Essays discuss reason and understanding, interpretation, language, meaning, the human sciences, social sciences, and general hermeneutic theory.

I discuss the knowledge account of legal proof in Moss (2023) and develop an alternative. The unifying thread throughout this article are reflections on the beyond reasonable doubt (BRD) standard of proof. In Section 1, I will introduce the details of Moss’s account and how she motivates it via the BRD standard. In Section 2, I will argue that there are important disanalogies between BRD and knowledge that undermine Moss’s argument. There is however another motivation for the knowledge account: combined (...) with auxiliary claims, that is probabilistic knowledge and moral encroachment, it can provide a general solution to the puzzle of statistical evidence. Section 3 spells out the details. In Section 4, I suggest to combine the knowledge account with pragmatic encroachment, instead of moral encroachment, in order to stay clear of the thorny issues whether corporations have moral rights. In Section 5, I argue that the verdicts of Moss’s account in cases of false justified beliefs and non-luminous knowledge conflict with the BRD standard and thus call for abandoning the account. Based on the social function of the BRD standard, I suggest a replacement for the knowledge account that is also just as potent as a general solution for the puzzle of statistical evidence. While I will grant that knowledge is neither always necessary nor always sufficient for convictions, I will argue that the concept of knowledge nonetheless plays a significant and ineliminable role in legal decision-making. The present paper considers controversial utterances that were erroneously taken as derogatory. These examples are puzzling because, despite the audiences’ error, many speakers retract and even apologise for what they didn’t say and didn’t do. In recent years, intuitions about retractions have been used to test semantic theories. The cases discussed here test the predictive power of theories of derogatory language and help us better understand what is required to retract a slur. The paper seeks to answer three questions: are (...) the cases considered genuine retractions? If the speakers didn’t derogate by using a slur, how are the cases retractions of derogatory acts? Do these examples support expressive accounts of slurs? I argue that the examples provide evidence for an expressivist account of slurs: a slurring utterance (defeasibly) makes a derogatory speech act where the speaker expresses a commitment to a morally questionable appraisal state, such as disgust or contempt for a target group. A retraction of a derogatory speech act requires undoing the enactment of that commitment, which can be achieved with a genuine apology. This helps explain the conduct of audiences who misunderstand what the speaker says, and the speakers’ reactions. -/- . (shrink)

