El motivo del presente ensayo es presentar la tesis que gira en torno al problema de la libertad determinada y su relativa responsabilidad social. Dados los diversos factores que determinan la libertad de cada individuo, los niveles de responsabilidad varían según su situación; sostenemos el supuesto de que entre más libertad le permite el determinismo al individuo, mayor responsabilidad social adquiere.Para una amplia e inductiva comprensión de la tesis, primeramente, se desarrolla la primera parte en la cual se analiza el (...) alcance del Determinismo; se explican diversos factores que forman parte de él, así como la manera directa en que afectan la vida del individuo y su libertad. Además, se da a conocer el proceso del desarrollo histórico de la moral posterior al de la cultura y la sociedad, así como la mecánica que la tiene sujeta a cambios. En base a la obra de José Ingenieros, se presentan los tres estadios en los que los seres humanos, a partir de la determinación social, se posicionan. También se habla acerca del concepto de individualización, el efecto que tiene en cada estadio y su importancia en la trascendencia que conlleva a la perfección social.Ulteriormente, se presentan, de manera ilustrativa, las posibles divisiones sociales que presentan varios autores. Se ofrecen características que resultan esenciales para la tesis a la que se busca llegar. De igual manera, se hace énfasis en la importancia que cada una de estas divisiones tiene, pues el cambio social, es decir, el perfeccionamiento de la especie humana requiere, necesariamente, a cada una de ellas de igual manera; ninguna es más valiosa que la otra, la única diferencia reside en el grado de responsabilidad relativa a la limitación de su libertad.Posteriormente, en la última parte, se plantea la noción de ‘ideal’ y se señala la importancia moral que ésta implica. También se plantea el argumento de la tesis de manera concisa y se ofrece un ejemplo histórico de un ideal mal utilizado, que germinó en la barbarie humana. Finalmente, se ofrece una ligera reflexión, en base a un proverbio en torno al cual vale la pena meditar antes de realizar cualquier juicio ético. (shrink)

This article builds on the notion of legal tolerance and analyzes the scope of its definition. It situates the notion in the complex set of relations occurring between the major systems of society. Generally, legal tolerance, as a concept, is understood in light of the possibilities of the legal system of influencing other major systems? responses. On the other hand, tolerance is also the response of the legal system in respect to other major systems? communications. Although there is a common (...) understanding of tolerance as ?under punishing bias? in criminology or as political tolerance in political science, 1 the focus of this article is different. The central points here are, first, the analysis of legal tolerance as part of systemic communications and, second, the historicity of the transformations of the nation-state in its ability to cope with the growth of separate, distinct and partial systems of society. Tolerance seems relational and raises questions such as: ?How much can the legal system tolerate?? And also, ?Which societal topics belong to the social system's domain-matter?? These questions are relevant given that the concept of legal tolerance depends on the possibilities of a given system to steer, to direct or to influence other major systems? behavior, or to resist, respond or to address other systems, which are in its environment. The concept of legal tolerance requires an analysis of a cluster of related definitions to assess the implications of the concept. These definitions are the following: (1) The concepts that result from the historical process of structuration and that explain the emergence of social systems. (2) The definition of reflexivity and its relation with the ?second order cybernetics dilemma.? This is the place where heuristic and epistemological problems are found. Such problems result from both the problem of representation and from the ontological status of the real. This analysis will show why reflexivity is a key concept to explaining the transformations suffered by such systems. Then, legal tolerance is a newer development in respect to the idea of planning. As an alternative to hard planning, legal tolerance creates a fostering environment. Instead of a single system directing other systems, legal tolerance is relational and created collectively by the organizational national state using its (limited) power of legal creation. Legal tolerance also stems from the concerned subsystems of the society (economy, law, politics, science, along with others) by means of a variety of legislative products, public policies, alliances, and legal and other scientific communications that emerge as coordinating mechanisms among the alluded major subsystems. Cette étude, à partir du cas colombien, présente une théorie globale novatrice du trafic des drogues, qu'elle présente comme le symptôme de la situation générale de l'homme contemporain confronté aux problèmes de la mondialisation. Elle pose ainsi le problème du trafic des drogues comme la rencontre entre des subjectivités et les productions des grands systèmes économiques, politiques et juridiques, dans une perspective sociale et anthropologique critique.

