In dieser Monographie wird, beginnend mit einem biographischen und zeitgeschichtlichen Grundriss, zum ersten Mal das umfangreiche strafrechtliche, rechtsphilosophische und philosophische Gesamtwerk Arthur Baumgartens dargestellt. Baumgarten war im Jahr seiner bei Franz v. Liszt verteidigten Dissertation nach Genf berufen worden und lehrte in Köln, Basel, Frankfurt/M. und Berlin. Von der dreiteiligen "Wissenschaft vom Recht" urteilte Albrecht Mendelssohn Bartholdy im "Archiv des öffentlichen Rechts", hier sei die Jurisprudenz auf Philosophie gegründet, und die Lehre Baumgartens werde neben Stammler und Nelson die stärkste (...) Wirkung aufs Rechtsdenken gewinnen. Mit seinen philosophischen Schriften wurde Baumgarten, beeinflusst von James und Dewey, in den zwanziger und dreißiger Jahren des vergangenen Jahrhunderts ein Vordenker des sozialliberalen Pragmatismus in der deutschen Philosophie und nahm deren Hinwendung zur angloamerikanischen philosophischen Tradition um Jahrzehnte vorweg. 1933 erklärte er, unterm NS-Regime nicht Rechtwissenschaft lehren zu können, und ging von Frankfurt in die Schweizer Emigration. Die Erfahrung von Faschismus und Krieg führte ihn in der Mitte der vierziger Jahre zu sozialistischen Überzeugungen und Erwartungen und zur Marxschen sozialwissenschaftlichen Methode, so dass er, nach Frankfurt nicht zurückberufen, gleich anderen antifaschistischen Intellektuellen in die Ostzone und spätere DDR zog. Gerd Irrlitz behandelt die Hauptwerke und die marxistisch orientierten Texte Baumgartens – wie überhaupt die sozialliberale und die späte sozialistische Periode – nicht als Gegensätze, sondern als aufeinander bezogene und einander bedingende Konzepte, überzeugt, dass das Werk des Rechtsphilosophen unterm Erfordernis der Erneuerung des sozialen Liberalismus in der hochindustriellen Zivilisation neue Aktualität gewinnen kann. The multi-cultural nature of the Austro-Hungarian Empire in the late nineteenth century created much unrest among the many different ethnic groups within the Empire. As each group struggled against the other groups for more rights, dissolution threatened the Empire. The Hapsburg government under Franz Joseph used two different strategies in Austria and Hungary to keep the country united, and these strategies successfully kept the Empire together for half a century. After the Emperor’s death, opposing interests and separatism proved too (...) powerful without Franz Joseph’s uniting influence, and the Austro-Hungarian Empire collapsed. (shrink)

Although the principle of fair subject selection is a widely recognized requirement of ethical clinical research, it often yields conflicting imperatives, thus raising major ethical dilemmas regarding participant selection. In this paper, we diagnose the source of this problem, arguing that the principle of fair subject selection is best understood as a bundle of four distinct sub-principles, each with normative force and each yielding distinct imperatives: (1) fair inclusion; (2) fair burden sharing; (3) fair opportunity; and (4) fair distribution of (...) third-party risks. We first map out these distinct sub-principles, and then identify the ways in which they yield conflicting imperatives for the design of inclusion and exclusion criteria, and the recruitment of participants. We then offer guidance for how decision makers should navigate these conflicting imperatives to ensure that participants are selected fairly. (shrink)

This study forms part of a larger research project examining the election process for the Nobel prizes for Physiology or Medicine at the Karolinska Institute in Stockholm, and the role and function of the prizes in early 20th century Swedish and international medicine. The purpose of the study is to clarify the decision-making process which led to the Nobel prize for Paul Ehrlich in 1908, for work on immunity. His award was preceded by the most dramatic conflict within the prize (...) authority concerning any prizewinner prior to World War I, and thus is apt to illuminate both the implicit and explicit criteria and the strategies used in the prize deliberations.Ehrlich's chemical ideas on the immune response were criticized by the physical chemist Svante Arrhenius who recommended the application of his disciplines's methods and principles on immunological problems. This criticisms were brought into the Nobel prize debate by J.E. Johansson, a physiologist who asserted that Ehrlich's research was of little scientific value and therefore not worthy of a prize. Yet the majority of the Institute, led by its chairmam, the chemist K.A.H. Mörner, succeeded in awarding Ehrlich. (shrink)

If a comparison is made between the constitutional principles of 1831 with regard to the working of the parliamentary system and presentday political practice, then it appears that there has been an evolution in which the role of the parties is fundamental. Until about 1850 virtually no party-system existed in Belgium. The monarchy supported by the conservative forces of the nobility, the church and the landowners controlled the system. In the second half of the century there was a simultaneous increase (...) in the influence of parliament and the breakthrough of economic and political liberalism without the parties yet being able to impose the rules. Such rule making did not happen until around the turn of the century when the civil parliament became democratic and the big parties became integrated within it. From then on control over parliament and executive decision-taking came about through the party-structures. The period of crisis preceding the second world war obviously weakened this trend considerably; after 1945 it re-emerged even more strongly. (shrink)

