This paper takes as its starting point the phenomenon of young lawyers in ethical crisis. The teaching of ethics in the classroom and the ethos and environment of the law firm have created dissonance: knowing what it is right to do but being unable to do it. In examining this phenomenon, we develop the idea of commitment as a source of duty, loyalty, and courage that enables someone to accept and overcome reluctance to act ethically. Our conceptual framework combines two (...) models: Fineman’s radical view that vulnerability is universal, but ameliorated by the assets available to the individual, and Rest’s four component model that provides a taxonomy of precursors for ethical action and resilience. We consider how the structures and the relationships between law schools, regulators and law firms, acting in combination, support or degrade ethical resilience and development of a commitment to ethical action. We close by considering how changes to the structure planned by one regulator in England and Wales deplete the assets available to the young lawyer and thereby the profession. (shrink)

Firms and industries increasingly subscribe to voluntary codes of conduct. These self-regulatory governance systems can be effective in establishing a more sustainable and inclusive global economy. However, these codes can also be largely symbolic, reactive measures to quell public criticism. Cross-sector alliances (between for-profit and nonprofit actors) present a learning platform for infusing participants with greater incentives to be socially responsible. They can provide multinationals new capabilities that allow them to more closely ally social responsibility with economic performance. This paper (...) examines learning facilitators in cross-sector alliances that enrich corporate understanding of stakeholder concerns. It suggests that these organizational learning experiments can translate into globally responsible practices and processes that improve the content and effectiveness of voluntary corporate codes. The proposal to allow assisted dying for people who are not severely ill reignited the Dutch end‐of‐life debate when it was submitted in 2016. A key criticism of this proposal is that it is too radical a departure from the safe and well‐functioning system the Netherlands already has. The goal of this article is to respond to this criticism and question whether the Dutch system really can be described as safe and well functioning. I will reconsider the usefulness of the (...) suffering criterion, and I will ultimately argue this criterion should be rejected altogether. Instead, we should consider moving towards an autonomy‐only approach to assisted dying. This would resolve some significant issues occurring under the current system of assisted dying in the Netherlands and ultimately make the process safer and better functioning. I will then consider some possible objections to adopting an autonomy‐only approach and provide some preliminary responses to these also. I will finally highlight some potential areas where further research may be necessary, namely, how to mitigate the effect of external factors such as poverty or other life aspects that may have the potential to distort the individual's ability to make autonomous decisions. I will also consider some possible international lessons that can be taken from both current as well as the proposed practice in the Netherlands. (shrink)

ObjectiveTo examine measurement agreement between a vocabulary test that is administered in the standardized manner and a version that is administered with a brain-computer interface.MethodThe sample was comprised of 21 participants, ages 9–27, mean age 16.7 years, 61.9% male, including 10 with congenital spastic cerebral palsy, and 11 comparison peers. Participants completed both standard and BCI-facilitated alternate versions of the Peabody Picture Vocabulary Test - 4. The BCI-facilitated PPVT-4 uses items identical to the unmodified PPVT-4, but each quadrant forced-choice item (...) is presented on a computer screen for use with the BCI.ResultsMeasurement agreement between instruments was excellent, including an intra-class correlation coefficient of 0.98, and Bland-Altman plots and tests indicating adequate limits of agreement and no systematic test version bias. The mean standard score difference between test versions was 2.0 points.ConclusionThese results demonstrate that BCI-facilitated quadrant forced-choice vocabulary testing has the potential to measure aspects of language without requiring any overt physical or communicative response. Thus, it may be possible to identify the language capabilities and needs of many individuals who have not had access to standardized clinical and research instruments. (shrink)

Unfortunately, a capitalist, consumer culture such as that of the United States presents a variety of serious obstacles to the successful inculcation of any new environmental virtues. Hence, inculcation of environmental virtues should not be the sole focus of environmental education. Compositionality in Plant Fixed Expressions Shelley Ching-yu Hsieh, Chinfa Lien, Sebastian Meier Abstract This paper examines fixed expressions that contain plant names in Mandarin Chinese and German corpora. It aims to reveal the compositionality of the concepts of the vehicle flower by means of frame semantics, and then popular vehicles (plant names) and underlying conceits (the associations between vehicles and meanings) of plant fixed expressions in these two languages will be explored. The linguistic frames of flowers show that German (...) focuses on function by adopting usability and edibility of plants in their expressions, whereas Mandarin Chinese perceives outer appearance of plants and compile “visualized” Chinese expressions. People observe and perceive plants from different standpoints and thus compose different concepts in their minds and languages. Chinese vehicles fall mainly into the categories of trees and flowers, while German vehicles are fruits and divisions of plants such as seeds and roots. This confirms the functional and visual perspective of the respective languages and further suggests the individualism of the Germans as well as the holism of the Mandarin Chinese speakers. (shrink)

