Jon Pahl Valparaiso University In a recent survey I conducted of visitors to the Vietnam Veterans Memorial in Washington, D.C, 92 percent agreed that "the memorial is a sacred place, and should be treated as such."1 Clearly, this place, by some reports the most visited site in the U.S. capital, draws devotion. But how does a pilgrimage (...) to this memorial function?2 Does pilgrimage to "the wall" serve to "heal a nation," as its builders intended, or does pilgrimage to the memorial ironically legitimize structures of violence like those which led the United States into the Vietnamese conflict in the first place?3 My argument builds upon the work of René Girard to suggest that pilgrimage to the Vietnam Veterans Memorial can legitimize the violence of American culture by 'The survey was of 185 pilgrims attending ceremonies during Veterans Day, November 11, 1993 and 1994. Several recent works explore the interface between civil religion and violence, notably John E. Bodnar, Karal Ann Marling, and Edward T. Linenthal. On sacred places, the pioneering work of Mircea Eliade, The Sacred and the Profane, remains important but must be supplemented by Jonathan Z. Smith's Imagining Religion. 1 Victor and Edith Turner argue cogently that "if a tourist is half pilgrim, a pilgrim is half tourist" (20). Many visitors to the Vietnam Veterans Memorial understand themselves only as tourists, but their behavior appears to me to warrant treatment under the category of "pilgrimage." 3 I assume a "maximalist" definition of violence, which understands the word to refer not only to physical harm to individuals, but also to systemic, social structures of exclusion (such as racism), and ideological (or symbolic) justifications of violence (see Robert McAfee Brown; for a minimalist approach, see Gerald Runkle). 166Jon Pahi reinforcing scapegoating.4 At the same time, however, the established religious pluralism and voluntarism of American culture—evident in this pilgrimage process—diffuses violence. Furthermore, the democratic character of this pilgrimage empowers pilgrims to critique idolatrous worship of the nation, and to witness to authentic reverence for life. Mimesis on the mall A brief impressionistic portrait ofthe way visitors experience the Vietnam Veterans Memorial will demonstrate how the memorial draws pilgrims into a mimetic process—a key feature of Girard's theory. Many pilgrims stop at the memorial as part of a National Park Service 'Tourmobile' circuit of museums and memorials, or as part of another bus tour (school and senior citizens groups are especially common ). These busses disembark pilgrims at the base of the Lincoln Memorial, directly in front of the reflecting pool on the national mall, in sight of the Washington Monument and the Capitol. Pilgrims may, or may not, first climb the steps of the Lincoln Memorial (a powerful shrine with implications for understanding violence in its own right). Moving north, they eventually proceed along a sidewalk lined with Fig. 1 "Three Men Statue".,. several tents where veterans organizations sell T-shirts, medals, bumper-stickers, books, and other memorabilia. The first stop for many pilgrims is the "Three Men Statue" (Fig. 1) located in a grove just past the tents. 4 I summarize Girard's theory as follows: Beginning with mimetic desire, rivalry for an object escalates and threatens the social order. Religion—and notably sacrifice of the scapegoat—creates sufficient unanimity to restore a sense of social order, but does so through violence itself, masking through myth and ritual a vicious cycle of aggression we know as the history of human culture. A National Shrine to Scapegoating?167 This bronze statue (and the American flag which flies nearby) was not part ofthe original design for the memorial, and was dedicated in 1985, three years after the wall of names. It was the result of a compromise between founders of the Vietnam Veterans Memorial Fund led by veteran Jan Scruggs and a group led by 1992 Presidential candidate H. Modern societies are characterized by a division of epistemic labor between laypeople and epistemic authorities. Authorities are often far more competent than laypeople and can thus, ideally, inform their beliefs. But how should laypeople rationally respond to an authority’s beliefs if they already have beliefs and reasons of their own concerning some subject matter? According to the standard view, the beliefs of epistemic authorities are just further, albeit weighty, pieces of evidence. In contrast, the Preemption View claims that, when one (...) discovers what an authority believes, it is not permissible to rely on any of one’s own reasons concerning the subject matter. The original version of this view, as proposed by Linda Zagzebski, has recently been severely criticized for recommending blind trust and for abandoning even minimal standards for critical thinking. In our paper, we defend a new version of the Preemption View—Defeatist Preemptionism—in a way that differs radically from Zagzebski’s. We argue that our view can be derived from certain widely accepted general epistemic principles. In particular, we claim that preemption can be identified as a special case of source sensitive defeat. Moreover, we argue that Defeatist Preemptionism does not lead to the undesirable consequences that critics ascribe to the Preemption View. The paper thus articulates the foundations and refinements of the Preemption View, such that it adequately captures the phenomenon of epistemic authority and the rational requirements related to it. The paper presents an ethical analysis and constructive critique of the current practice of AI ethics. It identifies conceptual substantive and procedural challenges and it outlines strategies to address them. The strategies include countering the hype and understanding AI as ubiquitous infrastructure including neglected issues of ethics and justice such as structural background injustices into the scope of AI ethics and making the procedures and fora of AI ethics more inclusive and better informed with regard to philosophical ethics. These measures (...) integrate the perspective of AI justice into AI ethics, strengthening its capacity to provide comprehensive normative orientation and guidance for the development and use of AI that actually improves human lives and living together. The impact of smaller firm size on corporate social responsibility (CSR) is ambiguous. Some contend that small businesses are socially responsible by nature, while others argue that a smaller firm size imposes barriers on small firms that constrain their ability to take responsible action. This paper critically analyses recent theoretical and empirical contributions on the size–social responsibility relationship among small businesses. More specifically, it reviews the impact of firm size on four antecedents of business behaviour: issue characteristics, personal characteristics, organizational (...) characteristics and context characteristics. It concludes that the small business context does impose barriers on social responsibility taking, but that the impact of the smaller firm size on social responsibility should be nuanced depending on a number of conditions. From a critical analysis of these conditions, opportunities for small businesses and their constituents to overcome the constraining barriers are suggested. (shrink)

