This study contrasts the evidence exclusion principles within the adversarial legal system of the United States, particularly the “fruit of the poisonous tree” doctrine, with the inquisitorial system of Vietnam. The U.S. model, emphasizing the exclusion of unlawfully obtained evidence to protect the presumption of innocence and ensure fair trials, relies on the Fourth Amendment to prevent police misconduct. Conversely, Vietnam, with its focus on uncovering the truth, has started to adopt adversarial elements, including evidence exclusion, to align with international (...) standards and enhance human rights protections within its criminal justice system. The research examines the application of the “fruit of the poisonous tree” doctrine in the U.S. and its implications for Vietnamese legal reforms, especially the proposed amendments to Article 87 of Vietnam's Criminal Procedure Code. These reforms aim to exclude unlawfully obtained evidence while allowing for the use of evidence collected independently from illegal actions. Highlighting the need for a balanced approach that respects procedural rights and promotes justice, the study advocates for comprehensive legal reforms in Vietnam. It suggests amendments to refine evidence exclusion principles, ensuring they reflect both the Vietnamese context and the progressive features of U.S. criminal justice practices, thereby enhancing the fairness and integrity of criminal proceedings. A central issue in the philosophy of technology concerns the relationship between technology and the conditions under which technology develops. Traditionally, two main accounts are given of this relationship. The social constructivist approach considers technology to be largely determined by “social” factors. By contrast, technological determinism describes technology as self-determinative, and as following its own independent aim of greater efficiency. This paper discusses two alternatives to these conceptions of technology, namely, the accounts offered by Bruno Latour and Martin Heidegger. It (...) examines their common theses that our present misunderstanding of technology is due to a continued commitment to the subject–object distinction. In the paper it is argued that bridging the digital divide may cause a new ethical and social dilemma. Using Hardin's Tragedy of the Commons, we show that an improper opening and enlargement of the digital environment (Infosphere) is likely to produce a Tragedy of the Digital Commons (TDC). In the course of the analysis, we explain why Adar and Huberman's previous use of Hardin's Tragedy to interpret certain recent phenomena in the Infosphere (especially peer-to-peer communication) may not be entirely (...) satisfactory. We then seek to provide an improved version of the TDC that avoids the possible shortcomings of their model. Next, we analyse some problems encountered by the application of classical ethics in the resolution of the TDC. In the conclusion, we outline the kind of work that will be required to develop an ethical approach that may bridge the digital divide but avoid the TDC. (shrink)

In this paper we introduce three methods to approach philosophical problems informationally: Minimalism, the Method of Abstraction and Constructionism. Minimalism considers the specifications of the starting problems and systems that are tractable for a philosophical analysis. The Method of Abstraction describes the process of making explicit the level of abstraction at which a system is observed and investigated. Constructionism provides a series of principles that the investigation of the problem must fulfil once it has been fully characterised by the previous (...) two methods. The perinatal necropsy is an important investigation following fetal or neonatal loss. Legal requirements on registration decree that consent is needed before necropsy can proceed in some of these babies. However, there are ill-defined grey areas which are open to legal and ethical difficulties. This paper discusses the problems that can arise with consent for a necropsy in the perinatal period. Some of these problems are clearly legal or ethical but all can cause distress to parents at a time of (...) grief and bereavement. The issues may not be readily resolved but public debate and ad hominem decisions on each perinatal loss may help to alleviate the problems. (shrink)

An application of Narrative Knowledge Representation Language (NKRL) techniques on (declassified) ‘terrorism in Southern Philippines’ documents has been carried out in the context of the IST Parmenides project. This paper describes some aspects of this work: it is our belief, in fact, that the Knowledge Representation techniques and the Intelligent Information Retrieval tools used in this experiment can be of some interest also in an ‘Ontological Modelling of Legal Events and Legal Reasoning’ context.

