A stronger policy of organ retrieval from cadaveric donors: some ethical considerations.C. L. Hamer - 2003 - Journal of Medical Ethics 29 (3):196-200.
Taking organs from dead people seems, prima facie, to raise fewer ethical complications than taking organs from other sources. There are, however, serious ethical problems in taking organs from the dead unless there is premortem evidence that this is what the deceased would have wanted, or at least, not have objected to. In this paper we will look at a “strong” opting out policy as proposed by John Harris. We will argue that people can be harmed after their death and (...)

    Reassessing the molecular biology of sperm–egg recognition with mouse genetics.Jurrien Dean - 2004 - Bioessays 26 (1):29-38.
The zona pellucida is an extracellular coat that surrounds mammalian eggs and early embryos. This insoluble matrix separates germ from somatic cells during folliculogenesis and plays critical roles during fertilization and early development. The mouse and human zona pellucida contain three glycoproteins (ZP1 or ZPB, ZP2, ZP3), the primary structures of which have been deduced by molecular cloning. Targeted mutagenesis of endogenous mouse genes and transgenesis with human homologues provide models to investigate the roles of individual zona components. Collectively, the (...)

Designing Student Reflections to Enable Transformative Learning Experiences.Michael Flierl & Russ Hamer - 2019 - Teaching Philosophy 42 (2):87-106.
Many philosophy instructors want their students to change the way they think about and act in the world. Reflection can be one way to bring this about, yet it is common for student reflections to fail to enable this desired transformative learning experience. Our research investigated how instructors can design better reflective assignments to cultivate a more transformative learning experience for students. Using thematic analysis, a qualitative research method, we analyzed student reflection data to identify themes and patterns of student (...)

A Dynamic Reconstruction of the Presumption of Innocence.David Hamer - 2011 - Oxford Journal of Legal Studies 31 (2):417-435.
The criminal defendant is presumed innocent and his guilt must be proved beyond reasonable doubt for conviction. On some issues, however, the defendant must prove his innocence on the balance of probabilities to avoid conviction. Commentators have despaired of reconciling reverse burdens with the presumption in a principled way. Andrew Stumer has made a fresh attempt; however, his solution is overly rigid and rule bound. The presumption is engaged in a dynamic enterprise—minimizing the expected cost of error, mistaken acquittals as (...)

Caregiver decision-making concerning involuntary treatment in dementia care at home.Vincent R. A. Moermans, Angela M. H. J. Mengelers, Michel H. C. Bleijlevens, Hilde Verbeek, Bernadette Dierckx de Casterle, Koen Milisen, Elizabeth Capezuti & Jan P. H. Hamers - 2022 - Nursing Ethics 29 (2):330-343.
Background: Dementia care at home often involves decisions in which the caregiver must weigh safety concerns with respect for autonomy. These dilemmas can lead to situations where caregivers provide care against the will of persons living with dementia, referred to as involuntary treatment. To prevent this, insight is needed into how family caregivers of persons living with dementia deal with care situations that can lead to involuntary treatment. Objective: To identify and describe family caregivers’ experiences regarding care decisions for situations (...)

  14. A Critique of Humoristic Absurdism. Problematizing the legitimacy of a humoristic disposition toward the Absurd.Thom Hamer - 2020 - Utrecht: Utrecht University.
To what extent can humorism be a legitimate disposition toward the Absurd? The Absurd is born from the insurmountable contradiction between one’s ceaseless striving and the absence of an ultimate resolution – or, as I prefer to call it, the ‘dissolution of resolution’. Humoristic Absurdism is the commitment to a pattern of humorous responses to the Absurd, which regard this absurd condition, as well as its manifestation in absurd situations, as a comical phenomenon. Although the humoristic disposition seems promising, by (...)

    Meaning Things in Words.Colin Hamer - 1970 - Philosophical Studies (Dublin) 19:5-10.
THE MEANING of a word is in the letters not like fruit in a dish but more like one’s reflection in a mirror. Just as a man sees himself by looking in the mirror rather than at it, so he enjoys insight into possible routes by inspecting the map instead of just glancing at it, and he understands meaning in signs and images. In our experience of living there is the problem of bringing order out of chaos, of taking the (...)

The Parable As Mirror: An Examination of the Use of Parables in the Works of Kierkegaard.Russell Hamer - unknown
This dissertation focuses on an exploration of the use of parables in the works of Soren Kierkegaard. While some work has been done on Kierkegaard’s poetic style, very little attention has been paid to his metaphors, despite their prevalent use in his works. Much of the scholarship instead treats his parables as mere examples of philosophical concepts. In this work, I argue that Kierkegaard’s parables function primarily to cause the reader to see him or herself truly. The parables work like (...)