In the debate about actions in virtual environments two interdependent types of question have been pondered: What is a person doing who acts in a virtual environment? Second, can virtual actions be evaluated morally? These questions have been discussed using examples from morally dubious computer games, which seem to revel in atrocities. The examples were introduced using the terminology of “virtual murder” “virtual rape” and “virtual pedophilia”. The terminological choice had a lasting impact on the debate, on the way action (...) types are assigned and on how moral evaluation is supposed to be conducted. However, this terminology and its theoretical consequences, while sometimes resulting in correct results, lead to absurd results when applied across the board. It will be suggested that these absurd consequences can be avoided by a different answer to the question what people in virtual worlds are doing. Alleged virtual actions are first and foremost the creation and modification of data-structures and the resulting output in computer hardware. Such modifications of data structure and imagery can be performed with different intentions, purposes and styles, which will influence the type and moral evaluation of a user’s actions. This reinterpretation allows for a more complex analysis of the moral reasons for praiseworthiness or blameworthiness of actions in virtual environments. This analysis takes not just harm and effects on character into account but the peculiar ways in which speech acts can be morally wrong: e.g. agitatory, deceptive, bullshitting. (shrink)

Is knowledge-how, or “practical” knowledge, a species of knowledge-that, or “theoretical” knowledge? There is no comfortable position to take in the debate around this question. On the one hand, there are counterexamples against the anti-intellectualist thesis that practical knowledge is best analysed as an ability. They show that having an ability to ϕ is not necessary for knowing how to ϕ. On the other hand, the intellectualist analysis of practical knowledge as a subspecies of theoretical knowledge is threatened by its (...) own set of counterexamples, which convincingly establish that practical knowledge lacks many of the typical characteristics of theoretical knowledge. Most strikingly it does not even appear to require a belief. In this paper, I develop an account of practical knowledge that avoids these counterexamples. It also manages to preserve both the status of such knowledge as a cognitive achievement and its apparently close conceptual relation to abilities. I start with the counterexamples against the necessity of abilities for practical knowledge and show that they fail because they underestimate the cognitive demands of attempts. I then make use of the logic of dispositions to bridge the gap that counterexamples against the necessity of abilities for practical knowledge open. It is argued that, instead of the ability to ϕ, it is a specific disposition to have the ability to ϕ that constitutes practical knowledge about ϕ. The resulting theory is an anti-intellectualist position that preserves essential intellectualist motivations and thus should be satisfactory for proponents of both views. (shrink)

