The representation of knowledge in the law has basically followed a rule-based logical-symbolic paradigm. This paper aims to show how the modeling of legal knowledge can be re-examined using connectionist models, from the perspective of the theory of the dynamics of unstable systems and chaos. We begin by showing the nature of the paradigm shift from a rule-based approach to one based on dynamic structures and by discussing how this would translate into the field of theory of law. In order (...) to show the full potential of this new approach, we start from an experiment with NEUROLEX, in which a neural network was used to model a corpus of French Council of State decisions. We examine the implications of this experiment, especially those concerning the limits of the model used, and show that other connectionist models might correspond more adequately to the nature of legal knowledge. Finally, we propose another neural model which could show not only the rules which emerge from legal qualification (NEUROLEX's goal), but also the way in which a legal qualification process evolves from one concept to another. Les avancées rapides dans les technologies numériques ont considérablement changé et amélioré la façon dont les données, informations et outils peuvent être diffusés, gérés, utilisés et réutilisés dans la recherche, et ont créé de nouvelles opportunités pour accélérer le progrès dans la science et l’innovation. Ces développements sont principalement dus au large mouvement formel ou informel de la peer production et à la diffusion globale de l’information mobilisant la coopération de communautés distribuées œuvrant dans des environnements en réseaux. Les initiatives (...) comme celle de Science Commons s’appuient sur un modèle économique de la science évoluant dans un environnement numérique et plus précisément sur un socle de partage et d’échange entre communautés de pairs comme modalité de production. Beaucoup d’autres initiatives de ce type sont en cours . Nous avons choisi Science Commons, dont l’objectif, au-delà de la communication scientifique, vise à accélérer la traduction des données en découverte – en débloquant tous les verrous y compris juridiques qui empêchent que la société bénéficie plus rapidement des résultats scientifiques. La philosophie et les outils pratiques de Science Commons seront décrits comme constitutifs d’une approche résolument ouverte de la connaissance scientifique, dans la lignée de la déclaration de Berlin .Rapid advances in the digital technologies have profoundly changed and improved the way in which data, information and tools can be disseminated, managed, used and re-used in research, and have created new opportunities to speed up progress in science and innovation. These developments are mainly due to an emerging broader movement in support of formal and informal « peer production » and global dissemination of information drawing on the cooperation of distributed science and knowledge communities working in open networked environments. Initiatives like the Science Commons rely on an economic model where science evolves in a digital environment, and more specifically on sharing and exchanges between peer communities as a basis for production. Many other initiatives of this kind are under way . We have chosen the Science Commons, whose objective, over and above scientific communication, is to speed up the translation of data into discovery by removing all barriers, including legal obstacles, that prevent society from enjoying the benefits of scientific results as quickly as possible. The philosophy and practical tools of the Science Commons are described as making up a resolutely open approach to scientific knowledge, as recommended by the Berlin Declaration. (shrink)

Unlike usual real graphs which have a low number of edges, we study here a dense network constructed from legal citations. This study is achieved on the simple graph and on the multiple graph associated to this legal network, this allows exploring the behavior of the network structural properties and communities by considering the weighted graph and see which additional information are provided by the weights. We propose new measures to assess the role of the weights in the network structure (...) and to appreciate the weights repartition. Then we compare the communities obtained on the simple graph and on the weighted graph. We also extend to weighted networks the amphitheater-like representation of this legal network. Finally we evaluate the robustness of our measures and methods thus taking into account potential errors which may occur by getting data or building the network. Our methodology may open new perspectives in the analysis of weighted networks. (shrink)

