El presente artículo recuerda momentos cruciales de una historia del sujeto que va de Jacques Lacan a Alain Badiou. Tras la división y la subversión lacaniana del sujeto, se revisan reacciones que intentan revertirla en varios autores. Estas reacciones se contrastan con la idea badiouana de la escisión del sujeto entre el esplacio y el fuera-de-lugar. La absolutización estructuralista del esplacio estructural se ilustra con la acción de la estructura de Jacques-Alain Miller, se aproxima al argumento de las estructuras que (...) descienden a la calle con el que Lacan defendió la posición estructuralista contra Lucien Goldmann y se explica por la forclusión del sujeto en el estructuralismo, en el sistema capitalista y en la ciencia en general. Con respecto al campo científico, se muestra cómo fue definido primero por la forclusión y luego por la suturación del sujeto en Miller, simultáneamente por la forclusión y la suturación en Lacan, y sólo por la forclusión en Badiou, quien empezará negando y terminará aceptando la existencia de un sujeto de la ciencia, pero diferente del de Lacan y Miller. A key philosophical feature of Peter Jackson’s film interpretation of J.R.R. Tolkien’s The Lord of the Rings is its use of fantasy to inspire a “recovery” of the actual or, in other words, a reawakening to the beauty of nature and the many possible ways of living in healthier ecological relation to the world. Though none of these ways is perfectly achieved, this pluralistic view is demonstrated in the various lifeways of Hobbits, Elves, Men, and Ents. All of the positive (...) relationships embodied in the films—to trees, mountains, horses, and vegetable gardens—involve loving care and attention, receiving nourishment and livelihood without instrumentalization, or reducing nature to mere resource. The films also vividly display a variety of ugly and destructive ways of using the land to accrue power and wealth. These noxious ways, specifically because they actively destroy the lands that they use, always need more. They will thus eventually annihilate the beautiful ways of being if they are not actively resisted. Some of those who would rather be tending their own trees, gardens, or horses or even wandering in the wild forests must therefore turn their attention to struggle and resistance instead. This is a struggle full of grief, and at times even verging on despair, but it is marked by the refusal to give up hope. Indeed, what Jackson and Tolkien have to say about hope is as important in responding to the ecological crisis as anything they have to say about nature, inasmuch as they help to remind us that even in our own times, “there is still hope.”. The extent and mechanisms through which religion intertwines with decision-making processes in family firms remain inadequately understood. Family firm owners, driven by their commitment to ethical business practices and the safeguarding of their socioemotional wealth, actively seek cues to inform their decision-making processes. This research demonstrates that, among these guiding cues, top-level executives’ perceived religiosity emerges as a relevant factor. Building upon the socioemotional wealth perspective and conducting a longitudinal analysis based on listed family firms between 2009 and 2018, our (...) findings reveal a positive association between family voting rights and the presence of board members perceived to be religious. Furthermore, this relationship is less pronounced if family firms operate in industries with high research and development intensity. Our study confirms that boards with high shares of religiously perceived directors are positively associated with the appointment of chief executive officers perceived to be religious during succession events. We thereby present a unique perspective that acknowledges perceived religiosity as a micro-level constituent shaping board membership and successor selection. This investigation captures the intricate interplay between religion and family firms under a socioemotional wealth umbrella, offering important insights to the family business ethics discourse. Especialmente, porque representa el camino a través del cual el ser humano lucha contra el mal. Sin embargo, el perdón se ha erosionado debido a los malentendidos asociados con su aplicación en la psicología y la vida pública. En este sentido, este artículo busca proporcionar una definición del perdón desde su carácter interpersonal. En otras palabras, en este trabajo afirmamos que es en los (...) encuentros cara a cara donde las personas enfrentan el mal, manifiestan su condición de personas y también la esfera de gratuidad a la que responde su realidad más íntima. Así, comenzaremos con la definición común del perdón y examinaremos cada uno de sus elementos constituyentes para presentar una configuración lo más completa posible de su realidad. Esta configuración servirá como un arquetipo para distinguir el perdón de la aceptación de sí, la liberación de sí y la reconciliación. Estas distinciones proponen la idea de que el perdón surge genuinamente de las relaciones interpersonales, allí donde un individuo pide el don de la liberación del mal cometido y otro lo concede libremente. This book stems from an examination of how Western philosophy has accounted for the foundations of law. In this tradition, the character of the “sovereign” or “lawgiver” has provided the solution to this problem. But how does the sovereign acquire the right to found law? As soon as we ask this question we are immediately confronted with a convoluted combination of jurisprudence and theology. The author begins by tracing a lengthy and deeply nuanced exchange between Derrida and Nancy on the (...) question of community and fraternity and then moves on to engage with a diverse set