En el presente artículo, el autor analiza la adecuada reinserción social del recluso como finalidad de la ejecución de la pena privativa de la libertad. Con ese propósito, el jurista identifica los diferentes modelos de readaptación social (“readaptación para la moralidad” y “readaptación para la legalidad”), con sus virtudes y críticas. Por último, Arocena examina los condicionamientos que impone un arquetipo de Estado social y democrático de Derecho, a la hora de adherir a uno u otro de esos modelos, y (...) finalmente expone sus razones a favor de un paradigma de readaptación social mínimo. La contaduría pública se ha vuelto una profesión importante en la actualidad, dado el cargo de confianza que asumen dentro de una institución al ser los emisores de información financiera relevante para la gerencia o la alta dirección. A su vez, es importante resaltar la gran cantidad de casos relacionados con la pérdida de valores y actos de corrupción que se presentan a diario en los medios de comunicación, la cual refleja la falta de ética de los profesionales a la (...) hora de ejercer sus funciones. En este contexto, se resalta el concepto de ética profesional, el cual garantiza el buen desempeño de un profesional bajo una serie de normas éticas que regulan su comportamiento. Por ello, el objetivo del presente artículo fue explorar el rol de la ética profesional en la formación y el ejercicio profesional del contador público. Los datos y consejos proporcionados por un contador definen en gran medida las decisiones tomadas respecto a la estructura financiera de una empresa u organización, razón por la cual un contador debe ser una persona íntegra e interesada en perseguir el interés general. Dadas las deficiencias existentes en la integridad ética y moral de los contadores, tanto universidades como empresas están implementando medidas para combatir este problema, buscando fortalecer la confianza de la población en la contaduría y prevenir que los futuros profesionales caigan en prácticas inmorales que dañan a la sociedad. Este trabajo presenta un análisis de las obras testimoniales de Jorge Alberto Taiana, Miguel Bonasso y Juan Manuel Abal Medina. El objetivo es observar las diferentes operaciones memorísticas que los autores ponen en juego a la hora de reconstruir la figura y el rol de Juan Domingo Perón durante el proceso abierto con la apertura electoral de mayo de 1971 hasta la muerte del viejo líder tres años después.

De la identidad literaria salvadoreña como exilio, se examina la obra clásica de nueve autores. Al aplicar una perspectiva psicoanalítica, el ensayo toma como punto de partida una tarjeta que Roque Dalton envió desde Cuba a una amante lejana en El Salvador. La escritura establece la deuda y la memoria como principios rectores para recuperar el pasado. Un compromiso subjetivo con el objeto del amor perdido la patria y la amante dicta el movimiento de la inscripción poética. Esta ausencia del (...) cuerpo a recuperar se aplica en seguida, en primer lugar, a Francisco Gavidia, que funda el indigenismo salvadoreño, utilizando técnicas literarias europeas, con lo cual ignora las lenguas indígenas, luego a Alberto Masferrer, que se retrata sufriendo las tribulaciones y la pasión de Cristo en el exilio, antes de construir un proyecto político de país. En tercer lugar, Arturo Ambrogi percibe en el campesino salvadoreño al poeta medieval localizado en un locus amoenus, encantado por la belleza del campo. Francisco Miranda Ruano inaugura una visión más trágica, ya que su salida de la ciudad para recrear el esplendor del campo concluye con su regreso a los suburbios pobres, antes de suicidarse. En quinto lugar, Salarrué mezcla fantasía y realismo para retratar sus diversas máscaras o personajes, así como para disimular la violencia sexual y racial. Según el proverbio español “el hábito hace al monje”, el ser y los actos se juzgan siempre por la apariencia. Claudia Lars prescribe un movimiento dual, primero para sustituir su nombre real, Carmen Brannon, por su seudónimo literario, y luego para recuperar su infancia de sus habilidades adultas, que ella desarrolla, gracias al legado poético de su padre extranjero. Los hermanos Alfred y Miguel Ángel Espino proponen un patrimonio complejo. Si el primero idealiza el campo en una recuperación nostálgica del vientre materno cuya contrapartida nombra al amante imposible que lo inclina al suicidio, el segundo apunta a restituir una educación verdaderamente americana, sin revitalización alguna de las lenguas indígenas ni de su tierra ancestral confiscada. José Napoleón Rodríguez Ruiz estipula cómo solo un recuerdo lejano recupera un relato testimonial del pasado. Al vaticinar un tema de actualidad -el acoso sexual y la migración, su personaje campesino narra cómo el exilio reinventa su identidad rural. Finalmente, en un retorno sinodal, desde lejos, Dalton replica la nostalgia de Rubén Darío por ser alguien más de lo que es a la hora de recrear sus años de formación como poeta. En resumen, este bosquejo de nueve autores del siglo XX delinea no solo cómo una idea de exilio anticipa la diáspora actual. El ensayo también sugiere cómo los estudios culturales continúan una nostálgica recuperación de la memoria por una revolución sinódica, y reclama la actualidad de aquellos autores consagrados en un canon literario monolingüe. Using the optical ether as a case study, this article advances four lines of consideration to show why synchronic versions of the divide et impera strategy of scientific realism are unlikely to work. The considerations draw from the nineteenth-century theories of light, the rise of surprising implication as an epistemic value from the time of Fresnel on, assessments of the ether in end-of-century reports around 1900, and