A considerable number of books and papers have analyzed normative concepts using new techniques developed by logicians; however, few have bridged the gap between the English legal culture and the Continental tradition in legal philosophy. This book addresses this issue by offering an introductory study on the many possibilities that logical analysis offers the study of legal systems. The volume is divided into two sections: the first covers the basic aspects of classical and deontic logic and its connections, advancing an (...) explanation of the most important topics of the discipline by comparing different systems of deontic logic and exploring some of the most important paradoxes in its domain. The second section deals with the role of logic in the analysis of legal systems by discussing in what sense deontic logic and the logic of norm-propositions are useful tools for a proper understanding of the systematic structure of law. Este trabajo es una crítica a la distinción entre lagunas de conocimiento y reconocimiento. En Normative Systems, Alchourrón y Bulygin sostienen que estas indeterminaciones en la aplicación del derecho son problemas diferentes. Según AB, las lagunas de conocimiento surgen por nuestro deficiente conocimiento de las circunstancias del caso, pero las lagunas de reconocimiento se producen por la vaguedad del lenguaje. Para resolver las lagunas de conocimiento, los juristas usan presunciones y para resolver las lagunas de reconocimiento es preciso redefinir los (...) conceptos. Sin embargo, AB no ofrecen una reconstrucción específica de la vaguedad y ello afecta al análisis de esos tipos de lagunas. En particular, AB creen que la vaguedad es un problema epistémico y, por ello, un sistema completo puede ofrecer una respuesta correcta para cada caso individual aun cuando no podamos conocer esa solución. Pero, cuando se asume que la vaguedad es un problema epistémico, entonces no existen mayores razones para distinguir entre lagunas de conocimiento y lagunas de reconocimiento. This paper analyzes the distinction between gaps of knowledge and gaps of recognition. In Normative Systems, Alchourrón and Bulygin claim that both indeterminacies are different problems that arise in the application of general norms to individual cases. Where through ignorance of certain properties of the facts, we cannot determine whether an individual case belongs to a generic case, we speak of gap of knowledge. On the contrary, gaps of recognitions are caused by the semantic indeterminacy of the concepts which define a generic case. In order to solve gaps of knowledge, jurists use legal presumptions, but the solution of a gap of knowledge requires the redefinition of a certain concept. However, AB believe that vagueness is only an epistemic problem. For this reason, they conclude that a complete normative system resolves every possible individual case even though we can still find epistemic indeterminacies. However, this paper shows that if vagueness is characterized as an epistemic problem, there will be no relevant reason for stressing the distinction between gaps of recognition and gaps of knowledge. We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. En este trabajo ofrezco un análisis de algunas de las ideas más importantes sostenidas por Ricardo Caracciolo en su ensayo sobre hechos y justifi cación de las decisiones judiciales. Estas tesis son: a) tesis de la aplicación posible. Las normas generales sólo se pueden aplicar a los casos que ellas regulan; b) tesis de la aplicación efectiva. Una norma general es aplicada a un hecho sólo si la premisa que describe ese hecho es verdadera. Este artículo muestra que hay buenas (...) razones para revisar ambas tesis ya que ellas pasan por alto una distinción relevante entre distintos sentidos de ‘casos individual’: casos individuales de un universo del discurso y casos individuales de un caso genérico. Como consecuencia de ello, se señala que es necesario modelar un concepto de justifi cación jurídica que no presuponga a esas mencionadas tesis. (shrink)