P.After some 30 years of incisive intervention in Platonic scholarship, Holger Thesleff here offers us "an attempt to elaborate and ground more firmly some basic theses which I have propounded in various contexts before," (1) a rather modest description of what he also describes as an (...) attempt to contribute toward "a more general agreement on how to read and interpret Plato" (5). The richness of this book makes it impossible to describe in any detail, and I shall content myself with indicating some of what I take to be its principal points of view.Thesleff"s concern for agreement arises from his perception of the vastly discrepant schools of Plato interpretation, of which the most important for him might be labeled esotericist, analytic, and "literary." The last, which can hardly be called a school at all, includes a variety of scholars who downplay "literal" interpretation and emphasize such things as "dramatic artistry, the structure of the dialogues, the characterization of settings and persons, shifts of style, allusions, play, and irony" (3). Thesleff's sympathies clearly lie with these people, perhaps to an extent which, as I shall suggest, will limit the effectiveness of his attempt to move toward a consensus.As the title indicates Thesleff builds his reading around what he calls Plato's two-level model. This two-level model is not, as one might suppose, what has been called Plato's two worlds view, the belief in a world of pure being beyond the perceived world we inhabit. Indeed, it is not a doctrine or set of doctrines at all. Rather "it is an intuitive 'vision' which offers only crude basic patterns and frames for the structures of Plato's thinking, feelings, intuitions, and intentions, from his youth to his old age, and for our understanding of them" (123). Clearly one cannot expect a full and precise articulation of this vision. Thesleff proceeds by discussing in terms of their role in the earlier dialogues ten hierarchic pairs which form part of Plato's vision: divine/human, soul/body, leading/being led (particularly important in the conduct of a Socratic discussion), truth/appearance, knowledge/opinion, intellect/senses, defined/undefined, stability/change, one/many, same/different. These hierarchic or asymmetric pairs are contrasted by Thesleff with what he calls polar opposites like large/small and light/dark. He also stresses that the hierarchic pairs of Plato's two-level model involve no separation (chorismos), but rather a communion (koinônia).As the words "from his youth to his old age" in the quotation of the previous paragraph indicate, Thesleff is a "unitarian" in his approach to Plato. His Plato is not a philosopher whose positions changed through time as a result of reasoned argument. What many scholars take to be doctrines later given up, e.g., the view that learning is being reminded (anamnêsis), are "thought experiments," which are not followed up, thought experiments made within the context of the unchanging two-level vision.Although Thesleff is a unitarian in the sense I have indicated, he does believe that a kind of order of composition can be constructed for the dialogues. I say "kind of" because Thesleff's chronology involves assumptions of revisions over time, multiple authorship, and even dialogues "written down" by people other than Plato. The resulting chronology is complex, and I here only indicate it in rough form in a way which [End Page 272] brings out what I take to be its major points. Leaving out of account those Socratic" dialogues which Thesleff takes to be latish and the posthumously completed Laws, we can say that a series of late dialogues starts with the Parmenides and includes the Timaeus, Critias, Sophist, Politicus, and Philebus. All other dialogues, including the Theaetetus, were written prior to the Parmenides with the exception of the Republic, which Thesleff proposes is in its ultimate shape a late work, representing "only and purely Plato's 'own' and personal philosophy" (115). Civility is often treated as an essential virtue in liberal democracies that promise to protect diversity as well as active disagreement in the public sphere. Yet the fear that our tolerant society faces a crisis of incivility is gaining ground. Politicians and public intellectuals call for "more civility" as the solution--but is civility really a virtue? Or is it something more sinister--a covert demand for conformity that silences dissent? Mere Civility sheds light on this tension in contemporary political theory and (...) practice by examining similar appeals to civility in early modern debates about religious toleration. In seventeenth-century England, figures as different as Roger Williams, Thomas Hobbes, and John Locke could agree that some restraint on the wars of words and "persecution of the tongue" between sectarians would be required; and yet, they recognized that the prosecution of incivility was often difficult to distinguish from persecution.--. In History After Lacan, Teresa Brennan argues that Jacques Lacan was not an ahistorical post-structuralist. She tells the story of a social psychosis, beginning with a discussion of Lacan's neglected theory of history which argued that we are in the grip of a psychotic's era which began in the seventeenth century and climaxes in the present. By extending and elaborating on Lacan's theory, Brennan develops a general theory of modernity. Contrary to postmodern assumptions, she argues, we need a general (...) historical explanation. An understanding of historical dynamics is essential if we are to make the connections between the outstanding facts of modernity--ethnocentrism, the relation between the sexes, and ecological catastrophe. A challenging feminist, interdisciplinary study, History After Lacan will be essential reading for social, cultural, and political theorists, historians, psychoanalysts, and literary theorists. Both the diagnosis and medical treatment of gender dysphoria —particularly in children and adolescents—have been the subject of significant controversy in recent years. In this paper, we outline the means by which GD is diagnosed in children and adolescents, the currently available treatment options, and the bioethical issues these currently raise. In particular, we argue that the families and healthcare providers of children presenting with GD currently face two main ethical dilemmas in decision making regarding treatment: the pathway dilemma and (...) the consent dilemma. The idea that one can 'soak up' someone else's mood or sense the tension in a room is familiar - as in 'negative energy'. This ability to borrow or share states of mind is now pathologized, as the author shows in relation to affective transfer in psychiatric clinics.