It is agreed on all hands that the original version of the conditional analysis of dispositions is defeated by so-called finks and maskers. Some have responded to this predicament by contending that the counterfactual on the right-hand side of the analysis should be expected to hold only when the property it purports to describe is in normal conditions. The essay argues that at the end of the day this idea must presuppose that one is able to arrive at specific descriptions (...) of the factors interfering with the manifestation of a disposition, which calls into question its utility. Who is responsible for the events and consequences caused by using artificially intelligent tools, and is there a gap between what human agents can be responsible for and what is being done using artificial intelligence? Both questions presuppose that the term ‘responsibility’ is a good tool for analysing the moral issues surrounding artificial intelligence. This article will draw this presupposition into doubt and show how reference to responsibility obscures the complexity of moral situations and moral agency, which can be analysed (...) with a more differentiated toolset of moral terminology. It suggests that the impression of responsibility gaps only occurs if we gloss over the complexity of the moral situation in which artificial intelligent tools are employed and if—counterfactually—we ascribe them some kind of pseudo-agential status. A number of well-developed theories shed light on the question, under what circumstances our beliefs enjoy epistemic justification. Yet, comparatively little is known about epistemic defeat--when new information causes the loss of epistemic justification. This book proposes and defends a detailed account of epistemic defeaters. The main kinds of defeaters are analyzed in detail and integrated into a general framework that aims to explain how beliefs lose justification. It is argued that defeaters introduce incompatibilities into a noetic system and thereby (...) prompt a structured re-evaluation process that makes a justified reinstatement of the defeated belief impossible. The account is then applied to the topic of disagreement, where it is used in an argument for conciliationism, as well as a new explanation for higher-order defeat. Throughout the book, the notion of defeat is the center of attention, while a number of new issues are discussed at the intersections of defeat and justification. Specifically, new problems are raised for broadly internalist accounts of defeat, a fully descriptive reliabilist account of defeat is provided, and the case for normative defeat is revisited. The problem of masking is widely regarded as a grave threat to the conditional analysis of dispositions. Unlike the difficulty arising in connection with finkish situations, the problem does not involve the (dis)appearance of a disposition upon the arrival of its activating conditions. Consequently, some promising responses to the finkish cases, in particular David Lewis's reformed analysis, are ill‐equipped to deal with masks. I contend that the difficulty posed by masks can be surmounted by supplementing the counterfactual at the heart (...) of the conditional analysis with a ceteris paribus clause. In spelling out this idea, I first examine the issue of provisos in nomic statements. Then I show how the employment of the ceteris paribus clause escapes the objections that are often raised against it, including the charge that the clause cannot informatively capture all the possible masks of a disposition. Summary This article examines the complex nature of post-war Italian political thought, stressing the importance of Italy's unusual institutional and historical political arrangements, but also the vibrancy of its political ideologies in this period. In the past it has often been argued that the dysfunctional nature of post-war Italian democracy with its rapidly changing governments, and widespread corruption—which nonetheless coexisted with the one party, the Christian Democrats, being constantly in power—led to the atrophying of political theory in general, and political (...) ideologies in particular. But this picture is strongly disputed here—on the contrary it is argued that Christian Democratic, Left and liberal political ideologies were all complex and interesting. Thus if Christian democracy should ultimately be seen as an ‘ideology of transition’ which existed to help Catholicism adapt to the parameters of modern mass democracy, and which lacked a thinker of the calibre of Jacques Maritain, it nevertheless contained within it important debates on the role of the state, between such interesting thinkers as Giuseppe Dossetti and Alcide De Gasperi. And if anything, political thinking on the Left in the post-war period was even more complex, with visceral debates within the (large) Communist Party (PCI) over whether to work within the law—between such thinkers as Palmiro Togliatti and the Il Manifesto group. Equally on the more revolutionary Left, there were important debates about how quickly capitalism could be made to collapse through revolutionary action between thinkers such as Raniero Panzieri and his more radical disciples, Mario Tronti and Antonio Negri, while later, due to the general failure of these revolutionary efforts, post-modern thinkers such as Gianni Vattimo sought to abandon grand metaphysical narratives, whilst retaining a commitment to Left of centre political commitments. Finally, although not part of a widespread mass movement, the liberal thought of Norberto Bobbio was also highly interesting and sophisticated—borrowing from Hobbes and Kelsen, he sought to advocate a modest form of liberal democracy which allowed for civilised forms of conflict, and the protection of minorities, and which rejected the contention of Marxists that civil rights could not be distinguished from economic ones. Overall, if normative aspirations in post-war Italian politics were often frustrated in practice, this was certainly not due to any lack of theoretical vibrancy. (shrink)