Este trabajo analiza los aspectos más destacados de la polémica entre Juan Carlos Bayón y Eugenio Bulygin acerca de las lagunas jurídicas, el principio de prohibición y el alcance de la discreción judicial. En esta disputa, Bulygin defiende cuatro tesis centrales, enunciadas en Normative Systems : una cuidadosa distinción entre normas y proposiciones normativas es esencial para resolver el problema de las lagunas jurídicas, la versión débil del principio de prohibición no sirve para mostrar que no existen lagunas, la versión (...) fuerte del principio de prohibición es verdadera solo cuando el sistema es completo, y en casos de lagunas jurídicas, los jueces tienen discreción para resolver estas situaciones. Sin embargo, Bayón señala que el problema no es la falta de distinción entre normas y proposiciones normativas sino el desacuerdo acerca de cuándo una solución jurídica es concluyente. La diferencia entre soluciones prima facie y concluyente es esencial porque en ciertas situaciones, el derecho no da una respuesta pero tampoco deja espacio para la discrecionalidad judicial. Según Bayón, en estos casos el principio de prohibición "todo lo que no está prohibido está permitido" juega un papel fundamental. Este trabajo muestra que los argumentos de Bayón son insuficientes para rechazar las tesis clásicas defendidas por Bulygin. In this paper I analyze the most relevant aspects of the controversy between Juan Carlos Bayón and Eugenio Bulygin about the existence of legal gaps, the so called "principle of prohibition" and the scope of judicial discretion. In this debate, Bulygin defends four classical theses advanced in his wellknown book, Normative Systems : a careful distinction between norms and norm propositions is actually needed in order to solve the problem of legal gaps, the analytical truth of the weak version of the principle of prohibition cannot guarantee the completeness of legal systems, the strong version of the principle of prohibition is true only if legal systems are complete, and judges have discretion in cases of legal gaps. However, Bayón claims that the problem is not the lack of distinction between norms and norm proposition but rather the identification of conclusive legal solutions. Conclusive legal solutions must be distinguished from the prima facie solutions provided by explicitly enacted norms. According to Bayón, the difference between conclusive and prima facie solutions is essential in legally irrelevant cases; in such cases the principle of prohibition plays an essential role because it entails the rejection of judicial discretion. In this paper I claim that the arguments advanced by Bayón fail to provide a sound ground for discarding the classical theses defended by Bulygin. (shrink)

In this paper, I consider some problems concerning the structure of legal systems. In order to do this, I basically analyze the promulgation and derogation of legal rules. Frequently, promulgation has been referred to as the introduction of a rule into, and derogation as the removal of a rule from, a normative system. I try to show that there is more to it than that. One of the main ideas of the paper is that the enactment or derogation of a (...) legal rule by an authority na restricts the competence of all lower authorities: Once a rule R has been enacted by an authority na, authorities inferior to na cannot remove R from the normative system; and when R has been derogated by na, lower authorities do not have the competence to introduce R into the system. Further important questions include: What happens with derogated rules? What is the structure of the set of derogated rules? When does a rule belong to a derogated set, and when is it removed from a derogated set? These questions are very important for a theory of legal systems, and I try to give some possible answers. Perhaps the main conclusion of the paper is that promulgation and derogation can be considered very similar processes with respect to legal systems. (shrink)

