem preconizada por variadas razões (passados incómodos? temas difíceis? grupos não poderosos? …) ou com as competências de pensamento histórico (multiperspetiva, significância, causalidade, empatia, …) que parecem ter sido esquecidas quando se estruturou certo percurso de aprendizagem para estudantes com (...) idades entre os 6 e os 15 anos. Como considerações maiores, constata-se, naqueles textos curriculares (denominado Aprendizagens Essenciais), uma aparente simplificação genérica da narrativa histórica que se conta aos mais jovens cidadãos do mundo atual. A inevitável seleção de determinados saberes em detrimento de outros, na verdade, contribui, acima de tudo, para o escamotear de uma literacia histórica que podia, e devia, alcançar outros níveis. O processo de ensino (e de aprendizagem) da História, desde o começo da escolaridade obrigatória, tem de orientar-se no sentido de uma formação cidadã, esclarecida, democrática, intertemporal. As inexistências no que concerne aos conteúdos considerados ou ao raciocínio potenciado, por sua vez, somente comprometem aquele desígnio. (shrink)

El objetivo de este artículo es evaluar dos fundamentos morales que permiten enmarcar la discusión acerca de la justicia social y el desarrollo humano. Por un lado, Amartya Sen parte de presupuestos éticos como la libertad para brindar un marco evaluativo que analice la pobreza y la calidad de vida. Por el otro, Martha Nussbaum, desde presupuestos filosóficos como la dignidad, establece una guía práctica para el correcto funcionamiento y desarrollo de la vida humana. Ambos autores convergen en la idea (...) según la cual la pobreza es una condición de vulnerabilidad ante la vida y que, además, sus consecuencias transgreden las distintas dimensiones políticas, económicas y sociales de la vida humana. De ahí que se pueda decir que la pobreza transgrede y obstruye el pleno goce de los derechos políticos, económicos, sociales y culturales de los ciudadanos. A pesar de sus diferencias conceptuales, ambas posturas brindan nuevas herramientas interpretativas a la hora de tematizar el desarrollo humano y analizar la pobreza. Estas amplían y enriquecen el concepto de justicia social. Esta ampliación da un nuevo sentido a lo concebido como desarrollo humano, toda vez que este puede ser considerado como un derecho. Ahondar sobre el carácter vinculante de considerar el desarrollo humano como un derecho, se convierte en una herramienta conceptual eficaz en la lucha contra la pobreza. (shrink)

In this paper I suggest an alternative reading of the value of Hegel’s systematic approach to nature from the perspective of environmental philosophy. Taking the paradigmatic example of the “new materialist” ontologies, I present the problems with an inflationary justification for the argument for the need of a shift in the “scientific” representation of nature. On the basis of these problems, I suggest that Hegel’s view of nature as axiologically impotent sheds light into why emancipatory environmental theory needs not hinge (...) on a determinate understanding of nature. In my reading, this rejection can be harmonized with the asymmetric nature of our responsibility towards non-human nature. (shrink)

This review essay explores recent historical and anthropological literature on the emergence and development of transcultural psychiatry in the second half of the twentieth century. It examines how postcolonial psychiatry attempted to remove itself from its erstwhile colonial frameworks and strove to introduce new concepts and paradigms to make itself relevant in the context of decolonization and postwar reconstruction. The essay looks at both continuities and discontinuities between colonial and post-colonial transcultural psychiatry, asking how the recent surge of scholarly literature (...) in this field engaged with these issues. Deliberative democracy started out as an ideal for mass democracy. Lately, however, its large-scale ambitions have mostly been shelved. This article revivifies the ideal of mass deliberative democracy by offering a clear mechanism by which everyone in the community can be included in the same conversation. The trick is to make use of people’s overlapping social communicative networks through which informal deliberative exchanges already occur on an everyday basis. Far from being derailed by threats of polarization, echo chambers, and motivated (...) reasoning, informal networked deliberation can indeed put everyone in touch, directly or indirectly, with everyone else. Pocos fenómenos han suscitado tanto debate en América Latina como es la cuestión de su integración, que, a pesar de sus luces y sus sombras, sus avances y retrocesos, sigue ahí, presente, a pesar de las incertidumbres que los diferentes acontecimientos políticos generan sobre su futuro próximo.