"Multiverse" cosmologies imagine our universe as just one of a vast number of others. While this idea has captivated philosophy, religion, and literature for millennia, it is now being considered as a scientific hypothesis--with different models emerging from cosmology, quantum mechanics, and string theory. Beginning with ancient Atomist and Stoic philosophies, Mary-Jane Rubenstein links contemporary models of the multiverse to their forerunners and explores the reasons for their recent appearance. One concerns the so-called fine-tuning of the universe: nature's constants (...) are so delicately calibrated that it seems they have been set just right to allow life to emerge. For some thinkers, these "fine-tunings" are evidence of the existence of God; for others, however, and for most physicists, "God" is an insufficient scientific explanation. Hence the allure of the multiverse: if all possible worlds exist somewhere, then like monkeys hammering out Shakespeare, one universe is bound to be suitable for life. Of course, this hypothesis replaces God with an equally baffling article of faith: the existence of universes beyond, before, or after our own, eternally generated yet forever inaccessible to observation or experiment. In their very efforts to sidestep metaphysics, theoretical physicists propose multiverse scenarios that collide with it and even produce counter-theological narratives. Far from invalidating multiverse hypotheses, Rubenstein argues, this interdisciplinary collision actually secures their scientific viability. In real-time, Twitter strongly imprints world events, popular culture, and the day-to-day; Twitter records an ever growing compendium of language use and change; and Twitter has been shown to enable certain kinds of prediction. Vitally, and absent from many standard corpora such as books and news archives, Twitter also encodes popularity and spreading through retweets. Here, we describe Storywrangler, an ongoing, day-scale curation of over 100 billion tweets containing around 1 trillion 1-grams from 2008 to 2020. For each day, we (...) break tweets into 1-, 2-, and 3-grams across 150+ languages, record usage frequencies, and generate Zipf distributions. We make the data set available through an interactive time series viewer, and as downloadable time series and daily distributions. We showcase a few examples of the many possible avenues of study we aim to enable including how social amplification can be visualized through ‘contagiograms’. (shrink)

The recently revised Common Rule requires that donors of biospecimens for research be informed if their specimens might be used for commercial profit. The Common Rule, however, does not apply to sharing or selling de-identified biospecimens that are “leftover” from clinical uses. As a result, many medical researchers remain uncertain of their legal and ethical obligations when a commercial entity expresses interest in these specimens.

