En este artículo examino las posiciones de McDowell y Davidson acerca del dualismo de esquema y contenido. Defiendo que este dualismo no puede recuperarse de las críticas de Davidson incluso en la sugestiva forma defendida por McDowell. Defiendo que McDowell falla al evaluar el verdadero alcance y significado de los argumentos davidsonianos y que su empirismo mínimo no puede evitar algunos de los problemas que otras posiciones empiristas muestran.

The combination of student Self-Regulation (SR) and the context of Regulatory Teaching (RT), each in varying degree, has recently been demonstrated to have effects on achievement emotions, factors and symptoms of stress, and coping strategies. The aim of the present research study is to verify its possible further effects, on academic behavioral confidence and procrastination. A total of 1193 university students completed validated online questionnaires with regard to specific subjects in their degree program. Using an ex post facto design, multivariate (...) analyses and structural equation modeling (SEM) were carried out in order to test the relationships predicted by the model. SR and RT had a significant joint effect in determining the degree of academic behavioral confidence and of procrastination. Academic behavioral confidence also significantly predicted reasons for procrastinating, and these in turn predicted activities of procrastination. Conclusions are discussed, insisting on the combined weight of the two variables in determining academic behavioral confidence, reasons for procrastinating and activities subject to procrastination, in university students. Implications for guidance and educational support of university students and teachers are analyzed. (shrink)

El autor Luis Rodríguez Manzanera propone el concepto de macrocriminalidad al referirse a una etapa histórica que involucra el desarrollo de manifestaciones delictivas, que se mantienen por una justificación sociopolítica y que implica a toda una sociedad. Esta definición fue propicia incorporarla para el análisis de Noticia de un secuestro (1996), debido a que, en esta novela periodística, se narran sucesos vinculados con acciones subversivas que respaldan el tráfico ilícito de drogas, junto con atentados que provocó Pablo Escobar, organizador del (...) Cartel de Medellín (Colombia), a las entidades gubernamentales. Algunos indicadores que se apropian a esta conceptualización son la violencia, la locura y el narcoterrorismo. (shrink)

The self- vs. external-regulation behavior theory, SR-ER Theory model has postulated the Self-Regulation /Non or De-Regulation/Dys-regulation continuum in the person and in their context. The model also generates a behavioral heuristic that allows us to predict and explain the variability of other dependent behavioral variables in a range of scenarios. Consequently, the objective of this study was to validate the different scales prepared on the basis of the theory presented. A total of 469 students voluntarily completed at different times the (...) five questionnaires presented, to give a total of 1,385 completed questionnaires. Using an ex post facto design, descriptive, correlational, confirmatory factorial analysis, reliability, and concurrent validity analyses were carried out. The scales were analyzed individually and as a whole. The results showed the acceptable structure of scale and consistent levels of reliability. The five levels generated by the SR-NR-DR combinatory heuristic that arises from the theoretical model determined significant differences in the levels of the variables analyzed for each psychological context. We discuss the theoretical implications and the implications for the assessment and improvement of the behaviors analyzed in function of the personal and contextual regulation levels evaluated. Our purpose in this paper is to contribute to a practice-based characterization of scientific inference. We want to explore whether Brandom’s pragmatist–inferentialist framework can suitably accommodate several types of ampliative inference common in scientific reasoning and explanation (probabilistic reasoning, abduction and idealisation). First, we argue that Brandom’s view of induction in terms of merely permissive inferences is inadequate; in order to overcome the shortcoming of Brandom’s proposal, we put forward an alternative conception of inductive, probabilistic reasoning by appeal to the (...) notion of degrees of commitment. Moreover, we examine the sorts of inferential commitments operative in other types of ampliative inferences, such as abduction or reasoning involving idealizations and assumptions. We suggest that agents engaging in these forms of reasoning often undertake restricted inferential commitments, whose scope and reach are more limited that in the case of the commitments associated with full beliefs. Religion and spirituality (R/S) serve as coping mechanisms for circumstances that threaten people’s psychological well-being. However, using R/S inappropriately to deal with difficulties and problems in daily life may include the practice of Spiritual Bypass (SB). SB refers to avoiding addressing emotional problems and trauma, rather than healing and learning from them. On the other hand, coping strategies may be determined by the cultural context. This study aims to describe the presence of SB in individuals who may have experienced stressful (...) situations and to understand the influence of culture on SB by comparing SB in two culturally different groups. The sample consists of a total of 435 people, 262 of Honduran nationality and 173 of Spanish nationality. Both groups are approximately equivalent in age and gender. The degree of SB, stressful events, perception of social support and spiritual well-being are examined, respectively, through the Spiritual Bypass Scale, and specific items and subscales from the Social Readjustment Rating Scale, Multidimensional Scale of Perceived Social Support, and the Functional Assessment of Chronic Illness Therapy - Spiritual Wellbeing. The results showed a higher spiritual well-being and use of SB in the Honduran sample as compared to the Spanish sample, but similar social support and stressful events. Furthermore, some of the factors predicting SB were different between the two samples. While age and a greater number of R/S practices were important in both samples, for the Honduran sample the variables that best explained SB were being a Christian, having greater social support, fewer stressful events, and greater attendance at church or temple. For the Spanish sample, however, the variable that best explained SB was studying R/S texts. Therefore, SB must be understood within the culture in which it develops, since in different cultural contexts it appears to relate to differing factors. Thus, SB becomes a possible functional or dysfunctional coping strategy depending on the social context. (shrink)

