Partiendo de la distinción filosófica entre las leyes de la ciencia y las leyes de la naturaleza, en el presente artículo se defiende la indispensabilidad explicativa de las leyes de la ciencia en el campo de las ciencias cognitivas. Se sostiene que las leyes de la ciencia desempeñan un papel epistémico indispensable tanto en el análisis funcional como en la explicación mecanicista de las capacidades cognitivas. De esta manera, se ofrece una elucidación plausible del poder explicativo (...) de las ciencias cognitivas en términos del papel epistémico de las leyes de la ciencia, suspendiendo el juicio, de manera prudente, respecto del controvertido estatus metafísico de las leyes naturales. Se pone en evidencia que tanto quienes defienden como quienes rechazan el compromiso ontológico con leyes causales intencionales presuponen que esas leyes no contribuyen a la explicación funcionalista ni mecanicista de los fenómenos que describen. Sin embargo, en el presente trabajo se argumenta, primero, que el análisis funcional requiere la especificación de leyes científicas no causales y, segundo, que la representación científica precisa de las actividades y de la organización dinámica de un mecanismo se despliega mayoritariamente, en el contexto de un modelo mecanicista, mediante la especificación de leyes científicas. La conclusión es que las leyes científicas (aunque no necesariamente las leyes de la naturaleza) desempeñan un papel indispensable en la explicación en ciencias cognitivas. (shrink)

En este artículo pretendo desmantelar la opinión generalizada según la cual una interpretación relacional del espaciotiempo no es posible. Centro mi atención en el hecho de que las variables dinámicas usualmente están asociadas a objetos materiales en las teorías físicas. El tensor métrico de la Teoría General de la Relatividad (TGR) es un objeto dinámico así que —sostengo— este debe ser mejor entendido como un campo material en toda regla. Este argumento me lleva a vincular la naturaleza relacional del (...) espaciotiempo a las dificultades para formular una genuina ley de conservación de energía-momento en la TGR.I will try to dismantle the widespread impression that a relational account of spacetime is not possible. I concentrate on the fact that dynamical variables are usually linked to material objects in physical theories. The metric tensor field of GR is a dynamical object so, I claim, it should be viewed as a matter field. The argument links the relational ontological status of spacetime to the failure to provide a genuine law of energy-momentum conservation within General Relativity. (shrink)

La búsqueda de la perfección humana como un afán de mejora constante es compartida tanto por la tradición ética de la virtud de la ley natural tomista como por el movimiento transhumanista. Sin embargo, nociones divergentes de la naturaleza humana y de su telos diferencian profundamente ambos esfuerzos por transformar positivamente la humanidad. El presente trabajo aclara el significado de la tradición de la ley moral natural y la distingue de los malentendidos que podrían surgir de una reducción de la (...) naturaleza a procesos biológicos no racionales. A continuación, el artículo examina cómo una noción adecuada de la naturaleza humana y de los bienes que satisfacen dicha naturaleza pueden orientar un debate constructivo sobre qué tipos de mejora biomédica han de aceptarse como útiles para el florecimiento humano y cuáles deben ser dejados de lado por ser perjudiciales para el auténtico crecimiento. Sin una norma objetiva de la naturaleza humana con la cual juzgar las propuestas de mejora, los cambios biotécnicos ya no pueden distinguirse en categorías de mejora o disminución. El texto muestra por qué tanto los críticos bioconservadores de la mejora humana como los defensores transhumanistas de las alteraciones biotecnológicas radicales presentan visiones empobrecidas de las capacidades de transformación y perfección de la naturaleza humana. En contraste, el tomismo tiene los recursos intelectuales para superar las nociones estáticas de la naturaleza humana y puede corregir las imprecisiones filosóficas del discurso transhumanista contemporáneo sobre la posthumanidad. Este trabajo, por tanto, proporciona los fundamentos antropológicos necesarios para explorar el papel que las virtudes pueden desempeñar en el cumplimiento de la orientación dinámica de la naturaleza humana hacia la perfección. In the philosophy of physics and philosophy of time there is a widely-extended thesis according to which our experience of the passage of time is unreal to the extent that it has no objective grounds in nature as described by our best physical theories. Particularly, as dynamical laws belonging to such theories are temporally symmetric, and they do not distinguish both time directions, the experienced temporal asymmetry turnouts to be illusory. In this paper, I shall argue that we have sound (...) reasons to cast doubts on such thesis. For the one thing, it is not so clear to me to what extent we really have experience of the passage of time. For another thing, it is highly questionable that our dynamical laws are temporally symmetric, and if so, that they were useful to argue against our assumed experience of the passage of time. En este trabajo sostengo que la concepción mecanicista no captura la relevancia explicativa de la ley de polarización dinámica de Cajal. La relevancia explicativa de la ley se fundamenta en su rol como principio de diseño neuronal. Como tal, la ley nos brinda acceso epistémico a intervenciones ideales, conceptualmente posibles, sobre la localización de los diversos componentes de los centros nerviosos, y nos permiten evaluar el impacto de esas intervenciones sobre las condiciones de viabilidad del organismo.