This article argues that a particular metaphysical model permeates cultural practices surrounding pregnancy: the foetal container model. Widespread uncritical reliance on this view of pregnancy has been highly detrimental to women's liberty and reproductive autonomy. In this article, I extend existing critiques of the medical treatment of pregnant women to the context of the burgeoning commercial surrogacy industry. In doing so, I aim to show that our philosophical analysis in both spheres is constrained by the presupposition that the foetus and (...) pregnant woman are metaphysically and ethically distinct entities. By exploring the similarities and differences between the expectations placed on pregnant women in these two spheres, I show that the foetal container model is not a homogeneous understanding of pregnancy applied consistently across contexts; rather, it has been used to justify various practices and attitudes toward pregnancy and pregnant women through different moral frameworks, in the service of different overarching aims. ArgumentIn 1877, a young mathematician named Joseph Boussinesq presented amémoireto theAcadémiedes sciences which demonstrated that some differential equations may have more than one solution. Boussinesq linked this fact to indeterminism and to a possible solution to the free will versus determinism debate. Boussinesq's main interest was to reconcile his philosophical and religious views with science by showing that matter and motion do not suffice to explain all there is in the world. His argument received mixed criticism that addressed both his (...) philosophical views and the scientific content of his work, pointing to the physical “realisticness” of multiple solutions. While Boussinesq proved to be able to face the philosophical criticism, the scientific objections became a serious problem, thus slowly moving the focus of the debate from the philosophical plane to the scientific one. This change of perspective implied a wide discussion on topics such as instability, the sensitivity to initial conditions, and the conservation of energy. The Boussinesq debate is an example of a philosophically motivated debate that transforms into a scientific one, an example of the influence of philosophy on the development of science. (shrink)

The `riddle of femininity', like Freud's reference to women's sexuality as a `dark continent', has been treated as a romantic aside or a sexist evasion, rather than a problem to be solved. In this first comprehensive study, Teresa Brennan suggests that by placing these theories in the context of Freud's work overall, we will begin to understand why femininity was such a riddle for Freud.

This is a three paper dissertation. ;for paper 1. Quine held that quantifying into modal contexts is illegitimate. It is sometimes thought that if he is right about this, then essentialist claims make no sense. Perhaps as a consequence of this thought together with the current prominence of essentialist views, there have been two good fairly recent attacks on Quine's argument against quantifying into modal contexts: Neale's revival of Smullyan's points and Kaplan's paper "Opacity". I first argue that Quine's view (...) is not refuted by Neale or Kaplan. I next explain that nonetheless, essentialists need not surrender in the face of Quine's injunction against quantifying in. Quine's work does not rule out the intelligibility of essentialist theses; it does however issue a challenge to explain the mysterious notion of metaphysical necessity. ;Abstract for paper 2. I examine the case that has been made for origin essentialism and find it wanting. I focus on the arguments of Salmon and Forbes. Like most origin essentialists, they have been concerned to respect the intuition that slight variation in the origin of an artifact or organism is possible. But, I argue, both of their arguments fail to respect this intuition. Salmon's argument depends on a sufficiency principle for crossworld identity, which should be rejected, if---as Salmon concedes---a given artifact might have been originally made from slightly different material. Similarly, Forbes's argument succeeds only if essentially the same argument can be used to establish a claim that---by his own admission---is too strong, namely that no variation, however slight, in an organism's origin is possible. ;Abstract for paper 3. Chisholm's Paradox suggests that origin essentialism is incompatible with the view that some variation in the origin of a given thing is possible. Since the latter view is strongly supported by intuition, origin essentialists have been eager to offer solutions to the paradox. In this paper I look at three allegedly different solutions to the paradox: Forbes's, Salmon's, and Lewis's. I give new criticisms of Forbes's view and offer new defenses of what I call the "Salmon-Lewis solution". (shrink)

