Kelsen wrote a book, much less known than his Reine Rechtslehre (Pure Theory of Law), called Was ist Gerechtigkeit (What is Justice), in which he attempts to show how and why several theories of justice, formulated by authors ranging from Greece to European Illuminism, are wrong. One of those concepts is Aristotle’s, as exposed in his Nichomachean Ethics. In this article, I argue that in order to show Aristotle wrong, Kelsen misinterprets his theory, then ignores the practical consequences it implies. (...) I attempt to demonstrate that, although highly influenced by the (retrograde) mores of his time, Aristotle’s theory can be useful to us today, which Kelsen denies. Em sua obra magna, O mundo como vontade e representação, Arthur Schopenhauer entende a sua filosofia como um sistema orgânico e afirma que o mundo é vontade e aparece como representação, ou seja, tudo é vontade e, por conseguinte, manifestação da vontade. De modo especial, o autor define uma das formas mais penetrantes da vontade, assim chamada de Vontade de vida, entendida como uma força obscura e cega; um impulso terrível e dramático, que move os indivíduos de forma dolorosa (...) e brutal. Este desejo extremamente rude e irrefletido é condicionado pelo instinto de conservação. Um dos problemas a ser ressaltado é de que existe uma condição existencial relacionada a vida humana que é o sofrimento humano e a espécie humana seria a mais suscetível ao sofrimento. A vida é um perpétuo combate e cada indivíduo é apenas um instrumento da vontade que luta para impor o que parece necessário, já que todo o querer nasce de uma necessidade. Em todos os graus de objetivação da vontade, existe necessariamente uma luta contínua entre os indivíduos de todas as espécies. O ponto de partida de toda luta está no egoísmo, representado na figura de Éris. Em virtude de a essência íntima da natureza, a Vontade de vida, ter como expressão máxima o impulso sexual. Os poetas e filósofos antigos, dentre eles Hesíodo, Parmênides, Péricles, Aristóteles, afirmaram que Eros seria o primeiro, o criador, o princípio do qual provêm todas as coisas. A natureza, cuja essência íntima é a Vontade de vida, compele com todas as forças o homem e o animal para a propagação da espécie. Tal vontade de vida, preocupa-se exclusivamente com a conservação da espécie e, neste caso, o indivíduo pode ser considerado em vão. (shrink)

This work consists of the first lipogrammatic translation and the first ever made into the Portuguese language of Book VII of the work _De aetatibus mundi et hominis_, credited to the late and African writer Fulgentius, the Mytographer. _De aetatibus_ is a consecutive lipogram that has a prologue and other 14 Books, with constriction in the initial 14 letters of Fulgentius’ alphabet. In this seventh section of the work, Fulgentius discusses the biblical age of the judges, avoiding the use of (...) lexical units containing the letter 'g', which was cultivated in the proposed translation text, which was developed from the critical edition by Rudolf Helm. RESUMOO problema principal deste trabalho é realizar algumas considerações sobre o problema filosófico da normatividade, tal como ele aparece na obra Wittgenstein on Rules and Private Language, de Saul Kripke (1982). Para tanto, breves considerações sobre o argumento e a resposta céticos do Wittgenstein de Kripke, associadas a considerações sobre fundacionismo e sobre questões constitutivas referentes à normatividade, serão realizadas. Ao final, o texto discutirá brevemente perspectivas sobre como elementos que caracterizam a normatividade poderiam ser explicados adotando-se a via disposicional.AbstractThe (...) main problem of this work is to make some considerations about the philosophical problem of normativity, as it appears in Saul Kripke’s Wittgensensein on Rules and Private Language (1982). Este artigo discute como os clipes Mandume, Boa Esperança e Eminência Parda do rapper de Emicida, realizam um retorno à ferida colonial e apontam opacidades históricas, opressões e exclusões daí derivadas, como forma de conduzir a uma releitura afetiva e resistente do/no tempo e instigar ações estéticas de re-existência. Para isso, realizamos uma análise audioverbovisual dos clipes procurando observar a construção desse discurso a partir de três categorias analíticas: retorno memorialístico, corporalidade desumanizada e vida livre da violência e da morte.

Concern with elective-death decisions usually focuses on individuals' competence and understanding of their situations and prospects. If problematic influences on individuals are considered, they almost invariably have to do with matters such as depression and the effects of medication. Too little attention is paid to how individuals, as subjects, are products of both external cultural and social influences on them, and of internal efforts and needs that determine their subjectivity.