Una forma clásica de explicar el significado de una oración es establecer sus condiciones deverdad. Sin embargo, dado que sólo las oraciones declarativas encajan con este tipo de análisis, las oraciones (e.g. imperativas) que carecen de valor de verdad quedan fuera de este análisis. Con el objeto de evitar esta dificultad, algunas veces se ha sugerido que el cumplimiento de un imperativo les el valor semántico de I, y que este valor depende del concepto de verdad. En este artículo, explicamos (...) esta sugerencia mediante un lenguaje artificial: el lenguaje LN. Nuestra propuesta consiste en suministrar una reconstrucción del concepto de eficacia a partir de la relación de cumplimiento, analógamente a la reconstrucción del concepto de verdad a partir de la relación de satisfacción. Nuestras conclusiones principales son las siguientes: 1) el significado de una oración imperativa es establecido por sus condiciones de eficacia y 2) esta teoría del significado de los imperativos suministra una base semántica, adeucada para la lógica deóntica.A classical way of explaining the meaning of certain sentences is to establish their truth-conditions. However, since only declarative sentences fit this kind of analysis, sentences (e.g. imperatives) which lack truth-value remain outside the theory of meaning. In order to avoid this difficulty, it is sometimes suggested both that compliance with an imperative I is the semantic value of I, and that this value is dependent on the concept of truth. In this article, we explain this suggestion with the help of a constructed language: the artificial language NL. Our proposal Is to provide a reconstruction of the concept of effectiveness from the relation of compliance, on the analogy of the reconstruction of the concept of truth from the relation of satisfaction. Our main conclusions are: 1) the meaning of a imperative sentence would be established by its effectiveness-conditions and 2) this theory of meaning of imperatives would provide a semantic basis, suitable to the deontic logic. In his influential paper Legal Reasons, Sources and Gaps' reprinted in The Authority of Law (Oxford: Oxford University Press, 1979), Raz says that legal gaps only exist when law speaks with uncertain voice or when it speaks with many voices, but there are no gaps when law is silent. In this later case, rules of closure, which are analytically true, prevent from the occurrence of gaps. According to Raz, if there is a gap in a legal system, then both the (...) claim that there is a conclusive legal reason to perform a certain action, and its negation are neither true nor false. Therefore, one of the Raz's most important contributions to the solution of the problem of legal gaps is to remark that legal discourse is not altogether governed by the principle of bivalence. However, philosophers often claim that the denial of bivalence leads to a logical inconsistency. If this claim were true, then Raz's solution to the problem of gaps would be seriously threatened. In this paper we show ‐ with the aid of a sophisticated analytical tool, i.e. von Wright's Truth Logic ‐ that the rejection of bivalence only commits us to accept the trivial conclusion that propositions can lack truth‐values. For this reason, Raz's paper can still be regarded as a good starting‐point for analyzing the relationships among norms, practical reasoning and legal gaps. However, we also show that in order to admit propositions which are neither true nor false, Raz's theses must be reformulated. Otherwise, the claim that there is no gap when law is silent would not be compatible with the rejection of bivalence. (shrink)

Although the correlation between Entrepreneurial Orientation and concrete actions to set up a business or the Probability of Starting a Business has been widely studied, the psychological factors that can affect this relationship have not yet been sufficiently addressed in the field of entrepreneurship. One of them is curiosity. Both at theoretical and empirical level, a distinction are usually made between two types of curiosity. I-type curiosity is associated with the anticipated pleasure of discovering something new, and D-type curiosity is (...) associated with reducing uncertainty and eliminating unwanted states of ignorance. Consequently, this paper aims to analyze the moderating role that the types of curiosity play in the relationship between EO and PSB, considering their interaction with sociodemographic variables. The sample of this cross-sectional study consisted of 1,761 participants. The EO scale and a curiosity scale were applied. In addition, participants were asked, based on their perception, how likely they were to start their own business within the next 5 years. A simple moderation analysis was considered to test the moderating role of both types of curiosity in the relationship between EO and PSB. Next, a double moderation analysis was carried out in order to identify, which sociodemographic variables moderate the moderating effect of curiosity. The results show that only the D-type component moderates the relationship between EO and PSB: The higher the D-type curiosity, the stronger the association between EO and PSB. In terms of sociodemographic variables, neither culture nor gender showed a moderating effect on the moderation exerted by D-type curiosity. While, age did moderate the moderating effect of D-type curiosity on the relationship between EO and PSB. Results are discussed in terms of spirituality and the resolution of problems associated with the entrepreneurial process, considering cognitive and psychological factors, particularly with an emphasis on explaining why only D-type curiosity shows a moderating effect. Finally, the limitations of the study and potential future lines of research are pointed out. (shrink)