Pretendemos con este texto explorar la presencia y función, a veces problemática y contradictoria, del pensamiento orteguiano y de algunos de los conceptos fundamentales de su circunstancialismo, en su trasvase directo –vía sus reflexiones argentinas– o su trasplante críticamente mediado –vía México–, a tierras americanas. La relevancia en la promoción y justificación del pensamiento filosófico latinoamericano moderno y actual de las ideas orteguianas adquieren especial interés cuando son indagadas en los años cruciales del inicio del destierro español en México.

El presente artículo demuestra como el uso de los cuadernillos de trabajo se convierten en una herramienta importante de las estrategias docentes para la enseñanza y aprendizaje del inglés en el CECyTEC. El aumento en los índices de aprobación en este campo disciplinar muestran que esta estrategia tiene un impacto positivo al implementarse en los diferentes planteles y que esta metodología en un futuro pudiera ser implementada en otros estados. Se llega a esta conclusión a través de varios ensayos; se (...) inicia con este proyecto en septiembre de 2020, no propiamente como cuadernillo sino como una compilación de actividades y ejercicios, mismos que no tuvieron un gran impacto en los estudiantes, ya que las oraciones, textos y ejemplos eran ajenos a su cotidianidad o realidad inmediata, se carecía de gráficos o imágenes que ayudaran a focalizar la atención del joven, así como también la ausencia de enlaces o links para que el estudiante siguiera practicando el contenido en cuestión. A partir del semestre febrero-junio 2021 se realizan todos estos “ajustes/modificaciones” resultando más atractivos en contenido y diseño. (shrink)