This paper presents reasons against semantic relativism. Semantic relativism is motivated by intuitions that are presumed to raise problems for traditional or contextualist semantics in contested domains of discourse. Intuition-based arguments are those based on competent speakers’ putative intuitions about seeming faultless disagreement, eavesdropper, and retraction cases. I will organize the discussion in three parts. First, I shall provide a brief introduction to the intuition-based arguments offered in favor of semantic relativism. Second, I shall indicate that there are ways for (...) contextualism to explain the (appearance of) intuitions that support semantic relativism. Ever since Mary Astell was introduced as the “First English Feminist” in 1986, scholars have been perplexed by her dual commitments to natural equality and social, political, and ecclesiastical hierarchy. But any supposed “paradox” in her thought is the product of a modernist conceit that treats equality and hierarchy as antonyms, assuming the former must be prior, normative, and hostile to the latter. Seeing this, two other crucial features of Astell’s thought emerge: her ethics of ascent and her psychology of (...) superiority. These, in turn, illuminate her lifelong fascination with ambition as a feminine virtue, as well as her curious embrace of Machiavelli. Astell’s politics and ethics are thus doubly worthy of recovery, both as the product of a singularly brilliant early modern mind and as a fascinating but forgotten vision of “equality before egalitarianism” that sheds light on the persistent complexities of equality and hierarchy to this day. Assisted reproduction often involves biological contributions by third parties such as egg/sperm donors, mitochondrial DNA donors, and surrogate mothers. However, these arrangements are also characterised by a biological relationship between the child and at least one intending parent. For example, one or both intending parents might use their own eggs/sperm in surrogacy, or an intending mother might conceive using donor sperm or gestate a donor embryo. What happens when this relationship is absent, as in the case of 'double‐donor surrogacy' arrangements (...) (DDS)? Here, a child is conceived using both donor eggs and sperm, carried by a surrogate, and raised by the commissioning parents. In this paper, I critically examine proposals to allow DDS in the United Kingdom, and the intentionalist justification for treating this practice distinctly (morally and legally speaking) from private adoption. I argue that the intentionalist approach cannot plausibly justify such a distinction and that other approaches to moral parenthood are also unlikely to succeed. (shrink)

The development of artificial intelligence (AI) in medicine raises fundamental ethical issues. As one example, AI systems in the field of mental health successfully detect signs of mental disorders, such as depression, by using data from social media. These AI depression detectors (AIDDs) identify users who are at risk of depression prior to any contact with the healthcare system. The article focuses on the ethical implications of AIDDs regarding affected users’ health-related autonomy. Firstly, it presents the (ethical) discussion of AI (...) in medicine and, specifically, in mental health. Secondly, two models of AIDDs using social media data and different usage scenarios are introduced. Thirdly, the concept of patient autonomy, according to Beauchamp and Childress, is critically discussed. Since this concept does not encompass the specific challenges linked with the digital context of AIDDs in social media sufficiently, the current analysis suggests, finally, an extended concept of health-related digital autonomy. Concepts stand at the centre of human cognition. We use concepts in categorizing objects and events in the world, in reasoning and action, and in social interaction. It is therefore not surprising that the study of concepts constitutes a central area of research in philosophy and psychology, yet only recently have the two disciplines developed greater interaction. Recent experiments in psychology that test the role of concepts in categorizing and reasoning have found a great deal of variation, across individuals and (...) cultures, in categorization behaviour. Meanwhile, philosophers of language and mind have investigated the semantic properties of concepts, and how concepts are related to linguistic meaning and linguistic communication. A key motivation behind this was the idea that concepts must be shared across individuals and cultures. With the dawn of experimental philosophy, the proposal that the experimental data from psychology lacks relevance to semantics is increasingly difficult to defend. -/- This volume brings together leading psychologists and philosophers to advance the interdisciplinary debate on the role of concepts in categorizing and reasoning, the relationship between concepts and linguistic meaning and communication, the challenges conceptual variation poses to communication, and the social and political effects of conceptual change. This paper analyzes the political promise of Rorty’s shift from atheism to anticlericalism in the last decade of his life. It seeks to deliver primarily a concise summary of this shift, and of its transformative motivation. Then a critique of this shift is followed by the suggestion of a friendly amendment: its extension towards a pragmatic pluralism. The outlined Rortyan conception of a serene, and, at the same (...) time robust, politics of religion is proposed as a promising answer to the question of how secular liberal citizens should react to the “return of the gods.”.
