Although philosophers often focus on the essays of Leopold's Sand County Almanac, especially "The Land Ethic," there is also a normative argument present in the stories that comprise most of the book. In fact the shack stories may be more persuasive, with a subtlety and complexity not available in his prose piece. This paper develops a narrative ethics methodology gleaned from rhetoric theory, and current interest in narrative ethics among literary theorists, in order to discern the normative underpinnings of the (...) stories in Part 1. The narrative ethics approach sidesteps the need to ground the land ethic in ethical theory—which has been a reconstructive and problematic task for the philosophical interpreters of Leopold—and suggests, instead, that it emerges in Leopold's very effort to narrate his, professional, personal, and practical experience with nature. The involves examining the stories in terms of their emotional, logical and performative aspects. The result is an analysis that shows not only how these stories express normative claims, but also justify them. One conclusion of the analyses is that, in the narratives, there is less emphasis on the problematic notion of an over-arching "community" than in the prose pieces, and more emphasis on the metaphor of other living things as "fellow travelers" in the "odyssey of evolution." Second, the narratives take on an ironic attitude toward the ecological order, less discernable in the prose essays. The order itself may not be ethically admirable, but should be preserved since it makes possible any ethical relations within it. Thus, the narrative reading suggests some temperance to the usual holistic interpretation of his land ethic and its concomitant criticisms especially the charge of ecofacism. We should not take the land ethic imperative at its face value, in the sense that the good of the order itself is an intrinsic good. In the narratives, individuals are shown not merely to be means to the ecological whole, but the focus of sympathy and concern, in a manner that demands their good should also be an object of moral consideration. A teoria convergente da verdade de Peirce é uma abordagem intuitiva e razoável da verdade. No seu sentido mais geral, vincula a verdade aos resultados da investigação. De acordo com a máxima pragmática, Peirce percebeu que as consequências práticas de afirmações verdadeiras são de trazer investigações à fruição e resolver opinião. No entanto, a teoria da verdade de Peirce é muitas vezes difamada e mal-entendida. Argumenta-se, aqui, que uma vez que se entende que a teoria convergente é uma inferência e (...) generalização oriunda do notável teorema matemático conhecido como a Lei dos Grandes Números, e como esse teorema fornece certeza matemática à indução como o cerne do método científico, muitos dos problemas desaparecem. Abstract:In my response to the commentators, I agree with Rosa Mayorga that Duns Scotus should be included as an important influence on Peirce's notion of agency, as well as his sense of the highest good. I explain, however, how Peirce's triadic view of agency is an improvement that relates to current debates between moral internalism and externalism. In response to Diana Heney, I defend Peirce's notion of evolutionary love as a form of intergenerational altruism, necessary to any community of inquiry. (...) I also argue, in response to her query, that Peirce did not subscribe to moral perfectionism. Instead, there is good reasons to think that he was a meliorist in Dewey's sense. The end is improvement, which seems to be an endless process, rather than the movement towards a static end. I agree with Aaron Wilson's claim that the pragmatic definition of truth implies the convergence theory of truth. However, I explain how the convergence theory of truth might be elaborated as to apply to ethical claims. I also discuss how the 'would be' of the convergence theory of truth is a problematic measure of moral claims. Like progress in science, it is better to measure a moral norm in terms of its improvement from previous ones. I take issue with Wilson's account of moral reality and his claim that truth can be attained by individuals in the absence of community. I end by arguing that reasonableness has to be understood as a process rather than a perfected state. (shrink)

Baseada principalmente nos rascunhos de Minute Logic em 1902 e as Palestras de Harvard em 1903, as características essenciais de uma ciência normativa são discutidas e a relação da estética às outras duas ciências normativas da lógica e (...) da ética é analisada. O conceito de Peirce de bondade estética é desenvolvido, e os critérios para o que ele considera como um summum bonum são examinados. As próprias formulações de Peirce do summum bonum são examinados, inclusive sua noção de razoabilidade concreta, como também uma explicação interessante dos ideais fundamentais encontrada em um fragmento de manuscrito de 1903. : According to T.L. Short, Peirce's early thought-sign account of semeiotic engenders fatal flaws. On the one hand, it entails an infinite regressus of representation that cannot feasibly explain the connection between signs and objects and, on the other, an infinite progressus, leaving Peirce's theory without the wherewithal to account for the sign's meaning and significance. According to Short, Peirce overcomes the first flaw through the robust development of the notion of the index and the concept of collateral experience. The (...) second flaw is overcome through the pragmatic theory of meaning, connected as it is