En la vida cotidiana del ejercicio del derecho, ya sea en el campo de la judicatura, ora en el del litigio, bien sea en el de la academia, o en actividades administrativas, es bastante común que se hable de la prueba sumaria; pero desafortunadamente no es común que se tenga plena conciencia de su entidad, alcances y usos conforme a su propia naturaleza. Es preocupante observar la peligrosa y antijurídica ligereza, con la cual se acude a la prueba sumaria; pero (...) no para darle su natural uso, sino para superar omisiones de los sujetos procesales con interés de parte en el cumplimiento de las cargas probatorias. La prueba sumaria es utilizada en forma deliberada para conseguir ciertas ventajas probatorias en el proceso, con evidente desmedro del derecho de prueba de la contraparte, afectación de la garantía de la igualdad real de las partes en el proceso, y conculcación del derecho de defensa en toda su extensión. En realidad, el mal uso de la prueba sumaria implica violar los principios probatorios de necesidad, publicidad, contradicción, legalidad y formalidad de la prueba. En otros términos, la utilización indiscriminada de la prueba sumaria, sin el cuidado y la estrictez exigidos expresamente por el mismo legislador para poder usarla, constituye una manifiesta violación al derecho constitucional fundamental al debido proceso. La racionalidad de la globalización está basada en la relación instrumental mediobeneficio. La planificación económica para la obtención de mayores ganancias cada vez en los distintos mercados parece exigir una incesante no-intervención del Estado. Sin embargo, la dinámica de la acumulación y reproducción del capital precisa de una neo-planificación de las estrategias económicas con el consentimiento del Estado en negociación con agentes transnacionales a nivel tanto estrictamente nacional y regional como global. Dicha delineación de los parámetros económicos alumbra ciertos efectos (...) en sectores antaño regulados en exclusiva por el Estado-Nación: a saber, el derecho, la sociedad y las relaciones internacionales. De igual forma, la democracia como sistema de gobierno sufre los avatares de la economización creciente de la política, consentida por los poderes públicos. Por tanto, los derechos económicos, sociales y culturales, consagrados en las cartas constitucionales como derechos fundamentales, junto al subsidiario modelo de Estado Social, son puestos en tela de juicio de manera continua por parte de la racionalidad económica, que observa en los mismos un obstáculo a salvar para la maximización de los beneficios. Growing evidence in recent years has led to an agreement on the importance and benefits that inclusive education has for students with special educational needs (SEN). However, the extension and universalization of an inclusive approach will also be enhanced with more evidence on the benefits that inclusion has for all students, including those without SEN. Based on the existing knowledge that learning interactions among diverse students are a key component of educational inclusion, the aim of this study is to identify (...) the impact on students without SEN of being educated with students with SEN in shared, inclusive, interactive learning environments. Data were collected in three schools using a qualitative approach with a communicative orientation. Semistructured interviews were held with teachers as well as community volunteers participating in the schools. Further, focus groups were conducted with students and teachers. The results show that students without SEN benefit from participating in interactive learning activities with peers with SEN in different ways: (1) they learn to respect others, accept differences, and acknowledge different abilities, thereby creating opportunities for new friendships to develop; (2) they learn about abilities related to helping others participate and learn, to be patient and to gain the satisfaction in helping others learn and behave better; and (3) they benefit from the cognitive effort required to explain themselves and from the contributions of peers with SEN from which they can learn. In the epistemological context of theory transferand scientific exchanges, the aim of this paper is to indicate the presence of Weberian categories and ideas on dependency theory formulated by Fernando Cardosoand Enzo Faletto. Here we see how the construction of this paradigm was based on some issues, concepts, approaches and orientations of the Weberian research program formulated by José Medina Echavarría to explain Latin American development. We will also consider the contexts of enunciation and reception theories, allowing us to talk (...) about the "sociological school" that was formed in the Social Planning Division of ILPES in mid-sixties, crucial for understanding the history of sociology in Latin America. En el contexto de la discusión epistemológica sobre el examen de las transferencias y los intercambios científicos de las teorías, el objetivo de este artículo es señalar la presencia de categorías e ideas weberianas en lateoría de la dependencia formulada por Fernando Cardoso y Enzo Faletto. Aquí veremos cómo la construcción de este paradigma se sustentó en algunos temas, conceptos, enfoques y orientaciones del programa de investigación weberiano formulado por José Medina Echavarría para explicar el desarrollo latinoamericano. También tendremos en cuenta los contextos de enunciación y de recepción de las teorías, lo que nos permitirá hablar de la "escuela sociológica" que se formó en la División de Planificación Social del ILPES a mitad de los años 60, decisiva para comprender la historia de la sociología en América Latina. El artículo 270.2 del Código penal español hace responsables a los prestadores de servicios intermediarios cuando existe una facilitación activa y no neutral de un comportamiento infractor en las obras protegidas por copyright. Ello se ha traducido en un mecanismo incierto que fomenta la colaboración acrítica con los titulares del copyright sin ponderar de forma adecuada la creatividad social a través del uso transformativo de la obra. Este artículo propone un análisis de la autoría como signo distintivo con la finalidad (...) de corregir esta incertidumbre normativa mediante una interpretación restrictiva del derecho de uso exclusivo eliminando los usos derivados como fuente generadora de una obligación de actuar, y a la vez, reconociendo la necesidad de un mecanismo de contra-notificación que permita al supuesto infractor una defensa efectiva de sus intereses sin que ello implique la pérdida de la condición de actor neutral. The literature on epistemic injustice currently displays a logocentric or propositional bias that excludes people with intellectual disabilities from the scope of epistemic agency and the demands of epistemic justice. This paper develops an account of epistemic agency and injustice that is inclusive of both people with and people without intellectual disabilities. I begin by specifying the hitherto undertheorized notion of epistemic agency. I develop a broader, pluralist account of epistemic agency, which relies on a conception of knowledge that accounts (...) not only for propositional knowing, but also for other types of knowing that have been largely neglected in debates on epistemic injustice and agency. Based on this pluralist account of epistemic agency, I then show that people with intellectual disabilities qualify as epistemic agents and therefore as subjects of epistemic justice. Finally, I argue that this pluralist account of epistemic agency pushes us to revisit the current conception of epistemic injustice and to expand its taxonomy in two important ways. (shrink)