We explore one aspect of the structure of a codified legal system at the national level using a new type of representation to understand the strong or weak dependencies between the various fields of law. In Part I of this study, we analyze the graph associated with the network in which each French legal code is a vertex and an edge is produced between two vertices when a code cites another code at least one time. We show that this network (...) distinguishes from many other real networks from a high density, giving it a particular structure that we call concentrated world and that differentiates a national legal system (as considered with a resolution at the code level) from small-world graphs identified in many social networks. Our analysis then shows that a few communities (groups of highly wired vertices) of codes covering large domains of regulation are structuring the whole system. Indeed we mainly find a central group of influent codes, a group of codes related to social issues and a group of codes dealing with territories and natural resources. The study of this codified legal system is also of interest in the field of the analysis of real networks. In particular we examine the impact of the high density on the structural characteristics of the graph and on the ways communities are searched for. Finally we provide an original visualization of this graph on an hemicyle-like plot, this representation being based on a statistical reduction of dissimilarity measures between vertices. In Part II (a following paper) we show how the consideration of the weights attributed to each edge in the network in proportion to the number of citations between two vertices (codes) allows deepening the analysis of the French legal system. We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. It is common to hear talk of the aim of belief and to find philosophers appealing to that aim for numerous explanatory purposes. What belief 's aim explains depends, of course, on what that aim is. Many hold that it is somehow related to truth, but there are various ways in which one might specify belief 's aim using the notion of truth. In this article, by considering whether they can account for belief 's standard of correctness and the epistemic (...) norms governing belief, I argue against certain prominent specifications of belief 's aim given in terms of truth, and advance a neglected alternative. This essay considers the reliability and proper role of authorial intention in the interpretation of figurative language and argues that, even in cases of metaphor and irony, the meaning of a text must remain logically independent of the intent of its historical author. Irony and metaphor have been broadly considered to be the most problematic cases for the anti-intentionalist approach to interpretation. The arguments in this essay address standard intentionalist arguments and, in the end, defend a sort of hypothetical intentionalism (...) that is, in all significant respects, anti-intentionalist. « L’anarchie », comme en témoigne l’omniprésence du qualificatif « anarchique » dans De l’absurdité sur des échasses, est essentielle pour comprendre le chemin argumentatif développé dans la critique benthamienne des droits de l’homme. C’est seulement à partir d’elle qu’apparaissent clairement les différents pans de cette critique, mais surtout son ordre et son sens déterminés par ce qui vaut comme le fondement de toute la critique, la théorie des fictions. Une fois reconnue l’importance de ce fondement, alors la continuité et (...) la systématicité de la critique comme la propension dévastatrice de cette argumentation se déploient entièrement, et devient cette « machine de guerre » contre les droits de l’homme. « L’anarchie » est bien le fil directeur de la critique, en tant qu’elle est le moyen et la fin même de la Déclaration des droits de l’homme pour Bentham. Dans tous les pays et particulierement en Europe, les citoyens, les magistrats et les juristes en general deplorent la complexite normative. Comment traiter la complexite des normes a prendre en compte dans toutes les decisions fondees sur la regle de droit? Depuis une quinzaine d'annees, l'etude des systemes complexes a fait de grands progres tant du point de vue des methodes que de la modelisation. L'approche politique et l'approche scientifique semblent a priori eloignees, mais elles convergent sur l'interet de prendre (...) en compte un objet nouveau: la complexite des systemes. Ces systemes font emerger de nouvelles proprietes, non observables au niveau des elements constitutifs, par une dynamique difficilement previsible, et rendent vaine toute analyse en sous-systemes plus simples. Pour la premiere fois, des specialistes des systemes complexes, des juristes, des philosophes, des experts de l'action publique et de l'evaluation des lois conjuguent leurs reflexions pour depasser les problematiques de la simplification et proposent des concepts et des outils totalement nouveaux pour comprendre et traiter de facon simple l'inevitable complexite du droit. In this article, I defend the idea that Bentham's international political theory entails a cosmopolitan dimension. First, I explain that Bentham rejects two pillars of internationalism, namely, the sovereign's unconstrained autonomous power and authority in international politics, and the legal and moral personality of the state in the international realm. This critique leads Bentham to construct a complex international political theory which places the issue of states’ responsibility at its centre. Bentham's international theory articulates a minimalist international system of cooperation (...) between states and an institutional model of public officials’ responsibilities that together play the crucial role in securing the greatest happiness of the greatest number in the world. In this last part, I explain how Bentham's international political theory relies heavily on the responsibilities of states, a set of responsibilities that encompasses both national and cosmopolitan responsibilities that public officials in each state hold. Here I look to some work in the historical sciences in order to draw out some of the epistemic benefits of “speculative narratives,” which bears on some more general epistemic benefits of speculative reasoning. Due to the contingent nature of much historical evidence, some degree of speculative reasoning is necessary to get the epistemological ball rolling in the historical sciences, and I argue that speculative narratives provide the necessary sort of frameworking apparatus for doing precisely this. Sometimes, learning about the origins of a belief can make it irrational to continue to hold that belief—a phenomenon we call ‘genealogical defeat’. According to explanationist accounts, genealogical defeat occurs when one learns that there is no appropriate explanatory connection between one’s belief and the truth. Flatfooted versions of explanationism have been widely and rightly rejected on the grounds that they would disallow beliefs about the future and other inductively-formed beliefs. After motivating the need for some explanationist account, we raise (...) some problems for recent versions of explanationism. Examines the lived experience of social encounters drawing on phenomenological insights.

