The rhetorical view suggests that the goal of factual ar- gumentation in legal proceedings is to persuade the fact-finder about the facts under litigation. However, R does not capture our social expecta- tions: we want fact-finders to know the facts justifying their decisions, and persuasion does not necessarily lead to knowledge. I want to present an epistemic theory of argumenta- tion honoring our expectations. Un- der my account, factual argumenta- tion aims to transmit knowledge to the fact-finder.

El estudio de aspectos generales referidos a la moral y a la ética permitió acceder a definiciones, bases legales y evolución histórica, a la vez que se profundiza en su repercusión en el sector salud y se desarrollan (...) las peculiaridades del trabajo anatomopatológico desde sus manifestaciones en la actividad asistencial, docente e investigativa. Se concluye que los principios éticos generales de la conducta profesional y médica son aplicables al trabajo anatomopatológico en todas sus esferas; al igual que los de la bioética. ABSTRACT The objective of the present study is directed to exhibit ethical peculiarities of the anatomical-pathological work in view of the historical-social reality. Theoretical and empirical methods are used and from the documentary analysis it occurs with modality in the contemporary approaches. The study of general aspects referred to the morality and to the ethics allowed to gain access to definitions, legal bases and historical evolution, simultaneously that deepens in its aftereffect in the sector health and the peculiarities of the anatomical-pathological work develop from its declarations in the welfare, teaching and investigative activity. RESUMEN Se fundamenta la concepción teórica general de la educación axiológica en el contexto del sistema de enseñanza de postgrado para la formación de educadores ambientales. Se aplicaron los métodos del nivel teórico analítico-sintético, inductivo-deductivo, histórico-lógico y ascensión de lo abstracto a lo concreto, con la intención de sistematizar información proveniente de la bibliografía consultada y de la experiencia profesional de los autores. Se defiende la idea de considerar la existencia de una dimensión ambiental de valores universales, en lugar de (...) hacer referencia a valores estrictamente ambientales. Se enfatiza en la importancia que, para la educación, adquiere la estimulación de la actividad valorativa del sujeto, a partir de una noción precisa del sistema de virtudes y fortalezas del carácter. Se identifican cinco valores básicos a desarrollar en el educador ambiental, para asegurar, desde el punto de vista axiológico, su desempeño en la preparación de diferentes sectores sociales y consolidar la necesaria contribución de los mismos a la sostenibilidad ecológica. ABSTRACT In this paper a general theoretical conception of axiological education is systematized in the context of the postgraduate educational system in the training of environmental educators. Methods of the theoretic level to systematize information obtained from the bibliography and from the vocational experience of the author. The category value is analyzed aimed at using it unilaterally from the environmental perspective and it is concluded that it is much more objective, from the theoretical point of view, to assume the existence of an environmental dimension of universal values ​​rather than of strictly environmental values. It emphasizes on the importance of the stimulation of the person’s valuating activity for education, from a precise notion of the system of virtues and character strengths. Five basic values are identified ​​ to be developed in an environmental educator to ensure, from the axiological point of view, his performance in the preparation of different social sectors to strengthen their necessary contribution to ecological sustainability. Resumen En este trabajo se estudia la percepción de un grupo de estudiantes universitarios sevillanos, sin conocimientos especializados sobre la variación geográfica y social del español, hacia las variedades andaluza, canaria y castellana. Los resultados revelan la presencia significativa de juicios negativos hacia su propia modalidad de habla, tanto en lo relativo a la pronunciación como a su asociación con un estatus social bajo. No obstante, se produjo un incremento de consideraciones positivas cuando se les pidió la valoración de los (...) habitantes de su región, los andaluces. La variedad castellana, que se identificó como la forma de hablar más prestigiosa, recibió las valoraciones más positivas: fue considerada una pronunciación clara y sus hablantes se asociaron a una posición social elevada. En tercer lugar, las creencias sobre la variedad canaria reforzaron algunos tópicos como la dulzura del acento. (shrink)

