He argues that it cannot deliver what it promises—and if it could, no one would want what it is selling.”—David Cole, _New York Review of Books__ Originalism, the view that the meaning of a constitutional provision is fixed when it is adopted, was once the fringe theory of a few extremely conservative legal scholars but is (...) now a well-accepted mode of constitutional interpretation. Three of the Supreme Court’s nine justices explicitly embrace the originalist approach, as do increasing numbers of judges in the lower courts. Noted legal scholar Erwin Chemerinsky gives a comprehensive analysis of the problems that make originalism unworkable as a method of constitutional interpretation. He argues that the framers themselves never intended constitutional interpretation to be inflexible and shows how it is often impossible to know what the “original intent” of any particular provision was. Perhaps worst of all, though its supporters tout it as a politically neutral and objective method, originalist interpretation tends to disappear when its results fail to conform to modern conservative ideology. The only certain thing is our death, but what good is the certainty of our death if it remains uncertain when it will come? We know our needs, but where are the limits to their fulfilment? When it has become uncertain who or what determines what actually happens, when the world oppresses us physically and emotionally and the only certainty in the future is our death, when our needs and the limits of their fulfilment have become unclear to us, then nothing helps more than reflection - reflection on our nature and its place in the world, thinking about the hierarchy of our needs, about how we can harmonise the success of our lives with reason and justice. BackgroundEnd-of-life decisions remain a hotly debated issue in many European countries and the acceptance in the general population can act as an important anchor point in these discussions. Previous studies on determinants of the acceptance of end-of-life interventions in the general population have not systematically assessed whether determinants differ between withdrawal of life-prolonging treatment and euthanasia.MethodsA large, representative survey of the Austrian adult population conducted in 2014 included items on WLPT and EUT. We constructed the following categorical outcome: rejection of (...) both WLPT and EUT, approval of WLPT but rejection of EUT, and approval of both WLPT and EUT. The influence of socio-demographics, personal experiences, and religious and socio-cultural orientations on the three levels of approval were assessed via multinomial logistic regression analysis.ResultsHigher education and stronger socio-cultural liberal orientations increased the likelihood of approving both WLPT and EUT; personal experience with end-of-life care increased only the likelihood of approval of WLPT; and religiosity decreased approval of EUT only.ConclusionThis study found evidence for both shared and different determinants for the acceptance of WLPT and EUT. ABSTRACT An ontological analysis of time and of serial order is offered within the framework of a comprehensive ontology wherein the category of facts plays a crucial role. It is applied to distinguish them while various ways and contexts in which both have been mixed up in past and in present philosophy are discussed. The good reasons for that mix-up and the astonishing difficulty of keeping them apart are considered. The focus is more on the ontology of order than on (...) the ontology of time. The latter is too wide a subject. It turns out that order has not really been grounded even in set theory. The ontology of serial order expounded is new. It is also needed for the adequate ontological analysis of relational facts. (shrink)

Today, there are many natural sciences, one of which is physics, but there is no science in the sense of a Theory of Nature. In our everyday life, the opinion is rightly held that there is only one nature, but whether this opinion stands up to reflection is questionable. When we apply the speculation that Aristotle developed in Metaphysics Λ to his Physics, we will see, that Aristotle has developed a Theory of Nature that consists in posing the question of (...) the being of the natural being (Frage nach dem Sein des Naturseienden). The standardinterpretation wants us to believe that Aristotle founded a substance metaphysics with a corresponding theology, and that he practised natural science. But, our hermeneutical situation could lead us to an "Aristotle today" and free us from old beliefs so that we, like Thomas Aquinas and others, could learn from a contemporary Aristotle as an immediate interlocutor. One of the learning points, for example, would be that questions are more crucial than new assertions, even if they are sophisticated, and that unassertive thinking (unbehauptendes Denken) in a topical attitude can lead us to insight into the multiplicity of worlds. This insight would have immediate consequences for our behaviour towards our co-inhabitants of our planet and towards our environment. (shrink)