There is vast evidence that accounts for the association between entrepreneurial orientation and the probability of starting a business. However, there are not many studies that test how psychological factors moderate this relationship. A variable that has been little studied in this relationship is Grit. Grit is considered a personality trait defined as perseverance and passion for long-term goals. Grit considers two sub-dimensions, one linked to the consistency of interests and the other linked to perseverance in the effort. The objective (...) of this article is to analyze the moderating role that both sub-dimensions of grit plays in the relationship between EO and PSB, considering its interaction with sociodemographic variables such as age, gender, and culture. This cross-sectional study has a sample of 1,761 participants, active workers. The EO scale and a Grit Scale were applied. In addition, participants were asked, based on their perception, how likely they were to start their own business within the next 5 years. A simple moderation analysis was considered to test the moderating role of grit in the relationship between EO and PSB. Subsequently, a double moderation analysis was carried out in order to identify which sociodemographic variables moderate the moderating effect of grit on the relationship in question. The results show that only the Grit-Passion component of grit moderates the relationship between EO and PSB. Regarding the sociodemographic variables, neither age, culture, nor gender showed a moderating effect on the moderation exercised by Grit-Passion in the relationship between OE and PSB. The results are discussed in terms of psychological capital, particularly with an emphasis on explaining why only the Grit-Passion shows a moderating effect on the relationship between EO and PSB, in detriment of Grit-Perseverance. In addition, the power of grit in the field of entrepreneurship is discussed, considering that its moderating effect is transversal to variations in age, gender and culture, as well as its relevance when considering interventions and pedagogical models in the field of entrepreneurship. Cleansing inductions reduce the impact of negative and positive reactions, whereas connection manipulations magnify them. We suggest that grounded procedures can produce these effects by affecting the perceived validity of thoughts. In accord with the self-validation theory, we also note the importance of considering how moderators, such as the meaning of the action and the timing of inductions, affect outcomes.

Cet article propose une lecture critique du Despotisme de la Chine, un texte riche mais peu commenté, où Quesnay expose explicitement le contenu de sa pensée politique. Par l’analyse de Despotisme de la Chine nous voudrions défendre trois idées qui font sens autour de la représentation de la Chine qui est faite par Quesnay. La première est naturellement de montrer en quoi ce texte est représentatif de la pensée de Quesnay (et, plus largement, de l’école des physiocrates). La deuxième est (...) de souligner que le cas de la Chine, tel qu’il est vu par Quesnay, permet de penser l’économie en tant qu’activité, discipline, ou même science qui se situe au cœur du fondement de la philosophie politique qu’il avance. La troisième est d’indiquer comment la compréhension des logiques économiques d’après Quesnay relève finalement d’une observation intelligente du réel, de lier la loi positive (le politique fondé par l’économique, pour ce qui est alors connu de la Chine) et la loi naturelle (en somme : ce qui est et ce qui doit être). Au cœur de ces trois vues se trouve une réflexion sur ce pays lointain et nul autre (sinon la France). Loin d’être un simple prétexte pour avancer ses arguments, la Chine est surtout une façon de voir, de révéler, de saisir la nature d’une pensée (la physiocratie), d’une discipline (l’économie), et de sa portée (la science et le politique). De Neys makes some useful points regarding dual-process models, but his critique ignores highly relevant theories of judgment from the persuasion literature. These persuasion models predate and often circumvent many of the criticisms he makes of the dual-process approaches he covers. Furthermore, the persuasion models anticipated some of the correctives to dual-process models that he proposes.

En este trabajo analizo la autonomía y relevancia normativa de las normas permisivas. En especial, mis propósitos principales son revisar dos tesis escépticas: los permisos y las normas permisivas pueden reducirse a otras formas normativas, e.g. derogación de prohibiciones, y no se producen diferencias significativas cuando se permite una conducta que no había sido previamente regulada. Ambas tesis son examinadas en relación a la naturaleza y función del principio de clausura normativa. La conclusión de este trabajo es que las normas (...) permisivas, y en particular las normas de clausura, pueden cumplir una importante función en los sistemas normativos y son una herramienta útil para analizar otros problemas como las lagunas del derecho y la discreción judicial. This text proposes an interpretation of the work of Franklin Leopoldo e Silva based on the reading of some of his numerous published articles and books, without neglecting the classes and guidance received from the stage of Scientific Initiation to Postdoctoral studies. Precisely, by highlighting the importance of three thinkers widely studied by Professor Franklin – Berkeley, Bergson and William James –, we suggest that at the heart of this philosophical experience there would be a constant: empiricism. The presence and impact of Hispanics/Latinos in the United States cannot be ignored. Already the largest minority group, by 2050 their numbers will exceed all the other minority groups in the United States combined. The diversity of this population is often understated, but the people differ in terms of their origin, race. language, custom, religion, political affiliation, education and economic status. The heterogeneity of the Hispanic/Latino population raises questions about their identity and their rights: do they really constitute a group? (...) That is, do they have rights as a group, or just as individuals? This volume, addresses these concerns through a varied and interdisciplinary approach. (shrink)

