Taking organs from dead people seems, prima facie, to raise fewer ethical complications than taking organs from other sources. There are, however, serious ethical problems in taking organs from the dead unless there is premortem evidence that this is what the deceased would have wanted, or at least, not have objected to. In this paper we will look at a “strong” opting out policy as proposed by John Harris. We will argue that people can be harmed after their death and (...) that the posthumous removal of organs against their expressed wishes is one form that such harm might take. The zona pellucida is an extracellular coat that surrounds mammalian eggs and early embryos. This insoluble matrix separates germ from somatic cells during folliculogenesis and plays critical roles during fertilization and early development. The mouse and human zona pellucida contain three glycoproteins (ZP1 or ZPB, ZP2, ZP3), the primary structures of which have been deduced by molecular cloning. Targeted mutagenesis of endogenous mouse genes and transgenesis with human homologues provide models to investigate the roles of individual zona components. Collectively, the (...) genetic data indicate that no single mouse zona pellucida protein is obligatory for taxon‐specific sperm binding and that two human proteins are not sufficient to support human sperm binding. An observed post‐fertilization persistence of mouse sperm binding to “humanized” zona pellucida correlates with uncleaved ZP2. These observations are consistent with a model for sperm binding in which the supramolecular structure of the zona pellucida necessary for sperm binding is modulated by the cleavage status of ZP2. The criminal defendant is presumed innocent and his guilt must be proved beyond reasonable doubt for conviction. On some issues, however, the defendant must prove his innocence on the balance of probabilities to avoid conviction. Commentators have despaired of reconciling reverse burdens with the presumption in a principled way. Andrew Stumer has made a fresh attempt; however, his solution is overly rigid and rule bound. The presumption is engaged in a dynamic enterprise—minimizing the expected cost of error, mistaken acquittals as (...) well as wrongful convictions. Stumer’s fixed criminal standard and stringent restrictions on reverse burdens work against this goal. A more flexible approach is required, reflecting the calculus of error management. Where the cost or probability of wrongful conviction is relatively low, and the cost or probability of mistaken acquittal relatively high, it may be necessary to lower the standard of proof, or even to reverse the burden of proof. To inhibit these strategies is to increase the expected cost of error at trial. (shrink)

Background: Dementia care at home often involves decisions in which the caregiver must weigh safety concerns with respect for autonomy. These dilemmas can lead to situations where caregivers provide care against the will of persons living with dementia, referred to as involuntary treatment. To prevent this, insight is needed into how family caregivers of persons living with dementia deal with care situations that can lead to involuntary treatment. Objective: To identify and describe family caregivers’ experiences regarding care decisions for situations (...) that can lead to involuntary treatment use in persons living with dementia at home. Research design: A qualitative descriptive interview design. Data were analysed using the Qualitative Analysis Guide of Leuven. Participants and research context: A total of 10 family caregivers providing care for 13 persons living with dementia participated in in-depth semi-structured interviews. Participants were recruited by registered nurses via purposive sampling. Ethical consideration: The study protocol was approved by the Ethics Committee of the University Hospitals Leuven and the Medical Ethical Test Committee Zuyderland. Findings: Family caregivers experience the decision-making process concerning care dilemmas that can lead to involuntary treatment as complicated, stressful and exhausting. Although they consider safety and autonomy as important values, they struggle with finding the right balance between them. Due to the progressive and unpredictable nature of dementia, they are constantly seeking solutions while they adapt to new situations. Family caregivers feel responsible and experience social pressure for the safety of persons living with dementia. They may be blamed if something adverse happens to the persons living with dementia, which increases an already stressful situation. Their experience is influenced by characteristics of the care triad such as practical and emotional support, knowledge, and previous experiences. Discussion and conclusion: To prevent involuntary treatment, professionals need to proactively inform family caregivers, and they need to support each other in dealing with complex care situations. To what extent can humorism be a legitimate disposition toward the Absurd? The Absurd is born from the insurmountable contradiction between one’s ceaseless striving and the absence of an ultimate resolution – or, as I prefer to call it, the ‘dissolution of resolution’. Humoristic Absurdism is the commitment to a pattern of humorous responses to the Absurd, which regard this absurd condition, as well as its manifestation in absurd situations, as a comical phenomenon. Although the humoristic disposition seems promising, by (...) virtue of humor’s recognition of incongruity and its denial of an ultimate resolution, and succeeds in countering three major objections, it falls prey to the claim that comprehensive humorism portrays as frivolous what is earnest, thereby renouncing the gravity of the desire for ultimate resolution, which is fundamental to the notion of the Absurd. In an attempt to explore alternative roles for humor in a legitimate disposition toward the Absurd, Metamodern Absurdism is suggested, which revolves around a post-ironic oscillation between humor and earnestness. In short, only in a role limited to one pole of an oscillatory pattern of responses can humor be integrated in a legitimate disposition toward the Absurd. (shrink)