This chapter explores the ethics of Robert Daly's actions in the episode “USS Callister”. We consider issues of privacy that relate to him stealing his co‐workers DNA in order to scan them into the game, as well as the ethics of how he treats the digital avatars of his co‐workers within the game. Examining Daly's actions from a few different approaches, we argue that Daly's actions towards his co‐workers avatars are very likely immoral, though ultimately we cannot know without knowing (...)

Understanding Kierkegaard's parables.Russell Hamer - 2021 - Jefferson, North Carolina: McFarland & Company, Inc., Publishers.
Kierkegaard is often praised for his poetic writing style. Throughout his works, especially his pseudonymous ones, he often breaks from philosophical prose and instead uses extended metaphors, fairy tales, parables, and allegories. This book, which is the first that directly addresses Kierkegaard's parables, argues that they help the reader undergo transformative change. It asks why Kierkegaard uses parables in a broad sense, how they function as a form of indirect communication, why Kierkegaard must remain secretive about the purpose of the (...)

Common sense assures me I am free and responsible for my actions, but on the other hand it is admitted that my way of acting is determined by temperament, heredity and environmental conditioning. Is man an autonomous centre of consciousness expressing himself in feeling-revealing behaviour, or is ‘man’ a short-hand expression for a bundle of heterogeneous phenomena? Ryle believes that the conceptual geography of ‘I’, ‘you’ and ‘he’ is not yet satisfactorily established. But in his view such mental perplexities are (...)

This article reviews contemporary response to several contrasting strands of recent empirical work. It begins with discussing the scope and rationale of evidence law. Experimental studies on eyewitness memory and testimony illustrate the potential value of empirical studies to the practice of investigations, prosecutions, and appeals. This article discusses several lines of empirical inquiry employing diverse methodologies, experiments, surveys, and approaches and reviews their limitations, and implications and significance for the understanding and practice of law. Many of the contributions from (...)

Population monotonic path schemes for simple games.Barış Çiftçi, Peter Borm & Herbert Hamers - 2010 - Theory and Decision 69 (2):205-218.
A path scheme for a game is composed of a path, i.e., a sequence of coalitions that is formed during the coalition formation process and a scheme, i.e., a payoff vector for each coalition in the path. A path scheme is called population monotonic if a player’s payoff does not decrease as the path coalition grows. In this study, we focus on Shapley path schemes of simple games in which for every path coalition the Shapley value of the associated subgame (...)

How germline genes promote malignancy in cancer cells.Jan Willem Bruggeman, Jan Koster, Ans M. M. van Pelt, Dave Speijer & Geert Hamer - 2023 - Bioessays 45 (1):2200112.
Cancers often express hundreds of genes otherwise specific to germ cells, the germline/cancer (GC) genes. Here, we present and discuss the hypothesis that activation of a “germline program” promotes cancer cell malignancy. We do so by proposing four hallmark processes of the germline: meiosis, epigenetic plasticity, migration, and metabolic plasticity. Together, these hallmarks enable replicative immortality of germ cells as well as cancer cells. Especially meiotic genes are frequently expressed in cancer, implying that genes unique to meiosis may play a (...)

The susceptible-transmissible-removed (STR) model is a deterministic compartment model, based on the susceptible-infected-removed (SIR) prototype. The STR replaces 2 SIR assumptions. SIR assumes that the emigration rate (due to death or recovery) is directly proportional to the infected compartment’s size. The STR replaces this assumption with the biologically appropriate assumption that the emigration rate is the same as the immigration rate one infected period ago. This results in a unique delay differential equation epidemic model with the delay equal to the (...)

This essay argues the image of the ‘Mystical Body’ or ‘Body of Christ’ is fully intelligible only in light of the Cross. The Body of Christ is a cruciform Body. As the Body of Christ crucified and risen, it is presently being configured to Christ in the world through self-sacrificial love. The essay traces the place of the Cross in some representative twentieth-century Catholic theologies of the Mystical Body, in light of the perspective of Thomas Aquinas. I first survey four (...)

Nonviolent movements have become a new form of human agency. Between 1900 and 2006, more than 100 such movements appeared, and more than half were successful in dissolving oppression or achieving people's rights. Movements self-organize to summon mass participation, develop cognitive unity in the midst of dissension, and build resilient force on the content of shared beliefs. Some movements may even be a new venue for consciousness that "grows to something of great constancy" as Shakespeare said about "minds transfigured so (...)
