This article reappraises the dogmatic function, a social function related to biological and cultural reproduction and consequently to the reproduction of the industrial system itself. On the borderline of anthropology and of the history of law – applied to the West – this study takes a new look at the question raised by psychoanalysis concerning the role of law in modern human behaviour.

Ces Lecons X abordent le phenomene humain hors de la conception toute faite repandue par les doctrines de la transparence. Ici, il s'agit de considerer chaque civilisation et ses facades sociales a l'instar d'un Texte, comme montage langagier, et de reconnaitre la condition theatrale de l'espece douee de parole. Dans cette perspective se revelent les structures dogmatiques du sujet et de la societe qui, du fait du langage, s'entre-appartiennent. La rehabilitation d'une tradition de pensee portee par le terme antique de (...) dogma, transmis par la Grece a l'Occident jusqu'a l'ere industrielle, rouvre des chemins longtemps verrouilles et remet a l'ordre du jour la question immemoriale: que veut dire instituer l'animal humain? Au carrefour de ces chemins: la suprematie de la relation d'identite / alterite, avec ce qu'elle postule du cote du lien d'image, objet des grandes manoeuvres religieuses et politiques. Ainsi, prendre en compte la vie de la representation comme ressort de la fonction d'instituer entraine a interroger les procedures genealogiques d'acces a la realite, les systemes normatifs differencies et, du meme pas, a decouvrir la face cachee du principe de Raison. Sont mises au jour la fragilite humaine et les incertitudes de l'edification sociale. Les echafaudages inventes par l'anthropos pour la reproduction et la survie ne sont intelligibles que mis en rapport avec la dimension de l'Ancetre, autrement dit du Temps, cette vision des lointains, marqueur des civilisations: scenario fondateur, elaboration des attaches au present, horizon de l'inconnu a venir. Cette donnee basique donne relief aux domaines qui sont strategiques parce qu'ils touchent au destin des montages instituants a l'echelle de l'espece: religion, techno-science-economie, regles et preceptes du droit. A notre epoque de deraisonnement multiforme, ou les individus sont malmenes et guettes par la menace de perdre pied, il convient de porter le regard sur ces constructions de discours - poussees de facon recurrente au delire meurtrier, de nos jours sous des formes inedites - et sur leur portee structurale. Si la notion d'anthropologie, aujourd'hui figee et si galvaudee que j'hesitai a la reprendre, peut retrouver vigueur, ce sera au prix du depassement de l'impasse a laquelle a finalement abouti cette discipline: a quoi sert le penser? In his Leçons VII (Le désir politique de dieu) Pierre Legendre applies the idea or expression of ‘instituting time’ (‘instituer le temps’), that is, working with time as a malleable material, but at the same time conceptualising time as dogmatic time, especially in the interpretation of law. In lieu of an abstract, here is a brief excerpt of the content:The Commandment against the Law Writing and Divine Justice in Walter Benjamin’s “Critique of Violence”Tracy McNulty (bio)Pierre Legendre has shown that the Romano-canonical legal traditions that form the foundations of Western jurisprudence “are founded in a discourse which denies the essential quality of the relation of the body to writing” [“Masters of Law” 110]. It emerges historically as a repudiation of Jewish legalism and Talmud law, where (...) the rite of circumcision encodes the subject’s entry into law as an “allegiance to the absolute Writing,” or the “relationship between the human subject and the logical place of the Other” [110–11; see also “les juifs”]. In this shift, one understanding of writing is displaced by another: the material inscription of the letter, as an incommunicable limit or cut, is supplanted by the fantasy of what Legendre calls a “living writing,” a writing “in the heart” that promotes an ideal of perfect communication in which nothing is lost, in which meaning is lodged in an absolute Other who guarantees all knowledge. In his words, “we belong to a culture in which a mystically alienated human body stands in the place of the absolute book. The state has emerged from this structure.... Its basic characteristics can be set out by means of a fundamental Romano-pontifical maxim: the Emperor carries all the archives in his breast (omnia scrinia habet in pectore suo)” [“Masters of Law” 109].The ultimate theological source of this Roman maxim is Paul’s polemic against the Jewish law in the Epistle to the Romans. Paul’s polemic is structured by a distinction between two orders