Human knowing is more an intending of facts or states of affairs than a relation to them. Knowledge is not a predicamental relation. Consciousness is related to its object not as North Pole to South Pole, nor as container to contained, but as matter to form, and to the physical form (...) of the object of consciousness there corresponds the intentional form of the consciousness itself. To know reality is not to acquire it, grasp it, have it, possess it, contemplate it or dwell in it; it is to be informed by it i.e. intentionally to become it. Knowledge is the form rather than the cause of rational behaviour: technique, method, knack, skill, expertise, know-how, flair, strategic sense, prudence, taste, discretion, caution, judiciousness, decorum, conscientiousness, style, discipline, sagacity, discrimination, wisdom, respect for sense. Such principles operate not by description of nor prescription for, but by incarnation in and information of performance. It is, for instance, man’s respect for sense that is the form of a logically clear expression, and ideas are skills in the use of words. This human capacity and achievement is an intentional becoming, an actuation of the subject, bringing him to act. Yet, properly speaking, it is not action but passion. For knowing is an effect of which reality is the cause, and this causality is not a relation: actio est in passo—not in the agent, nor between the agent and the patient, but in the patient as from the agent, an actuation of the subject in dependence on the object. Of course it may be argued that non datur actio in distans, but far from requiring some intellectual ether, this only means that action and passion are not candidates for the application of spatial or temporal predicates. The known need not be close to the knower. True knowledge is the form of our reason when it is truly about matters of fact. It is not, then, a relation between subject and object, but a knowledge of states of affairs or facts constituted by interrelated objects which, to be known, must comprise some states of affairs of whose constituent objects some, at least, are knowing subjects. Knowing is the second act or actualization of the intellect Thomists regard as second potency, first act, or accidental passive potency. But knowing is not a transitive activity. It is an achievement of intention, not an episode. It is a capacity, disposition, proneness or inclination, in so far as it connotes the abiding possibility of its contents’ polymorphic propositional and non-propositional expression in rational behaviour, which is an effect of knowing as an achievement, though it is also rightly said to be informed by know-how rather than caused by it. THE MEANING of a word is in the letters not like fruit in a dish but more like one’s reflection in a mirror. Just as a man sees himself by looking in the mirror rather than at it, so he enjoys insight into possible routes by inspecting the map instead of just glancing at it, and he understands meaning in signs and images. In our experience of living there is the problem of bringing order out of chaos, of taking the (...) ‘1’ out of the world to transform it into a meaningful word. Art is the communication of society, and social dealienation depends on our creating and sustaining symbols of integration great enough to overcome the disintegrative forces of fear and weakness. This dissertation focuses on an exploration of the use of parables in the works of Soren Kierkegaard. While some work has been done on Kierkegaard’s poetic style, very little attention has been paid to his metaphors, despite their prevalent use in his works. Much of the scholarship instead treats his parables as mere examples of philosophical concepts. In this work, I argue that Kierkegaard’s parables function primarily to cause the reader to see him or herself truly. The parables work like (...) mirrors, reflecting our true selves back onto ourself. In this way, the parables prompt Kierkegaard’s readers to overcome the illusion of Christendom and to instead recognize the requirements that authentic Christianity places upon them. My dissertation begins with an examination of the purpose that Kierkegaard saw for his authorship. By focusing on his later works, I argue that Kierkegaard primarily wanted to bring the religious forward in his readers. He thought that in order to accomplish this he needed to start with works describing the life that he thought most of his readers lived, a life of pleasure seeking, and to slowly move them towards the religious. I then present Kierkegaard’s view of what Christianity essentially consists of, subjectivity, and of the style of communication that is tied to subjectivity. Kierkegaard claims that when communicating subjective truths that we must employ an indirect style. I go on to argue that parables very much fit into this style and that they work to cause tension on the part of the reader. The reader of the parable must choose between various competing interpretations that the parable presents, and in choosing how to interpret the parable, the reader reveals and discloses him or herself. I follow this up with an examination of a number of parables from different works of Kierkegaard, showing how they function in this manner. I end by arguing that Kierkegaard’s parables are designed to function like mirrors, revealing ourselves to us. (shrink)