the roots of ether theorizing in now superseded metaphysical assumptions. I argue that appeals to conscience do not constitute reasons for granting healthcare professionals exemptions from providing services they consider immoral (e.g. abortion). My argument is based on a comparison between a type of objection that many people think should be granted, i.e. to abortion, and one that most people think should not be granted, i.e. to antibiotics. I argue that there is no principled reason in favour of conscientious objection qua conscientious that allows to treat these two cases differently. (...) Therefore, I conclude that there is no principled reason for granting conscientious objection qua conscientious in healthcare. What matters for the purpose of justifying exemptions is not whether an objection is ‘conscientious’, but whether it is based on the principles and values informing the profession. A common assumption in non-relativistic quantum mechanics is that self-adjoint operators mathematically represent properties of quantum systems. Focusing on spin, we argue that a natural view considers observables as determinable properties and their eigenvalues as their corresponding determinates. We provide a taxonomy of the different views that one can hold, once it is accepted that spin can be modelled with the determinable-determinate relation. In particular, we present the two main families of views, dubbed Spin Monism and Pluralism, and we show (...) that the current literature does not take a stance between the two. Then we put forward two arguments in favour of the former. Finally, we present a new account of Spin Monism, that is absent in current literature; such a view is worth discussing, or so we contend, because several compelling considerations support it, and it opens new ways of thinking about the ontology of quantum mechanics. We investigate the uniform computational content of the open and clopen Ramsey theorems in the Weihrauch lattice. While they are known to be equivalent to $\mathrm {ATR_0}$ from the point of view of reverse mathematics, there is not a canonical way to phrase them as multivalued functions. We identify eight different multivalued functions and study their degree from the point of view of Weihrauch, strong Weihrauch, and arithmetic Weihrauch reducibility. All over Europe, the provision of healthcare services is widely considered a primary duty of the government. Universal access to medical care can be considered a basic ingredient of the so-called “European social model.” But if universal access to medical care is seldom questioned, European governments—faced with expanding costs caused by an increasing demand driven by an aging population and technology-driven improvements—are contemplating the possibility of “rationing”1 treatments, or the possibility of allowing a greater role for private suppliers. If a (...) “multi-tier” healthcare system has long been anathema to the European leadership, guaranteeing a uniform access to state-of-the-art care seems to be well beyond the means of states suffering from persisting debt crisis. Was the failure of state-controlled “adequate” healthcare totally unpredictable? Far-sighted criticisms had been offered by two eminent thinkers in the classical liberal tradition, Herbert Spencer and Friedrich A. von Hayek . Neither author is usually recognized as a forerunner of contemporary critics of the welfare state, and both investigated the issue of the state financing and providing health services well before or right after the establishment of national health services. With the benefit of hindsight, reading Spencer and Hayek helps us to understand how the crisis of state-supplied healthcare is not rooted in the mere progress of clinical technology, but is rather the logical consequence of the theoretical basis of the model itself. Whereas modern theorists of the welfare state tend to offer theories that are impervious to a critical appraisal of their unintended consequences—insofar as they are framed in a language of “rights”—both Hayek and Spencer understood that human systems are complex, and that unwanted effects of public policy should be taken into account. Although Spencer emphasized the moral hazards accruing from the paternalism involved in governmental provision of health services, Hayek explained how modern healthcare systems differ from real, private insurance designed to offer proper coverage against risks. These authors appreciated that the politicization of healthcare was bound to result in both standardization of care and disregard for the responsibility that comes with personal freedom. These two “diagnoses before the illness” can help us in defining the challenges and the potential solutions that healthcare systems face today. Understanding the fatal conceits inherent in the very architecture of national health services can be the first step toward healing our healthcare systems. (shrink)

Sociological approaches to inquiry on emotion in educational settings are growing. Despite a long tradition of research and theory in disciplines such as psychology and sociology, the methods and approaches for naturalistic investigation of emotion are in a developmental phase in educational settings. In this article, recent empirical studies on emotion in educational contexts are canvassed. The discussion focuses on the use of multiple methods within research conducted in high school and university classrooms highlighting recent methodological progress. The methods discussed (...) include facial expression analysis, verbal and nonverbal conduct, and self-report methods. Analyses drawn from different studies, informed by perspectives from microsociology, highlight the strengths and limitations of any one method.