Background: The prevalence of anxiety and depression in young students is associated with biosocial factors and scholastic stress. However, few studies have evaluated emotional-affective symptoms that are related to the immune system and antioxidant parameters in young individuals without diagnoses of affective disorders.Aim: This study aims to assess the relationship between emotional-affective symptoms and glutathione concentrations and CD4 and CD8 lymphocyte counts in college students.Methods: College students completed standardized psychometric instruments, including the Perceived Stress Scale, Hamilton Anxiety Scale, Beck Depression (...) Inventory, Familiar Social and Friends Support Scale, and Rosenberg Scale. Blood samples were biochemically analyzed. Analyses of variance were conducted between four groups according to symptom severity.Results: A considerable prevalence of stress, anxiety, and depression symptoms was observed and negatively correlated with self-esteem and socio-familiar support. Perceived stress was sexually dimorphic. Although biochemical parameters were within reference ranges, glutathione, CD4, and CD8 tended to be lower in participants with anxiety and depression symptoms, which may be of predictive value.Conclusion: The relationship between antioxidant/immune parameters and socio-affective scores is latent in undiagnosed college students who might develop affective disorders. The findings suggest that during the initial development of affective disorders, stress management strategies should be implemented to help college students cope with the academic load and monitor negative changes in their physiological state. We explored the home learning environments of 173 Mexican preschool children in relation to their numeracy performance. Parents indicated the frequency of their formal home numeracy and literacy activities, and their academic expectations for children’s numeracy and literacy performance. Children completed measures of early numeracy skills. Mexican parent–child dyads from families with either high- or low-socioeconomic status participated. Low-SES parents reported higher numeracy expectations than high-SES parents, but similar frequency of home numeracy activities. In contrast, high-SES parents reported higher frequency (...) of literacy activities. Path analyses showed that operational numeracy activities were positively related to children’s numeracy skills in the high- but not in the low-SES group. These findings improve the understanding of the role of the home environment in different contexts and provide some insights into the sources of the variable patterns of relations between home learning activities and children’s numeracy outcomes. They also suggest that SES is a critical factor to consider in research on children’s home numeracy experiences. (shrink)

We present an instrument developed to explain to students the concept of the personal ethical threshold. The PET represents an individual's susceptibility to situational pressure in his or her organization that makes moral behavior more personally difficult. Further, the PET varies according to the moral intensity of the issue at hand, such that individuals are less vulnerable to situational pressure for issues of high moral intensity, i.e., those with greater consequences for others. A higher PET reflects an individual's greater likelihood (...) of adhering to the morally correct path, even in the face of high situational pressures and low moral intensity. PET questionnaires were completed by 506 students representing eight business schools throughout the United States. Relationships between respondents' PET and their gender, age, and major field of study, as well as the geographical location of their school, are explored. Results indicate that older students have higher PETs and that students attending schools in the northeastern part of the United States have lower PETs. These findings are discussed. It is argued that the PET instrument can be used to help students identify organizational pressures and intrapersonal processes that can impede their moral behavior in organizations. (shrink)