Segundo, su paso hacia una imaginación pictórica mediada por un poder capaz de reunir (...) a los hombres e imponerse, que refiere el placer hacia una realidad de signos y comportamientos comunes. In At the Will of the Body , Arthur Frank told the story of his own illnesses, heart attack and cancer. That book ended by describing the existence of a "remission society," whose members all live with some form of illness or disability. The Wounded Storyteller is their collective portrait. Ill people are more than victims of disease or patients of medicine they are wounded storytellers. People tell stories to make sense of their suffering when they turn their diseases (...) into stories, they find healing. Drawing on the work of authors such as Oliver Sacks, Anatole Broyard, Norman Cousins, and Audre Lorde, as well as from people he met during the years he spent among different illness groups, Frank recounts a stirring collection of illness stories, ranging from the well-known--Gilda Radner's battle with ovarian cancer--to the private testimonials of people with cancer, chronic fatigue syndrome, and disabilties. Their stories are more than accounts of personal suffering: they abound with moral choices and point to a social ethic. Frank identifies three basic narratives of illness in restitution, chaos, and quest. Restitution narratives anticipate getting well again and give prominence to the technology of cure. In chaos narratives, illness seems to stretch on forever, with no respite or redeeming insights. Quest narratives are about finding that insight as illness is transformed into a means for the ill person to become someone new. (shrink)

El término "expresividad poética" se refiere a las múltiples articulaciones del plano de la expresión, derivadas del valor expresivo del signo lingüístico (ROSSET 1970: 135) y de su particular papel en los dominios poéticos. Los rasgos de significado (como proyección, elevación y relieve) permiten considerar expresivos todos los enunciados poéticos que constituyen un momento particularmente denso en la consolidación formal de la convergencia entre los dos planos (expresión/contenido); por eso se destacan de los otros por su alta densidad de paralelismos (...) estructurales y de isomorfismos, procedimientos responsables de que uno tenga la impresión de que una forma particular de contenido sólo puede ser manifestada por el recorte determinado de una expresión específica. Estas consideraciones tienen un impacto inmediato en la lectura, interpretación y práctica de traducción de poemas, lo que se pretende aquí demostrar, a través del ejemplo de traducción de una fábula de Fedro, escrita en metro yámbico. The term "poetic expressiveness" refers to the multiple joints of the plan of expression, derived from the expressive value of the linguistic sign (ROSSET: 1970, 135) and its particular role in the field of poetry. The features of meaning, such as projection, elevation and salience, make it possible to consider expressive all poetic statements which constitute particularly dense instances in the formal consolidation of a convergence between the two planes (expression/content), and therefore it stands out from the others due to the high density of structural parallelisms and isomorphisms, which are procedures responsible for the impression that a particular form of content can only be expressed by cutting that same specific form of expression out. These considerations have an immediate impact on the reading, interpretation and practice of translating poems, which is intended to be demonstrated here, through an example of translation of a Phaedrus' fable, written in iambic meter. The English Franciscan, William of Ockham (c. 1285-1349), was one of the most important thinkers of the later middle ages. Summoned to Avignon in 1324 to answer charges of heresy, Ockham became convinced that Pope John XXII was himself a heretic in denying the complete poverty of Christ and the apostles and a tyrant in claiming supremacy over the Roman empire. Ockham's political writings were a result of these personal convictions, but also include systematic discourses on the basis and functions (...) of spiritual and secular power as well as exhaustive discussions of Franciscan poverty and the general problem of papal heresy. Ockham emerges in this study as a man deeply committed to natural and Christian human rights, who found these fundamental values so seriously menaced in his time that their survival could be assured only by radical, even revolutionary, personal action and by a basic reworking of traditional political thought. Pragmatist views inspired by Peirce characterize the content of claims in terms of their practical consequences. The content of a claim is, on these views, determined by what actions are rationally recommended or supported by that claim. In this paper I examine the defeasibility of these relations of rational support. I will argue that such defeasibility introduces a particularist, occasion-sensitive dimension in pragmatist theories of content. More precisely, my conclusion will be that, in the sort of framework naturally derived from (...) Peirce’s pragmatist maxim, grasping conceptual contents is not merely a question of mastering general rules or principles codifying the practical import of claims, but decisively involves being sensitive to surrounding features of the particular situation at hand. Background Biomedical and ethnographic studies among indigenous people are common practice in health and geographical research. Prior health research misconduct has been documented, particularly when obtaining genetic material. The objective of this study was to crossmatch previously published data with the perceptions of the Waorani peoples about the trading of their genetic material and other biological samples. Methods We conducted a mixed methods study design using a tailored 15-item questionnaire in 72 participants and in-depth interviews in 55 participants belonging to (...) 20 Waorani communities about their experiences and perceptions of participating in biomedical research projects. Additionally, we conducted a systematic review of the literature in order to crossmatch the published results of studies stating the approval of an ethics committee and individual consent within their work. Results A total of 40 men and 32 women, with a mean age of 57 ± 15 years agreed to be interviewed for inclusion. Five main categories around the violation of good clinical practices were identified, concerning the obtention of blood samples from a recently contacted Waorani native community within the Amazonian region of Ecuador. These themes are related to the lack of adequate communication between community members and researchers as well as the voluntariness to participate in health research. Additionally, over 40 years, a total of 38 manuscripts related to the use of biological samples in Waorani indigenous people were published. The majority of the studies did not state within their article obtaining research ethics board approval, and 71% did not report obtaining the informed consent of the participants prior to the execution of the project. Conclusion Clinical Research on the Waorani community in the Ecuadorian Amazon basin has been performed on several occasions. Unfortunately, the majority of these projects did not follow the appropriate ethical and professional standards in either reporting the results or fulfilling them. The results of our investigation suggest that biological material, including genetic material, has been used by researchers globally, with some omitting the minimum information required to guarantee transparency and good clinical practices. We highlight the importance of stating ethics within research to avoid breaches in research transparency. (shrink)