Par ces temps de grands malaises identitaires, subjectifs et collectifs, où les frontières vacillent, où l'identité fait problème - tantôt elle chavire et tantôt elle se crispe -, on découvre avec surprise que le concept de différence est lui aussi insuffisant pour rendre compte de toutes ces effervescences: il est trop simple, trop figé... Nous décrivons ici ces lieux par lesquels on passe pour devenir différent, et tenter de faire quelque chose de "sa" différence; ces moments où nous sommes "entre (...) deux"; dans les contextes les plus variés: l'écrivain qui se débat entre deux langues, la femme qui, pour accéder à sa propre féminité, doit se dégager de la Femme originelle, l'adolescent ou le jeune qui cherche à faire le pas sans passer à l'acte ou, simplement, se ranger, et même le chômeur cherchant "une place" - tous passent par un entre-deux. Celui-ci se révèle être un passage ou une impasse, selon que l'origine qui se rejoue dans cette épreuve se révèle accessible ou pas à une sorte de partage - qu'il s'agit justement d'éclairer. L'entre-deux est donc plus qu'un nouveau concept, c'est une épreuve où l'on s'affronte à l'Origine - perdue ou redonnée, morcelée ou en bloc. On s'y affronte à la fois pour la retrouver et pour s'en dégager. Et l'origine est une dynamique à laquelle on a affaire chaque fois qu'il s'agit de se déplacer. Infallibilism is the view that a belief cannot be at once warranted and false. In this essay we assess three nonpartisan arguments for infallibilism, arguments that do not depend on a prior commitment to some substantive theory of warrant. Three premises, one from each argument, are most significant: if a belief can be at once warranted and false, then the Gettier Problem cannot be solved; if a belief can be at once warranted and false, then its warrant can be transferred (...) to an accidentally true belief; if a belief can be at once warranted and false, then it can be warranted and accidentally true. We argue that each of these is either false or no more plausible than its denial. Along the way, we offer a solution to the Gettier Problem that is compatible with fallibilism. (shrink)

Pharmaceutical industry marketers are confronted with specific ethical issues linked to the tension between the economic interest being pursued and the health mission of this sector. Indeed this dual mission could be problematic for them when the two objectives contradict each other. We use the concept of moral dissonance to examine how marketers in the pharmaceutical industry perceive the profit/health tension inherent in their sector and how they deal with it. Based on narratives of 18 marketers working in the pharmaceutical (...) sector, our qualitative study identifies ethical conflicts of varying intensity that generate differing degrees of moral dissonance among marketers. To cope with this moral dissonance, they use the following strategies: (1) minimize the sensitivity of their activity; (2) invoke the benefits to patients; and (3) avoid behaviors that conflict with their values. In Lukács: Praxis and the Absolute, Daniel Andrés López reassembles Lukács’s philosophy of praxis on a Hegelian basis, as a conceptual-historical totality, both defending him and proposing an unprecedented, immanent critique that raises problems for Marxian philosophy as a whole.

" Qualia " is an unfamiliar term for something that could not be more familiar to each of us: the ways things seem to us. As is so often the case with philosophical jargon, it is easier to give examples than to give a definition of the term. Look at a glass of milk at sunset; the way it looks to you--the particular, personal, subjective visual quality of the glass of milk is the quale of your visual experience at the (...) moment. The way the milk tastes to you then is another, gustatory quale, and how it sounds to you as you swallow is an auditory quale; These various "properties of conscious experience" are prime examples of qualia. Nothing, it seems, could you know more intimately than your own qualia ; let the entire universe be some vast illusion, some mere figment of Descartes' evil demon, and yet what the figment is made of will be the qualia of your hallucinatory experiences. Descartes claimed to doubt everything that could be doubted, but he never doubted that his conscious experiences had qualia, the properties by which he knew or apprehended them. (shrink)

