Intangible cultural heritage is an invaluable treasure for human being and China is a country endowed with rich ICH. Among all the measures of safeguarding ICH, intellectual property tools are effective while controversial. As China started relatively late in the legal protection of ICH, the gap between legislation and judiciary needs to be filled in. This study examines the IP protection of ICH in China based on the current laws and regulations and then provides a semiotic approach to the relevant (...) legal evolution in China. This study, taking in some experiences outside China, goes further to provide recommendations for improving the IP protection in China. (shrink)

Offers the first focused study of the shifei debates of the Warring States period in ancient China and challenges the imposition of Western conceptual categories onto these debates. In recent decades, a growing concern in studies in Chinese intellectual history is that Chinese classics have been forced into systems of classification prevalent in Western philosophy and thus imperceptibly transformed into examples that echo Western philosophy. Lin Ma and Jaap van Brakel offer a methodology to counter this approach, and illustrate their (...) method by carrying out a transcultural inquiry into the complexities involved in understanding shi and fei and their cognate phrases in the Warring States texts, the Zhuangzi in particular. The authors discuss important features of Zhuangzi’s stance with regard to language-meaning, knowledge-doubt, questioning, equalizing, and his well-known deconstruction of the discourse in ancient China on shifei. Ma and van Brakel suggest that shi and fei apply to both descriptive and prescriptive languages and do not presuppose any fact/value dichotomy, and thus cannot be translated as either true/false or right/wrong. Instead, shi and feican be grasped in terms of a pre-philosophical notion of fitting. Ma and van Brakel also highlight Zhuangzi’s idea of “walking-two-roads” as the most significant component of his stance. In addition, they argue that all of Zhuangzi’s positive recommendations are presented in a language whose meaning is not fixed and that every stance he is committed to remains subject to fundamental questioning as a way of life. We estimate that 208,000 deep brain stimulation (DBS) devices have been implanted to address neurological and neuropsychiatric disorders worldwide. DBS Think Tank presenters pooled data and determined that DBS expanded in its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. The DBS Think Tank was founded in 2012 providing a space where clinicians, engineers, researchers from industry and academia discuss current and emerging DBS technologies and logistical and ethical issues facing the field. (...) The emphasis is on cutting edge research and collaboration aimed to advance the DBS field. The Eighth Annual DBS Think Tank was held virtually on September 1 and 2, 2020 (Zoom Video Communications) due to restrictions related to the COVID-19 pandemic. The meeting focused on advances in: (1) optogenetics as a tool for comprehending neurobiology of diseases and on optogenetically-inspired DBS, (2) cutting edge of emerging DBS technologies, (3) ethical issues affecting DBS research and access to care, (4) neuromodulatory approaches for depression, (5) advancing novel hardware, software and imaging methodologies, (6) use of neurophysiological signals in adaptive neurostimulation, and (7) use of more advanced technologies to improve DBS clinical outcomes. There were 178 attendees who participated in a DBS Think Tank survey, which revealed the expansion of DBS into several indications such as obesity, post-traumatic stress disorder, addiction and Alzheimer’s disease. Since March 14, 2020, Spanish citizens have been confined to their homes due to the impact of the COVID-19 pandemic. Participating in musical activities has been associated with reduced anxiety and increased subjective wellbeing. The aim of this study is to analyze how Spanish citizens used music during the lockdown period. We also study perceptions of the impact music has in everyday life, in particular examining the respondents’ insights into the effects of listening to music in situations of isolation. The (...) study was conducted using the MUSIVID19 questionnaire administered to a total of 1868 Spanish citizens. The results indicate that during lockdown, respondents perceived an increase in the time they devoted to musical activities such as listening, singing, dancing or playing an instrument. The participants also reported using music to cope with the lockdown, finding that it helped them to relax, escape, raise their mood or keep them company. The findings suggest an improvement in their perception of the value of music in personal and social wellbeing during the lockdown. However, the study reveals significant differences in the use and perceptions of music according to respondents’ personal situations. Age and feelings of vulnerability may lead to more conservative uses of musical practice and to more moderate perceptions of the positive values of music. (shrink)