Climate change is a threat to food system stability, with small islands particularly vulnerable to extreme weather events. In Puerto Rico, a diminished agricultural sector and resulting food import dependence have been implicated in reduced diet quality, rural impoverishment, and periodic food insecurity during natural disasters. In contrast, smallholder farmers in Puerto Rico serve as cultural emblems of self-sufficient food production, providing fresh foods to local communities in an informal economy and leveraging traditional knowledge systems to manage varying ecological and (...) climatic constraints. The current mixed methods study sought to document this expertise and employed a questionnaire and narrative interviewing in a purposeful sample of 30 smallholder farmers after Hurricane María to identify experiences in post-disaster food access and agricultural recovery and reveal underlying socioecological knowledge that may contribute to a more climate resilient food system in Puerto Rico. Although the hurricane resulted in significant damages, farmers contributed to post-disaster food access by sharing a variety of surviving fruits, vegetables, and root crops among community members. Practices such as crop diversification, seed banking, and soil conservation were identified as climate resilient farm management strategies, and smallholder farmer networks were discussed as a promising solution to amass resources and bolster agricultural productivity. These recommendations were shared in a narrative highlighting socioecological identity, self-sufficiency, community and cultural heritage, and collaborative agency as integral to agricultural resilience. Efforts to promote climate resilience in Puerto Rico must leverage smallholder farmers’ socioecological expertise to reclaim a more equitable, sustainable, and community-owned food system. (shrink)

Background: Nurses are the largest professional group in healthcare and those who make more decisions. In 2014, the Committee on Bioethics of the Council of Europe launched the “Guide on the decision-making process regarding medical treatment in end-of-life situations”, aiming at improving decision-making processes and empowering professionals in making end-of-life decisions. The Guide does not mention nurses explicitly. Objectives: To analyze the ethical principles most valued by nurses working in palliative care when making end-of-life decisions and investigate if they are (...) consistent with the framework and recommendations of the Guide; to identify what disputed/controversial issues are more frequent in these nurses’ current end-of-life care practices. Design: Qualitative secondary analysis. Participants/context: Three qualitative datasets including 32 interviews from previous studies with nurses working in palliative care in Portugal. Ethical consideration: Ethical approval was obtained from the Ethics Research Lab of the Instituto de Bioética. Ethical procedures are thoroughly described. Findings: All participant nurses referred to autonomy as an ethical principle paramount in end-of-life decision-making. They were commonly involved in end-of-life decision-making. Palliative sedation and communication were the most mentioned disputed/controversial issues. Discussion: Autonomy was highly valued in end-of-life care and decision-making. Nurses expressed major concerns in assessing patients’ preferences, wishes, and promoting advance care planning. Nurses working in palliative care in Portugal were highly involved in end-of-life decision-making. These processes embraced a collective, inclusive approach. Palliative sedation was the most mentioned disputed issue, which is aligned with previous findings. Communication also emerged as a sensitive ethical issue; it is surprising, however, that only three nurses referred to it. Conclusion: While the Guide does not explicitly mention nurses in its content, this study shows that nurses working in palliative care in Portugal are involved in these processes. Further research is needed on nurses’ involvement and practices in end-of-life decision-making. (shrink)

Purpose– The purpose of this paper is to examine how Slow Tech can support the celebration of the 20-year series of ETHICOMP conferences, with its ethical and societal focus, building on earlier descriptions of Slow Tech. The paper takes Slow Tech’s ideas a step further to explore how a roadmap and concrete checklist of activities can be developed.Design/methodology/approach– The paper is a thought leadership or conceptual piece. Its approach is based on a normative, qualitative discourse. It, nevertheless, indicates a shift (...) towards concrete actions.Findings– Extracting from a brief historical overview, the paper lays out the means of building a Slow Tech roadmap and a Slow Tech checklist of actions. It also investigates a number of the challenges that might face Slow Tech in the future.Research limitations/implications– The paper has implications for stakeholder fields as far-ranging as corporations, computing professional associations, universities and research institutions and end-users.Originality/value– As with other investigations of Slow Tech, the value of this paper is in its call for reflection followed by action. It provides a useful complement and counterbalance to an earlier paper by the same authors: “Slow Tech: a quest for good, clean and fair ICT” published inJournal of Information, Communication and Ethics in Society(Vol. 12, issue 2, pp. 78-92). This essay aims to defend the need to help animals in any disaster situation, be it anthropogenic, natural, or hybrid. To this end, I will first establish a brief foundation of the antispeciesist principles that have been advocated by different theorists over the last decades. Then, I will describe the conflict between environmental and animal approaches as a problem for the consideration of animals in unfavorable situations. This will be followed by the ways in which animals can be harmed in (...) such contexts. After that, I will argue that many anthropogenic disasters affect animals, but they also deserve aid in the face of natural disasters: they are sentient beings and capable of suffering just like humans, to whom help is offered unconditionally in such cases. Finally, I will propose sentience, particularly suffering, and an ecofeminist and antispeciesist approach to address the situation of animals in disaster situations in a dialogic way between environmentalist and individual-centered positions. Scanlon (2008) has argued that his theory of permissibility (STP) has more explanatory power than the Doctrine of Double Effect (DDE). I believe this claim is wrong. Borrowing Michael Walzer’s method of inquiry, I will evaluate the explanatory virtue of these accounts by their understanding of actual moral intuitions originated in historical cases. Practically, I will evaluate these accounts as they explain cases of hostage crises. The main question in this context is: is it permissible that nation-states act with military (...) force in order to liberate hostages, even if those actions put the lives of the hostages at risk? The first part of this paper has an operative reconstruction of the relevant theories. In the second section, two cases of hostage crises will be considered: the Moscow theater hostage crisis of 2002, and the Jaque Operation, which occurred in Colombia in 2008. Additionally, it will be shown that DDE explains these cases better than STP. Finally, this paper offers a critical analysis of Scanlon’s account of the explanatory power of both STP and DDE. El presente artículo versa sobre la relación entre el sistema que el filósofo mexicanoJosé Vasconcelos llama monismo estético y su teoría del conocimiento, donde primalo que denomina “conocimiento emocional”. Se ubica, además, al pensamientovasconceliano en el contexto del pensamiento latinoamericano de principios delsiglo xx y la reacción antipositivista de la época.