of law: the “law of God” and the “law of sin.” The first is associated with the intelligible “spirit” of the law, which is “written in the heart,” the second with the prescriptive “letter” of the Jewish law, which compromises or corrupts the first by binding it to a particular representation and consigning it to written form. Paul’s solution is to bypass the law, to bypass representation, and perhaps even language itself. The prescriptive “letter” of the Jewish law must be sublated by the law of the spirit, such that “we serve not under the old written code but in the new life of the Spirit” [Romans 7: 6]. Christ, as the living embodiment of the law of God, upholds the spirit of the law by “fulfilling”––and so rendering obsolete–its written form.The doctrine of Christ as the “living law” sustains what Legendre describes as a “banalisation of writing” [“Masters of Law” 111], a disregard for its material inscription that holds the letter to be nothing more than a placeholder, a flawed or incomplete representation of a meaning or truth that is itself beyond words. Engaging with modern political discussions such as black lives matter and Roe v Wade, Richards draws from jurists such as Pierre Legendre, Yan Thomas, and philosophers such as Agamben, Arendt, Esposito to explore how the same institutions that offer rights protection can easily and without much notice, take them away.

Italian Abstract: Per giustificare l’autorità e la validità della scienza economica, gli economisti sono spesso ricorsi all’argomento che le leggi e i postulati di questo sapere sono verità scientifiche, nel senso di verità empiriche, logiche o autoevidenti. Tuttavia, questo discorso, in quanto discorso legittimante o discorso sull 'importanza' della scienza economica, sembra contraddire una siffatta argomentazione giacché non statuisce né verità empiriche né verità logiche, e tanto meno verità autoevidenti. A quale tipo di verità, allora, fa riferimento la predica della (...) scienza economica? Perché la scienza economica, in quanto sapere, viene predicata come una ‘legge’ a cui bisognerebbe obbedire? Esiste un legame storico e teoretico tra la struttura giuridico-politica della legittimità e la predica, la retorica e/o il discorso della scienza economia nella sfera pubblica? In che senso un sapere è un 'istituzione'? -/- In questo articolo esamino il ‘caso Einaudi’ come exemplum dei discorsi sulla scienza economica fatti dagli economisti nella sfera pubblica. However, this discourse, as a legitimating discourse, or as a discourse on the ‘significance’ of the economic science, seems to contradict such a claim since it does not assert either empirical, logical or self-evident truths. To what type of truth, then, does the preaching of the economic science refer? Why is the economic science, as a savoir, preached as a ‘law’ to which one should obey? Is there an historical and theoretical nexus between the legal-political structure of the legitimacy and the preaching, rhetoric or discourse of the economic science? What does it mean that a savoir is an ‘institution’? -/- In this article I examine the ‘Einaudi case’ as an exemplum of the discourses on the economic science done by economists in the public sphere. Analysing Einaudi’s preaching and epistemological speculation and comparing it with that of Pareto, Robbins, Weber and Schumpeter, I will show how from the background of well known dichotomies – such as positive/normative, fact/values, to be/ought to be, analysis/vision – the epistemological-anthropological opposition between Reason and passions emerges. This opposition is often assimilated to another long-lasting antithesis: that between Reason and faith. Moving from the perspective of Pierre Legendre’s «dogmatic anthropology», and by an apparently paradoxical reversal of the juridical and theological concepts of Einaudi’s discourse, I will try to formulate a notion of normativity of economic science, which is also applicable to other sciences, in view of an overcoming of the (false) opposition between Reason and passions. Wrestling with the Angel is a meditation on contemporary political, legal, and social theory from a psychoanalytic perspective. It argues for the enabling function of formal and symbolic constraints in sustaining desire as a source of creativity, innovation, and social change. The book begins by calling for a richer understanding of the psychoanalytic concept of the symbolic and the resources it might offer for an examination of the social link and the political sphere. The symbolic is a crucial dimension of (...) social coexistence but cannot be reduced to the social norms, rules, and practices with which it is so often collapsed. As a dimension