The increased prevalence of advanced‐stage chronic diseases has augmented the need for palliative care teams. In Colombia, although the legislation promotes palliative care development, people still die without receiving management from a palliative care team. In addition, judiciary regulations regarding euthanasia have generated public confusion and ethical conflicts among members of the palliative care teams. Therefore, this study aimed to perform a bioethical reflection on the relationship between palliative care and euthanasia supported by data on euthanasia requests in a palliative (...) care program. This reflection is based on retrospective and descriptive observational data, collected in two highly complex hospitals in Bogotá, Colombia. A total of 50 euthanasia requests were identified, of which 62% met the defined criteria, 16% did not, and 22% were not considered by the interdisciplinary committee for the right to die with dignity due to early death. All patients were treated and followed up by a palliative care team until their death. This study considered that palliative care could be a complement management for patients requesting euthanasia based on their experience by supporting the decision‐making, alleviating suffering, and providing emotional support in the last days of life. This paper takes on several distinct but related tasks. First, I present and discuss what I will call the “Ignorance Thesis,” which states that whenever an agent acts from ignorance, whether factual or moral, she is culpable for the act only if she is culpable for the ignorance from which she acts. Second, I offer a counterexample to the Ignorance Thesis, an example that applies most directly to the part I call the “Moral Ignorance Thesis.” Third, I argue for a (...) principle—Don’t Know, Don’t Kill—that supports the view that the purported counterexample actually is a counterexample. Finally, I suggest that my arguments in this direction can supply a novel sort of argument against many instances of killing and eating certain sorts of animals. (shrink)

This paper connects the question of the rationality of voting to the question of what it is morally permissible for elected representatives to do. In particular, the paper argues that it is rational to vote to increase the strength of the manifest normative mandate of one's favored candidate. I argue that, due to norms of political legitimacy, how representatives ought to act while in office is tied to how much support they have from their constituents, where a representative’s “support” is (...) a function of the percentage of adults living in the political jurisdiction who voted for her. In a representative system, whether a particular law or policy is legitimate is in part a function of how much support the particular representative government has, rather than simply being a function of the governmental structure or the normative content of the law or policy. Representatives with more support can permissibly act more like trustees (doing what they think is best) and less like delegates (doing what their constituents presently prefer). I argue that this fact provides a reason for individuals to vote, even given the incredibly small chance an individual voter has of casting a pivotal vote. (shrink)

The COVID-19 pandemic has impacted medical care in many ways; previously, a patient would enter a hospital and had an approximate idea of what would happen upon his admission, the physician informed them about it, but in the last two years this scenario has changed. Therefore, our aim was to identify if bioethical principles are present in the physician–patient relationship and the effect of these in the health care provided, through an observational and descriptive study where patients answered the validated (...) ReMePaB questionnaire that measures the presence of bioethical principles in the physician–patient relationship, on the seventh day of their hospital stay and 24 h after discharge, during the period from 1 August to 5 November 2020. In autonomy, an improvement in the score was observed in the second application compared to the first measurement; in the principle of non-vulnerability, the same scenario was observed for the first and second measurements, respectively. In the principles of beneficence, dignity, and justice, no statistically significant differences were observed. Considering the presence or absence of bioethical aspects in health care in this pandemic creates an area of opportunity to know the feelings of the patient during the care received and to maintain what is done well and improve those aspects that can be improved. Ausgehend von einem kurzem Blick in die Geschichte des Einfühlungskonzepts betrachtet der Beitrag zunächst dessen begriffliche Entwicklung in der Psychoanalyse. Empathie, so die These, sei als moderne Konzeption von Einfühlung unter dem Einfluss der Nachbarwissenschaften zu einem verkörperlichten Zugang für ich-syntone Anteile im anderen geworden. Vorgeschlagen wird, Empathie um psychoanalytische Verstehenselemente zu erweitern, um auch einen Zugang zum Unbewussten, Verdrängten, dem Ich Fremden zu finden, und dazu zum klassischen Begriff der Einfühlung zurückzukehren. Unter Rückgriff auf Waldenfels’ Phänomenologie des Fremden und (...) das von der Kleinkindforschung herausgearbeitete affektiv-kognitive Gedächtnissystem wird Einfühlung als kreative Antwort auf ein pathisches Ereignis im unmittelbaren Kontakt zum anderen spezifiziert. Dabei kann auch zwischenkörperlich gewonnenes Verstehen nach der hier vertretenen Auffassung immer nur subjektiv sein und seine transformative Kraft vor allem im korrigierenden Dialog