It has been observed that whereas painters and musicians are likely to be embarrassed by references to the beauty in their work, mathematicians instead like to engage in discussions of the beauty of mathematics. Professional artists are more likely to stress the technical rather than the aesthetic aspects of their work. Mathematicians, instead, are fond of passing judgment on the beauty of their favored pieces of mathematics. Even a cursory observation shows that the characteristics of mathematical beauty are at variance (...) with those of artistic beauty. For example, courses in art appreciation are fairly common; it is however unthinkable to find any mathematical beauty appreciation courses taught anywhere. This article responds to Gavan Duffy's critique of AnalogiesatWar in his recent essay on the agent-structure debate in the JJPS (2001, 2: 161giving structure its duestructure” with process, perceptual, and personality variables; (3) misinterprets my assumptions while neglecting the findings of recent works that corroborate the findings of AnalogiesatWar; and (4) fails to demonstrate one of his key suggestions, i.e. the importance of showing how agents and structures are mutually constitutive. In this paper we show that the Gupta-Belnap systems S# and S* are П12. Since Kremer has independently established that they are П12-hard, this completely settles the problem of their complexity. The above-mentioned upper bound is established through a reduction to countable revision sequences that is inspired by, and makes use of a construction of McGee.

Esse estudo apresenta os conceitos de documento e documentação propostos por Paul Otlet (1868-1944) presentes no âmbito da Revista do Serviço Público (RSP). Publicada desde 1937, a RSP contempla artigos nas áreas de Administração e Gestão pública, Políticas públicas e Economia do setor público, sendo considerada um importante veículo de informação no Brasil, contemporâneo ao período de efervescência do pensamento de Otlet. A pesquisa consiste numa Revisão Sistemática de Literatura (RSL) com análise documental da RSP no período entre 1951 e (...) 1975. Como procedimento de seleção dos artigos, utiliza o protocolo de pesquisa RSL elaborado por Valentim (2020). A partir do corpus de análise dos textos recuperados identifica os artigos que apresentam os conceitos de “documento” e “documentação” segundo Otlet, bem como os elementos constitutivos sobre o cenário da documentação no Brasil, na perspectiva da publicação de autores brasileiros na RSP, concluindo que os trabalhos analisados contemplam e ampliam a temática da Documentação com importantes reflexões de Otlet para a Ciência da Informação no Brasil. Este artículo estudia la revisión que hace Antonio Pérez de la identidad intencional de Pedro Auréolo entre el ser aparente de una cosa como conocida y su ser real extramental. La teoría de la cognición de Pérez es claramente deudora de la teoría de la intencionalidad de Auréolo. Al igual que este, Pérez se apoya en el instrumento lógico de la connotación y en la identidad entre la especie inteligible y el acto de conocimiento. Pérez está de acuerdo con la (...) teoría de Auréolo, afirmando una identidad de indistinción entre el ser aparente de la cosa como conocida y el ser real de la cosa extramental. Sin embargo, Pérez parece no estar plenamente satisfecho con la teoría de la cognición de Auréolo, e introduce algunos cambios relevantes. En primer lugar, emplea la doctrina suareziana de que todo acto intencional, aunque apunta directamente a un objeto, reflexiona virtual o indirectamente sobre sí mismo. Como consecuencia, apoya una identidad entre el lado formal –es decir, el acto de cognición– y el lado objetivo –es decir, la cosa reconocida–. En segundo lugar, ofrece una definición de la identidad de indistinción que difiere de la de Auréolo. Al hacerlo, Pérez equipara el ser aparente con una forma universal, es decir, el acto de cognición como tal, caracterizando todo acto particular de cognición como propio de todo ser inteligente. Este artículo pretende estudiar la crítica de Antonio Pérez a la teoría de la identidad intencional de Pedro Auréolo. La teoría de la cognición de Pérez es claramente deudora de la doctrina de la intencionalidad de Auréolo. El jesuita español utiliza a menudo las mismas expresiones lingüísticas que Auréolo (como "ser aparente") y coincide con él en la identidad intencional entre el conocedor -que coincide en acto con el acto de conocer- y el objeto conocido, que es lo mismo que (...) existe fuera del intelecto. Tanto Pérez como Auréolo basan su teoría de la identidad intencional en el De anima de Aristóteles, pero el jesuita