of human life that is introduced by language--and thus inescapably "other" with respect to the laws of nature--the symbolic is an undeniable fact of human existence. Yet the same cannot be said of the forms and practices that represent and sustain it. In designating these laws, structures, and practices as "fictions," Jacques Lacan makes clear that the symbolic is a dimension of social life that has to be created and maintained and that can also be displaced, eradicated, or rendered dysfunctional. The symbolic fictions that structure and support the social tie are therefore historicizable, emerging at specific times and in particular contexts and losing their efficacy when circumstances change. They are also fragile and ephemeral, needing to be renewed and reinvented if they are not to become outmoded or ridiculous. Therefore the aim of this study is not to call for a return to traditional symbolic laws but to reflect on the relationship between the symbolic in its most elementary or structural form and the function of constraints and limits. McNulty analyzes examples of "experimental" (as opposed to "normative") articulations of the symbolic and their creative use of formal limits and constraints not as mere prohibitions or rules but as "enabling constraints" that favor the exercise of freedom. The first part examines practices that conceive of subjective freedom as enabled by the struggle with constraints or limits, from the transference that structures the "minimal social link" of psychoanalysis to constrained relationships between two or more people in the context of political and social movements. Examples discussed range from the spiritual practices and social legacies of Moses, Jesus, and Teresa of Avila to the political philosophy of Hannah Arendt and Jacques Rancière. The second part is devoted to legal and political debates surrounding the function of the written law. It isolates the law's function as a symbolic limit or constraint as distinct from its content and representational character. The analysis draws on Mosaic law traditions, the political theology of Paul, and twentieth-century treatments of written law in the work of Carl Schmitt, Walter Benjamin, Sigmund Freud, Pierre Legendre, and Alain Badiou. In conclusion, the study considers the relationship between will and constraint in Kant's aesthetic philosophy and in the experimental literary works of the collective Oulipo. (shrink)

How « the Father » became the cause of the pathologies affecting the family. When, in the 1960s, fathers lost their control over procreation and their control over women and children, some cracks started to appear in the edifice of patriarchal domination. There followed a reaction in which all the disorders today troubling the order of the family came to be traced back to this eclipse of the father figure. From this there emerged a veritable « State psychological apparatus » (...) whose aim was the sanctification of the traditional domestic functions : the father as the figure of authority, the mother as carer. Indifferent to its social and historical dimensions, Oedipus assumed the status of a, presumably universal, « symbolic order », dominated by the father and master. MT here calls into question the entire conceptual order of Lévi-Strauss and Lacan : the idea that the foundation of power and reason is naturally a masculine prerogative. Above all else, the article calls into question the interpretation put forward by Pierre Legendre, which assigns to a (patriarchal) juridical order the task of structuring the psyche. (shrink)

David Gray Carlson and Peter Goodrich argue that the postmodern legal mind can be characterized as having shifted the focus of legal analysis away from the modernist understanding of law as a system that is unitary and separate from other aspects of culture and society. In exploring the various "other dimensions" of law, scholars have developed alternative species of legal analysis and recognized the existence of different forms of law. Carlson and Goodrich assert that the postmodern legal mind introduced a (...) series of "minor jurisprudences" or partial forms of legal knowledge, which both compete with and subvert the modernist conception of a unitary system of law. In doing so scholars from a variety of disciplines pursue the implications of applying the insights of their disciplines to law. Carlson and Goodrich have assembled in this volume essays from some of our leading thinkers that address what is arguably one of the most fundamental of interdisciplinary encounters, that of psychoanalysis and law. While psychoanalytic interpretations of law are by no means a novelty within common law jurisprudence, the