We understand that the practice of Philosophy with Children within the school, proposed by Walter Kohan, invites practitioners to think about themselves and, in that reflective act, to know what they are – and what they are being -, what they want and do not want to be, giving themselves the possibility of self-transformation. In order to transform ourselves, says this philosopher, it is necessary to abandon the devices that lead us to be what we are. But, what are we? (...) What are we as teachers? What are we as students? What devices lead us to be what we are? To think about these questions we analyze, with Michel Foucault, the school, an institution where the practice of Philosophy with Children takes place, in order to understand the power relations that exist in this space. We will understand how this power relations shape and define what it is to be a teacher and to be a student. To do this, we start with an introduction to Foucault’s thought, analyzing what is power, pastoral power, disciplinary power and resistance that, according to the French philosopher, shapes school as an educational locus. Likewise, we will present the Philosophy with Children proposal and expose the possibility and need, stated by Kohan, for philosophy to reflect on the coercive practices of power experienced in the classroom and, from there, to create and openness to other forms of relationship between those who inhabit it. Finally, we argue that the practice of Philosophy with Children constitutes, in Foucault's terms, a practice of resistance within schools. (shrink)

In fact, the breach between developing countries and developed countries is constantly growing. However, there is not a clear definition of what a developing country is, thus sometimes hindering the classification of countries in this category. The lack of such a definition may be due to the heterogeneity of developing countries. Nevertheless, we can found developing countries subcategories and legal effects of their establishment.

Esta investigación presenta los fonemas segmentales y realizaciones alofónicas del mapudungun hablado en Los Álamos, VIII Región del Biobío. Es un estudio de carácter descriptivo, realizado de acuerdo con el formato estándar del descriptivismo norteamericano. Los datos fueron entregados por seis adultos hablantes de las localidades rurales de Pangue y Sara de Lebu. Los instrumentos utilizados fueron dos listas léxicas ad hoc. Luego de presentar el inventario de fonemas y alófonos, este artículo se focaliza en los segmentos de estatus controversial (...) [t̟]/[n̟]/[l̟], [ʃ]/[tʃ], [ɣ], [v]/[f] y [ð]/[θ]. Los principales resultados obtenidos incluyen la ausencia de estatus fonémico de [n̟] y [l̟]; el estatus fonémico de [t̟], [ʃ] y [ɣ]; la tendencia a realizar con sonoridad los segmentos fricativos labiodental e interdental ; y la ocurrencia de algunos segmentos que podrían ser atribuidos de manera plausible a la influencia de la fonología segmental del español. The climatic emergency that threats the Arctic constitutes a challenge for the International Community. The inhabitants of this space, mainly indigenous peoples, face a dramatic situation, because their way of life is disappearing. In this context, Arctic peoples formulate the right to be cold. This paper analyzes the implications of this proposal from the point of view of International Human Rights Law, examining the progress made in the link between the environment, climate change and human rights, the initiatives that the (...) In this article the author attempts to establish whether we can find a “theory of appearance” in the philosophy of Jan Patočka. The “appearance” for Patočka is basically composed of two elements. First there is a “primeval movement” which accounts for an infinite possibility of phenomena. The second element is the relation of this movement with an “addressee”, the subjectivity. If we begin to analyse the unity of these two elements we fundamentally come across three problems: what is it that (...) appears, when appearance presupposes a certain totality of appearance; how does this total appearance come forth; and, finally, is this whole “structure of appearance” taken as a free movement, kept once and for all within the boundaries of phenomenology, which is founded on a precise and positive term of “appearance” — or do we have to stipulate a special “experience” as the starting point of a phenomenology, which accepts the abyssal impossibility to control its frame?