C. B. Martin's finkish cases raise one of the most serious objections to conditional analyses of dispositions. David Lewis's reformed analysis is widely considered the most promising response to the objection. Despite its sophistication, however, the reformed analysis still provokes questions concerning its ability to handle finkish cases. They focus on the applicability of the analysis to 'baseless' dispositions. After sketching Martin's objection and the reformed analysis, I argue that all dispositions have causal bases which the analysis can unproblematically invoke.

In this paper, I present a solution to the problem that the need to accommodate the phenomenon of epistemic defeat poses for reliabilism. Defeaters are supposed to remove justification for previously justified beliefs. According to standard process reliabilism, the justification of a belief depends on the reliability of a process that is already completed when a defeater for that belief is obtained. It is hard to see, then, how a defeater can affect reliabilist justification, if that justification, from the perspective (...) of the defeater, lies wholly in the past. What is more, undercutting defeaters plausibly defeat by generating incompatibilities with higher-order propositions :105–118, 2014; Melis in Philos Stud 170:433–442, 2014). This is hard to integrate with reliabilism which explicitly denies higher-order conditions for justification. I argue that both of these phenomena can be accommodated by it via what I call the “Replacement Principle”: when a defeater is obtained, it generates either a logical incompatibility or a doxastic incompatibility. The resulting tension is registered and initiates a reasoning process that compares the epistemic support for the defeater with that for the defeated belief. This process may replace the original reliable formation process as a doxastic base for the defeated belief. If the defeater is not given its due weight in the reasoning process, that process was unreliable and if the defeated belief is retained as a result, it will be unjustified. This is intuitively the right result. Since reasoning is reliable, only if it is rational, the account manages to capture the intuition that disregarding a defeater would be irrational without having to make rationality a condition for justification. Replacement is not only plausible on causal pictures of doxastic basing, but also required in order to allow for the possibility of belief reevaluation in general and is therefore not an ad hoc addition to reliabilism, but rather part of its inherent explanatory resources. In recent years, the use of historical cases in philosophy of science has become a proper topic of reflection. In this article I will contribute to this research by means of a discussion of one very famous example of case-based philosophy of science, namely the debate on the London & London model of superconductivity between Cartwright, Suárez and Shomar on the one hand, and French, Ladyman, Bueno and Da Costa on the other. This debate has been going on for years, (...) without any satisfactory resolution. I will argue here that this is because both sides impose on the historical case a particular philosophical conception of scientific representation that does not do justice to the historical facts. Both sides assume, more specifically, that the case concerns the discovery of a representational connection between a given experimental insight – the Meissner effect – and the diamagnetic meaning of London and London’s new equations of superconductivity. I will show, however, that at the time of the Londons’ publication, neither the experimental insight nor the meaning of the new equations was established: both were open for discussion and they were stabilized only later. On the basis of this historical discussion, I will then propose an alternative approach to the case study: the case should not be seen as a site of confrontation between pre-existing philosophical accounts, but rather as a way to historically elaborate and develop philosophical concepts. I will then show how approaching the historical episode in this way suggests an alternative approach to the philosophical study of representation, according to which it involves the establishment, over time, of a stable connection between constellations of different elements that, through discussion and engagement with alternative views and approaches, come to constitute phenomenon and meaning. The discovery that people far away are in bad shape seems to generate a sense of guilt on the part of many articulate people in our part of the world, even though they are no worse off now that we’ve heard about them than they had been before. I will take it as given that we are certainly responsible for evils we inflict on others, no matter where, and that we owe those people compensation. Not all similarly agree that it (...) is not in general our duty to make other people better off, and therefore not in general our fault when people are not better off than they happen to be, even if perhaps we could have made them so by efforts of our own. Nev ertheless, I have seen no plausible argument that we owe something, as a matter of general duty, to those to whom we have done nothing wrong. Still, morally commendable motives of humanity and sympathy support beneficence, and if we wish to call those “duties,” there is something to be said for that, too. I shall, in fact, try to say it later in this essay. (shrink)