El autor no sólo mezcla diferentes idiomas, también inventa nuevos términos que germinan y se significan, en gran medida, desde su dimensión sonora. Personajes, y acontecimientos reales y ficticios se mezclan, formando una amalgama donde variantes de arquetipos mitológicos transcurren una glocalidad cíclica perpetua. La protagonista femenina, Anna Livia Plurabelle (ALP), es un (...) personaje mutante que deviene diferentes elementos naturales a lo largo del texto. El murmullo del río se confunde con el suyo propio, en un pulso narrativo que sobrescribe la orilla en la historia. De fondo siempre se oyen voces y, aunque no son claras, sugieren. Esta obra literaria no se lee, se escucha; no se entiende, se deduce. La presente investigación se sitúa en el contexto actual de auge en la aplicación de la Inteligencia Artificial (IA) al procesado de textos. Somete a prueba la transcripción realizada a partir de la locución de algunos pasajes de Finnegans Wake, evaluando el grado de acierto y los posibles sesgos o desviaciones de los resultados. Two methodological claims in Hart's TheConceptofLaw have produced perplexity: that it is a book on 1 and that it may also be regarded as an essay in 2 Are these two ideas reconcilable? We know that mere analysis of our legal concepts cannot tell us much about their properties, that is, about the empirical aspect of law. We have learned this from philosophical criticisms of conceptual analysis; yet Hart informs us that analytic jurisprudence can be reconciled with descriptive sociology. The (...) answer to this puzzle lies in the notion of nonambitious conceptual analysis. The theorist analyzes concepts but accepts the limitations of conceptual analysis and therefore uses empirical knowledge and substantive arguments to explain, refine, or perhaps refute initial insights provided by intuitions. This is the conclusion that this paper arrives at as an argumentative strategy to defend Hart's legal theory from the criticisms of Stavropoulos and Dworkin. The latter argues that Hart's legal theory cannot explain theoretical disagreements in law because he relies on a shared criterial semantics. Stavropoulos aims to show that Hart's semantics is committed to ambitious conceptual analysis and relies on the usage of our words as a standard of correctness. Both attacks aim to show that the semantic sting stings Hart's legal theory. This essay refines both challenges and concludes that not even in the light of the most charitable interpretation of these criticisms is Hart's legal theory stung by the semantic sting. This study defends the view that Hart's methodological claims were modest and that he was aware of the limits of conceptual analysis as a philosophical method. Colemanand Shapiro have recently advanced a second at- tempt to reconcile Hart’s practice theory of rules and the idea of the normativity of law; i.e., the idea that legal rules qua social rules give reasons for actions and, in some circumstances create and impose duties and obligations. Their argumentative strategy is to resort to elements in Bratman’s work on shared agency and planning, though they introduce important and substantive modifications to Bratman’s own explanation. Bratman describes his own theory as a (...) modest theory of the will where the notion of planning plays a fundamental role. Both Shapiro’s and Coleman’s application of Bratman’s planning theory of agency to an authority structure such as law is impressive, but a number of objections can be levelled, with the intention of grasping both the nature of authority structures and the normativity of law. Although I have referred to Shapiro’s and Coleman’s applica- tions as being similar to one another, the differences are sub- stantive and important. I will scrutinise both Shapiro’s and Coleman’s explanations of ‘shared agency’ and discuss the objections that can be raised against each application. (shrink)

Can Hart's non-cognitivism be reconciled with his rejection of the predictive and sanction-based explanations of law? This paper analyses Hart's notion of the internal point of view and focuses on the notion of acceptance of a rule along the lines of a non-cognitivist understanding of intentional actions. It is argued that a non-cognitivist analysis of acceptance of rules is incomplete and parasitic on a more basic or primary model of acceptance that does not involve mental states. This basic or primary (...) model of acceptance explains actions in terms of other actions and in terms of reasons for actions that are both presented as good-making characteristics and transparent to the agent. If Hart's internal point of view is able to work as the key argument to reject predictive and sanction-based explanations of law, it needs to make the outward approach of intentional action basic or primary rather than rely on an inward approach such as the one advanced by non-cognitivism. The British Medical Association and Royal College of Physicians have published new guidance, endorsed by the General Medical Council, on decision-making about clinically assisted nutrition and hydration and adults who lack capacity to consent. The development of the guidance follows a series of legal cases which has created confusion about the precise circumstances in which an application to the court is required before CANH is withdrawn which has culminated with the decision of the Supreme Court in National Health Service Trust (...) versus Y. 1 This confirmed that there is no requirement to go to court, providing there is agreement as to the patient’s best interests, the provisions of the Mental Capacity Act 2005 have been observed, and the relevant professional guidance has been followed. The new guidance covers all decisions to start, restart, continue, or stop providing CANH in patients who are not imminently dying, in circumstances where CANH is the primary life-sustaining treatment being provided. It goes beyond the category of patients in permanent vegetative state or minimally conscious state who have previously been the subject of court applications, and also covers decisions for patients with neurodegenerative conditions and patients who have suffered a sudden onset brain injury in addition to having multiple comorbidities or general frailty which is likely to impact on life expectancy. It provides a clear statement of doctors’ legal responsibilities, covers the importance of robust best interests’ assessments and sets out the process to be followed for sufficient independent scrutiny of decisions. In light of some of the identified problems with decisions about CANH, a particular focus of the guidance is on the importance of regular best interests’ assessments, and it provides detailed practical guidance about how to approach these. Despite the increase in global research on health inequalities, more needs to be done to strengthen efforts to inform local interventions. In this article, we ask what determines the local capacity to engage in research on health inequalities. A bibliometric analysis identified Spain as the 10th highest global contributor to this research field (1966–2015), yet a significant proportion of this production was affiliated to just a few institutions in Barcelona. How and why has the city produced so much health inequalities (...) research over four decades? A realist explanatory case study was conducted to test and refine six causal mechanisms, and identify the contextual conditions that might have activated them to generate this outcome. Data was triangulated from 10 semi-structured interviews, and scientific and grey literature. Our findings confirmed that several of our proposed mechanisms - functioning under certain conditions over time - explain the large volume of health inequalities research in Barcelona. Based on these findings, key lessons from the city's experience are suggested. Further research is needed on this topic. (shrink)