extent and possibilities of the terrain opened up by psychoanalysis have yet to be extensively addressed. The intentional subject and "reasonable man" of law are disassembled in psychoanalysis to reveal a chaotic and irrational libidinal subject, a sexual being, a body and its drives. The focus of the present collection of essays is upon desire as an inner law, upon love as an interior idiom of legality, and represents a signficant and at times surprising development of the psychoanalytic analysis of legality. These essays should appeal to scholars in law and in psychology. Pierre Legendre. Entendiendo que es allí en la tensión misma entre lo dicho, lo ausente y lo im-puesto donde se inscribe la posibilidad misma de la acción. Mientras que Kristeva aborda la pregunta por la transformación a partir de una crítica vuelta sobre la semiótica misma, Spivak inscribe una teoría del cambio en el marco de una relectura semiótica de la subalternidad. Dans Parcours de la reconnaissance, « se reconnaître dans le lignage » est conçu comme la première expérience de reconnaissance de soi paisible. Traitant de filiation, Ricoeur cite deux auteurs peu compatibles entre eux : Françoise Héritier et Pierre Legendre. Cet article élucide ce passage, montrant que ce double appel est motivé chez Ricoeur par un souci de voir l’« ordre des places » filiales rester intact. La référence à Héritier exprime un féminisme en germe chez Ricoeur, différencialiste, (...) plaidant pour un binarisme des sexes sans hiérarchie. Quant à la référence à Legendre, elle sert de propédeutique à la phénoménologie ricoeurienne du don « sans prix », mais dénote aussi l’appréhension de Ricoeur quant à certaines demandes contemporaines de reconnaissance. Dans le parcours ricoeurien de la reconnaissance-identité, où « se reconnaître dans le lignage » paraît essentiel, trouve-t-on la place pour des personnes intersexuées, transsexuelles, transgenres ou issues de familles monoparentales, homoparentales, alloparentales? En plus de répondre à cette question, j’explique pourquoi Ricoeur rejette le lacanisme de Legendre, et comment il critiquerait le structuralisme d’Héritier s’il avait pris le temps de le faire. This paper constitutes a critical exploration of the functional features underpinning the unconscious of institutional attachment—namely an attachment which is understood in terms of the subject-infant’s love for his institutional parent-power holder, and the indefinite need for a subject to remain within its infantile condition under the parenthood of the State. We venture beyond the Paternal metaphor and move towards the neglected metaphor of the Mother, so focal in the individual process of identification, assumption of language and the permanent attachment (...) to the space of prohibition and Law. A new position in Language is defined. To understand how the psychic space of the infant is artfully subjugated in the making of the Western culture and domination of the Western system of legal interpretation, an enquiry into the legal emblematic history of representations is necessary to map the process through which the subject learns its legal self and relationship with otherness through what Pierre Legendre coined as the Occidental Mirror and the triangular logic of reflexivity. A final enquiry interrogates the way the legal institution places itself in the position of the specular image that captivates the subject-infant within a procreated legal order, a law-giving and law abiding life starting from the laws of the familial structure reinforced by the role of the parents and by analogy, by the State assuming that role in the institutional life of the ad infinitum infant. The aim of this paper is to assess the relevance of somatic evolution by natural selection to our understanding of cancer development. I do so in two steps. In the first part of the paper, I ask to what extent cancer cells meet the formal requirements for evolution by natural selection, relying on Godfrey-Smith’s (2009) framework of Darwinian populations. I argue that although they meet the minimal requirements for natural selection, cancer cells are not paradigmatic Darwinian populations. In the second (...) part of the paper, I examine the most important examples of adaptation in cancer cells. I argue that they are not significant accumulations of evolutionary changes, and that as a consequence natural selection plays a lesser role in their explanation. Their explanation, I argue, is best sought in the previously existing wiring of the healthy cells. (shrink)