En "Legal Reasons, Sources and Gaps", Raz señala que las lagunas jurídicas existen sólo cuando el derecho habla con voz incierta o cuando habla con muchas voces, pero que no hay lagunas cuando el derecho guarda silencio. En este último caso habría reglas de clausura, analíticamente verdaderas, que impiden la ocurrencia de esas lagunas. Según Raz, si hay una laguna en un sistema jurídico, entonces no es verdadero ni falso que exista una razón concluyente para ejecutar cierta acción. Así, una (...) de las contribuciones más importantes de Raz a la solución del problema de las lagunas jurídicas es subrayar que el discurso jurídico no está completamente controlado por la bivalencia. Sin embargo, a menudo se sostiene que el rechazo de la bivalencia conduce a contradicciones. Si esta afirmación fuese verdadera, entonces la solución de Raz al problema de las lagunas jurídicas se vería seriamente amenazada. En este artículo mostramos, con ayuda de una herramienta analítica sofisticada, i.e., la lógica de la verdad de G.H. von Wright, que el rechazo de la bivalencia sólo nos compromete a aceptar la conclusión trivial de que puede haber proposiciones que no son verdaderas ni falsas. Por esta razón, el trabajo de Raz todavía puede ser considerado un buen punto de partida para analizar las relaciones entre normas, razonamiento práctico y lagunas jurídicas. Judgments vary in the extent to which they are based on interpretation versus relatively direct access to mental contents. That is, a judgment might require a trivial amount of interpretation (e.g., translating one's immediately accessible ) or a rather substantial amount of confabulation. Recognizing this continuum of interpretation underlying judgment could be more fruitful than debating a categorical introspection versus interpretation distinction.

In this article, the authors review a contemporary social psychological perspective on persuasion with an emphasis on explicating the psychological processes that underlie successful attitude change. Those mechanisms by which variables in the persuasion setting can influence attitude change are: (a) affect the amount of information processing; (b) bias the thoughts that are generated or (c) one’s confidence in those thoughts (or other structural features); (d) serve as persuasive arguments or evidence or (e) affect attitudes by serving as simple cues (...) and heuristics. This article analyzes the evolution of state capacity in Peru during the recent commodity boom. Peru’s economic growth happened in a context in which inclusive democratic institutions were at play for the longest period ever registered in the country and at a time when political elites decided to invest considerable resources in developing state capacity. This case illustrates how boom-led economic growth can lead to the institutional strengthening of a weak state. However, state capacity continues to be low in Peru. (...) The causal mechanism that yields such continuity differs from those entertained in classic path-dependent explanations of state capacity in Latin America. The article identifies a novel mechanism that helped reproduce the Peruvian path intertemporally. This relational mechanism suggests that state capacity remains low because of the relatively enhanced capacities of state challengers to locally fend off and contest an otherwise much stronger state apparatus. The article argues, on that basis, the need to employ a relational analysis that gauges net state strength with respect to the power acquired by relevant non-state actors who might challenge state authority across different local arenas. Classic conceptualizations of state capacity are indeed relational, but conventional applications are predominantly unilateral and, thus, misleading. Unilateral notions of state capacity are those that focus on either state efforts and investments to assert state capacity or, alternatively, on the presence of challenges that curtail the levels of actually observed state capacity. Cancer is a singular cellular state, the emergence of which destabilises the homeostasis reached through the evolution to multicellularity. We present the idea that the onset of the cellular disobedience to the metazoan functional and structural architecture, known as the cancer phenotype, is triggered by changes in the cell's external environment that occur with ageing: what ensues is a breach of the social contract of multicellular life characteristic of metazoans. By integrating old ideas with new evidence, we propose that with (...) ageing the environmental information that maintains a multicellular organisation is eroded, rewiring internal processes of the cell, and resulting in an internal shift towards an ancestral condition resulting in the pseudo‐multicellular cancer phenotype. Once that phenotype emerges, a new local social contract is built, different from the homeostatic one, leading to tumour formation and the foundation of a novel local ecosystem. (shrink)