This article argues that there is no sound basis for thinking that we have a general and strong duty to rectify disparities of wealth around the world, apart from the special case where some become wealthy by theft or fraud. The nearest thing we have to a rational morality for all has to be built on the interests of all, and they include substantial freedoms, but not substantial entitlements to others' assistance. It is also pointed out that the situation of (...) the world's poor is not that of victims of disasters, but simply of less-developed technology, which can be repaired by full and free trade relations with others. The true savior of the world's poor is the businessman, not the missionary. What we do need to do is strike down barriers to commerce, rather than requisition "aid.". (shrink)

The article explores the relationship between the German historian Reinhart Koselleck and the Germanjurist Carl Schmitt. It focuses especially on how Koselleck's doctoral thesis,,Kritik und Krise" approaches Schmitt's 1938 study on Thomas Hobbes. Both scholars are contextualized in the intellectual and academic milieu of Heidelberg in the early 1950s.

George Molnar’s contention that some dispositional properties are displayed without the aid of any activating conditions poses a challenge to the conditional analysis of dispositions. Since the invocation of activating conditions is regarded as a crucial feature of the analysis, spontaneous dispositions are believed to expose its inadequacy by eluding its scope. The challenge goes to the very heart of the conditional approach to dispositions, allegedly revealing a deep flaw in all its incarnations. Granting that there may be spontaneously manifestable (...) dispositions, I argue that the conditional analysis can successfully accommodate them by elevating the potential causal relation between a disposition and its manifestation. The essay takes the widespread complaint that societies today are deeply divided and polarized as a starting point. Affirming that there is no democracy without division, it asks what it means for conflict and disagreement to be dealt with in a respectful and civil manner. As an illustration of the main argument, the way that liberals have engaged with populist leaders is criticized on both a strategic and normative level. An alternative to existing strategies of dealing with the conflict between (...) liberals and populist is then proposed. Finally, the article also asks under what conditions civil disobedience might be an appropriate response to authoritarian populism. (shrink)

This article identifies a distinct strand of 20th-century liberal thought that was exemplified by Isaiah Berlin, Raymond Aron and, to a lesser extent, Karl Popper. I offer a stylized account of their common ideas and shared political sensibility, and argue that their primarily negative liberalism was a variety of what Judith Shklar called the `liberalism of fear' — which put the imperative to avoid cruelty and atrocity first. All three founded their liberalism on a `politics of knowledge' that was directed (...) primarily against Marxist philosophies of history and less against the idea of bureaucratic planning, as, in contrast, was the case with Friedrich von Hayek's thought. Moreover, all three subscribed to more or less explicit versions of value pluralism, and claimed that, in the circumstances of modernity, Weber's `clash of values' was exacerbated and required a particularly prudential approach to politics; this prudential management of value conflicts in turn was best entrusted to cultivated bureaucratic elites. All shared an image of a tolerant and humane society — essentially an idealized version of Britain — but said perhaps too little on the question how societies without the appropriate traditions of moderation and compromise were to be liberalized. This book deals with the history of the problem whether or not time can fully exist without the mind. This has been a vital issue in the philosophy of time, with intriguing arguments and solutions, from Aristotle to the present.

