The article aims at revealing the historical reinterpretations of one of social sciences’ key concepts, namely that of ideology. Referring to the analyses of Étienne Balibar and Jacques Derrida, it tries, firstly, to clarify the main moments of the Marxian concept of ideology. In Karl Marx’s view ideology is an expression of the social deformations of consciousness in class divided bourgeois society, while in the works of his disciples, among others Louis Althusser, the ideological phenomenon is generalized and conceived of (...) as a basic principle of all human practice and as a necessary condition for the social integration of individuals. Moving still further form Marx, Pierre Bourdieu deepens Louis Althusser’s line of interpretation and abandons the very concept of ideology substituting for it the concepts of “doxa,” which does not bind human sociality to consciousness, but to corporeal dispositions. Unlike ideology, doxa is not just an effect of an already constituted social reality, but rather a principle of its constitution, and, therefore, a principle of constitution of social domination as well. This article aims to study the present-day disarray of radical social critique, as represented by Alain Badiou and Slavoj Žižek, which lacks reliable mainstays in contemporary societies and therefore resorts to religion in order to justify the universality of its revolutionary project. Emphasizing the opposition between particularity and universality, both Badiou and Žižek reject religion as a cultural particularity, attempting at the same time to discover in religion the symbolic codifications of the universal experience of a radical social change. Precisely (...) this is the task of Alain Badiou’s book on Saint Paul, which focuses on religious events such as the Resurrection and religious concepts such as grace. However, as the article tries to point out, this recourse to religion is certainly not innocuous, insofar as the desired radicality of social critique implies dogmatism, traditionalism and a hidden appeal to violence. The article aims to study the usages of the “people” as a critical idea in the texts of two contemporary radical political philosophers: Slavoj Žižek and Alain Badiou. The author’s intention is not so much to point out the divergence between them, rather it is to grasp a common trend imposing the figure of the “people” as a main subject of the political and as a source of a desired, but hardly conceivable social change. The strong appeal to an epochal (...) rupture, yet unsupported by any utopia, could be considered as a double crisis—of the institutions of liberal democracy as well as of the critical imagination itself. The article is dedicated to the pragmatic social critique as one of the most influential patterns of contemporary social critique. It is focused on the evolution of Luc Boltanski’s pragmatic sociology of the critique, which initially refused to play an overtly critical role and restricted itself to reconstructing the modalities of critique social actors recourse to in their everyday practices. In his most recent publication, however, Boltanski seems to return to Pierre Bourdieu’s definition of sociology as a critical sociology. According (...) to Boltanski, the critical vocation of sociology is supposed to answer the increasing critical deficit that social actors experience in the context of contemporary societies with their complex forms of domination.The aim of our study is to make this two-sided transformation comprehensible by putting into question the underlying methodological and political arguments. The pragmatic sociology seems methodologically more convincing but politically weaker than Bourdieu’s critical sociology. Moreover, it seems more legitimate but less efficient in its critical effects. How could this dilemma of social critique opposing requirements of legitimacy and requirements of efficiency be solved? Law is the main regulator of public relations, and the question of the proper use and understanding of legal language is essential for law enforcement. This topic is of interest to both lawyers and philosophers, who often join efforts to study it. This article attempts precisely to take such an interdisciplinary approach when examining legal rules as specific linguistic conventions. First of all, for the sake of a better and more thorough understanding of legal language, legal norms are viewed both (...) from the point of view of semantics and from the point of view of pragmatics. Therefore, for this purpose, a distinction is made between legal norms and legal provisions as their linguistic equivalent. Legal norms are then explored through Wittgenstein's Later Philosophy, which describes their semantic content. The pragmatic aspect of the question is explained through John Austin's theory, thus treating legal rules as a kind of specific speech act of a conventional nature. (shrink)

Law is a main source of justice in a democratic society, and as such it must send clear and unequivocal messages to its addressees. Therefore, the question of the meaning in the legal vocabulary does not lose its relevance and universality. The present study examines the question of the linguistic significance of legal norms in legal vocabulary, applying an interdisciplinary approach. Joining the thesis that the legislation can be considered as an expression of the legally significant will of the rule-making (...) authority, the legal provisions will be presented as an intentional act. In search of the most appropriate explanatory method, two kinds of theories will be applied in parallel: Paul Grice's theory of linguistic meaning, on the one hand, and some theories with both textualist and intentionalist orientation, on the other. Subsequently, the communicative maxims proposed by Grice will be related to selected normative requirements related to the language of the normative acts. (shrink)

