Perfect ethical duties have usually puzzled commentators on Kant's ethics because they do not fit neatly within his taxonomy of duties. Ethical duties require the adoption of maxims of ends: the happiness of others and one's own perfection are Kant's two main categories. These duties, he claims, are of wide obligation because they do not specify what in particular one ought to do, when, and how much. They leave ‘a latitude for free choice’ as he puts it. Perfect duties, however, (...) such as the duties of respect, to avoid suicide, lying, and servility, do not appear to require the adoption of ends but only the performance or omission of specific types of actions. The puzzle is how these duties can be ethical, and therefore wide. Faced with this difficulty, Mary Gregor denies that perfect ethical duties are wide. She claims that they are an ‘anomaly’ and that they do not belong to ethics proper but to moral philosophy in general. She argues that these duties are derived from the categorical imperative, instead of, as Kant himself appears to have thought, the first principle of virtue. Taking a very different approach, Onora O'Neill finds the perfect/imperfect distinction of little importance and suggests doing without it altogether. Most other interpreters also assume that ‘wide’ is opposed to ‘perfect’ so that a wide perfect duty is a conceptual impossibility. (shrink)

I criticize the widely accepted “practical” interpretation of the universality test contained in Kant’s first formula of the categorical imperative in the Groundwork of the Metaphysics of Morals – the formula of the universal law of nature. I argue that this interpretation does not work for contradictions in conception because it wrongly takes contradictions in the will as the model for them and, as a consequence, cannot establish a clear distinction between the two kinds of contradiction. This interpretation also assumes (...) an understanding of universality that departs from Kant’s own and, cannot, for this reason, capture the kind of contradiction that he explicitly claims to establish. I provide an alternative interpretation, which I call revised logical interpretation, that allows us to account for contradictions in conception, including those examples that the practical interpretation cannot handle, as well as to establish a clear distinction between the two kinds of contradiction. Friends and foes of liberal neutrality assume that neutrality presupposes pluralism. On this view, the state should be neutral among the many permissible conceptions of the individual good that citizens affirm. I argue that neutrality need not be construed as a response to pluralism. I focus on the case of specifically religious neutrality and argue that it can be an appropriate political response to what I call “the fact of religious hegemony,” which is a social scenario in which a particular (...) religion is unanimously recognized as dominant. Religious neutrality, in this kind of context, requires the state to avoid all religious words and symbols that can be taken as an expression of endorsement or criticism of religion. I take this conception of religious neutrality from both political history and current political practice and discourse. Neutrality was originally conceived of as a proper political response in contexts of religious hegemony both in France and in Mexico. Today, and despite the growth of religious pluralism, this conception continues to be a live political posture in the places where it first originated. I call it “neutrality as independence from religion” and argue that it differs from liberal neutrality in crucial respects. (shrink)

De acuerdo con Hume, las evaluaciones morales se basan en los sentimientos de aprobación o de desaprobación que experimentamos al contemplar el carácter de una persona desde un punto de vista general. También sostiene que la adopción de esta perspectiva no se debe a una exigencia de la razón, sino que obedece a operaciones naturales de la imaginación. En este trabajo discuto la pregunta sobre el mecanismo psicológico por el que adoptamos este punto de vista general. Para ello explico primero (...) otras operaciones de la imaginación que son centrales en las evaluaciones morales: la asociación de percepciones en la producción de las pasiones del amor, el orgullo, el odio y la humildad; la transmisión de fuerza y vivacidad entre las percepciones; y la simpatía. A continuación señalo que el supuesto mecanismo natural de la imaginación por el cual adoptaríamos el punto de vista general parece no poder existir. Sugiero que, en lugar de ello, esta perspectiva puede concebirse como una construcción social o, como Hume diría, un "artificio" de los seres humanos. In this thesis I consider two common, though directly opposed, interpretations of Kantian morality. According to what I call "the other-regarding interpretation," Kantian morality is primarily about the regulation of human interaction. According to what I call "the private and internal interpretation," Kantian morality is primarily self-regarding since what chiefly matters, on this view, is adopting moral motives. I argue that both interpretations rest on a failure to understand Kant's distinction between ethics and justice , a distinction which he introduces (...) in The Metaphysics of Morals, on which I primarily focus. As I interpret this distinction, ethics addresses the question about the supreme individual good , whereas justice addresses the question how to make possible the coexistence of the freedom of action of a plurality of agents who pursue their personal ends. I argue that the other-regarding interpretation tends to reduce morality to justice , whereas the internal and private interpretation reduces morality to ethics and cannot accommodate Kantian justice as part of morality. I focus most of my attention on the former view because it has been significantly more influential in recent debates. Against this view, I argue that ethics, on Kant's account, is about the pursuit of the supreme individual good , and not about the regulation of human interaction. The tendency to reduce morality to justice is manifest in the thesis that the justification of principles of personal morality rest upon an agreement as well as in a certain version of the thesis of the priority of the right over the good. Both theses are present in the work of Jurgen Habermas. The use of agreement is common among followers of John Rawls's who attempt to extend his Contractarian justification of principles of justice to the domain of personal morality. Such an extension, I argue, presupposes an understanding of personal morality by analogy with justice. Paradoxically, these two theses are regarded as "Kantian," though they have contributed to the distortion in recent debates of what I argue is central to Kant's ethics. (shrink)