Drawing on various resources and requirements (as expressed by Dewey, Wittgenstein, Sellars, and Brandom), this paper proposes an externalist view of conceptual mental episodes that does not equate them, even partially, with vehicles of any sort, whether the vehicles be located in the environment or in the head. The social and pragmatic nature of the use of concepts and conceptual content makes it unnecessary and indeed impossible to locate the entities that realize conceptual mental episodes in non-personal or subpersonal contentful (...) entities (vehicles). Persons, who engage in social practices of deontic scorekeeping (Brandom), and who are thus able to produce appropriate inferential behaviour, enact conceptual mental episodes and the basis of their supervenience. Les études réunies ici témoignent de la découverte de la philosophie analytique par les philosophes français de l’après-guerre : dans les années 1950, Pierre Hadot fut en effet l’un des premiers à s’intéresser aux rapports entre logique et langage dans la pensée de Wittgenstein. Here we are witness to the great cultural event of the West, the emergence of a Latin philosophical language translated from the Greek. Once again, it would be necessary to make a systematic study of the formation of this technical vocabulary that, thanks to Cicero, Seneca, Tertullian, Victorinus, Calcidius, Augustine, and Boethius, would leave its mark, by way of the Middle Ages, on the birth of modern thought. Can it be hoped that one day, with current technical means, it will (...) be possible to compile a complete lexicon of the correspondences of philosophical terminology in Greek and Latin? Furthermore, lengthy commentaries would be needed, for the most interesting task would be to analyze the shifts in meaning that take place in the movement from one language to another. In the case of the ontological vocabulary the translation of ousia by substantia, for example, is justly famous and has again recently inspired some remarkable studies. This brings us once more to a phenomenon we discretely alluded to earlier with the word philosophia, and which we will encounter throughout the present discussion: the misunderstandings, shifts or losses in meaning, the reinterpretations, sometimes even to the point of misreading, that arise once tradition, translation, and exegesis coexist. So our history of the Hellenistic and Roman thought will consist above all of recognizing and analyzing the evolution of meanings and significance. Pierre Hadot holds the chair of the History of Hellenistic and Roman Thought at the Collège de France. He is the author of many books and articles on the history of ancient philosophy and theology. Among his works are Plotin et la simplicité du regard, Porphyre et Vitctorinus, Marius Victorinus: Recherches sur sa vie et ses oeuvres, and Exercises spirituels et philosophie antique. Arnold I. Davidson, executive editor of Critical Inquiry, is associate professor of philosophy and a member of the Committees on the Conceptual Foundations of Science and General Studies in the Humanities at the University of Chicago. He introduced and edited the “Symposium on Heidegger and Nazism” . He is currently working on the history of horror as it relates to the epistemology of norms and deviations. Paula Wissing, a free-lance translator and editor, has recently translated Marcel Detienne and Jean-Pierre Vernant’s The Cuisine of Sacrifice among the Greeks . She also contributed translations of articles by Maurice Blanchot, Philippe Lacoue-Labarthe, and Emmanuel Levinas for the “Symposium on Heidegger and Nazism.”. (shrink)

Alvin Goldman contends that, in addition to the familiar sense or use of the term “knowledge” according to which knowledge is at least true justified belief, there is a weaker yet strict sense or use of the term “knowledge” according to which knowledge amounts to nothing more than information-possession or mere true belief. In this paper, I argue that Goldman has failed to show that there is such a weaker sense, and that, even if he had shown this, he has (...) not shown that this putative weaker sense is a strict one by his own criterion for strictness. Criticisms and rejections of representationalism are increasingly popular in 4E cognitive science, and especially in radical enactivism. But by overfocusing our attention on the debate between radical enactivism and classical representationalism, we might miss the woods for the trees, in at least two respects: first, by neglecting the relevance of other theoretical alternatives about representationalism in cognitive science; and second by not seeing how much REC and classical representationalism are in agreement concerning basic and problematic issues dealing with mental content (...) and intentionality. In order to expand and exemplify these ideas, this paper presents two heterodox