The social sciences playa variety of multifaceted roles in the policymaking process. So varied are these roles, indeed, that it is futile to talk in the singular about the use of social science in policymaking, as if there were one constant relationship between two fixed and stable entities. Instead, to address this issue sensibly one must talk in the plural about uses of dif ferent modes of social scientific inquiry for different kinds of policies under various circumstances. In some cases, (...) the influence of social scientific research is direct and tangible, and the connection between the find ings and the policy is easy to see. In other cases, perhaps most, its influence is indirect-one small piece in a larger mosaic of politics, bargaining, and compromise. Occasionally the findings of social scientific studies are explicitly drawn upon by policymakers in the formation, implementation, or evaluation of particular policies. More often, the categories and theoretical models of social science provide a general background orientation within which policymakers concep tualize problems and frame policy options. At times, the in fluence of social scientific work is cognitive and informational in nature; in other instances, policymakers use social science primarily for symbolic and political purposes in order to le gitimate preestablished goals and strategies. Nonetheless, amid this diversity and variety, troubling general questions persistently arise. (shrink)

Supererogatory acts are those that lie “beyond the call of duty.” There are two standard ways to define this idea more precisely. Although the definitions are often seen as equivalent, I argue that they can diverge when options are infinite, or when there are cycles of better options; moreover, each definition is acceptable in only one case. I consider two ways out of this dilemma.

In this chapter, Benjamin Bourcier argues that Bentham’s politics of global commerce evolved from enlightenment cosmopolitanism aspirations to gradually integrate several features of an economic imperialist model. Bentham’s series of writings on colonial and commercial projects share a relative similarity with the British imperial ideology of his time. Observing that Bentham’s politics of global commerce is not perfectly coherent, Bourcier interrogates how these changes reveal a close historical and conceptual relation between enlightenment cosmopolitan ideas on commerce and the (...) burgeoning development of British imperial ideology. On cherche ici à pallier ce manque par une étude des rapports entre Hobbes et Bentham dans le champ de la philosophie politique, juridique et morale. On espère ainsi expliquer les points communs, influences, réappropriations, différences et oppositions existant entre ces deux (...) pensées et contribuer par là à faire mieux comprendre leur rôle dans l’histoire de la philosophie moderne anglaise. Souvent délaissée, la pensée politique de l’international chez Hobbes et Bentham recèle plus de points communs qu’on ne pourrait le penser. Pour reconstruire philosophiquement cette pensée, en s’attachant plus spécifiquement au rapport entre économie et politique, on explique d’abord leur commune opposition aux colonies et aux politiques étrangères bellicistes. On montre ensuite comment ils comprennent le commerce international, l’économie et le marché en relation avec l’État, et enfin qu’on ne saurait constituer une théorie politique internationale assurant la sécurité, la paix (...) et la prospérité qui soit autonome et séparée de la théorie de l’État. This article takes issue vigorously with what it argues are the disempowering effects of Judith Butler's more recent work, for transgendered people in particular and accordingly for the queer movement in general. In so doing it contests the way in which the reception of Butler's work in France has been mediated by a transphobic psychoanalytic establishment and attacks Butler for playing along with their self-interested political agenda by retelling, in Paris, for their ears, an anecdote of a savoury encounter with (...) a transgendered interlocutor in a subcultural queer space in San Francisco. Sometimes it takes years of debate for philosophers to discover what it is they really disagree about. Sometimes they talk past each other in long series of books and articles, never guessing at the root disagreement that divides them. But occasionally a day comes when something happens to coax the cat out of the bag. "Aha!" one philosopher exclaims to another, "so that's why you've been disagreeing with me, misunderstanding me, resisting my conclusions, puzzling me all these years!".

The contributions made by British intellectuals to modern internationalInternational political thought have been at the centre of several debates in recent decades in disciplines such as international relations.

Ma première rencontre avec David Lieberman date de 2014. A l’initiative de mon co-directeur de thèse Malik Bozzo-Rey, David Lieberman avait été invité à participer à mon comité de suivi de thèse. Il avait lu les quelques pages présentant les avancées de mes recherches et sa participation à ce comité comme ses commentaires avaient été très soutenant et généreux. La suite de ma recherche doctorale a largement été nourrie par ses travaux et n’ont pas cessé de l’être depuis. La grande (...) force et l'originalité de David a été l'inflexion qu'il a porté à la division entre ce qui relève de la philosophie politique et de la philosophie du droit chez Bentham. Il développe une interprétation ‘politique’ de la philosophie de Bentham en se concentrant sur l’idéal de codification et il voit dans ce thème et cet objet ce qui orchestre la continuité des écrits de Bentham des années 1780 à ceux de 1832.