Consensual homicide remains a crime in jurisdictions where active voluntary euthanasia has been legalized. At the same time, both jurisdictions, in which euthanasia is legal and those in which it is not, recognize that all patients (whether severely ill or not) have the right to refuse or withdraw medical treatment (including life-saving treatment). In this paper, I focus on the tensions between these three norms (the permission of active euthanasia, the permission to reject life-saving treatment, and the prohibition of consensual (...) homicide), assuming a justification of euthanasia based on the right to (personal) autonomy. I argue that the best way to provide a coherent account of these norms is to claim that patients have two distinct rights: the right to autonomy and the right to bodily integrity. This solution has some relevant implications for the discussion of the legalization of active euthanasia. (shrink)

Los defensores de la ética de la virtud usualmente califican a la ética kantiana como una moralidad centrada en el acto porque, sostienen, su principal objeto de evaluación moral son los actos particulares, con lo cual un acto puede ser moralmente bueno a pesar de que el carácter de quien lo lleva a cabo no sea virtuoso. Sostienen que, por el contrario, la ética debe centrarse en el carácter de las personas, de modo que un acto es moralmente valioso sólo (...) cuando es la expresión de un carácter virtuoso. El propósito de este artículo es mostrar que, en contra de lo que sostienen los partidarios de la ética de la virtud, el principal objeto de evaluación moral en la ética kantiana es el carácter de las personas. El imperativo categórico no exige la realización de actos particulares, sino la adopción de máximas de fines, las cuales son principios para una vida completa. Sostengo que la adopción de estas máximas necesariamente requiere la adquisición de un carácter virtuoso, de tal modo que quien se compromete sinceramente con los principios éticos lleva a cabo acciones buenas y tiene también un carácter moral. Throughout a distinguished career, Bob Hale’s work has addressed this question on a number of fronts, through the development of a Fregean approach to ontology, an essentialist theory of modality, and in his work on neo-logicism in the philosophy of mathematics. This collection of new essays engages with these themes (...) in Hale’s work in order to make further progress in our understanding of ontology, modality, and the relations between them. Some essays directly address questions in modal metaphysics, drawing on ontological concerns. Others raise questions in modal epistemology and its links to matters of ontology, such as the challenge to give an epistemology of essence. There are also several essays engaging with questions of what might be called ‘modal ontology’: the study of whether and what things exist necessarily or contingently. Such issues can be raised and addressed directly, but they also have an important bearing on the kinds of semantic commitments engendered in logic and mathematics, e.g., to the existence of sets, or numbers, or properties, and so on. It is thus explored in some chapters to what extent one’s ontology—and indeed, one’s ontology of necessary beings—interacts with other plausible assumptions and commitments. (shrink)