La cuestión de la creación artística ha sido motivo de reflexiones desde hace siglos: si es un fin en sí misma o si es medio de lograr otros fines, políticos e ideológicos. El presente trabajo se encamina a estudiar cuáles son las ideas al respecto planteadas en el marxismo y cuál ha sido el origen teórico del realismo socialista, considerado como un añadido posterior, ajeno a las concepciones de Marx.

Este artículo realiza una defensa de las axiologías centradas en el sufrimiento, que sostienen la prioridad de evitar el sufrimiento frente a la promoción de otros valores. Para ello, explica en primer lugar cómo ciertas cuestiones relativas a la creación de individuos sugieren la existencia de una asimetría entre el sufrimiento y la felicidad. Continúa describiendo un conjunto de argumentos a favor de la prioridad del sufrimiento relativos a individuos ya existentes. Asimismo, señala y responde a distintas objeciones que podrían (...) ser dirigidas contra estas axiologías. Finalmente, concluye que las posiciones centradas en el sufrimiento no están todavía lo bastante exploradas y pueden tener un gran potencial. (shrink)

Based on the notion of bad faith, the article seeks to lay the foundations for a diagnosis of contemporaneity, having as an index, on the one hand, the lack of human determination and, on the other, the effectiveness of the world.

Purpose– The purpose of this paper is to introduce the term Slow Tech as a way of describing information and communication technology that is good, clean and fair. These are technologies that are human centred, environmentally sustainable and socially desirable.Design/methodology/approach– The paper's approach is based on a qualitative discourse that justifies the introduction of Slow Tech as a new design paradigm.Findings– The limits of the human body, and the need to take into account human wellbeing, the limits of the planet (...) and stakeholders' interests in decision making, all suggest the need for a new paradigm, Slow Tech, in the design of ICT and ICT systems. Three scenarios are described as case studies.Practical implications– In order to prepare the next generation of researchers and computer professionals, many different actions need to be taken. Universities and colleges need to redesign education programmes for computer scientists and engineers by introducing subjects related to the social and ethical implications of computing, and computer professionals' associations need to introduce a code of ethics or ethical analysis into their members' career development. As a result, future computer professionals who are familiar with the Slow Tech approach will be able to collaborate much more easily across the kind of cross disciplinary teams suited to design human centred, sustainable and desirable technologies.Social implications– Rather than simply focusing on the role of computer professionals, all members of society are called to play a new role in the design of future ICT scenarios. Starting a societal dialogue that involves computer professionals, users, researchers, designers, ICT industrialists, and policy makers is very much needed.Originality/value– The value of this paper is in its call for reflection followed by action. Based on an holistic approach to the design of new ICT systems, the paper advocates a new starting point for systems design: it should be based on a long-term view of the desirability and social importance of technologies, their environmental impact and sustainability, and the fairness and equity of the conditions of workers involved in the computing manufacturing processes. A theoretical framework for the reinforcement learning of aesthetic biases was recently proposed based on brain circuitries revealed by neuroimaging. A model grounded on that framework accounted for interesting features of human aesthetic biases. These features included individuality, cultural predispositions, stochastic dynamics of learning and aesthetic biases, and the peak-shift effect. However, despite the success in explaining these features, a potential weakness was the linearity of the value function used to predict reward. This linearity meant that the learning process employed (...) a value function that assumed a linear relationship between reward and sensory stimuli. Linearity is common in reinforcement learning in neuroscience. However, linearity can be problematic because neural mechanisms and the dependence of reward on sensory stimuli were typically nonlinear. Here, we analyze the learning performance with models including optimal nonlinear value functions. We also compare updating the free parameters of the value functions with the delta rule, which neuroscience models use frequently, vs. updating with a new Phi rule that considers the structure of the nonlinearities. Our computer simulations showed that optimal nonlinear value functions resulted in improvements of learning errors when the reward models were nonlinear. Similarly, the new Phi rule led to improvements in these errors. These improvements were accompanied by the straightening of the trajectories of the vector of free parameters in its phase space. This straightening meant that the process became more efficient in learning the prediction of reward. Surprisingly, however, this improved efficiency had a complex relationship with the rate of learning. Finally, the stochasticity arising from the probabilistic sampling of sensory stimuli, rewards, and motivations helped the learning process narrow the range of free parameters to nearly optimal outcomes. Therefore, we suggest that value functions and update rules optimized for social and ecological constraints are ideal for learning aesthetic biases. (shrink)