The aim of this article is to provide a historical response to Michel Janssen’s (2009) claim that the special theory of relativity establishes that relativistic phenomena are purely kinematical in nature, and that the relativistic study of such phenomena is completely independent of dynamical considerations regarding the systems displaying such behavior. This response will be formulated through a historical discussion of one of Janssen's cases, the experiments carried out by Walter Kaufmann on the velocity-dependence of the electron's mass. Through a (...) discussion of the different responses formulated by early adherents of the principle of relativity (Albert Einstein, Max Planck, Hermann Minkowski and Max von Laue) to these experiments, it will be argued that the historical development of the special theory of relativity argues against Janssen's historical presentation of the case, and that this raises questions about his general philosophical claim. It will be shown, more specifically, that Planck and Einstein developed a relativistic response to the Kaufmann experiments on the basis of their study of the dynamics of radiation phenomena, and that this response differed significantly from the response formulated by Minkowski and Laue. In this way, it will be argued that there were, at the time, two different approaches to the theory of relativity, which differed with respect to its relation to theory, experiment, and history: Einstein's and Planck's heuristic approach, and Minkowski's and Laue's normative approach. This indicates that it is difficult to say, historically speaking, that the special theory of relativity establishes the kinematical nature of particular phenomena. Instead, it will be argued that the theory of relativity should not be seen as a theory but rather as outlining an approach, and that the nature of particular scientific phenomena is something that is open to scientific debate and dispute. This article takes up a text that Rancière published shortly after The Ignorant School Master appeared in French, ‘École, production, égalité’[School, Production, Equality] (1988), in which he sketched the school as being preeminently the place of equality. In this vein, and opposed to the story of the school as the place where inequality is reproduced and therefore in need of reform, the article wants to recount the story of the school as the invention of a site of equality and as (...) primordially a public space. Inspired by Rancière, we indicate first how the actual (international and national) policy story about the school and the organizational technologies that accompany it install and legitimate profound inequalities, which consequently can no longer be questioned (and become ‘invisible’). Second, the article recasts and rethinks different manifestations of equality and of ‘public‐ness’ in school education and, finally, indicates various ways in which these manifestations are neutralized or immunized in actual discourses and educational technologies. Brain age prediction is a relatively new tool in neuro-medicine and the neurosciences. In research and clinical practice, it finds multiple use as a marker for biological age, for general health status of the brain and as an indicator for several brain-based disorders. Its utility in all these tasks depends on detecting outliers and thus failing to correctly predict chronological age. The indicative value of brain age prediction is generated by the gap between a brain’s chronological age and the predicted (...) age, the brain age gap (BAG). This article shows how the clinical and research use of brain age prediction tacitly pathologizes the states that it is sensitive to. It will be argued that the tacit character of this transformation conceals the need for its explicit justification. (shrink)

Justin Holt argues that the Rawlsian requirements for justice are, contrary to Rawls’ own pronouncements, better met by socialism than ‘property owning democracy’, both of them preferring both to just plain capitalism, even with a welfare state tacked on. I suggest that Rawls’s ‘requirements’ are far less clear than most think, and that the only clarified version prefers the capitalist welfare state.