of texts from the Marquis de Sade, Saint Augustine, Kant, Hegel, and Kafka. These texts—which range from the canonical to the apocryphal—all struggle in their own manner with the question of the foundations of law. Each offers a path to the law. If a reader accepts any path as it is and follows without question, the law is set and determined and the possibility of dialogue is closed. This manuscript reports on a landmark symposium on the ethical, legal and technical challenges of xenotransplantation in the UK. King’s College London, with endorsement from the British Transplantation Society (BTS), and the European Society of Organ Transplantation (ESOT), brought together a group of experts in xenotransplantation science, ethics and law to discuss the ethical, regulatory and technical challenges surrounding translating xenotransplantation into the clinical setting. The symposium was the first of its kind in the UK for 20 years. This paper (...) summarises the content of the expert lectures showcasing the progress which has been made in xenotransplantation including—the history of xenotransplantation, advances in gene edited animals and progress towards clinical xenotransplantation. We then set out the ethical and legal issues still to be resolved. Finally, we report the themes of the roundtable discussion highlighting areas of consensus and controversy. While the detail of the legal discussion was directed towards the UK, the principles and summary reported here are intended to be applicable to any jurisdiction seeking to implement clinical xenotransplantation. In Olivi´s division of the sciences, which can be found in his treatise De perlegendis philosophorum libris, c. 9, there seems to be a twofold place for metaphysics: one as part of the theoretical sciences and another as part of the practical, alongside medicine and ethics. This view is based on a misreading of the manuscripts. For the second appearance of metaphysics one should read “mechanica” instead. The recent proliferation of terms used to articulate the likely features of future warfare—“hybrid,” “unconventional,” and especially “deep” wars—suggests that far from witnessing a coherent military readjustment to future threats, we are instead seeing linguistic, largely bureaucratic efforts to think about the near future, and how we should respond today, in order to be prepared. These military-policy terms are meaningful within expert communities, and may even (...) express felt reality eloquently. However, on the front line, and in the public square, expert discourse smacks of bureaucratic involution, possibly even intentional obfuscation, thus generating paranoia about the true state of affairs. We introduce the subject of modal model theory, where one studies a mathematical structure within a class of similar structures under an extension concept that gives rise to mathematically natural notions of possibility and necessity. A statement φ is possible in a structure (written φ) if φ is true in some extension of that structure, and φ is necessary (written φ) if it is true in all extensions of the structure. A principal case for us will be the class Mod(T) (...) of all models of a given theory T—all graphs, all groups, all fields, or what have you—considered under the substructure relation. In this article, we aim to develop the resulting modal model theory. The class of all graphs is a particularly insightful case illustrating the remarkable power of the modal vocabulary, for the modal language of graph theory can express connectedness, k-colorability, finiteness, countability, size continuum, size ℵ1, ℵ2, ℵω, ℶω, first ℶ-fixed point, first ℶ-hyper-fixed point, and much more. A graph obeys the maximality principle φ(a)→φ(a) with parameters if and only if it satisfies the theory of the countable random graph, and it satisfies the maximality principle for sentences if and only if it is universal for finite graphs. Why do gardens matter so much and mean so much to people? That is the intriguing question to which David Cooper seeks an answer in this book. Given the enthusiasm for gardens in human civilization ancient and modern, Eastern and Western, it is surprising that the question has been so long neglected by modern philosophy. _Abstract_: In this paper, we argue that the recent debates and proclaimed crises in psychology are partly due to a reflection deficit and the reductionist understanding of psychology as exclusively a science. For this reason, we introduce Psychological Humanities as a novel interdisciplinary approach that defines psychology as its object of investigation and opens a field of reflection. Although the study of psychological topics with an orientation toward the humanities is not new, either within or outside of psychology, we argue (...) for the introduction of the collective term Psychological Humanities for four reasons: (1) the definition of Psychological Humanities does more justice to central psychological subject areas such as subjectivity, (2) it serves as a common term of interconnectedness and visibility, (3) it resonates with new reflective fields in related disciplines, such as the medical humanities, and (4) it is more consistent with intersubjective practice in applied psychology. In what follows, we present our approach to Psychological Humanities, developed at the University of Lübeck. Sebbene lo studio di argomenti psicologici con un orientamento verso le discipline umanistiche non sia nuovo, né all’interno né all’esterno della psicologia, sosterremo l’introduzione del termine collettivo _Psychological Humanities_ per quattro motivi: (1) la definizione di _Psychological Humanities_ rende maggiormente giustizia ad aree tematiche psicologiche centrali come la soggettività, (2) funge da termine comune di