entfalten. It is widely accepted that electoral representative democracy is better—along a number of different normative dimensions—than any other alternative lawmaking political arrangement. It is not typically seen as much of a competition: it is also widely accepted that the only legitimate alternative to electoral representative democracy is some form of direct democracy, but direct democracy—we are told—would lead to bad policy. This article makes the case that there is a legitimate alternative system—one that uses lotteries, not elections, to select political (...) officials— that would be better than electoral representative democracy. This book examines the human ability to participate in moments of joint feeling. It presents an answer to the question concerning the nature of our faculty to share in what might be called episodes of collective affective intentionality. The proposal develops the claim that our capacity to participate in such episodes is grounded in an ability central to our human condition: our capacity to care with one another about certain things. The author provides a phenomenologically adequate account of collective affective (...) intentionality that takes seriously the idea that feelings are at the core of our emotional relation to the world. He details a form of group emotional orientation that relies on the fact that the participating individuals have come to share a number of concerns. Readers will learn that at the heart of a collective affective intentional episode, one does not merely find a set of shared concerns, but also a particular mode of caring. In the end, the argument presented in this monograph makes plausible the idea that the emotions through which humans participate in moments of affective intentional community express our nature. In addition, it shows that the debate on collective affective intentionality also permits us to better understand the relationship between two conflicting philosophical pictures of ourselves: the idea that we are essentially social beings and the claim that we are creatures for whom our personal existence is an issue. Thus, aiming at an elucidation of the nature of our ability to feel together, the book offers a detailed account of what it is to situationally express our human nature by caring about something in a properly joint manner. Para identificar las tendencias de la investigación teológica latinoamericana se hace una Revisión Sistemática de Literatura sobre 494 artículos de siete revistas teológicas de alto impacto en este continente, teniendo presente como marco teórico las definiciones de la Teología Latinoamericana, de la Liberación y del Pueblo, en el contexto actual de la Iglesia Católica, a propósito de los desafíos para una Teología en contexto y en salida. Con una metodología mixta, se miden varias dimensiones de las publicaciones como, por ejemplo, (...) las universidades de mayor producción, la procedencia de los investigadores, el lugar de la mujer en la investigación teológica y los principales temas que se investigan en Teología en América Latina, desde la generalidad de los campos teológicos hasta la particularidad de temáticas específicos. En conclusión, se evidencia, entre otros asuntos, la preferencia por la reflexión teológica desde el magisterio del Papa Francisco, la recuperación de la memoria de las conferencias de Medellín y Aparecida, los aportes del Concilio Vaticano II, la mística y la espiritualidad y la vigencia de la Teología latinoamericana en la investigación actual. Even good lawyers get a bad rap. One explanation for this is that the professional rules governing lawyers permit and even require behavior that strikes many as immoral. The standard accounts of legal ethics that seek to defend these professional rules do little to dispel this air of immorality. The revisionary accounts of legal ethics that criticize the professional rules inject a hearty dose of morality, but at the cost of leaving lawyers unrecognizable as lawyers. This article suggests that the (...) problem with both the professional rules and the extant accounts of legal ethics is that they treat the role of lawyer as largely uniform, whereas lawyers actually serve several importantly different roles in different contexts. The central insight of the article is that legal ethics must be fundamentally context-sensitive: what lawyers are morally permitted or required to do depends on the background context in which they are working. Additionally, by taking context into account, this article is the first to present a theory of legal ethics as appropriately shaped and constrained by normative political philosophy and norms of political legitimacy. -/- Specifically, the article argues that people act as lawyers in three different contexts: State v. Individual (situations in which the State seeks to apply some general law to a particular individual), Individual v. Individual (situations in which private individuals are engaged in a dispute), and Individual v. State (situations in which individuals object to State conduct on constitutional or other grounds unrelated to the question of whether a general law applies to their particular case); that the value of lawyers, qua lawyers, stems from a different source in each of these contexts; and that a theory of legal ethics must take into account both of these first two claims. This article develops one such theory - the Multi-Context View. To demonstrate how the theory applies in practice, the article applies the Multi-Context View to two significant issues in legal ethics: the ethical issues involved in deciding whether to represent a client and the moral permissibility