The text examines the status of the truth in the legal norms, trying to answer the questions of whether they can be subject to a truth assessment and, if such an assessment is possible, how a truth value can be attributed to legal norms. To achieve this goal, first of all, the text discusses some basic linguistic conceptions concerning the nature and truth of legal norms and subsequently, a a complex approach is being proposed for attributing truth-value to legal norms. György Márkus, as a leading member of the Budapest School led by György Lukács in Hungary, is closely concerned with aesthetics. His final unfinished writings in political exile in Sydney were focused on the question of modern cultural autonomy. From the 1960s to the new century, from Budapest to Sydney in Australia, he established a new form of Neo-Marxist aesthetics on the basis of critical theory drawn from Lukács to the Frankfurt School. His aesthetics includes three dimensions: an aesthetics of (...) praxis, a reconstruction of Lukács’s aesthetics and a theory of aesthetic modernity. His aesthetics is characteristic of analytic philosophy, especially ‘categorical analysis’. It shifts from philosophical aesthetics in the Hungarian period, which is based on an ontological foundation, that is, materialist phenomenology, to social or sociological aesthetics in the Australian period concerning social modernity, institution, constitution, culture, and so on. This is a turn from a philosophical paradigm to a structural one as regards aesthetics, which indicates a break with Lukács’s late return in the early 1960s to Hegelian inspired Ontology of Social Being. Márkus is strictly and essentially an essayist in fragments, who distinguishes himself from the other members of the Budapest School in this way. Ironically, this genre is once again influenced by the young Lukács’s aesthetics. (shrink)

Past research suggests that spiritual leadership plays a pivotal role in enhancing employee job performance, yet we have little understanding of how and when spiritual leadership enhances employee job performance. The present study explores how and when spiritual leadership promotes job performance by examining relational energy as a mediator and leader integrity and relational energy differentiation as boundary conditions. We tested the theoretical model with data gathered across three phases over 12 months from 497 employees and their supervisors in 108 (...) groups. Results showed that the positive relationship between spiritual leadership and job performance was mediated by relational energy. Moreover, we found that leader integrity amplified the mediated relationship between spiritual leadership and employee job performance via relational energy. In contrast, relational energy differentiation weakened this mediated relationship. (shrink)

In recent years, more and more Chinese women have joined the legal profession and have made remarkable achievements in this field. Gender stereotypes, however, which involve a deep-rooted social concept, have seriously hindered Chinese women’s development in the legal profession and have had a profound and adverse impact on women’s career progression. Based on the statistical data in the public domain as well as the ethnographic data drawn from interviews with legal professionals and informal conversations with lawyers known to the (...) principal author, this paper focuses on women in the Chinese legal profession, identifies the causes of women’s dilemmas in their career development as well as the impact of gender stereotyping on them within the legal profession in order to provide some insights on improving gender equality in China. According to the authors, the causes of gender stereotypes in China are diverse: Existing legal institutions promote and maintain such stereotyping practices; traditional gender concepts enter into and disseminated in people’s thoughts; the theory of biological determinism in the field of science misleads the general public; and the legal system constructs women’s status as workers and mothers. In view of this, it is necessary to achieve substantive equality in China’s legal profession by weakening men’s domination of the legal profession, improving the structure and ideology of relevant institutions and policies in offering women more incentives for career development, and also changing women’s understanding of and efforts against biased gender stereotypes. This will help break down China’s gender stereotypes, promote gender equality in the legal profession, and address the dilemma of women’s legal career development. (shrink)

This paper uses the Process Dissociation Procedure to explore whether people can acquire unconscious knowledge in the serial reaction time task [Destrebecqz, A., & Cleeremans, A. . Can sequence learning be implicit? New evidence with the Process Dissociation Procedure. Psychonomic Bulletin & Review, 8, 343–350; Wilkinson, L., & Shanks, D. R. . Intentional control and implicit sequence learning. Journal of Experimental Psychology: Learning, Memory, and Cognition, 30, 354–369]. Experiment 1 showed that people generated legal sequences above baseline levels under exclusion (...) instructions. Reward moved exclusion performance towards baseline, indicating that the extent of motivation in the test phase influenced the expression of unconscious knowledge. Experiments 2 and 3 revealed that even with reward, adding noise to the sequences or shortening training led to above-baseline exclusion performance, suggesting that task difficulty and the amount of training also affected the expression of unconscious knowledge. The results help resolve some current debates about the role of conscious awareness in sequence learning. (shrink)