La actual discusión sobre las infracciones juveniles de ley en un marco neoliberal, limita su causa a las decisiones individuales y da preeminencia a la política penal para enfrentarla. Tal perspectiva desvincula en general los delitos de su contexto y específicamente de las consecuencias del sistema socioeconómico neoliberal en la sociedad. Es decir, para el caso de esa mayoría de la población abandonada por el Estado Subsidiario, se ignoran las dinámicas culturales de formación de identidad o de lazos de (...) pertenencia, y la marginación estructural que implica un acceso decreciente a los recursos y oportunidades socioeconómicas. Tal escenario de precariedad general y constante se transforma en una influencia o incentivo material y cultural para acceder por medio del delito a esos recursos y oportunidades. Así, pretender resolver problemas socioeconómicos preferentemente por medios penales es una mirada incompleta, ineficaz e ideologizada. (shrink)

Foucault denuncia que la espiritualidad cristiana, al plantear que el conocimiento de la verdad se logra en relación con la Palabra de Dios, incurre en una circularidad. Esta circularidad trae como consecuencia que el autoconocimiento no tenga por meta la autoafirmación de sí, sino la renuncia de sí para la afirmación de otro trascendente, generando así un poder pastoral que, en medio de la dinámica de la salvación, exige el sometimiento obediente de la persona a una ley heterónoma. El propósito (...) del texto es argumentar la siguiente hipótesis: la espiritualidad del Barroco Hispano —en la medida en que pone en epojé a Dios, la Palabra Revelada y el mundo humano— ofrece claves significativas para comprender el acceso a la verdad no como una renuncia de sí, sino como el ejercicio espiritual de un sí mismo dinamizado por el amor creativo. El objetivo de este artículo es arrojar luz sobre la significación histórica de la teoría política de Spinoza, mostrando que, en lo que respecta a la explicación de la dinámica del poder y de la naturaleza de las entidades políticas, compite con ventaja con teorías rivales de inspiración contractualista, y que es capaz de superar las ambigüedades y contradicciones que asolan a las concepciones modernas de la ley. Mediante una lectura atenta de los textos, argumento que el análisis metafísico que (...) Spinoza lleva a cabo para determinar la naturaleza, condiciones y alcance del poder del Estado le permite eludir algunos de los dualismos característicos del pensamiento político contemporáneo. En la medida en que para Spinoza el consentimiento general es un requisito inherente al poder, y rompe con un modelo contractualista de las normas políticas todavía vinculado a concepciones abstractas de orden platónico. La perspectiva spinozista puede conciliar así la dinámica del poder con la de la libertad. (shrink)