of the use of tactical delay. Este trabajo parte de la noción filosófica de alteridad, que se puede complementar con las aportaciones de la teoría feminista y su reflexión sobre la diferencia sexual. Hay, al menos, tres aspectos del pensamiento feminista que interesa destacar a propósito de la alteridad: en primer lugar, la crítica a la construcción de lo femenino como alteridad con respecto a lo masculino; en segundo lugar, y de la mano del feminismo de la diferencia, es interesante reflexionar sobre las experiencias físicas y (...) simbólicas de la maternidad, que proporcionan un nuevo modelo de ‘alteridad irreductible’ y nuevos contenidos para una ética del cuidado; en tercer lugar, y partiendo de las consideraciones de Ricoeur sobre la dialéctica entre identidad y mismidad, la alteridad sexual puede ser reformulada como una construcción dinámica articulada a partir de la tensión entre las dimensiones discursivas y performativas. Asimismo, este estudio trata de arrojar luz acerca del desarrollo histórico de varios rasgos dialectales, los cuales pueden ayudarnos a comprender mejor la evolución de los dialectos árabes en Marruecos y en el Magreb. This essay begins with a Native American women's perspective on Early Feminism which came about as a result of Euroamerican patriarchy in U. S. society. It is followed by the myth of "tribalism," regarding the language and laws of U. S. colonialism imposed upon Native American peoples and their respective cultures. This colonialism is well documented in Federal Indian law and public policy by the U. S. government, which includes the state as well as federal level. The paper proceeds to (...) compare and contrast these Native American women's experiences with pre-patriarchal and pre-colonialist times, in what can be conceptualized as "indigenous kinship" in traditional communalism; today, these Native American societies are called "tribal nations" in contrast to the Supreme Court Marshall Decision which labeled them "domestic dependent nations." This history up to the present state of affairs as it affects Native American women is contextualized as "patriarchal colonialism" and biocolonialism in genome research of indigenous peoples, since these marginalized women have had to contend with both hegemonies resulting in a sexualized and racialized mindset. The conclusion makes a statement on Native American women and Indigensim, both in theory and practice, which includes a native Feminist Spirituality in a transnational movement in these globalizing times. The term Indigensim is conceptualized in a postcolonialist context, as well as a perspective on Ecofeminism to challenge what can be called a "trickle down patriarchy" that marks male dominance in tribal politics. A final statement calls for "Native Womanism" in the context of sacred kinship traditions that gave women respect and authority in matrilineal descendency and matrifocal decision making for traditional gender egalitarianism. Conventional truth describes things as delivered by ordinary experience; ultimate truth captures the way that things are independent of our interests, practices, and cognitive faculties. It is notoriously difficult to provide an adequate analysis of either conventional or ultimate truth, however. This chapter develops a previous scholarly suggestion to understand conventional truth in Madhyamaka as deflationary truth. It points out that this suggestion is a good one only if a supplementary theory of meaning, which the deflationary theory of truth presupposes, (...) can be given in a way that is consistent with both the limitations of the deflationary theory of truth and with Madhyamaka antirealist metaphysics. It then offers a presentation of Dharmakīrti’s theory of apoha in order to argue that the resources necessary to give the required account of meaning can be found in Dharmakīrti’s account of intentional mental content. En primer lugar se lleva a cabo un análisis fenomenológico del sufrimiento como elemento de extrañamiento, presencia heterogénea que irrumpe en la existencia y altera su curso normal. A continuación se trata sobre la violencia, entendida aquí como una relación intersubjetiva en la que un individuo interactúa con otro a través del dolor, ya sea infligiéndolo o padeciéndolo. Uberrima Fides is a legal doctrine that governs insurance contracts and expects all parties to the insurance agreement to act in good faith by declaring all material facts relative to a policy. The doctrine originated in England in 1766 with the case Carter v Boehm ruled by Lord Mansfield. Ever since, it has become, with some differences in interpretation, a cornerstone of insurance relationships around the world. The role that trust plays within it, however, is not simple and should not (...) be taken for granted. While it is expected that an idea of trust represents an order of truth, trust in itself is the outcome of a complex negotiation of moral orders. Semiotically, trust operates here not as a Kantian category for the understanding but as a signifier of an order of truth that upholds the possibility for insurance relationships. Trust, as sign, operates as a condition of possibility for the performance of insurance. In this article, a Foucaultian approach is employed to problematise the idea of trust and its role in insurance relationships. The case of mis-selling of insurance policies in the United Kingdom since the 1980s, which has given rise to numerous legal rulings, is used as the empirical site for the problematisation. (shrink)