This chapter explores the ethics of Robert Daly's actions in the episode “USS Callister”. We consider issues of privacy that relate to him stealing his co‐workers DNA in order to scan them into the game, as well as the ethics of how he treats the digital avatars of his co‐workers within the game. Examining Daly's actions from a few different approaches, we argue that Daly's actions towards his co‐workers avatars are very likely immoral, though ultimately we cannot know without knowing (...) Daly's thoughts. Finally, we end the chapter with some considerations relating to video games in general and the ways in which we must act when we play video games. (shrink)

Kierkegaard is often praised for his poetic writing style. Throughout his works, especially his pseudonymous ones, he often breaks from philosophical prose and instead uses extended metaphors, fairy tales, parables, and allegories. This book, which is the first that directly addresses Kierkegaard's parables, argues that they help the reader undergo transformative change. It asks why Kierkegaard uses parables in a broad sense, how they function as a form of indirect communication, why Kierkegaard must remain secretive about the purpose of the (...) parables, and how this secrecy plays an important role in Kierkegaard's authorship. This article reviews contemporary response to several contrasting strands of recent empirical work. It begins with discussing the scope and rationale of evidence law. Experimental studies on eyewitness memory and testimony illustrate the potential value of empirical studies to the practice of investigations, prosecutions, and appeals. This article discusses several lines of empirical inquiry employing diverse methodologies, experiments, surveys, and approaches and reviews their limitations, and implications and significance for the understanding and practice of law. Many of the contributions from (...) empirical legal studies are provisional and their precise value for practice is uncertain or ambiguous, but they raise important issues worthy of serious consideration. By identifying problems with eyewitness evidence and the limitations of many of the forensic sciences, and in many other ways, empirical and experimental studies have substantially outpaced legal experience. Indifference to empirical legal study is likely to reduce the social legitimacy of legal institutions. (shrink)

A path scheme for a game is composed of a path, i.e., a sequence of coalitions that is formed during the coalition formation process and a scheme, i.e., a payoff vector for each coalition in the path. A path scheme is called population monotonic if a player’s payoff does not decrease as the path coalition grows. In this study, we focus on Shapley path schemes of simple games in which for every path coalition the Shapley value of the associated subgame (...) provides the allocation at hand. Obviously, each Shapley path scheme of a game is population monotonic if and only if the Shapley allocation scheme of the game is population monotonic in the sense of Sprumont (Games Econ Behav 2:378–394, 1990). We prove that a simple game allows for population monotonic Shapley path schemes if and only if the game is balanced. Moreover, the Shapley path scheme of a specific path is population monotonic if and only if the first winning coalition that is formed along the path contains every minimal winning coalition. We also show that each Shapley path scheme of a simple game is population monotonic if and only if the set of veto players of the game is a winning coalition. Cancers often express hundreds of genes otherwise specific to germ cells, the germline/cancer (GC) genes. Here, we present and discuss the hypothesis that activation of a “germline program” promotes cancer cell malignancy. We do so by proposing four hallmark processes of the germline: meiosis, epigenetic plasticity, migration, and metabolic plasticity. Together, these hallmarks enable replicative immortality of germ cells as well as cancer cells. Especially meiotic genes are frequently expressed in cancer, implying that genes unique to meiosis may play a (...) role in oncogenesis. Because GC genes are not expressed in healthy somatic tissues, they form an appealing source of specific treatment targets with limited side effects besides infertility. Although it is still unclear why germ cell specific genes are so abundantly expressed in cancer, from our hypothesis it follows that the germline's reproductive program is intrinsic to cancer development. Objective: Atypical patterns of language lateralization due to early reorganizational processes constitute a challenge in the pre-surgical evaluation of patients with pharmaco-resistant epilepsy. There is no consensus on an optimal analysis method used for the identification of language dominance in MEG. This study examines the concordance between MEG source localization of beta power desynchronization