O objetivo deste artigo é fornecer novos dados historiográficos sobre a assistência concedida às crianças da cidade de Braga, na ocasião do seu falecimento, no século XVIII. No trabalho que realizamos, foi possível analisar alguns dados sobre o anúncio da morte das crianças de Braga, os seus velórios, sepultamentos e a assistência às suas almas, através de fontes documentais das confrarias da cidade e das Constituições Sinodais do arcebispado. A análise testamental forneceu menos dados, mas revelou a provável preocupação de (...) alguns indivíduos, com a salvação das almas dos filhos falecidos com mais de sete anos de idade. (shrink)

As origens do mosteiro situado no concelho de Cabeceiras de Basto, distrito de Braga, em Portugal, têm sido objeto de debate historiográfico. No tempo presente deste artigo existem duas teses em confronto relativamente a esta questão. Uma aponta para uma origem entre os séculos XI e XII. A segunda tese defende que essa fundação teve lugar durante o século VII. Neste artigo pretendemos apresentar as fontes documentais em que se fundamentam, procedendo, igualmente, a uma análise crítica das referidas fontes. El presente artículo indaga sobre dos categorías del pensamiento de Gilles Deleuze relacionadas con el régimen escolar que son ‘evaluación inmanente’ y ‘aprendizaje esencial’. Estas categorías exhiben su pertenencia genérica a las tradiciones del régimen escolar, pero permiten traspasar las segmentaciones disciplinarias y desenvolver la comprensión diferencial de la educación y lo educativo. A la vez, se reflexiona acerca de la interacción de ambas nociones para potenciar la emergencia de lo nuevo en la noción de vida.

ResumenEn este artículo se presenta el pensamiento de Hamann en dos aspectos principales. Por una parte, se analiza su relación crítica con el movimiento ilustrado (entendido como discurso dominante en su época) y se destaca su relación con Kant. Por otra parte, se investigan las líneas fundamentales de su concepción del lenguaje, considerada como un núcleo básico de su crítica a la Ilustración. This article discusses the contribution to evolutionary theory of Leonard Darwin, the eighth child of Charles Darwin. By analysing the correspondence Leonard Darwin maintained with Ronald Aylmer Fisher in conjunction with an assessment of his books and other written works between the 1910s and 1930s, this article argues for a more prominent role played by him than the previously recognised in the literature as an informal mentor of Fisher. The paper discusses Leonard’s efforts to amalgamate Mendelism with both Eugenics and (...) Darwinism in order for the first to base their policies on new scientific developments and to help the second in finding a target for natural selection. Without a formal qualification in biological sciences and as such mistrusted by some “formal” scientists, Leonard Darwin engaged with key themes of Darwinism such as mimicry, the role of mutations on speciation and the process of genetic variability, arriving at important conclusions concerning the usefulness of Mendelian genetics for his father’s theory. The text is part of the investigative concerns from the authors with regard to the dialogue between literature and science teaching. It starts from several theoretical approaches around the general didactics, university or superior didactics, science’s didactics and for last, literature’s didactics. This is largely due to our search which is focused in articulate the university didactics with science and literature’s didactics, meanwhile, we pretend to answer to the questions ¿How are the specific didactics of science and literature going to (...) contribute to the university didactics and how is the last one going to contribute to these specific didactics? ¿Is it the dialogue between science and literature possible? The paper has been made in middle education, in Educative Institution José Miguel de Restrepo y Puerta, from Copacabana and also in university education, in the academic unities of Dietetics and Nutrition School, Agricultural Sciences and Medicine, from the University of Antioquia. Finally, the partial results indicate: i) the necessity of general Didactics as a discipline focused on teaching and learning processes to ask itself for its internal problems and establish relations with specific didactics.