In China, neither reproduction and parenthood by lesbian couples nor their marital status are regulated or protected by law. In 2020, the first legal dispute in China involving a lesbian couple over custody of their joint baby was heard in court. This study examines the legal and ethical issues that lesbian couples confront when they decide to give birth to a child of their own. These challenges begin with regulatory restrictions on their lawful access to assisted reproductive technology and extend (...) to gaps in the legal establishment of parenthood. We found that the lack of access to legitimate reproductive assistance for lesbian couples in China has caused them to make efforts to circumvent laws and regulations to have a child. However, the legislative gaps later led to ethical dilemmas when resolving disputes over parenthood. This study discusses different accounts of establishing and determining natural parenthood in China and concludes by pointing out the urgent need for change in legislative and sociocultural attitudes toward both assisted reproductive technology and same‐sex relationships, mapping the way forward for lesbian couples to obtain better protection of procreation and parenthood before their marriage is culturally accepted and finally legalized. Metrics and their weaker forms are used to measure the difference between two data. There are many metrics that are available but not desired by a practitioner. This paper recommends in a plausible reasoning manner an easy-to-understand method to construct desired distance-like measures: to fuse easy-to-obtain pseudo-semi-metrics, pseudo-metrics, or metrics by making full use of well-known t-norms, t-conorms, aggregation operators, and similar operators. The simple reason to do this is that data for a real world problem are sometimes from multiagents. (...) A distance-like notion, called weak interval-valued pseudo-metrics, is defined by using known notions of pseudo-semi-metrics, pseudo-metrics, and metrics; this notion is topologically good and shows precision, flexibility, and compatibility than single pseudo-semi-metrics, pseudo-metrics, or metrics. Propositions and detailed examples are given to illustrate how to fabricate an expected or demanded WIVP-metric in practical problems, and WIVP-metric and its special cases are characterized by using axioms. Moreover, some WIVP-metrics pertinent to quantitative logic theory or interval-valued fuzzy graphs are constructed, and fixed point theorems and common fixed point theorems in weak interval-valued metric spaces are also presented. The number of elements in a small set of items is appraised in a fast and exact manner, a phenomenon called subitizing. In contrast, humans provide imprecise responses when comparing larger numerosities, with decreasing precision as the number of elements increases. Estimation is thought to rely on a dedicated system for the approximate representation of numerosity. While previous behavioral and neuroimaging studies associate subitizing to a domain-general system related to object tracking and identification, the nature of small numerosity processing is (...) still debated. We investigated the neural processing of numerosity across subitizing and estimation ranges by examining electrophysiological activity during the memory retention period in a delayed numerical match-to-sample task. We also assessed potential differences in the neural signature of numerical magnitude in a fully non-symbolic or cross-format comparison. In line with behavioral performance, we observed modulation of parietal-occipital neural activity as a function of numerosity that differed in two ranges, with distinctive neural signatures of small numerosities showing clear similarities with those observed in visuospatial working memory tasks. We also found differences in neural activity related to numerical information in anticipation of single vs. cross-format comparison, suggesting a top-down modulation of numerical processing. Finally, behavioral results revealed enhanced performance in the mixed-format conditions and a significant correlation between task performance and symbolic mathematical skills. Overall, we provide evidence for distinct mechanisms related to small and large numerosity and differences in numerical encoding based on task demands. (shrink)

Ma Dexin (1794–1874), the prestigious Sino‐Muslim philosopher, bridged Sufi ideas and Neo‐Confucian philosophy by his handling of the concept of the Great Mandate. For Ma, the Sufi idea of ‘the Muhammadan Reality’, namely the reality of the perfect human, could be understood through an adoption and exploration of an ontological and cosmological interpretation of the Confucian concepts ‘sage’ and ‘ming’. The paper explains how Ma departed from the Neo‐Confucian conceptual framework by holding that the Non‐Ultimate had more ontological significance than (...) the Supreme Ultimate. It is proposed that Ma's difference from the Neo‐Confucians on that point explains his identification of the Great Mandate with the Non‐Ultimate. (shrink)

Modal logic with counting is obtained from basic modal logic by adding cardinality comparison formulas of the form $ \#\varphi \succsim \#\psi $, stating that the cardinality of successors satisfying $ \varphi $ is larger than or equal to the cardinality of successors satisfying $ \psi $. It is different from graded modal logic where basic modal logic is extended with formulas of the form $ \Diamond _{k}\varphi $ stating that there are at least $ k$-many different successors satisfying $ (...) \varphi $. In this paper, we investigate the axiomatization of ML(#) with respect to different frame classes, such as image-finite frames and arbitrary frames. Drawing inspiration from existing works, we employ a similar proof strategy that uses the characterization of binary relations on finite Boolean algebras capable of representing generalized probability measures or finite (respectively arbitrary) cardinality measures. Our main result shows that any formula not provable in the Hilbert system can be refuted within a finite (respectively arbitrary) cardinality measure Kripke frame with a finite domain. We then transform this finite (respectively arbitrary) cardinality measure Kripke frame into a Kripke frame in the corresponding class, refuting the unprovable formula. (shrink)

Plagiarism is a problematic issue in universities across the globe (Curtis & Vardanega, 2016 ). This study explored the relationship between negative emotionality and positive attitudes toward plagiarism through the mediation of academic self-efficacy and self-control. Negative emotionality was examined as three components: stress, anxiety, and depression. Self-report surveys were completed by 454 university students to investigate the relationship between negative emotionality and positive attitudes toward plagiarism, as well as the mediating role of academic self-efficacy and self-control in this relationship. The hierarchical multiple regression found that negative emotionality significantly predicted positive attitudes toward plagiarism over and above age and gender (i.e., where male students and younger students were more likely to plagiarise). Furthermore, three mediation analyses showed that academic self-efficacy and self-control mediate the relationship between positive attitudes toward plagiarism and each component of negative emotionality. Considering these results, subsequent research should investigate whether implementing strategies that alleviate stress, anxiety, and depression could increase academic self-efficacy and self-control, which in turn, could then reduce positive attitudes toward plagiarism.