Em um processo coletivo, por meio de sua inserção nas relações produtivas, ao aprender o que lhe é necessário para executar suas atividades, o homem se humaniza, e vai criando o que necessita e pode, para atender suas necessidades, o que permite afirmá-lo enquanto produto e produtor da (...) cultura, da ciência e da tecnologia. E essa é a função básica da escola, preparar o aluno para, na medida em que se humaniza, assumir um lugar, uma posição reconhecida socialmente. Nesse processo, o Trabalho Colaborativo/Ombreado entre os professores da Educação Especial, do ensino comum e da equipe pedagógica escolar, envolvendo confiança e credibilidade entre os pares, é essencial ao desenvolvimento psicointelectual dos estudantes com deficiência/necessidades educativas especiais. Para melhor caracterizar o Trabalho Colaborativo, apresenta-se o resultado de uma pesquisa efetuada na Biblioteca Digital de Teses e Dissertações na qual se buscou identificar suas características, limites e desafios. A essência do Trabalho Colaborativo entre os professores está numa relação de apoio, na qual todos assumem a responsabilidade no processo de aprendizagem dos conteúdos escolares, o que exige espaço e tempo para sua consecução, além de uma fundamentação teórica que articulada a uma prática pedagógica lhe dê consistência. Se executado dessa forma, o Trabalho Colaborativo/Ombreado caracteriza-se como essencial à inclusão escolar. Conclui-se que, para efetivá-lo, torna-se imperiosa a definição clara e consciente dos objetivos para a escolarização, pois há muita diversidade entre as especificidades da deficiência ou das necessidades educacionais especiais. No entanto, essa forma de atuação articulada encontra diferentes entraves que se constituem em seus limites e desafios exigindo vontade política para minimizá-los, permitindo sua organização adequada. Discutem-se esses desafios e apresenta-se um exemplo no qual, pelo trabalho colaborativo pôde-se estabelecer condições para que uma aluna que, pelo vestibular conquistou uma vaga no curso de Medicina mas adquiriu uma tetraplegia no decorrer do curso, pudesse terminar sua graduação. Summary This paper notes and explores the attraction of Dugald Stewart's moral philosophy for women readers and a few women writers. Student lecture notes reveal the chronological development of his ideas, as he drew upon the works of Thomas Reid, Adam Smith, and Adam Ferguson, and responded to political events. Particular attention is paid to Stewart's comments relating to women and gender, through discussions of education, the institution of marriage, and population questions. After 1800, he shifted away from a speculative (...) conjectural history towards a philosophy of moral progress rooted in common sense philosophy and a belief in perfectibility. He taught a system of practical morality relevant to the education of children and strongly emphasised the importance of the association of ideas in childhood. For women readers, the message was contradictory in that he united an apparently conservative reinforcement of the relations of the sexes with a belief in the improvement of the condition of women through education in a modern, progressive, and commercial society. Johann Michael Haydn (1737–1806), court musician to the prince-archbishop of Salzburg, composed the Missa Sancti Hieronymi in 1777, apparently intended to mark the name-day of his employer: 30 September, the feast-day of St. Jerome. Because of its wind-band scoring, this Mass is unique, not only among Haydn’s Masses, but also in the Mass repertoire of Salzburg, and apparently in that of all late eighteenth-century Austria. The present article discusses the environment in which Haydn functioned and its effect on the practice (...) of church music in Salzburg and generally in Catholic Austria. Haydn’s employer, Archbishop Colloredo, was a proponent of Enlightenment thinking. He expressed in his Hirtenbrief of 1782 ideas opposed to the kind of sacred music then prevalent in Austria, in particular, the orchestral Mass. Reflective of the new Gottesdienstordnung promulgated by Emperor Joseph II, the proposed changes include the introduction of congregational hymns in the vernacular and severe reduction in numbers of liturgies and the amount of music allowed in them. Colloredo finds support for his ideas in the writings of St. Jerome and other church fathers. Given Haydn’s strong Catholic faith and dedication as a composer of sacred music, the article suggests that although he wrote the Missa as a dutiful servant of his employer, he meant it above all as a tribute to St. Jerome. The impacts of COVID-19 may be magnified in a shared environment like the household, especially with people spending extended time at home during the pandemic. Family resilience is the ability of a family to adapt to crisis and can be a protective factor against stress and negative affect. While there have been calls to address family resilience during the pandemic, there is a lack of empirical study on its benefit. In this dyadic observational study, we sought to investigate the concordance (...) of family members’ psychological responses to COVID-19, whether dyad members’ risk factors mutually affected each other’s psychological responses, and importantly, whether family resilience was a significant factor in these responses. A total of 200 family dyads from the same household completed the Family Resilience Assessment Scale and questionnaires on COVID-19 threat perception, impacts, and exposure. We found concordant dyad responses for COVID-19 threat perception, but not for psychological impact. Using the Actor-Partner-Interdependence Model framework, we found that one’s psychological impact was affected by the financial impact from both dyad members. After controlling for risk factors and demographic covariates, we found that family resilience significantly associated with lower COVID-19 psychological impact, though not with threat perception. The findings suggest that both family and individual factors need to be addressed and there may be benefit in addressing multilevel risk and protective factors using an ecological systems approach, which may help prepare the population for future crises. Democracy may contribute to friendly attitudes and positive attitudes toward outgroups (i.e., outgroup tolerance) because members of democratic societies learn to exercise their rights (i.e., cast a vote) and, in the process, listen to different opinions. Study 1 was a survey study with representative samples from 33 countries (N = 45, 070, 53.6% female) and it showed a positive association between the levels of democracy and outgroup tolerance after controlling for gender, age and the rate of immigrants influx from 2010 (...) to 2013. Study 1 demonstrated that members in countries with higher political participation and civil liberty showed greater tolerance toward immigrants. In Study 2, we conducted an experimental study in Taiwan (N = 93, 67.7% female) to further examine two potential mediators (opinion sharing and voting) of the effect of democratic system on tolerance toward outgroups (i.e., attitudes toward mental patients) after controlling for gender and age. We found that when individuals were allowed to share opinions and vote, they had the highest positive other-oriented emotions toward mental patients, which in turn led to greater tolerance toward outgroups compared to those who were not allowed to share opinions or vote. In general, these results demonstrated that the democratic system plays a critical role in increasing outgroup tolerance. Limitations of the two studies and implications regarding opinion sharing, voting, democratic systems, and effects on outgroup tolerance are discussed. (shrink)