Julia de Burgos, conocida como la poeta nacional de Puerto Rico, expresa en su obra un pensar poético en el cual se percibe el legado de los filósofos alemanes Kant y Nietzsche. Para el análisis de algunos aspectos de su poesía, es posible remitirse a la obra de Gaston Bachelard, El agua y los sueños, donde el autor plantea que la imaginación poética puede elaborar imágenes bien sea desde una causalidad formal o desde una causalidad material. Bachelard prefiere la poética (...) de la imaginación material y encuentra que hay leyes de la imaginación en lo que el saber antiguo denominaba los cuatro elementos: agua, aire, fuego y tierra. En otros libros suyos escribe sobre la tierra, el fuego, el aire; en el mencionado se ocupa de la imaginación poética del agua; el alma dinámica que fluye en la poesía de Julia de Burgos. (shrink)

La principal objeción contra al dualismo cartesiano en filosofía de la mente es que resulta incompatible con la ciencia. Se sostiene, en particular, que el principio de clausura causal del mundo físico y el teorema de preservación de la energía, así como el concepto de interacción dinámica de la física fundamental, desautorizan la postulación de interacciones causales entre sustancias pensantes y sustancias extensas. En este trabajo sostengo que esta conclusión es por lo menos apresurada y que no es un asunto (...) trivial refutar el dualismo cartesiano usando consideraciones empíricas. Mis tesis son: (i) que las críticas antidualistas basadas en premisas científicas colapsan en un reduccionismo metafísicamente implausible y (ii) que la teoría física no excluye la existencia de una relación de causación o interacción dinámica recurrente como la que se requiere para explicar la experiencia consciente, postulando un nexo pertinente entre mentes inmateriales y sistemas nerviosos. African jurisprudence, like African philosophy, continues to be hotly debated. This article contends that the debate straddles the uniqueness claim which either emphasises the existence or possibility of a peculiar legal framework on the continent, and a historical co-extensional position reiterating that African jurisprudence is a continuum of other legal traditions. The article argues that there is no uniquely African jurisprudence, and that what obtains within the structures of jurisprudence on the continent also exists within various legal traditions elsewhere, and (...) as such can at best be described as ‘jurisprudence in Africa’ rather than ‘African jurisprudence’. It defends this thesis through analytic and comparative explications of the content of natural law theory and legal positivism as experienced on the continent. It concedes that relics of the colonial legal experience create contestations that inform scholars’ calls for a return to traditional legal systems. It concludes that a reconstructive jurisprudence in Africa must take cognisance of the continent’s historical and evolutionary legal experiences, but that a unified or monolithic theory may not be sufficient to address the choice of functional jurisprudence. In recent years, emotions have become a major, vibrant topic of research not merely in the biological and psychological sciences but throughout a wide swath of the humanities and social sciences as well. Yet, surprisingly, there is still no consensus on their basic nature or workings. Ruth Leys’s brilliant, much anticipated history, therefore, is a story of controversy and disagreement. The Ascent of Affect focuses on the post–World War II period, when interest in emotions as an object of study began (...) to revive. This paper explores semi‐formal interactions between SRI‐investors that take the governance route rather than deploy a best‐in‐class logic or exclusionary screening. On the basis of a stakeholder typology of the investor and of the chosen topic of interaction, namely compliance with the core ILO labour conventions, the paper formulates 10 expectations about management reactions to the concerns raised by investors. These expectations cover responsiveness, acknowledgment of positions and general attitude. The expectations are then related to the factual discourse by management (...) responding to such concerns raised by investors. Based on data obtained from the Portfolio21‐correspondence, which is a joint initiative of European investors, it is found that management is very willing to discuss cases but at the same time denies the truth‐value of the allegations. The last decade has seen rise in technologies that allow humans to send and receive intimate touch across long distances. Drawing together platform studies, digital intimacy studies, phenomenology of touch, and ethics of technology, we argue that these new haptic communication devices require specific ethical consideration of consent. The paper describes several technologies, including Kiiroo teledildonics, the Kissenger, the Apple Watch, and Hey Bracelet, highlighting how the sense of touch is used in marketing to evoke a feeling of connection within (...) the digital sphere. We then discuss the ambiguity of skin-to-skin touch and how it is further complicated in digital touch by remediation through platforms, companies, developers, manufacturers, cloud storage sites, the collection and use of data, research, satellites, and the internet. Lastly, we raise concerns about how consent of data collection and physical consent between users will be determined, draw on examples in virtual reality and sex-robotics, and ultimately arguing for further interdisciplinary research into this area. The first is a conceptual matter: are trade marks capable of being property or are they ruled out as a matter of conceptual necessity? The second is conceptual-cum-descriptive: is the current law's treatment of trade marks treatment of them as property? This introduction to the special issue on information asymmetries in socially responsible investment introduces the concept of information asymmetries and offers an overview of how such information asymmetries pertain to SRI. We first point out that all Abanking@, in its different metiers, always is concerned with information asymmetries. That introductory concept is succeeded by an overview of the different metiers in banking. We try to diminish a general information asymmetry regarding the financial professions in general and their scope for SRI (...) more specifically. We then distinguish several types of information asymmetry that may be at play in SRI-projects and introduce the contributions in this issue. (shrink)