positions on intentionality and on the relations between content and representation. Special attention is paid to the way REC is rejecting these positions: I argue that this rejection reveals common assumptions with classical representationalism, but also undermines the coherence of REC’s conception of intentionality. Un aphorisme hante la philosophie occidentale. celui d'Héraclite, qui veut que " la Nature aime à se voiler ". Près de vingt-cinq siècles durant, ces quelques petits mots ont successivement signifié: que tout ce qui naît tend à mourir; que la Nature s'enveloppe dans des formes sensibles et dans des mythes; qu'elle cache en elle des vertus occultes ; mais également que l'Etre est originellement dans un état de contraction et de non-déploiement ; ou bien encore qu'il se dévoile en (...) se voilant. Ainsi cet aphorisme aura-t-il servi à expliquer les difficultés de la science de la nature, à justifier l'exégèse allégorique des textes bibliques ou à défendre le paganisme, à critiquer la violence faite à la nature par la technique et la mécanisation du monde, à expliquer enfin l'angoisse qu'inspire à l'homme moderne son être-au-monde. La même formule, illustrée par l'image du voile d'Isis et déployée par Pierre Hadot dans l'histoire de l'Occident, aura justifié, par suite de contresens créateurs, l'attitude prométhéenne - l'homme doit se rendre maître et possesseur de la Nature - comme l'attitude orphique - nul ne peut soulever le voile des mystères de la Nature, sinon le poète et l'artiste. Elle n'aura jamais cessé de tracer des perspectives nouvelles sur la réalité et de révéler les attitudes les plus diverses à l'égard de la Nature. Par là, elle confirme le propos de Nietzsche : " Une bonne sentence est trop dure à la dent du temps et tous les millénaires n'arrivent pas à la consommer, bien qu'elle serve à tout moment de nourriture. 1. Tout système juridique est production d’une histoire et d’une culture politiques déterminée, qui lui ont donné une organisation spécifique. Parler des limites de telles organisations peut s’entendre en deux sens, qui interagissent: premièrement, elles peuvent servir à différencier ces systèmes par rapport à d’autres ordres normatifs. Secondement, elles désignent ce que, par sa texture, le droit est hors d’état de réussir. 2. On comprend le concept de système comme une organisation aux structures différenciées de textes, de normes, d’acteurs. Ce (...) qui caractérise un système est son autoréférentialité et ses modes de clôture et ses modes d’ouverture. 3. Concernant la limite dans le second sens, on observera que la normativité comme mode d’action propre au droit le met souvent dans l’incapacité d’assumer pleinement les tâches de régulation qui lui sont confiées. Il s’agit d’une part d’une limite factuelle: celle de la technicité et du volume de ces tâches. D’autre part, la nécessité de plus en plus fréquente de prendre en compte les circonstances individuelles concrètes de l’application entraîne une légistique de diminution de la densité normative et, par conséquent, de déplacer une épistémologie fondée sur la répétition en direction de l’innovation. 4. Ces deux facteurs notamment font du droit un univers qui ne peut plus prétendre à une complétude cohérente: c’est un univers en constante évolution, qui exige pour sa mise en œuvre, de manière continue, l’apport d’informations provenant de son environnement. Ces apports circulent dans les modes d’ouverture du droit—la diminution de la densité normative et le recours à des expertises, des savoirs, des déontologies extérieures. Cependant, en vertu de l’autoréférentialité du droit, ces apports doivent être sélectionnés et juridicisés pour être intégrés dans le système juridique et préserver ainsi sa clôture. Il y a là une double programmation à respecter: la sélection doit d’une part respecter le cadre normatif du droit et de l’autre porter sur un choix correspondant aux attentes sociales qu’il s’agit de convaincre de son bien-fondé. Les limites du droit par rapport à d’autres ordres normatifs est ainsi définie par l’ordre juridique lui-même, dans le respect de cette double programmation. 5. Ce système a des présupposés politiques, culturels et historiques qui empêchent d’élaborer sans autre une essence du droit, valable urbi et orbi: notamment séparation des pouvoirs et liberté d’expression. Il n’est même pas certain qu’il puisse perdurer. En particulier, l’internalisation croissante du droit n’est guère conciliable avec son organisation telle que l’Occident l’a conçue. En outre, de plus en plus le droit devient l’objet d’une normativité supérieure, au nom de laquelle il est lui-même jugé: c’est le phénomène de l’économisation du droit. (shrink)