Something dramatic, revolutionary, is required. You have ideas. You might have a plan. But although you are certain of the wrong around you, you are not certain of the path forward. You have some doubt about the plan, whether it will work, its moral costs, and whether there are problems you cannot yet see. (...) You have revolutionary doubt. That is good. We need revolutions. But revolutions should not be only conducted by the certain. This article will help you to nourish that doubt, to see why it is almost always epistemically appropriate if also almost always difficult to maintain, to learn how to live and act with it, and to give it its due without it leading to paralysis and inaction. How does age matter to moral responsibility and criminal liability? Almost no one thinks that a 3-year old is morally responsible for what she does. No one would think an 8-year old should be held criminally liable for engaging in illegal criminal action—even for something seriously harmful such as intentionally setting fire to a building or badly harming another child. Something else should happen, certainly, but not criminal prosecution and conviction and State punishment. And that’s true even if we might (...) start to think that the 8-year old can be morally responsible, or at least somewhat morally responsible, for what she does. Disagreement might start to enter in as the age increases. What do we think of a 12-year old? A 15-year old? A 17-year old? Gideon Yaffe’s excellent book, The Age of Culpability, is focused on the question of why children—for these purposes, all people under the chronological age of 18—should be given a break, legally speaking, and why this should be done categorically. Yaffe argues that the fact that no one under 18 is eligible to vote is a key part of the explanation. In this paper, I raise two objections to Yaffe’s account. In particular, I raise several questions about the details of Yaffe’s account regarding what it is to “have a say over the law” and the way in which this makes a difference to criminal culpability. Maybe you only have 1000 units of some resource, but 10,000 people need the resource or would benefit from it. One question: why do you control the resource? Leave that aside for now. A second question: how should you allocate the resource? If you are a decision-maker in a health system, and if the resource has to do with medicine or public health, we are in the world of the ethics of scarce resource allocation decisions in healthcare. Munthe et al (...) 1 note that the ‘operational norms that guide actual decision making in this area tend to be similar across health systems’ and include principles concerning need, prognosis, equal treatment and cost-effectiveness. Even with just these principles, there are hard questions of how they ought to be specified, operationalised and balanced against each other when they conflict. They do not focus on this. Instead, they identify a concern: paying attention only to these principles in making allocation decisions may lead decision-makers to miss ‘negative dynamics’ that result from their decisions. They aim to rectify this by suggesting a ‘sustainability’ principle that would sit alongside these other ethical principles, serving as a side-constraint that rules out certain allocation choices or as a distinct reason to be weighed in the decision-making calculus. Although it has acquired an extraordinary social diffusion, entrepreneurial education has a certain lack of definition associated with its conceptualisation and meaning. It seems clear that entrepreneurial education is linked to the economic sphere, but it is not limited to the productive sector. The idea of entrepreneurial education has been progressively enriched, being linked to the development of skills for personal growth and social progress. Further clarification of the meaning and scope of entrepreneurial education is, therefore, needed. Thus, it is (...) relevant to analyse entrepreneurial identity in the context of personal identity via the theoretical–explanatory investigation of a model developed in two phases. A critical analysis leads us to study the different factors that intervene in the configuration of this identity in an attempt to construct a systemic map of entrepreneurial action. Between the private and the public, entrepreneurs seek new ways of facing the challenges of our times, trying to find new ways of regenerating the links between individuals and institutions and with society in general. In this sense, we show how entrepreneurial educational ecosystems acquire relevance insofar as they consider the subject as the principle of action rather than merely the result of various contextual factors. There has been a great deal of philosophical discussion about using people, using people intentionally, using people as a means to some end, and using people merely as a means to some end. In this paper, I defend the following claim about using people: NOT ALWAYS WRONG: using people—even merely as a means—is not always morally objectionable. Having defended that claim, I suggest that the following claim is also correct: NO ONE FEATURE: when it is morally objectionable to use people, (...) this is for many different kinds of reasons—there is no one wrong-making feature that every morally objectionable using has in common. After discussing these claims, I use them to present and motivate what I call the “precaution” theory of norms against using people. I conclude by considering a few cases from the criminal law context—cases that are naturally described as using people—to assess the moral appropriateness of this kind of use in these cases, and to demonstrate how the theory applies to the real world. En la actualidad, los jóvenes, nativos digitales y usuarios avanzados de redes