  1. Must Legalistic Conceptions of the Rule of Law Have a Social Dimension?N. W. Barber - 2004 - Ratio Juris 17 (4):474-488.
The article considers the nature of legalistic, or formal, conceptions of the rule of law, focusing particularly on the work of Joseph Raz and Albert Venn Dicey. It asks how such apparently narrow conceptions are generated, and how far they can resist including broader social claims. It concludes that the rationale behind legalistic conceptions compels them to address issues of poverty and the literacy of the law's subjects. However, legalistic conceptions of the rule of law can still avoid sliding into (...)

Sovereignty re-examined: the courts, parliament, and statutes.N. Barber - 2000 - Oxford Journal of Legal Studies 20 (1):131-154.
In this article the relationship between Parliament and courts is examined. The views of writers on sovereignty are considered and criticized. Two criticisms of the sovereignty theorists are made: first, that they wrongly assume that a legal system must attribute supreme legal power to a single source and, second, that they wrongly assume that statutes in the English system constitute absolute exclusionary reasons for decision. It is contended that legal systems, can, and the English Constitution does, contain multiple unranked sources (...)

The use of informed consent for medication treatment in hospital: a qualitative study of the views of doctors and nurses.V. Wirtz, A. Cribb & N. Barber - 2007 - Clinical Ethics 2 (1):36-41.
The use of informed consent for surgery or research has been widely studied; however, its use in other areas of clinical practice has received less attention. This study investigates how doctors and nurses understand informed consent in relation to the prescription and administration of medicines in secondary care. It uses a qualitative analysis of semi-structured in-depth interviews with 19 doctors and 6 nurses recruited from various specialties in a teaching hospital. The results indicate a striking gap between official and actual (...)

The golden age of phenomenology at the New School for Social Research, 1954-1973.Lester Embree & Michael D. Barber (eds.) - 2017 - Athens: Ohio University Press.
This collection focuses on the introduction of phenomenology to the United States by the community of scholars who taught and studied at the New School for Social Research from 1954 through 1973. During those years, Dorion Cairns, Alfred Schutz, and Aron Gurwitsch--all former students of Edmund Husserl--came together in the department of philosophy to establish the first locus of phenomenology scholarship in the country. This founding trio was soon joined by three other prominent scholars in the field: Werner Marx, Thomas (...)

    The Sources of Diodorus Siculus XVI.N. G. L. Hammond - 1938 - Classical Quarterly 32 (3-4):137-151.
The sources of the Sicilian narrative have been recently investigated by Barber and Laqueur. The former has suggested a comparison of Plutarch's Lives of Dion and Timoleon with the narrative of Diodorus as an avenue of approach to the problem; such a comparison will be applied later in order to check the conclusions reached by a survey of Diodorus' narrative. The latter has exploited the argument from detail, a method which has already been criticized in Article I. Space will (...)

    A Critical Study of Logical Paradoxes. [REVIEW]G. N. T. - 1971 - Review of Metaphysics 25 (2):354-355.
This work is, in large part, a series of refutations; it is also the author's Ph.D. thesis. First to be refuted is Russell's vicious circle principle as a general remedy for the solution of the paradoxes. The author rejects the classification of paradoxes into syntactic and semantic, since in his view there are no purely syntactic paradoxes. The distinction in logic between the uninterpreted syntactical aspect of a system and the system when given a determinate interpretation is held to be (...)

The question to be discussed in this paper can be put in simple terms: at what date were the collections of scholia on classical Greek authors compiled? Scholars have given two conflicting answers. The first was put forward by J. W. White in his edition of the scholia to Aristophanes' Birds. Developing an opinion of Dindorf, he suggested that the archetype of the scholia was a large parchment codex of the fourth or fifth century, which contained in the margins a (...)