to the notion of purpose and, ultimately, a complex theory of teleology. My commentary focuses primarily on Short's important analysis of Peirce's teleology. I argue that he is successful in giving a plausible, naturalistic account of Peirce's theory without straying from the spirit of Peirce's systematic thought. Although, in my view, the book is the best account of Peirce's semiotic grammar in print, it fails to give a sufficient systematic analysis of the other two branches of Peirce's semeiotic—critical logic and formal rhetoric. Abstract:In Charles Peirce on Ethics, Esthetics and the Normative Sciences, I argue that Peirce was motivated to develop a normative science of ethics because of his growing concern with the corruption of science in the Gilded Age, and the recognition that the pragmatic maxim entailed an amoral instrumentalism. Rather than taking a Kantian approach to resolve the latter issue, he adopts an Aristotelian one, engaging in a search for an ultimate end that could order all other ends. What is right (...) is what would be conducive to that end. As such he sees the necessity of a science of esthetics which would study such an end. However, rather than eudaimonia as the highest end, Peirce sees reasonableness as the summum bonum. Although barely sketched by Peirce, I argue that its principal sense is that of an ongoing process of self-correction away from error. In regard to this end, what is most important is the design of practices and the establishment of habits of conduct and sentiment most conducive to self-correction. For this reason, a proper community of inquiry with these features ought to be established, armed with the general methodology of science to assess the norms that guide the experiments of living together. Assurance that communities of inquiries are moving away from error and toward improvement is based on a convergence theory of truth. (shrink)

In his later years, Peirce proposed the idea of ethics as a normative science. Is such a thing possible? John Dewey asks “whether scientific propositions about the direction of human conduct, about any situation into which the idea of should enters, are possible; and, if so, of what sort they are and the grounds upon which they rest”. If the meaning of ‘science’ here is taken in its contemporary sense—the way in which physics or biology might be understood—then normative science (...) implies ethical naturalism, the position that normativity is explainable as a natural property, and capable of empirical study. Certainly the question of meaning has been a perennial one, but it has never before quite dominated philosophical minds as it has in the twentieth century. Positivism, phenomenology, analytic philosophy, pragmatism and structuralism have all made the concern for meaning central to their respective reflections. If we are, as Ricoeur says, “condemned to meaning,” then for some reason this imprisonment has struck home more forcefully than ever before. It is its pervasiveness that has allowed a discipline such as semiotics to (...) capture the imagination of our era where, as in the late Greek and Medieval period, it had lain barren after so many false starts. In the introduction, the pragmatist perspective is described as beginning with an examination of actual problems to develop solutions that may reveal what would be good or better than the present, rather than aiming at the development of a concept of the good that could then be applied in particular cases. The remainder of the book can be characterised as developing this notion of ethics through the lenses of philosophical debates, both historical and contemporary, on practical reasoning, community, inquiry, and moral progress. Following the introduction, Liszka presents in the second chapter his pragmatist, problem-based ethics as a response to the "tragedy of life", in the sense of an inevitable conflict of goods and values, with the melioristic slogan "solve problems, and good will follow". In the third chapter, Liszka delves deeper into the roots of his problem-based ethics by looking at the writings of the classical pragmatists, including Peirce's maxim of pragmatism, James's account of truth as that which brings us into a satisfactory relation with other parts of our experience, Peirce's notion of the community of inquiry, and Dewey's account of democracy as the setting for solving the problems of the community. James Wallace's account of practices as potential solutions for problems provides Liszka with an important stepping stone to his conclusion, drawn at the end of this chapter, that in order to solve problems, practices must aim to attain a good end in the right way.However, this formal conclusion does not provide specific guidance on how problems should be solved. Providing such guidance is the task of practical reason, the subject of chapter four. Liszka's discussion develops pragmatist perspectives on practical reasoning based on Wallace's account, Robert Brandom's distinctions between shapes of practical reasoning, as well as Peirce's account of desire. Recently, Jardas _et al_ have convincingly defended the patient preference predictor (PPP) against a range of autonomy-based objections. In this response, I propose a new autonomy-based objection to the PPP that is not explicitly discussed by Jardas _et al_. I call it the ‘objection from higher-order preferences’. Even if this objection is not sufficient reason to reject the PPP, the objection constitutes a pro tanto reason that is at least as powerful as the ones discussed by Jardas _et al._.

