Legal text retrieval serves as a key component in a wide range of legal text processing tasks such as legal question answering, legal case entailment, and statute law retrieval. The performance of legal text retrieval depends, to a large extent, on the representation of text, both query and legal documents. Based on good representations, a legal text retrieval model can effectively match the query to its relevant documents. Because legal documents often contain long articles and only some parts are relevant (...) to queries, it is quite a challenge for existing models to represent such documents. In this paper, we study the use of attentive neural network-based text representation for statute law document retrieval. We propose a general approach using deep neural networks with attention mechanisms. Based on it, we develop two hierarchical architectures with sparse attention to represent long sentences and articles, and we name them Attentive CNN and Paraformer. The methods are evaluated on datasets of different sizes and characteristics in English, Japanese, and Vietnamese. Experimental results show that: (i) Attentive neural methods substantially outperform non-neural methods in terms of retrieval performance across datasets and languages; (ii) Pretrained transformer-based models achieve better accuracy on small datasets at the cost of high computational complexity while lighter weight Attentive CNN achieves better accuracy on large datasets; and (iii) Our proposed Paraformer outperforms state-of-the-art methods on COLIEE dataset, achieving the highest recall and F2 scores in the top-N retrieval task. This paper investigates the task of reference resolution in the legal domain. This is a new interesting task in Legal Engineering research. The goal is to create a system which can automatically detect references and then extracts their referents. Previous work limits itself to detect and resolve references at the document targets. In this paper, we go a step further in trying to resolve references to sub-document targets. Referents extracted are the smallest fragments of texts in documents, rather than the (...) entire documents that contain the referenced texts. Based on analyzing the characteristics of reference phenomena in legal texts, we propose a four-step framework to deal with the task: mention detection, contextual information extraction, antecedent candidate extraction, and antecedent determination. We also show how machine learning methods can be exploited in each step. The final system achieves 80.06 % in the F1 score for detecting references, 85.61 % accuracy for resolving them, and 67.02 % in the F1 score for the end-to-end setting task on the Japanese National Pension Law corpus. Background: This study examined the cyberbullying experience and coping manners of adolescents in urban Vietnam and explored the mediating effect of different support to the associations between cyberbullying and mental health issues.Methods: A cross-sectional study was performed on 484 students at four secondary schools. Cyberbullying experience, coping strategies, psychological problems, and family, peer, and teacher support were obtained. Structural equation modeling was utilized to determine the mediating effects of different support on associations between cyberbullying and psychological problems.Results: There were 11.6 (...) and 28.3% of students who reported that they experienced and observed at least one cyberbullying act in the last 3 months, respectively. Among the victims, only 48.2% tried to stop the perpetrators. Meanwhile, the majority of observers belonged to the “Intervene” group who tried to report cyberbullying acts or help victims. Family support was found to partially mediate associations between cyberbullying experience and observation with levels of psychological problems among adolescents.Conclusion: The 3-month rate of cyberbullying experience and observation among urban adolescents aged 11–14 was low. However, current coping strategies against cyberbullying were not sufficient. Family support is an important factor that should be considered for designing interventions to mitigating the impacts of cyberbullying on the mental health of adolescents. (shrink)

Resumo: Com o fito de compreender as noções de história e juízo político, este artigo pretende mostrar a peculiar interpretação que Hannah Arendt faz da mais conhecida e discutida personalidade filosófica: Sócrates. Assim como outras ideias, tais como a de banalidade do mal, a natureza do terror totalitário e de espaço público, sua estrita pintura do filósofo grego nos demanda a tarefa de discriminar a diferença entre pensamento e ação. Seria acaso o juízo a ponte entre as atividades de pensamento (...) e da ação política? A preocupação, neste ensaio,é a de mostrar como Hannah Arendt estava procurando por um modo autêntico de filosofia política, cujo maior exemplo seria Sócrates. No mesmo sentido, também se debruça acerca do significado do juízo reflexionante, ideia bastante fecunda em sua obra que permanece ainda bastante alusiva.: In order to understand Arendt’s conceptions of history and political judgment, this article discusses her peculiar interpretation of Socrates. As with her other ideas, such as the banality of evil, the nature of totalitarian terror, and the public space, her portrayal of the Greek philosopher demands that we discriminate between thinking and acting. Would judgment by chance be the bridge between the activities of thought and political action? My aim in this essay is to show how Arendt, from beginning of her work, was looking for an authentic mode of political life, the major example of which is Socrates. I also address what Arendt meant by her idea of a reflexive judgment, an idea that has proved enormously suggestive yet which remains elusive. (shrink)

Influenced by the Wittgensteinian slogan “Don’t look for the meaning, look for the use,” ordinary language philosophers aimed to defuse various philosophical problems by analyzing key words in terms of what they are used to do or the conditions for appropriately using them. Although Moore, Grice and Searle exposed this error – mixing pragmatics with semantics – it still gets committed, now to a different end. Nowadays the aim is to reckon with the fact that the meanings of a great (...) many sentences underdetermine what we would normally mean in using them – even if the sentence is free of indexicality, ambiguity, and vagueness. This can be so because the sentence expresses a “minimal” proposition or even because it doesn’t fully express any proposition. Many theorists are led to defend “truth-conditional pragmatics” (or linguistic “contextualism”), to find a hidden indexical in every syntactic nook or semantic cranny, or otherwise to pay undue respect to seemingly semantic intuitions and intentions. This paper identifies various such moves and explains what’s regressive about them. (shrink)