PTEN‐induced kinase 1 (PINK1) is a Parkinson's disease gene that acts as a sensor for mitochondrial damage. Its best understood role involves phosphorylating ubiquitin and the E3 ligase Parkin (PRKN) to trigger a ubiquitylation cascade that results in selective clearance of damaged mitochondria through mitophagy. Here we focus on other physiological roles of PINK1. Some of these also lie upstream of Parkin but others represent autonomous functions, for which alternative substrates have been identified. We argue that PINK1 orchestrates a multi‐arm (...) response to mitochondrial damage that impacts on mitochondrial architecture and biogenesis, calcium handling, transcription and translation. We further discuss a role for PINK1 in immune signalling co‐ordinated at mitochondria and consider the significance of a freely diffusible cleavage product, that is constitutively generated and degraded under basal conditions. The extent to which EU countries take on their ‘fair share’ of asylum seekers is a contentious issue. Luc Bovens and Jane von Rabenau write on concern within Germany that the country is taking on a higher burden than other EU states. They argue that when compared on a per capita basis with similar EU countries, Germany performs relatively poorly in terms of acceptances for new refugees. Where Germany performs better is with respect to the size of the existing (...) refugee population within the country, however this may be a reflection of the difficulty refugees experience in gaining German citizenship. Paul Ricoeur holds that the “principal ambition” characterising Husserl’s phenomenology of internal time-consciousness is that of “making time itself appear.” Ricoeur thinks that ambition is doomed to run up against an unbridgeable gulf between Husserl’s approach and that of Kant. I raise a number of doubts about Ricoeur’s reading of Husserl. After a preliminary section introducing Husserl’s understanding of his phenomenological project in relation to the work of Kant, I sketch the main lines of his analysis of time-consciousness, and then (...) go on to evaluate Ricoeur’s interpretation of it. Having shown Husserl’s work on this matter to be more subtle than Ricoeur supposes, I explain how Ricoeur’s own inquiry into the consciousness of time lacks an adequate account of the time of consciousness. The way in which Husserl’s analysis might resolve this difficulty is indicated in the closing remarks. (shrink)

Information and communication technology has a great impact on contemporary society and people’s lives. Especially with the pervasive access to rapidly developing technology, the impact of ICT on society and human values, the norms of ICT use, and the ethical issues derived from them are beyond the past ethical framework and deserve more research attention. The purpose of this study was to explore the key factors that influence the decision-making behaviors of information professionals when they are faced with information ethics (...) issues. The study adopted the analytic hierarchical process method to develop the evaluation framework and criteria for information professional ethics and employed the professional fields of library and information science and information technology as examples to compare whether information professionals in different fields make different judgments on the aforementioned decision-making criteria. The results of the study validated the professional information ethics hierarchy and criteria and contributed to the field of information ethics research by providing information on the aspects that need attention in the cultivation of professionals in different fields. This study examines the different ways in which fractions are dealt with in two elementary mathematics textbook series: Kang Hsuan in Taiwan and Laskutaito in Finland. The results showed that the total number of fraction questions in Laskutaito is higher than that in KH and that Laskutaito highlights the basic definition of fractions to help children develop higher levels of reasoning. Fraction questions in Laskutaito were presented with a number of pictorial representations to clarify the concepts. Laskutaito includes more symbolic (...) representation of questions. Moreover, the questions posed in the Laskutaito reflect real-life situations, whereas the questions posed in KH do not connect with real life. The implications of this study are discussed and suggestions for future studies are made in this paper. (shrink)