Recent replication crises in psychology and other fields have led to intense reflection about the validity of common research practices. Much of this reflection has focussed on reporting standards, and how they may be related to the questionable research practices that could underlie a high proportion of irreproducible findings in the published record. As a developing field, it is particularly important for Experimental Philosophy to avoid some of the pitfalls that have beset other disciplines. To this end, here we provide (...) a detailed, comprehensive assessment of current reporting practices in Experimental Philosophy. We focus on the quality of statistical reporting and the disclosure of information about study methodology. We assess all the articles using quantitative methods that were published over the years 2013–2016 in 29 leading philosophy journals. We find that null hypothesis significance testing is the prevalent statistical practice in Experimental Philosophy, although relying solely on this approach has been criticised in the psychological literature. To augment this approach, various additional measures have become commonplace in other fields, but we find that Experimental Philosophy has adopted these only partially: 53% of the papers report an effect size, 28% confidence intervals, 1% examined prospective statistical power and 5% report observed statistical power. Importantly, we find no direct relation between an article’s reporting quality and its impact. We conclude with recommendations for authors, reviewers and editors in Experimental Philosophy, to facilitate making research statistically-transparent and reproducible. (shrink)

Testimonio que recoge algunas experiencias y reflexiones de la artista visual costarricense María Rapela en Alemania y de cómo se involucró en la gestión cultural, coordinando el Fieber Festival, una plataforma colaborativa y auto-gestionada de mujeres artistas migrantes iberoamericanas en Berlín entre el 2011 y el 2017.

Los inconmensurables impactos del conflicto armado experimentado en Colombia, transforman las distintas esferas de la vida cotidiana. En este contexto, el eje cafetero experimenta un imaginario social negacionista del conflicto armado en aras de consolidar un proyecto desarrollista en su territorio. El presente artículo resultado de un proyecto de investigación de cohorte cualitativo surge como resultado del dialogo entre la sociología relacional y filosofía histórica con la cual se analizan las relaciones entre transiciones y memorias en contextos matizados por históricas (...) violencias, reconociendo dispositivos de control que generan ocultamiento del conflicto, pero también prácticas de resistencia en la región cafetera. La discapacidad ha sido concebida a lo largo del tiempo de diferentes modos, lo cual fue ocasión para que algunos autores construyeran modelos para explicar ciertas praxis en torno al tema. Este artículo traza un recorrido desde el primer modelo hasta la actualidad. A su vez propone un nuevo, el Modelo de Comunicación y Reconocimiento Legítimo de la Discapacidad (MCRLD), el cual se caracteriza por un cambio de paradigma: pasar de la inclusión al reconocimiento. Para fundamentar esto, se presentan sus (...) tres categorías: reconocimiento, distancia y vulnerabilidad. También se expondrán las diferentes teorías y conceptos que lo sustentan. El propósito del MCRLD es profundizar en la idea del empoderamiento de las personas con discapacidad como parte de la diversidad de la sociedad, acortando brechas históricamente construidas y aún vigentes. The dispute on mongrelization starts to play a fundamental role in Latin America inside the modernist debates about the national unity between the end of the XIX century and the beginning of the XX century, to later acquire an unprecedented global diffusion in the eighties and the nineties of the last century. Using the writings of the Bolivian sociologist Silvia River Cusicanqui and of the Argentinian anthropologist, who has long since been active in Brazil, Rita Segato, the essay reconstructs the (...) historic and political happening of metissage in Latin America. The authors show that it is an historical concept which worked as an instance of legitimation both in the period of colonial oppression and later in the epoch of republican modernization. It represents the instrument to hide – if not to delete – the original character of modern State; for this reason it has been able to play a fundamental role in the epoch of liberalism as much as in the neoliberal one. However in mongrelization what is also at stake is that it can express the radically de-colonizing impulse of the differences as forms of litigation which inhabit the complex contemporary Latin American territories. The paper presents a case study of sustainable development in rural China through a medical mission and missionary education initiative that sought to empower locals through dental health care education. The training method used was culturally adapted so that following the facilitators’ departure, the dental clinic continued to be run by the trained locals who, then, also went on to empower others using the same training method.