interconnessione e visibilità, (3) richiama altri ambiti di riflessione in discipline affini quali le _medical humanities_ ed (4) è più coerente con la pratica intersoggettiva in psicologia applicata. According to the math tea argument, there must be real numbers that we cannot describe or define, because there are uncountably many real numbers, but only countably many definitions. And yet, the existence of pointwise-definable models of set theory, in which every individual is definable without parameters, challenges this conclusion. In this article, I introduce a flexible new method for constructing pointwise-definable models of arithmetic and set theory, showing furthermore that every countable model of Zermelo-Fraenkel ZF set theory and of (...) Peano arithmetic PA has a pointwise-definable end extension. In the arithmetic case, I use the universal algorithm and its Σ n generalizations to build a progressively elementary tower making any desired individual a n definable at each stage n, while preserving these definitions through to the limit model, which can thus be arranged to be pointwise definable. A similar method works in set theory, and one can moreover achieve V = L in the extension or indeed any other suitable theory holding in an inner model of the original model, thereby fulfilling the resurrection phenomenon. For example, every countable model of ZF with an inner model with a measurable cardinal has an end extension to a pointwise-definable model of ZFC + V = L[μ]. (shrink)

In Entities and Indices, M. J. Cresswell argued that a first-order modal language can reach the expressive power of natural-language modal discourse only if we give to the formal language a semantics with indices containing infinite possible worlds and we add to it an infinite collection of operators $${{\varvec{actually}}}_n$$ actually n and $$ Ref _n$$ R e f n which store and retrieve worlds. In the fourth chapter of the book, Cresswell gave a proof that the resulting intensional language, which (...) he called $${\mathscr {L}}^*$$ L ∗, is as expressive as an extensional variant of it, called $${\mathscr {L}}$$ L, which has full quantification over worlds. In both linguistics and philosophy, Cresswell’s book has been viewed as offering a compelling argument for preferring extensional systems in the study of natural language. In this paper, after providing a model-theoretic definition of the relation being as expressive as that can be applied to Cresswell’s languages $${\mathscr {L}}$$ L and $${\mathscr {L}}^*$$ L ∗, we show that the intensional language $${\mathscr {L}}^*$$ L ∗ is not as expressive as the extensional language $${\mathscr {L}}$$ L. This result, we claim, undermines Cresswell’s argument to the effect that English modal discourse has the power of explicit quantification over worlds. Additionally, we show that $${\mathscr {L}}^*$$ L ∗ does become as expressive as $${\mathscr {L}}$$ L when we add Cresswell’s operator of universal modality $$\square $$ □ to $${\mathscr {L}}^*$$ L ∗, which provides an extra amount of expressive power. Este trabajo intenta enfrentar una serie de dificultades sobre el lenguaje: una problemática secundaria en la filosofía poliana, pero que conecta con algunos temas principales. La problemática puede verse en dos sentidos: por un lado, el lenguaje representa, según Polo, un problema para la filosofía puesto que en su forma expresiva se trata de una producción posterior al pensar, con lo que se ve forzado a tratar sobre aquello que lo fundamenta. Sobra decir que la referencia del lenguaje al pensamiento (...) es imperfecta e incompleta (lo que pone en juego su uso metodológico-técnico). Por otro lado, el lenguaje mismo es un objeto de la propia filosofía, que debe dar cuenta de los modos de articular el sentido. Para enfocar ambos puntos, en este trabajo seguiré los siguientes pasos: primero señalaré la dificultad de acercamiento al lenguaje de la filosofía de Polo, es decir, a sus modos expresivos y tecnicismos propios; en segundo lugar intentaré situar esta dificultad en los términos del propio Polo, a saber, según el modo en que el lenguaje es un derivado poiético y por ende derivativamente intencional. Por último volveré sobre la capacidad expresiva que tiene el lenguaje respecto de algunas posibilidades metaobjetivas desde ciertos planteamientos estéticos. (shrink)

Philosophers have traditionally approached questions of meaning as part of the philosophy of language. In this book David Cooper broadens the analysis beyond linguistic meaning to offer a an account of meaning in general. He shows that not only words, sentences, and utterances in the linguistic domain can be described as meaningful but also items in such domains as art, ceremony, social action, and bodily gesture. Unlike much of the recent work in the philosophy of meaning, Cooper is not (...) concerned with trying to develop a theory of meaning but with examining the meaning of meaning through an overview of the behaviour and scope of "meaning" and its cognates, addressing questions about the import, function, and status of meaning. This fuller account of meaning not only addresses questions of the meaning of meaning but also the issues or problems that answers to those questions generate, such as, Is meaning just a misleading "folk" term for something more basic, such as the causal conditions governing the production of certain noises and movements? Is meaning something that we should strive for or should we let our lives "just be," rather than mean? By taking the problem of meaning out of the technical philosophy of language and providing a more general account Cooper is able to offer new insights into the meaning of meaning that will be of interest not only to philosophers of language but to philosophers working in other