The Global Financial Crisis of 2007–2009 exacerbated two distinct concerns about the independence of central banks: a concern about legitimacy and a concern about economic justice. This paper explores the legitimacy of independent central banks from the perspective of these two concerns, by presenting two distinct models of central banking and their different claims to political legitimacy and distributive justice. I argue primarily that we should avoid construing central bank independence in binary terms, such that central banks either are, or (...) are not, independent. I will argue that we should instead construe central bank independence in scalar terms, so that independence admits of degree, thus allowing us to develop an account of independence in which central banks can retain it to the extent necessary for economic efficiency, while meeting reasonable concerns regarding democratic legitimacy and economic justice. Image similarity metric, also known as metric learning in computer vision, is a significant step in various advanced image tasks. Nevertheless, existing well-performing approaches for image similarity measurement only focus on the image itself without utilizing the information of other modalities, while pictures always appear with the described text. Furthermore, those methods need human supervision, yet most images are unlabeled in the real world. Considering the above problems comprehensively, we present a novel visual similarity metric model named PTF-SimCM. It adopts (...) a self-supervised contrastive structure like SimSiam and incorporates a multimodal fusion module to utilize textual modality correlated to the image. We apply a cross-modal model for text modality rather than a standard unimodal text encoder to improve late fusion productivity. In addition, the proposed model employs Sentence PIE-Net to solve the issue caused by polysemous sentences. For simplicity and efficiency, our model learns a specific embedding space where distances directly correspond to the similarity. Experimental results on MSCOCO, Flickr 30k, and Pascal Sentence datasets show that our model overall outperforms all the compared methods in this work, which illustrates that the model can effectively address the issues faced and enhance the performances on unsupervised visual similarity measuring relatively. Auf makropolitischer Ebene gilt das besondere Interesse dem Entstehen und Vergehen von Staaten, entscheiden sich doch hiermit existenzielle Fragen des Seins einer politischen Gemeinschaft. Auf mikropolitischer Ebene geht es um die Frage, inwieweit dem Bürger "aufgegeben" ist, sich in Gesellschaft und Staat zu integrieren. Supranationalisierung und Globalisierung lassen die Kraft des Nationalstaates schwinden. Dem Übergang der Moderne in die Postmoderne entspricht der Übergang von der Welt der Staaten mit ihren durch Grenzen (...) abgeschlossenen Territorien zur Welt der Kontinente, Gemeinschaften und Netzwerke. Doch gibt es viele Stimmen, die meinen, der Staat sei auf absehbare Zeit nicht wegzudenken und als politische Gemeinschaft zu schützen.Werner Mäder ist anderer Auffassung: "Deutschland ist kein Staat mehr..." lautet sein Befund. Der Autor zieht Parallelen zu Hegels Schrift "Kritik der Verfassung Deutschlands" aus dem Jahre 1801 und seinen Kriterien des Staates. Nach Mäder ist das Grundgesetz nur noch eine "Gedankenverfassung", seine fundamentalen Voraussetzungen Staat, Souveränität, Nation, Volk und Demokratie substanziell ausgezehrt. Für Europa bedeutet dies, sich mit eigener Identität selbst zu behaupten, um den Souveränitätsverlust seiner Länder auszugleichen und auf eine neue Multipolarität der internationalen Beziehungen hinzuarbeiten. Oft hielt man sie für einen als Wissenschaft verkleideten Entwurf einer idealen Zukunftsgesellschaft, für eine Heilslehre. Umso erstaunlicher ist es daher, dass eine gründliche Erforschung des Marxschen Fortschrittsdenkens bislang noch aussteht. Denis Mäders Studie analysiert das moderne Fortschrittsdenken und die zeitgenössische Diskussion desselben. Vor diesem (...) Hintergrund rekonstruiert sie die Entstehung eines originären Fortschrittsbegriffs, den Marx in kritischer Auseinandersetzung mit seinem philosophischen Milieu (vor allem mit Hegel, den Hegelianern und Proudhon) gewinnt. Fortschritt ist die historische Bewegung des Guten. Zugleich aber gibt es für den Dialektiker Marx ohne Gegensatz keinen historischen Fortschritt. Building on the discussion between Stephen Darwall and Michael Tomassello, we propose an alternative evolutionary account of moral motivation in its two-pronged dimension. We argue that an evolutionary account of moral motivation must account for the two forms of moral motivation that we distinguish: motivation to be partial, which is triggered by the affective relationships we develop with others; and motivation to be impartial, which is triggered by those norms to which we give impartial validity. To that aim, we present (...) the second-person standpoint of morality, first as Darwall conceives of it, and then as we reinterpret it from a naturalistic approach. Then we synthesize Tomasello’s evolutionary account of morality, and Darwall’s objections to it. To reply to those objections, building on Tomasello’s proposal, we argue that the motivation to be impartial, and the feeling of obligation to comply with normative requirements, appeared when humans anticipated and, critically, internalized others’ sanctions to the violation of social norms. Consequently, we posit that social norms and sanctions appeared first at the community level, and only after that were they internalized in the form of self-directed reactive attitudes. Finally, we derive some corollaries that follow from our proposal. (shrink)