Se comparten experiencias áulicas de la Universidad Nacional de Rosario, Argenti- na. Su objetivo es crear un instrumento para evaluar la riqueza creativa en diseño mecánico, con un método exploratorio y propositivo de validación de instrumentos y pruebas piloto sobre 156 estudiantes. Resultaron de imaginar objetos diversos, compatibles con una vista dada, y definir cinco niveles de riqueza según la canti- dad, diversidad y calidad de respuestas comparadas contra un patrón de soluciones creado por expertos. Se ensayaron cambios de duración, (...) complejidad de estímulos y presencia de soluciones preexistentes que confirmaron su potencial para investigar la creatividad en este dominio específico. Post-war Japan has seen profound and rapid social change and transformation. One of the most visible areas of change in Japan has been medicine, and particularly the ethical practices and policies that guide medical decision-making. The formal discipline of bioethics, Seimei Rinri in Japanese, has grown by leaps and bounds since the late 1970s, when it began to appear in the curriculum and professional activities of Japanese medical schools and philosophy departments. The introduction of bioethics to Japan was timely, as (...) innovation in medicine and technology was evolving in ways that revealed that the intersection of medicine, traditional Japanese values, and new cultural trends was an area of great moral complexity. In its infancy, bioethics in Japan was more or less an import from the United States, where the discipline took its roots. Quickly, however, it became clear that Japan's history and tradition would call for a different approach, and the engagement of slightly different ethical issues. Organ transplantation, for example, sparked much greater controversy in Japan than it ever did in the United States. Today, Japan has one of the most dynamic bioethics programs in the world, and it is one that reflects both traditional Japanese culture and the need for inter-cultural engagement in an increasingly global world. Through a series of original chapters written by bioethicists and covering a range of ethical issues, this anthology shows that, in contrast to previous assumptions, Japanese bioethics has, in fact, taken on an identity that is undoubtedly separate from its American origins. Rich philosophical questions raised by medicine, human subjects research, and psychiatric care are being posed by scholars in a way that reflect Japanese tradition and is no longer simply reflective of, or shaped by, American traditions and philosophical problems. The book highlights and showcases these trends through a series of chapters written by some of the leading scholars in contemporary Japanese bioethics, many of whom were pioneers of the field when it began and are now nearing retirement. En este artículo se hace un seguimiento a la tradición hermenéutica como propuesta crítica y criteriológica para comprender las ciencias sociales y sus posibilidades metodológicas, el papel que juega el investigador en la construcción de sus objetos de estudio, y la dinámica de la historia como fenómeno que exige una aproximación interpretativa.

La llamada "moral civil" tiene tres características principales: es una "ética de mínimos", es plenamente racional, y se establece por consenso. Sin embargo, la ética no se mide por el número de preceptos, y los sistemas éticos no pueden ser clasificados por un criterio de cantidad. Más aun, es un punto de partida falso considerarla como un pensamiento racional uniforme frente a una pluralidad de creencias religiosas. Y si el consenso es sólo el resultado de una votación, puede fácilmente convertirse (...) en una dictadura de la mayoría. Por tanto, la ética civil tendría que buscarse en el sentido amplio de la justicia en vez de establecer un sistema nuevo. (shrink)