The contrast between third- and first-personal accounts of the experiences of autistic persons has much to teach us about epistemic injustice and epistemic agency. This paper argues that bringing about greater epistemic justice for autistic people requires developing a relational account of epistemic agency. We begin by systematically identifying the many types of epistemic injustice autistic people face, specifically with regard to general assumptions regarding autistic people’s sociability or lack thereof, and by locating the source of these epistemic injustices in (...) neuronormativity and neurotypical ignorance. We then argue that this systematic identification pushes us to construe epistemic agency as resulting from a fundamentally relational and dynamic process between an individual, others around them, and their social, cultural, or institutional environment, rather than as a fixed and inherent property of individuals. Finally, we show how our relational account of epistemic agency allows us to introduce the novel concepts of epistemic disablement and epistemic enablement. We argue that these two concepts allow us to more accurately track the mechanisms that undermine or facilitate epistemic agency, and thereby to better understand how epistemic injustice arises and to design more effective interventions to foster greater epistemic justice for autistic people. I analyze the relation between deliberative democracy and trust through the lens of epistemic justice. I argue for three main claims: (i) the deliberative impasse dividing majority and minority groups in many democracies is due to a particular type of epistemic injustice, which I call ‘hermeneutical domination’; (ii) undoing hermeneutical domination requires epistemic trust; and (iii) this epistemic trust is supported by the three deliberative democratic requirements of equality, legitimacy, and accountability. In arguing for those claims, I contribute to the (...) conceptualization of both epistemic injustice and domination, as well as to discussions of trust and deliberative democracy. (shrink)

Explainable artificial intelligence has become a vitally important research field aiming, among other tasks, to justify predictions made by intelligent classifiers automatically learned from data. Importantly, efficiency of automated explanations may be undermined if the end user does not have sufficient domain knowledge or lacks information about the data used for training. To address the issue of effective explanation communication, we propose a novel information-seeking explanatory dialogue game following the most recent requirements to automatically generated explanations. Further, we generalise our (...) dialogue model in form of an explanatory dialogue grammar which makes it applicable to interpretable rule-based classifiers that are enhanced with the capability to provide textual explanations. Finally, we carry out an exploratory user study to validate the corresponding dialogue protocol and analyse the experimental results using insights from process mining and argument analytics. A high number of requests for alternative explanations testifies the need for ensuring diversity in the context of automated explanations. (shrink)