In this article we conclude, via a comparison of the 19th C. scientific publications concerning the Belgian parliament and the state of parliamentological research of the day, that Belgian writers achieved an international standard. In Belgium, as elsewhere in Europe, parliamentology was pursued from the standpoint of various complementary schools of thought. Modern political history provided very detailed information about the functioning of the parliamentary institution; constitutional law investigated the juridical aspects of it ; political science transcended these juridical boundaries (...) and took account of the political aspects as well ; this method was also pursued in the field of political economy which, from a methodological point of view, can be regarded as the fundamental current of parliamentary sociology.It can be asserted that these writers are the founders of modern parliamentology despite the rather weak methodological foundation of their studies, the relative lack of empirical data-collection and the infiuenceof political commitment. As is still the case today, so also in the 19th C, the formal-juridical approach was dominant ; however, it was also insight-fully recognized that the most important problems of power lay in the mutual relations of the members of parliament themselves and in their relation to the majority, the opposition and the executive power. These studies furnish, therefore, very interesting lines of inquiry for the diachronic treatment of the majority of the problems of contemporary parliamentology. (shrink)

The eighteenth-century American founders believed that religion is special and deserves special constitutional protection, and that all peaceable faiths must be drawn into the constitutional process and protection. The founders introduced six constitutional principles for the protection of religious freedom: freedom of conscience, free exercise of religion, religious pluralism, religious equality, separation of church and state, and no state establishment of religion. Since the 1940s, the United States Supreme Court has upheld these religious freedom principles in more than 170 cases, (...) albeit unevenly of late. Moreover, in recent years religious freedom has come under sharp popular and academic attack, particularly as religious pathologies have come to light and religious freedom claims have clashed with sexual liberty claims. This article calls for a return to the first principles of religious freedom for all, at home and abroad, and for a new balance between religious freedom and other fundamental rights claims. When young children first come to school they bring with them a depth of being; the authors suggest that the educational community should respond to children with a pedagogy that is capable of nurturing this depth. The authors of this paper are teachers of many years’ experience. Their own work in classrooms has shown them that, paradoxically, depth in pedagogy is most surely to be found when teachers follow the light in the eyes of children. The authors draw upon a (...) selection of vignettes and narratives taken from classroom experiences to describe how this is done. They also show how children and teachers can approach the complex learning that requires transcendence of the known. Notions of relational consciousness (), as well as ethical and spiritual sensibility () are developed through reference to a range of educators including Bronson Alcott, Ralph Waldo Emerson, John Dewey, Stanley Cavell, Maxine Greene, Nell Noddings, Vivan Paley and Arthur Vogel. The broader educational community is reminded that school experiences should balance the measurable and the immeasurable. The authors question some aspects of the, sharing their concern that it may focus teachers’ attention too tightly on ‘that which is formed from without’. The authors suggest that the weight of this legislation may result in the neglect of some very important aspects of learning. The broader educational community is invited to consider the implications of a pedagogy of depth, to become more aware of the skill of transcending known limitations through coming to shared understanding, and to find ways to reconcile the potential violence of legislated structures with the being‐in‐the‐world of children in schools. While the Historische Kulturwissenschaft is introduced as a new way of writing history the question has to be answered what Kultur means or how it should be interpreted. The paper deals primarily with the special German notion of ‘Kultur’. The distinction between ‘intension’ and ‘extension’ is made and contrasted with both the narrow and the wide concept of ‘Kultur’. Writing history as new cultural history is shaped at least by five aspects: space, perspective, language, acting and time which are discussed (...) in this thesis. The intension of ‘Kultur’ in Historische Kulturwissenschaft leads to popularisation. The sense of the popular approach to history emphasizes modality in the conception and writing of history. In this study I will present the intellectual development of Schelling, Holderlin and Hegel during their formative years. Because of their similar social origins, the early thought of these young Swabians, during the 1790's, should be treated as a unit. Their experience as roommates at the Stift in Tiibingen and their close intellectual fellowship throughout the nineties made each extremely responsive to the others ideas. As mem bers of the political elite in Wiirttemberg, their intellectual assumptions were profoundly affected by (...) the crisis of Wiirttemberg and German political society and by the events of the French Revolution in a way ex plicable only in the light of their Swabian heritage. So, for example, seen in the context of HOlderlin's and Schelling's thinking, the genesis of Hegel's earliest mature philosophical assumptions appears to be not so much an event in the history of philosophy as a specific solution to the problems raised by the crisis of his society. The crucial role of Holderlin in the history of German Idealism should also become apparent as a result of this study. For reasons developed in the following, Holderlin's thinking bridged the gap not only between Kantianism and the new philosophy, which was to come to fruition in Hegel's mature thought, but also between the republican and the natio nalist phase in the history of German political thought. Whiteheads Prozessphilosophie und Piagets genetischer Strukturalismus stellen zwei der originellsten Denkentwurfe unseres Jahrhunderts dar. Beide Ansatze haben Forschungsaktivitaten auf den verschiedensten Gebieten angeregt. Alte Problemstellungen wurden in ihrem Licht transformiert und neue, uberraschende Losungsvorschlage erarbeitet. In diesem Buch wurde der systematische Versuch unternommen, Piagets genetischen Strukturalismus in Whiteheads Prozessphilosophie zu integrieren. Die inhaltlichen Parallelen - bis ins Detail und bis hin zu ansatzimmanenten Problemen - belegen, dass dies gegluckt ist. Whiteheads Prozessphilosophie erweist sich folglich als Hoffnungstrager in einer Zeit mit (...) zunehmend komplexer werdenden Problemen und interdisziplinaren Fragestellungen.". (shrink)

Abstract. In this paper, which was among Don Browning's last writings before he died, we review and evaluate the main arguments against the United Nations Convention on the Rights of the Child (the “CRC”) that conservative American Christians in particular have opposed. While we take their objections seriously, we think that, on balance, the CRC is worthy of ratification, especially if it is read in light of the profamily ethic that informs the CRC and many earlier human rights instruments. More (...) fundamentally, we think that the CRC captures some of the very best traditional Western legal and theological teachings on marriage, family, and children, which we retrieve and reconstruct for our day.