Artificial intelligence (AI) is a powerful tool for several healthcare tasks. AI tools are suited to optimize predictive models in medicine. Ethical debates about AI’s extension of the predictive power of medical models suggest a need to adapt core principles of medical ethics. This article demonstrates that a popular interpretation of the principle of justice in healthcare needs amendment given the effect of AI on decision-making. The procedural approach to justice, exemplified with Norman Daniels and James Sabin’saccountability for reasonablenessconception, needs (...) amendment because, as research into algorithmic fairness shows, it is insufficiently sensitive to differential effects of seemingly just principles on different groups of people. The same line of research generates methods to quantify differential effects and make them amenable for correction. Thus, what is needed to improve the principle of justice is a combination of procedures for selecting just criteria and principles and the use of algorithmic tools to measure the real impact these criteria and principles have. In this article, the author shows that algorithmic tools do not merely raise issues of justice but can also be used in their mitigation by informing us about the real effects certain distributional principles and criteria would create. This article documents some foregrounding devices that the media use to attract readers' attention to linguistic forms, all identified in sports reports relating to the Euro 2004 Football Championship published in various British newspapers. A functional explanation is offered in terms of the poetic and interactive character of such devices and their role in simulating friendship and encouraging `bonding' between the writers and readers. Their omnipresence in the British media is linked with structural characteristics of the English language, the readiness (...) of the British to tolerate manipulation of linguistic forms, and the general trend towards `infotainment' in the media. This article discusses the question of poverty and wealth in light of several theses put forward by Larry Temkin. The claim that there is a sort of cosmic injustice involved when great disparities of ability or of wealth are found. He is concerned especially about disparities that are undeserved. It is agreed that this is unfortunate, but not agreed that they are unjust in a sense that supports the imposition of rectification on anyone else. Nor is poverty typically "undeserved" in (...) the only really relevant sense: the poor simply do not produce enough to earn them high incomes, and probably correct incomes they derive are indeed what such efforts are worth in the circumstances. That persons with very low incomes may merit our sympathy is accepted, but sympathy leads to charity, rather than to the involuntary exploitation of the better off. The essay concludes with further observations about the relevance of free markets, and points to the iniquities of the restrictions on commerce that are the most potent source of perpetuated poverty today. ZusammenfassungDie Frage nach der Gerechtigkeit im Gesundheitswesen wird aus der Perspektive einer allgemeinen Theorie der Gerechtigkeit betrachtet. Diese Theorie ist ein Befähigungsansatz, der zwischen 1) der Grundversorgung aller Bürger mit Grundbefähigungen, 2) einem gerechten Anteil an den Früchten gesellschaftlicher Kooperation und 3) individuell erstrebten Gütern und Leistungen differenziert. Die Anwendung dieser Theorie reagiert auf charakteristische Probleme der Allokation im Gesundheitssektor: den prinzipiell ungedeckten Bedarf, die mangelnde Zurechenbarkeit des Bedarfes und die asymmetrische Informationsstruktur zwischen Patienten und Leistungserbringern.

ZusammenfassungDie Odysseus-Verfügung ist als besondere Form der Patientenverfügung zumindest in der Literatur hinlänglich bekannt. Die Verwendung des Begriffs und damit sein Gegenstandsbereich sind hingegen noch immer umstritten. Zudem wird oft nicht beachtet, dass es innerhalb dieses Gegenstandsbereichs Varianten von OVs zu differenzieren gilt, die sich auch in ihrer moralischen Rechtfertigung unterscheiden. Nicht zuletzt ist die Grundstrukturstruktur dieser Rechtfertigung umstritten. Vor diesem Hintergrund plädieren wir im Folgenden zunächst für eine Eingrenzung des Begriffs, mit der argumentative und klinisch-praktische Verwirrungen vermieden werden können. (...) Anschließend betrachten wir zwei Varianten von – Zwang legitimierenden – OVs, die sich in der individuellen Kompetenz des Destinatärs unterscheiden. Schließlich zeigen wir, dass deren Rechtfertigung ungeachtet des Umstandes, dass OVs auf Wiedererlangung der Urteils- und Steuerungsfähigkeit des Patienten angelegt sind, weder in einer gemutmaßten noch gar in einer faktischen retrospektiven Billigung von Zwang durch den Patienten liegt. Die primäre Legitimationsgrundlage von OVs besteht vielmehr in der ex ante erfolgenden Autorisierung durch den Betroffenen selbst. Die hier einzuräumende Autorität wiederum basiert auf dem Recht jeder Person auf lebensplanerische Selbstbestimmung.