There is a simple view of motivation on which desires are like pain-killers; they come in different strengths, and their strength determines their efficacy. That is, the stronger a desire the greater its motivational force and, when two desires conflict, the stronger one “wins out” over the weaker. This view makes it puzzling how anyone could ever exhibit “strength of will” and act on the weaker desire, even when it is a desire for something more highly valued than what is (...) more strongly desired. When the will, as the agent of reason, enters the fray, an explanation of what a person is motivated enough to do must reckon not only with competing desires and their motivational forces, but also with the will’s capacity to be affected by different ones in ways not proportional to their force. However, this complication sheds little light, for if the will must bestow its stamp of approval on a desire before the desire leads to action, then, it would seem, motivational force should be measured by strength of effect on the will. And if that’s the way to measure motivational force, then, since by that measure one always acts on the desire that affects one’s will most, there is no problem of strength of will after all. But the problem seems real, however inapt the label. (shrink)

Many physicists regard the flow of time as an illusion. There is an upper level flow of time, the phenomenon of past/present/future; and there is a lower level flow of time which is really a flow of events. Perceptual completion accounts for the lower level flow of time in a few ways: apparent movement; amodal completion; and dynamic change as exemplified by a newly described modal completion that we called happening. It acts like an illusory percept connecting discrete stimuli in (...) all sensory modalities. The past/present/future distinction cannot exist unless an object is perceived to be the same now as it is then. This cognition requires object persistence. Experiments with object persistence suggest the circumstances when that, too, is an illusory percept. The illusory percepts of object persistence and perceptual completion can account for the entire flow of time. Our findings and conclusions are congruent with a few time theories and cosmologies that suggest that the flow of time is an illusion. (shrink)

Sie dominiert als technische Konstruktion die Theorien und Praxen der wissenschaftlichen Revolution und bedingt entscheidend den Aufstieg der empirischen Wissenschaften. Als Metapher hat sie Erklärungskraft für barocke Modelle von Welt und Mensch, von Körper und Geist; bildlich repräsentiert sie kulturelle und natürliche, weltliche und religiöse Prozesse. Auch Literatur und Theater sind nicht ohne Maschinen zu denken. Darum geht es in diesem Buch: um die polyfunktionale Figur der Maschine in Bezug auf theater- und (...) literaturästhetische Diskurse und Performanzen. Denn Maschinen haben im rationalistisch-mechanistischen Barockzeitalter nicht nur philosophischen Erklärungswert - sie besitzen zugleich Generierungspotenzial: das Potenzial, Neues und Anderes, Mögliches und Unmögliches zu generieren. Die Poiesis der Maschine in der barocken Theater- und Literaturästhetik steht zur Diskussion. Vorgestellt werden zwei zentrale poietische Prozesse: Die Maschine generiert literarisch-theatrale Möglichkeitsräume auf der Bühne und im Buch. Confusion in terms inspires confusion in concepts. When a relevant distinction is not clearly marked or not marked at all, it is apt to be blurred or even missed altogether in our thinking. This is true in any area of inquiry, pragmatics in particular. No one disputes that there are various ways in which what is communicated in an utterance can go beyond sentence meaning. The problem is to catalog the ways. It is generally recognized that linguistic meaning underdetermines speaker (...) meaning because of the need for disambiguation and reference assignment and because people can speak figuratively or indirectly. But philosophers and linguists are coming to recognize that these are not the only ways. The situation may be described in Gricean terms: the distinction between what is said and what is implicated is not exhaustive. Charting the middle ground between the two will require attending to specific examples, noting their distinctive features, and articulating the relevant concepts. That is what I aim to do here. The COVID-19 pandemic prompted a nudge for public–private cooperation in healthcare to rapidly cope with limited resource. However, Vietnam’s historical reliance on a public healthcare system, combined with a traditional emphasis on socialization in the Polanyian sense, hindered the swift integration of the private sector. This research investigates path dependency in Vietnam’s public health sector, using theories including path dependency, Karl Polanyi’s double movement with legal analysis method to analyze the interplay of historical decisions, and socialist policies in healthcare. Recognizing (...) these institutional and market governance flaws, a deeper understanding of the role of law becomes vital in crafting strategies for a more resilient and sustainable healthcare system in Vietnam. In this article, Ho Chi Minh City is chosen as a case study due to its notable mix of public–private healthcare facilities and its status as a leading area in infection cases during the third COVID-19 wave. The article suggests that there should be a change in the way public and private sectors work together, one that is more in line with market-driven solutions which requires solid legal framework for cooperation beyond merely mobilizing resources. Traditional debate on the metaphysics of gender has been a contrast of essentialist and social-constructionist positions. The standard reaction to this opposition is that neither position alone has the theoretical resources required to satisfy an equitable politics. This has caused a number of theorists to suggest ways in which gender is unified on the basis of social rather than biological characteristics but is “real” or “objective” nonetheless – a position I term social objectivism. This essay begins by making explicit the (...) motivations for, and central assumptions of, social objectivism. I then propose that gender is better understood as a real kind with a historical essence, analogous to the biologist’s claim that species are historical entities. I argue that this proposal achieves a better solution to the problems that motivate social objectivism. Moreover, the account is consistent with a post-positivist understanding of the classificatory practices employed within the natural and social sciences. (shrink)

The traditional puzzles about belief reports puzzles rest on a certain seemingly innocuous assumption, that 'that'-clauses specify belief contents. The main theories of belief reports also rest on this "Specification Assumption", that for a belief report of the form 'A believes that p' to be true,' the proposition that p must be among the things A believes. I use Kripke's Paderewski case to call the Specification Assumption into question. Giving up that assumption offers prospects for an intuitively more plausible approach (...) to the semantics of belief reports. But this approach must confront a puzzle of its own: it turns out that every case is a Paderewski case, at least potentially. (shrink)