In his recent article, ‘A Gift to Theology? Jean-Luc Marion's ‘Saturated Phenomena’ in Christological Perspective’, Brian Robinette has critiqued Marion's phenomenology for confining theology to a one-sided approach to Christology, one that stresses only the passive, mystical reception of Christ. To correct this imbalance, Robinette brings Marion into dialogue with those more active Christologies or ‘prophetical-ethical’ liberation theologies of Gustavo Gutierrez, Johann Baptist Metz and others that stress a life-praxis focused on confronting evil and suffering. In this essay I am (...) arguing that Robinette has not fully developed the ‘logic’ of Marion's phenomenology of the ‘call and the gifted’, in which both a passive and an active element are operative. I explore more fully that very dynamic phenomenological process of the call-and-the-gifted as developed in Marion's work Being Given: Toward a Phenomenology of Givenness. Once viewed in Christological perspective, and especially in light of Christ's death and resurrection, Marion's phenomenology entails an ethical trope consistent with the mission of Christ as rendered in Scriptural revelation, and thus the gap between Marion's work and the prophetical-ethical theologies of Gutierrez and Baptist Metz becomes narrowed. abstract The possibility that organ sales by living adults might be made legal is morally distressing to many of us. However, powerful arguments have been provided recently supporting legalisation (I consider two of those arguments: the Consequentialist Argument and the Autonomy Argument). Is our instinctive reaction against a market of organs irrational then? The aim of this paper is not to prove that legalization would be immoral, all things considered, but rather to show, first, that there are some kinds of (...) arguments, offered in favour of legalisation, that are, in an important sense, illegitimate, and second, that even if legalisation might not be wrong all things considered, there are good reasons for our negative moral intuitions. Moreover, identifying these reasons will help highlight some features of moral decisions in non‐ideal situations, which in turn might be relevant to some other moral or policy choices. (shrink)

Genetic research in human beings poses deep ethical problems, one being the problem of distributive justice. If we suppose that genetic technologies are able to produce visible benefits for the well being of people, and that these benefits are affordable to only a favored portion of society, then the consequence is obvious. We are introducing a new source of inequality. In the first section of this paper, I attempt to justify some concern for the distributive consequences of applying genetics to (...) human beings. This concern transcends a mere preoccupation for material equality. I argue that genetic inequality can undermine the very basis of social cooperation, at least regarding health care. The second section is more practical. My aim is to defend how, at least in some legal and cultural frameworks , the undesired distributive consequences of genetics are more likely to arise and more difficult to avoid. (shrink)

How to reciprocate a precious gift? In this case the gift was given to us twice. First, in the shape of Paget Henry’s pioneering reinvention of René Ménil’s “Aesthetic Marxism.” Through it, second, we’re led to rediscover the fantastic world of Ménil’s hitherto ignored but crucial contribution to contemporary philosophy: his systematization of the poetics of revolt. Our debt with Ménil and Henry is unpayable. Our humble response in this essay is to offer readers a map to the treasure that (...) is Ménil’s thought. We aim to offer a path across and beyond the sedimentation and pacifying effects of given frames of judgment and the imagination in today’s post-classical public sphere. Most research on risk aversion in behavioral science with human subjects has focused on a component of risk aversion that does not adapt itself to context. More recently, studies have explored risk aversion adaptation to changing circumstances in sequential decision-making tasks. It is an open question whether one can identify evidence, at the single subject level, for such risk aversion adaptation. We conducted a behavioral experiment on human subjects, using a sequential decision making task. We developed a model-based approach for (...) estimating the adaptation of risk-taking behavior with single-trial resolution by modelling a subject’s goals and internal representation of task contingencies. Using this model-based approach, we estimated the subject-specific adaptation of risk aversion depending on the current task context. We found striking inter-subject variations in the adaptation of risk-taking behavior. We show that these differences can be explained by differences in subjects’ internal representations of task contingencies and goals. We discuss that the proposed approach can be adapted to a wide range of experimental paradigms and be used to analyze behavioral measures other than risk aversion. (shrink)