and fMRI with regard to lateralization and localization of expressive and receptive language areas using a visual verb generation task.Methods: Twenty-five patients with pharmaco-resistant epilepsy, including six (...) patients with atypical language lateralization, and ten right-handed controls obtained MEG and fMRI language assessment. Fourteen patients additionally underwent the Wada test. We analyzed MEG beta power desynchronization in sensor (controls) and source space (patients and controls). Beta power decrease between 13 and 35 Hz was localized applying Dynamic Imaging of Coherent Sources Beamformer technique. Statistical inferences were grounded on cluster-based permutation testing for single subjects.Results: Event-related desynchronization of beta power in MEG was seen within the language-dominant frontal and temporal lobe and within the premotor cortex. Our analysis pipeline consistently yielded left language dominance with high laterality indices in controls. Cadaver organs should be automatically availableThe shortage of donor organs and tissue for transplantation constitutes an acute emergency which demands radical rethinking of our policies and radical measures. While estimates vary and are difficult to arrive at there is no doubt that the donor organ shortage costs literally hundreds of thousands of lives every year. “In the world as a whole there are an estimated 700 000 patients on dialysis . . .. In India alone 100 000 new patients present (...) with kidney failure each year” . Almost “three million Americans suffer from congestive heart failure . . . deaths related to this condition are estimated at 250 000 each year . . . 27 000 patients die annually from liver disease . . .. In Western Europe as a whole 40 000 patients await a kidney but only . . . 10 000 kidneys”1 become available. Nobody knows how many people fail to make it onto the waiting lists and fail to register in the statistics. “As of 24th November 2002 in the United Kingdom 667 people have donated organs, 2055 people have received transplants, and 5615 people are still awaiting transplants.”2Conscious of the terrible and unnecessary tragedy that figures like these represent I have been advocating for more than 20 years now some radical measures to stem this appalling waste of human life. The susceptible-transmissible-removed (STR) model is a deterministic compartment model, based on the susceptible-infected-removed (SIR) prototype. The STR replaces 2 SIR assumptions. SIR assumes that the emigration rate (due to death or recovery) is directly proportional to the infected compartment’s size. The STR replaces this assumption with the biologically appropriate assumption that the emigration rate is the same as the immigration rate one infected period ago. This results in a unique delay differential equation epidemic model with the delay equal to the (...) infected period. Hamer’s mass action law for epidemiology is modified to resemble its chemistry precursor—the law of mass action. Constructing the model for an isolated population that exists on a surface bounded by the extent of the population’s movements permits compartment density to replace compartment size. The STR reduces to a SIR model in a timescale that negates the delay—the transmissible timescale. This establishes that the SIR model applies to an isolated population in the disease’s transmissible timescale. Cyclical social interactions will define a rhythmic timescale. It is demonstrated that the geometric mean maps transmissible timescale properties to their rhythmic timescale equivalents. This mapping defines the hybrid incidence (HI). The model validation demonstrates that the HI-STR can be constructed directly from the disease’s transmission dynamics. This essay argues the image of the ‘Mystical Body’ or ‘Body of Christ’ is fully intelligible only in light of the Cross. The Body of Christ is a cruciform Body. As the Body of Christ crucified and risen, it is presently being configured to Christ in the world through self-sacrificial love. The essay traces the place of the Cross in some representative twentieth-century Catholic theologies of the Mystical Body, in light of the perspective of Thomas Aquinas. I first survey four (...) theologians from the first half of the century who, in their understandings of the Mystical Body, gave a place to the Cross: Emile Mersch, Fulton Sheen, Charles Journet, and Pius Pasch. Here I also examine Pope Pius XII's encyclical Mystici Corporis. Second, I explore the approach of some notable Thomistic theologians or interpreters of Aquinas from the early 1960s onward: Jerome Hamer, M. J. Le Guillou, George Sabra, Jean-Pierre Torrell, and Herwi Rikhof. In this section, I also examine Vatican II's Lumen Gentium. My third and final section treats Aquinas himself, in order to reflect upon the place of the Cross in his understanding of the Mystical Body, as found in his biblical commentaries and the Summa theologiae. Nonviolent movements have become a new form of human agency. Between 1900 and 2006, more than 100 such movements appeared, and more than half were successful in dissolving oppression or achieving people's rights. Movements self-organize to summon mass participation, develop cognitive unity in the midst of dissension, and build resilient force on the content of shared beliefs. Some movements may even be a new venue for consciousness that "grows to something of great constancy" as Shakespeare said about "minds transfigured so (...) together."