The traditional blackface character Black Pete has been at the center of an intense controversy in the Netherlands, with most black citizens denouncing the tradition as racist and most white citizens endorsing it as harmless fun. I analyze the controversy as an utter failure, on the part of white citizens, of what Alison Jaggar has called multicultural literacy. This article aims to identify both the causes of this failure of multicultural literacy and the conditions required for multicultural literacy to be (...) possible. I argue that this failure of multicultural literacy is due to hermeneutical injustice and to white ignorance. I close by considering possible avenues for fostering multicultural literacy. (shrink)

The philosophical debate on secession has hitherto revolved primarily around the question of self-determination rather than that of distributive justice. Normative theorists of secession have approached the question of secession mostly in terms of the right that the secessionist group has to secede. Much less attention has been paid to the extent and the nature of obligations or duties that the seceding group might have toward the group it is leaving behind. At best, secession theorists have introduced clauses to the (...) effect that secession should not undermine the remainder state’s viability nor violate prior arrangements of reciprocal cooperation. While these clauses certainly reflect a certain concern for distributive justice, I argue that they are insufficient in two respects: they are problematically minimal in what they require, and the justification given for these clauses accounts only for part of the normative picture. In this paper, I address these two shortcomings by arguing that the seceding group might have significant duties of distributive justice toward the remainder group, and that these duties are associative in nature and stem from a concern to secure non-domination within the pre-secession polity. What is gained from my non-domination account, then, is that it is analytically more comprehensive and normatively more accurate. In arguing for claims and, the paper contributes both to the debate on secession as well as to the conceptualization of associative duties and of non-domination. (shrink)

Because secession centrally involves taking away a territory, a successful normative theory of secession must give a credible account of when a seceding group has a valid territorial claim. One of the most prominent types of normative theory of secession is remedial theories of secession. I argue that while remedial theories address the question of territorial justification, they fail to do so adequately, because their account is both arbitrary and internally inconsistent. I argue that addressing the question of territorial justification (...) non-arbitrarily and consistently requires adopting a broader and morally more plausible conception of justice than that on which remedial theories explicitly rely; and I show that this broader conception of justice is implicit in remedial theories’ account of territorial justification. Recognizing this, however, has significant implications for remedial theories, as it considerably broadens the scope of valid territorial claims, and hence of valid secessionist claims. (shrink)

The recent crisis involving the territory of Crimea has been characterized both as a case of wrongful annexation and as one of rightful secession. Territory and competing territorial claims lie at the heart of the normative questions of secession and annexation. Any normative theory of secession or of annexation must therefore address their territorial aspect: It must explain why one agent rather than another has a valid claim to the disputed territory. One of the most interesting, yet controversial, normative accounts (...) of secession has been offered by choice theorists of secession. Choice theorists adopt a rather permissive stance, based on the normative significance of political self-determination. Choice theories, however, have been widely criticized for failing to provide a satisfactory account of what legitimates the seceding group’s territorial claim. This article argues that it is possible to remedy choice theories’ failure to address the question of territorial justification adequately. To do so, this article offers a two-tier account of territory that is grounded in the normative significance of self-determination. It defends this account of territory by showing that it is implied by our normative condemnation of annexation. It argues that the same reasons that warrant opposition to annexation provide support for secession. In closing, this article revisits the case of Crimea in light of its two-tier account of territory, and considers what role international law and institutions might play in addressing this type of situation. El propósito de este manuscrito consistió en que el intelectual brindara un panorama de la producción literaria de su país a lo largo de la historia. Asimismo, su trayectoria que tiene como investigador y crítico de la Literatura permitió que pudiera ahondar en valoraciones que atañen a temas un tanto controversiales, como los pueden ser las entregas del Premio Nobel de Literatura, (...) la consolidación y la permanencia de un canon representativo en cada país o la realización de propuestas novedosas en torno a autores clásicos, como Dante Alighieri.
