Dans la médecine occidentale, le patient fut longtemps conçu comme un enfant à sauver, incapable ne serait-ce que de recevoir, de manière raisonnable, le savoir du médecin. Après la seconde Guerre Mondiale, la découverte des expérimentations scientifiques intolérables menées sur l’homme, mais aussi le vent libéral et individualiste des années 60, le progrès des biotechnologies, la démocratisation des savoirs ont favorisé l’émergence d’un nouveau paradigme et d’une nouvelle discipline : la bioéthique. Aujourd’hui, le médecin ne peut plus imposer son traitement (...) au malade, il doit, par respect de son autonomie, chercher à obtenir son consentement libre et éclairé. Les normes médicales et sociales, autrefois coercitives, voire transcendantes, sont aujourd’hui discutées et interrogées au regard des préférences et des valeurs individuelles. Des comités d’éthique pluridisciplinaires sont chargés de prendre en compte les demandes des patients qui ne cessent de bousculer les normes établies. (shrink)

Cet article vise à comprendre la persistance et la radicalisation de la critique écologique dans l’espace public malgré les tentatives de récupération des questions environnementales par le capitalisme via l’introduction dans les discours managériaux des « concepts verts » (développement durable, RSE, etc.). Nous développons les raisons pour lesquelles la critique écologique semble résister à sa récupération et mobilisons le concept marxien de « fétichisme de la marchandise » pour saisir la critique écologique comme remise en cause des fondements de (...) notre organisation économique. Humanity is made of technical objects. Despite of this fact, technique is not considered as a cultural matter especially in engineering schools where it should be taught. As teachers and searchers at the INSA Lyon, we have experienced the way and the difficulties to develop this technical culture.

The practice and development of modern medicine requires large amounts of data, particularly in the domain of cancer. The future of personalized medicine lies neither with “genomic medicine” nor with “precision medicine”, but with “data medicine”. The establishment of this DM has required far-reaching changes, to establish four essential elements connecting patients and doctors: biobanks, databases, bioinformatic platforms and genomic platforms. The “transformation” of scientific research areas, such as genetics, bioinformatics and biostatistics, into clinical specialties has generated a new vision (...) of care. Molecular tumor boards are one response to these changes and are now providing better access to next-generation sequencing and new cancer treatments to patients with inoperable or metastatic cancers, and those for whom the usual treatment has failed. However, MTB face a crucial ethical challenge: maintaining and improving the trust of patients, clinicians, researchers and industry in academic medical centers supported by private or public funding rather than providing genetic data directly to private companies. We believe that, in this era of DM, appropriate modern digital communication networks will be required to maintain this trust and to improve the organization and effectiveness of the system. There is, therefore, a need to reconsider the form and content of informed consent documents at all academic medical centers and to introduce dynamic and electronic informed consent. (shrink)

BackgroundSince 2006, the genetic testing company 23andMe has collected biological samples, self-reported information, and consent documents for biobanking and research from more than 1,000,000 individuals, through a direct-to-consumer online genetic-testing service providing a genetic ancestry report and a genetic health report. However, on November 22, 2013, the Food and Drug Administration halted the sale of genetic health testing, on the grounds that 23andMe was not acting in accordance with federal law, by selling tests of undemonstrated reliability as predictive tests for (...) medical risk factors. Consumers could still obtain the genetic ancestry report, but they no longer had access to the genetic health report in the United States. However, this did not prevent the company from continuing its health research, with previously obtained and future samples, provided that consent had been obtained from the consumers concerned, or with health reports for individuals from other countries. Furthermore, 23andMe was granted FDA authorization on February 19, 2015, first to provide reports about Bloom syndrome carrier status, and, more recently, to provide consumers with “carrier status” information for 35 genes known to cause disease.DiscussionIn this Debate, we highlight the likelihood that the primary objective of the company was probably two-fold: promoting itself within the market for predictive testing for human genetic diseases and ancestry at a low cost to consumers, and establishing a high-value database/biobank for research and personal information).SummaryBy dint of this marketing approach, a two-sided market has been established between the consumer and the research laboratories, involving the establishment of a database/DNA biobank for scientific and financial gain. Granting that various mental events might form the antecedents of an action, what is the mental event that is the proximate cause of action? The present article reconsiders the methodology for addressing this question: Intention and its varieties cannot be properly analyzed if one ignores the evolutionary constraints that have shaped action itself, such as the trade-off between efficient timing and resources available, for a given stake. On the present proposal, three types of action, impulsive, routine and strategic, are designed (...) to satisfy the trade-off above when achieving goals of each type. While actions of the first two types depend on non-conceptual appraisals of a given intensity and valence, strategic intentions have a propositional format and guide action within longer-term executive frameworks involving prospective memory. Corporate crises call for effective communication to shelter or restore a company's reputation. The use of corporate social responsibility claims may provide an effective tool to counter the negative impact of a crisis, but knowledge about its effectiveness is scarce and lacking in studies that consider CSR communication during crises. To help fill this gap, this study investigates whether the length of company's involvement in CSR matters when it uses CSR claims in its crisis communication as a means to counter (...) negative publicity. The use of CSR claims in crisis communication is more effective for companies with a long CSR history than for those with a short CSR history, and consumer skepticism about claims lies at the heart of this phenomenon. A prominent but poorly understood domain of human agency is mental action, i.e., thecapacity for reaching specific desirable mental statesthrough an appropriate monitoring of one's own mentalprocesses. The present paper aims to define mentalacts, and to defend their explanatory role againsttwo objections. One is Gilbert Ryle's contention thatpostulating mental acts leads to an infinite regress.The other is a different although related difficulty,here called the access puzzle: How can the mindalready know how to act in order to reach somepredefined result? A (...) crucial element in the solutionof these puzzles consists in making explicit thecontingency between mental acts and mentaloperations, parallel to the contingency betweenphysical acts and bodily movements. The paper finallydiscusses the kind of reflexivity at stake in mentalacts; it is shown that the capacity to refer tooneself is not a necessary condition of the successfulexecution of mental acts.