Parte de la premisa de que ésta es tomada como una estrategia para reconciliar la modernidad ilustrada, particular-mente tras el evento de la Revolución Francesa de 1789, tanto con el proyecto fundacional epistémico de la modernidad temprana como con su pasado antagónico: La concepción de la racionalidad retórica y hermenéutica, tal y como ésta procede de Platón y Aristóteles. El método de Hegel se (...) inscribiría en un afán por fusionar los aspectos omnipotentes de las narrativas ilustradas con los métodos premodernos de vinculación finita y fragmentaria con el sentido de la realidad. La recepción durante el siglo XX se preguntó si la filosofía nietzscheana era a-, im- o anti-política, es decir, si podía ser asimilada por la democracia, o si era antimoderna, elitista y reaccionaria. El italiano Roberto Esposito ha propuesto leerla como formando e informando el paradigma de la biopolítica. Se discuten cuatro lecturas de esa biopolítica: como formadora del paradigma de la inmunidad, como tanatopolítica, como liberal y neoliberal, y como biopolítica afirmativa. Twentieth-century readers wondered if Nietzschean philosophy was apolitical, (...) impolitic, or anti-political; that is, if it could be assimilated by democracy or if it was antimodern, elitist, and reactionary. The Italian philosopher Robert Esposito has proposed reading Nietzsche's philosophy as forming and informing the biopolitical paradigm. Four readings of these biopolitics are discussed: as part of the paradigm of immunity, as thanatopolitics, as liberal and neoliberal, and as affirmative biopolitics. (shrink)

In this paper the author reflects upon the past, the present and the future of philosophical education within the framework of a democratic mode of living, integrating three levels of argumentation: an autobiographic level, triggered by the encounter with an old school notebook that belonged to the author’s father; a conceptual level, in which the author recalls John Dewey’s pragmatist approach to philosophy; and a descriptive and proactive level, in which the author examines recent developments concerning the teaching of philosophy (...) and proposes a perspective on philosophical education in tune with these. The author underscores the importance of different displacements and transformations undergone by the practice of teaching philosophy during the last century, and sets up a contrast between the old practices, intended to provide a “correct view of the world”, and the urge for philosophy to provide a critique of society and knowledge. In this way, the author draws on Dewey’s ideal, according to which philosophy should carry out both a critique and a reconstruction of present experience. Finally, the author sets forth ten challenges for future philosophical education. (shrink)

This article examines a specific case of lying, at the same time judicial and mediatic, promoted from the highest levels of political power, the Leon Trotsky case, from the perspective of the work done by the International Commission of Investigation chaired by the American philosopher John Dewey. After a general justification and contextualization of the subject, and a historical account of the events that surrounded the “Moscow Trials” and the constitution of the Dewey Commission, some of the reasons why the (...) commission concluded that such processes had been judicial assemblies are reported. It closes with a reference to the way Dewey later denounced the media falsification of these events through the book Mission to Moscow. (shrink)

Resumen: La problematización de la relación entre individuo y sociedad ha atravesado la historia de las ciencias sociales. El objetivo de este escrito es mostrar la originalidad de los planteamientos de Freud sobre el tópico, a través de un análisis comparativo con las aproximaciones propias de las corrientes socioantropológicas de la escuela de Cultura y Personalidad y de la Sociología Francesa. Nuestra investigación se basó en un análisis bibliográfico tanto de algunos textos socioantropológicos claves sobre dicho debate, como de la (...) producción freudiana pertinente. La interpretación del material freudiano se organizó según tres tópicos: a) la afirmación de la determinación simbólica del síntoma, b) la borradura metodológica de la distinción individuo sociedad, y c) la teorización de una eficacia mítica, transindividual y transhistórica. Concluimos subrayando los aportes del pensamiento de Freud a la discusión: la afirmación de la determinación simbólica ofrece las condiciones para la superación de la relación de externalidad entre el polo del individuo y el de la sociedad, y el consecuente rechazo a una relación especular entre ambos. The aim of this paper is to show the originality of Sigmund Freud's ideas about the topic, through a comparative analysis with the approaches of the socio-anthropological currents of the school of Culture and Personality and of French Sociology. Our research was based on a bibliographical analysis of some key socio-anthropological texts on this debate, as well as the relevant Freudian production. The interpretation of the Freudian material was organized according to three topics: a) the affirmation of the symbolic determination of symptoms, b) the methodological erasure of the individual society distinction, and c) the theorization of a mythical, transindividual and transhistorical efficacy. We conclude by emphasizing the contributions of Freud's thought to the discussion: the affirmation of symbolic determination offers the conditions for overcoming the externality relation between the pole of the individual and that of society, and the consequent rejection of a specular relationship between the two.