Is reality the basis of everything or has reality itself an other basis? What makes reality – not the real things – to be active, to exist? The question of what is real seems to be an easy question, because in our daily lives we are and must be naive realists. We ourselves, the things around us, the world, the facts, all that is real. there must be several concepts of reality if we want to say that not only physical (...) or material things of everyday life are real, e. g. numbers, π, Dr. Faustus, thoughts, emotions and other things. On the other hand, given the difference of classical physics and modern physics, we see that even that form of knowledge, which seems to be most responsible for reality, natural science, cannot give the desired uniqueness in terms of what itself wants or needs to understand as real. Alternatively, when we see that nothing can be and nothing can be real without being in a world, and when we understand the world as the order of things, which I call worldI , then this leads us to the speculative answer that it is exactly the “unreal” worldI which is the reason why the everyday reality, worldI I , is real. The worldI is the basis for the reality of our empirical worldI I . The considerations presented here have nothing to do with the idealistic conception of possibility, founded in the power of the subject, nor with the existential concept of potentiality, founded in the Entwurf des Daseins. In this work, first published in two volumes in 1890 and 1894, Erwin Rohde, the German classical scholar and friend of Nietzsche, describes the ancient Greek cult of souls and establishes the sources of the belief in the immortality of the soul, exploring its relation to life both before and after death. This belief in the survival of the soul already existed in the earliest Greek writings, but when and from where did it originate? In Volume 1 Rohde examines (...) belief in the soul as it appears in Homeric poetry and within local cults, and finds that the idea of an afterlife is already represented in different forms in the works of Hesiod and Aeschylus. He also discusses burial rites and the Eleusinian Mysteries. Psyche, reissued here in the 1898 edition, remains a standard reference work on this topic. (shrink)

The aim of this article is to free Aristotle's Metaphysics, especially book XII (Lambda), frome some metaphysical and theological presuppositions by detecting their inappropriate conceptual framwork, which once was progressive, but now holds an obsolete position. Ousia, being (not substance, a much later concept, construed to solve other problems than Aristotle's), stand for a question, not for an answer. Book Lambda develops a highly speculative argument for this queston. The famous noesis noeseos says that empirical being and knowledge is the (...) realization of a noetic structure (noesis), laid down in our most fundamental opinioons about being. (shrink)

Clinical ethics consultation service remains undeveloped in developing countries. It is recognised that its introduction poses challenges. Malaysia, a multicultural society with diverse religions, values and perceptions further complicate the introduction of formal clinical ethics consultation service. Clinicians attending a national congress workshop completed a Strengths–Weaknesses–Opportunities–Threats analysis. The aim was to gain insight into clinician’s expectations and promote initiatives leading to the introduction of clinical ethics consultation service. Clinicians agree that clinical ethics consultation service can improve quality of care, reduce (...) healthcare costs and advocate for patients and providers. The analysis highlighted constraints in sufficient critical mass of relevant expertise and restricted opportunities for training. It is customary to draw a distinction between statements unconfirmable in practice and statements unconfirmable in principle. It may be impossible, for example, to confirm the statement “The star most distant from us in the universe has recently doubled in size,” but this impossibility is not of a logical kind. We could conceive of tests which would either confirm or disconfirm the statement, even if in fact we cannot carry them out. In contrast, the statement ‘Everything has recently doubled in (...) size’ cannot be confirmed for logical reasons, or so some philosophers have claimed. If everything were to double in size, including the very measuring rods used to detect expansions, it would be logically impossible, so the argument runs, to either confirm or disconfirm the above statement. Dem ersten Teil, der die Welt unter rein noetischen Voraussetzungen zeigt, entspricht Kants Werk Metaphysische Anfangsgründe der Naturwissenschaft. In (...) der Einleitung zum zweiten Teil des Dialogs führt Platon die Chora und einen neuen Typ von Grund ein. Dem entspricht im Opus postumum die Einführung des Äthers, der es erlaubt, von der Metaphysik zur Physik überzugehen, wie es die Chora erlaubt, von der rein noetischen zum empirischen Welt überzugehen. ************ If our factual experience must be based on something that is not itself experience, the question arises as to how the mediation of both areas comes about. Both Plato and Kant addressed this mediation, the former in the Timaeus, the latter in the Opus postumum. Plato’s dialogue is divided into two parts by two invocations to the gods, to which two of Kant’s works can be assigned in terms of content and function. The first part, which shows the world un- der noetic conditions, corresponds to Kant’s work Metaphysische Anfangsgründe der Naturwis- senschaft (Metaphysical Foundations of Natural Science), and in the introduction to the second part of the dialog Plato introduces the chora and a new type of reason. In the Opus postumum, this corresponds to the introduction of the ether, which makes it possible to move from metaphysics to physics, just as the chora makes it possible to move from the purely noetic to the empirical world. Bergmann advocated a universal realism different from that of Plato. His universals are different, and the fundamental tie connecting universals to particulars is also in many respects different from Plato's participation. Since Bergmann takes universals to be perceptible, it makes sense to argue empirically for the existence of the fundamental tie of exemplification. He holds that exemplification ties universals and particulars together into facts. However, finally he drops fundamental ties and attributes to diads of diversity the togetherness of universals and (...) particulars, though he is very reluctant to give up the principle that complexes need ties to give them unity.