This study investigates how social capital affects managers’ use of corporate resources. We find that for firms located in U.S. counties with a high level of social capital, (i) corporate cash holdings have higher marginal value, (ii) the contribution of capital expenditures to shareholder value is higher, and (iii) acquirers experience higher announcement-period abnormal stock returns. We further find that social capital decreases both over- and under-investment, and thus improves ex post corporate investment efficiency. Our evidence suggests that in communities (...) with a high level of social capital, strong social norms and dense social networks constrain unethical corporate behavior, which induces more efficient use of corporate resources. Socially Responsible Investment (SRI) has grown considerably over the past three decades. One form of SRI, engagement-SRI, is today by far the most practiced form of SRI (in assets managed) and has the potential to mainstream SRI even further. However, lack of formalized engagement procedures and evaluation tools leave the engagement practice too opaque for such a mainstreaming. This article can be considered as a first step in the development of a standard for the engagement practice. By developing an engagement (...) heuristic, this article offers a more transparent engagement dialog. Drawing on Stevenson’s and Austin’s speech-act theories, this article develops a classification of management’s responses to the signaling of allegations and controversies on two dimensions: a factual dimension concerning (dis)agreements on factual claims and an attitudinal dimension concerning (dis)agreements on responsibilities, values, and norms. On the basis of the distinctions this article develops, the authors provide for a synoptic table and offer a next-step heuristic for the engagement process that started with signaling a concern to management. The article uses an engagement logic that, while keeping the exit option for the investor open, allows management to address signaled concerns without having to let down or to opt out at the first setback in the dialog process between investor and investee corporation. Criminal violence is one of the most pressing problems in Latin America and the Caribbean, with profound political consequences. Its effects on social policy preferences, however, remain largely unexplored. This article argues that to understand such effects it is crucial to analyze victimization experiences and perceptions of insecurity as separate phenomena with distinct attitudinal consequences. Heightened perceptions of insecurity are associated with a reduced demand for public welfare provision, as such perceptions reflect a sense of the state’s failure to provide (...) public security. At the same time, acknowledging the mounting costs and needs that direct experience with crime entails, victimization is expected to increase support for social policies, particularly for health services. Survey data from twenty-four Latin American and Caribbean countries for the period 2008–12 show that perceptions of insecurity indeed reduce support for the state’s role in welfare provision, whereas crime victimization strongly increases such preferences. William Connolly is in error when he remarks that I begin my article with a discussion of scientific accounts that reduce the emotions to a few genetically wired categories and that I suggest that the cultural theorists who are interested in affect are driven in the same reductive direction.