sociales y plataformas de audio y vídeo online, recurren constantemente a YouTube como recurso lúdico para su aprendizaje. This article revises Foucault's account of biopolitics in the light of the impact of the molecular and digital revolutions on `the politics of life itself'. The confluence of the molecular and digital revolutions informationalizes life, providing an account of what it is to be a living thing in terms of complex adaptive and continuously emergent, informationally constituted, systems. Also revisiting Foucault's The Order of Things and its interrogation of the modern analytics of finitude, the article argues that our contemporary politics (...) of life is therefore distinguished by the quasi-transcendentals that now distinguish informationalized life: circulation, connectivity and complexity. Here, too, the article argues, the figure of Man, which once united the quasi-transcendentals of life, labour and language, is replaced by the contingency that now unites circulation, connectivity and complexity. Observing that a life of continuous emergence is also one in which production is continuously allied with destruction, such a life is lived as the continuous emergency of its own emergence. This account of contemporary biopolitics, together with its emergency of emergence, contrasts, in particular, with that offered by Agamben in his appropriation of Schmitt. (shrink)

Despite its biological importance, the mechanism of formation of cutin, the polymeric matrix of plant cuticles, has not yet been fully clarified. Here, for the first time, we show the participation in the process of lipid vesicles formed by the self‐assembly of endogenous polyhydroxy fatty acids. The accumulation and fusion of these vesicles (cutinsomes) at the outer part of epidermal cell wall is proposed as the mechanism for early cuticle formation. Se presenta una revisión bibliográfica en la que se valora la implementación de las estrategias curriculares en la Licenciatura en Enfermería, a partir de las asignaturas impartidas en el segundo año de la carrera. Se destaca la importancia de estos recursos pedagógicos en la formación de los estudiantes, su desarrollo y contribución a la solución de situaciones relacionadas con el cuidado, la calidad de la atención de salud, la disminución de eventos adversos y la seguridad del paciente. Las estrategias curriculares (...) vinculadas a la carrera de Enfermería constituyen una forma particular de desarrollar el proceso docente, caracterizadas por una direccionalidad coordinada que responde al perfil de salida del egresado, en la que se imbrican los contenidos y métodos teóricos y prácticos de las unidades curriculares correspondientes al plan de estudio, a partir de una estructura metodológica que garantiza su funcionamiento. Ello contribuye a la formación integral de un profesional competente. A bibliographic revision is presented in order to assess the implementation of curricular strategies in Nursing 2nd year subjects. The importance of teaching aids in students' training, their development and contribution to solve issues related to care and quality of the health system, the lowering of adverse events and the patient´s safety are pointed out. Curricular strategies related to Nursing represent a particular way to develop the teaching process, characterized by a coordinated direction which responds to the graduate's experience, in which theoretical and practical methods and contents of the curricular units that belong to the syllabus are interwoven, starting from a methodological structure that ensures these strategy functions. It contributes to the comprehensive formation of a competent professional. (shrink)

This study sets out the main points in Leonardo Polo’s theory of moral development, which systematically articulates goods, norms, and virtues. To make them easier to understand, each point has been compared with Kohlberg’s theory of moral development, which is well known to specialists and radically different to it. We have chosen three aspects of Kohlberg’s theory of moral development to highlight the uniqueness of Polo’s theory: a) Kohlberg does not account for the specificity of voluntary acts, particularly the act (...) of deciding; b) The options that solve Kohlberg’s dilemmas are isolated from potential prior and subsequent decisions, so his moral development ignores any internal biographical storyline to the decisions themselves; and c) The Kohlbergian morality is an ethics of justice and duty, thereby relegating the friendship, which to Polo is the culmination of ethics, to a morally irrelevant level. La literatura latinoamericana requiere desarrollar una teoría literaria pertinente que describa su variedad y especificidad. Junto con esto, la crítica al pensamiento moderno occidental debe centrarse en el rescate del acervo cultural latinoamericano, ignorado por la modernidad occidental. Por lo tanto, el objetivo de este artículo ha sido el de develar la estructura dialógica de Yo, el supremo (1985) en contraposición a la perspectiva monológica, inherente a la cultura occidental. A partir de un análisis interpretativo de la teoría filosófica y (...) de la crítica literaria, la tesis central de este artículo elude un “universo unidimensional” para presentar un desplazamiento permanente de textos (voces) que incorpora nuevos significados al lenguaje afectado por la dinámica de la cultura occidental. La obra de Augusto Roa Bastos debe ser interpretada, más allá de sus características representativas, como parte de un proyecto universal y utópico donde la alienación del individuo moderno desparece para dar paso a un conjunto de nuevos significados.