areas, such as epistemology and metaphysics. El presente trabajo de investigación tiene como objeto el estudio de la legislación penal en la República de Colombia desde 1890 hasta la actualidad con la ley 599 de 2000, este último conocido como el vigente Código Penal. Lo anterior, conforme a la siguiente pregunta problémica ¿se ha dado un desarrollo oportuno de la legislación penal colombiana que otorgue soluciones fehacientes a las necesidades de una política criminal sólida desde sus inicios hasta la actualidad? Con ello, se pretende analizar las (...) diversas escuelas que han influido en los legisladores a la promulgación y tipificación de los delitos y sus penas en el marco jurídico penal colombiano. Se destaca ante todo, el análisis que a lo largo del desarrollo del ordenamiento jurídico colombiano abarca el contexto constitucional, doctrinal y jurisprudencial, los cuales, han logrado evidenciar el carácter de un óptimo “derecho penal” a lo largo del contexto histórico del país en mención. Se destaca así, la gran influencia de las Escuelas Clásica, Positivista y Finalista, que a hoy han venido a establecerse con fuerza en Colombia a lo largo de su codificación, desde 1980 hasta la actual ley 599 del año 2000. Don’t Look Up is a 2021 Netflix original film about two astronomers who discover a 9-kilometer “planet killer” comet on a collision course with Earth. The way humanity responds to this threat – which is less than ideal, given that the movie ends with humanity’s destruction – is supposed to be an allegory for how humanity is dealing with the real-world threat of climate change. Consequently, we argue, the movie is an argument that presents the viewer with a moral imperative: (...) Do all that you can to prevent climate change. But does the argument work? To answer this question, we look at criticism of the movie, decipher its messages, examine the aptness of its analogy, and use the philosophy of Plato, Kant, and Peter Singer to explain exactly what kind of argument the film is. In the end, we conclude that, while most (although not all) criticisms of the film fall flat – it doesn’t really matter. Given that the moral imperative presented by the movie is undeniable, the only appropriate response to the film is an unrelenting effort to fulfill our duty to stop climate change. (shrink)

In this essay, I propose a standard of practical rationality and a grounding for the standard that rests on the idea of autonomous agency. This grounding is intended to explain the “normativity” of the standard. The basic idea is this: To be autonomous is to be self-governing. To be rational is at least in part to be self-governing; it is to do well in governing oneself. I argue that a person's values are aspects of her identity—of her “self-esteem identity”—in a (...) way that most of her ends are not, and that it therefore is plausible to view action governed by one's values as self-governed. This is also plausible on independent grounds. Given this, I say, rational agents comply with a standard—the “values standard”—that requires them to serve their values, and to seek what they need in order to continue to be able to serve their values. The “ultimate objective” of this book, says David Schmidtz, “is to examine the degree to which being moral is co-extensive with being rational”. For Schmidtz, an “end” gives us a reason for action provided that its pursuit is not undercut by some other end. Morality has a two-part structure. A person’s goal is “moral” if “pursuing it helps [her] to develop in a reflectively rational way,” provided its pursuit does not violate “interpersonal moral constraints”. Interpersonal constraints are imposed by (...) “collectively rational” social institutions, institutions that “make people in general better off by nonexploitative means”. Schmidtz’s view is a form of “actualism.” Our reasons are given by our actual goals, subject to the qualification mentioned above, and moral constraints are given by actually existing collectively rational institutions. Schmidtz concedes that this framework cannot guarantee that it is rational for every agent to be moral, and he concedes that his moral theory might be incomplete. Nevertheless, he argues, “morality and rationality make room for each other in a variety of ways”. (shrink)

Journals and publishers are increasingly using artificial intelligence (AI) to screen submissions for potential misconduct, including plagiarism and data or image manipulation. While using AI can enhance the integrity of published manuscripts, it can also increase the risk of false/unsubstantiated allegations. Ambiguities related to journals’ and publishers’ responsibilities concerning fairness and transparency also raise ethical concerns. In this Topic Piece, we offer the following guidance: (1) All cases of suspected misconduct identified by AI tools should be carefully reviewed by humans (...) to verify accuracy and ensure accountability; (2) Journals/publishers that use AI tools to detect misconduct should use only well-tested and reliable tools, remain vigilant concerning forms of misconduct that cannot be detected by these tools, and stay abreast of advancements in technology; (3) Journals/publishers should inform authors about irregularities identified by AI tools and give them a chance to respond before forwarding allegations to their institutions in accordance with Committee on Publication Ethics guidelines; (4) Journals/publishers that use AI tools to detect misconduct should screen all relevant submissions and not just random/purposefully selected submissions; and (5) Journals should inform authors about their definition of misconduct, their use of AI tools to detect misconduct, and their policies and procedures for responding to suspected cases of misconduct.