español señala una incoherencia en la doctrina de Auréolo, que contradice la concisa afirmación de Aristóteles sobre la identidad entre el conocedor y lo conocido durante el acto de conocimiento. Al examinar a fondo la teoría de la identidad intencional de Auréolo, concebida como una especie de identidad de indistinción, Pérez señala una incoherencia entre la descripción que hace Auréolo del acto de cognición y su concepción de la identidad de indistinción. Además, Pérez parece considerar insuficiente la identidad de indistinción de Auréolo utilizada para describir la identidad intencional que caracteriza el acto de cognición. En consecuencia, ofrece una nueva definición de identidad indistinta para presentar el ser aparente como una realidad indeterminada que puede ser determinada por cualquier contenido inteligible. Esta revisión péreziana de la teoría del ser aparente de Auréolo, por un lado, puede verse como un caso de revisionismo escolástico temprano moderno aplicado a un pensador medieval y, por otro, encuentra una aplicación más amplia en la metafísica y la antropología filosófica de Pérez. This paper considers the issue of fear in the field of international relations studies. Fear is a typical condition of international relations because of the anarchical nature of the international political system characterized by a common threat perception among states. Since the very beginning of international political thought the notion of fear has been given great consideration due to its correlation with conflict which is the main object of international relations. The paper argues that in order to better understand what (...) fear and perception in international relations is about is necessary to undertake the notion of political identity. In that sense we propose a would be political identity account of state that might share light on the perception of fear. We claim that the perception of fear depends on the type of identity of a given state. Hence we discuss three type of state political identity: weak-tribal, medium-ideological, strong-pluralistic. This study aims at ascertaining the existence of an organic legal policy in marriage matters, one which was followed by Roman Emperors in the IV and V centuries, in particular by Constantine. It is also aimed at showing that this policy corresponded to Christian ideas as expressed by various Church Fathers. Professor Orsini’s book enters the controversy that has marked the changing response to Coleridge’s work during the past forty years, stimulated recently by the accessibility of Coleridge manuscripts and by the publication of hitherto unpublished works. Professor Orsini himself contributes to our new knowl­edge by publishing here for the first time texts from the note­books. His book is of importance and interest because it examines problems which are rooted in world-wide intellectual developments of recent times. Counterposing his argument against the (...) theory that Col­eridge had anticipated Kant and Schelling, Professor Orsini marshalls impressive evidence that shows that Coleridge was familiar with the works of the German idealists and that they greatly influenced his thinking, to the extent that he was for a time an expounder of transcendental idealism, and should be credited with bringing it to England. Professor Orsini’s new findings will lead inevitably to reassessment of Coleridge’s status as a philosopher, though he insists that his report is an interim one, that a final estimate must wait until all Coleridge’s writings have been published and assessed. A generalized Onsager reciprocity theorem emerges as an exact consequence of the structure of the nonlinear equation of motion of quantum thermodynamics and is valid for all the dissipative nonequilibrium states, close and far from stable thermodynamic equilibrium, of an isolated system composed of a single constituent of matter with a finite-dimensional Hilbert space. In addition, a dispersion-dissipation theorem results in a precise relation between the generalized dissipative conductivity that describes the mutual interrelation between dissipative rates of a pair of (...) observables and the codispersions of the same observables and the generators of the motion. Some of the foundations of Heyes’ radical reasoning seem to be based on a fractional selection of available evidence. Using an ethological perspective, we argue against Heyes’ rapid dismissal of innate cognitive instincts. Heyes’ use of fMRI studies of literacy to claim that culture assembles pieces of mental technology seems an example of incorrect reverse inferences and overlap theories pervasive in cognitive neuroscience.