A new theory is taking hold in neuroscience. It is the theory that the brain is essentially a hypothesis-testing mechanism, one that attempts to minimise the error of its predictions about the sensory input it receives from the world. It is an attractive theory because powerful theoretical arguments support it, and yet it is at heart stunningly simple. Jakob Hohwy explains and explores this theory from the perspective of cognitive science and philosophy. The key argument throughout The Predictive Mind (...) is that the mechanism explains the rich, deep, and multifaceted character of our conscious perception. It also gives a unified account of how perception is sculpted by attention, and how it depends on action. The mind is revealed as having a fragile and indirect relation to the world. Important decisions that impact humans lives, livelihoods, and the natural environment are increasingly being automated. Delegating tasks to so-called automated decision-making systems can improve efficiency and enable new solutions. However, these benefits are coupled with ethical challenges. For example, ADMS may produce discriminatory outcomes, violate individual privacy, and undermine human self-determination. New governance mechanisms are thus needed that help organisations design and deploy ADMS in ways that are ethical, while enabling society to reap the full economic and social benefits of (...) automation. In this article, we consider the feasibility and efficacy of ethics-based auditing as a governance mechanism that allows organisations to validate claims made about their ADMS. Building on previous work, we define EBA as a structured process whereby an entity’s present or past behaviour is assessed for consistency with relevant principles or norms. We then offer three contributions to the existing literature. First, we provide a theoretical explanation of how EBA can contribute to good governance by promoting procedural regularity and transparency. Second, we propose seven criteria for how to design and implement EBA procedures successfully. Third, we identify and discuss the conceptual, technical, social, economic, organisational, and institutional constraints associated with EBA. We conclude that EBA should be considered an integral component of multifaced approaches to managing the ethical risks posed by ADMS. (shrink)

Climate change mitigation has become a paradigm case both for externalities in general and for the game-theoretic model of the Tragedy of the Commons (ToC) in particular. This situation is worrying, as we have reasons to suspect that some models in the social sciences are apt to be performative to the extent that they can become self-fulfilling prophecies. Framing climate change mitigation as a hardly solvable coordination problem may force us into a worse situation, by changing real-world behaviour to fit (...) our model, rather than the other way around. But while this problem of the performativity of the ToC has been noted in a recent paper in this journal by Matthew Kopec, his proposed strategies for dealing with their self-fulfilling nature fall short of providing an adequate solution. Instead of relying on the idea that modelling assumptions are always strictly speaking false, this paper shows that the problem may be better framed as a problem of underdetermination between competing explanations. Our goal here is to provide a framework for choosing between this set of competing models that allows us to avoid a ‘Russian Roulette’-like situation in which we gamble with existential risk. An exciting theory in neuroscience is that the brain is an organ for prediction error minimization. This theory is rapidly gaining influence and is set to dominate the science of mind and brain in the years to come. PEM has extreme explanatory ambition, and profound philosophical implications. Here, I assume the theory, briefly explain it, and then I argue that PEM implies that the brain is essentially self-evidencing. This means it is imperative to identify an evidentiary boundary between the brain (...) and its environment. This boundary defines the mind-world relation, opens the door to skepticism, and makes the mind transpire as more inferentially secluded and neurocentrically skull-bound than many would nowadays think. Therefore, PEM somewhat deflates contemporary hypotheses that cognition is extended, embodied and enactive; however, it can nevertheless accommodate the kinds of cases that fuel these hypotheses. The proposed European Artificial Intelligence Act (AIA) is the first attempt to elaborate a general legal framework for AI carried out by any major global economy. As such, the AIA is likely to become a point of reference in the larger discourse on how AI systems can (and should) be regulated. In this article, we describe and discuss the two primary enforcement mechanisms proposed in the AIA: the _conformity assessments_ that providers of high-risk AI systems are expected to conduct, and (...) the _post-market monitoring plans_ that providers must establish to document the performance of high-risk AI systems throughout their lifetimes. We argue that the AIA can be interpreted as a proposal to establish a Europe-wide ecosystem for conducting AI auditing, albeit in other words. Our analysis offers two main contributions. First, by describing the enforcement mechanisms included in the AIA in terminology borrowed from existing literature on AI auditing, we help providers of AI systems understand how they can prove adherence to the requirements set out in the AIA in practice. Second, by examining the AIA from an auditing perspective, we seek to provide transferable lessons from previous research about how to refine further the regulatory approach outlined in the AIA. We conclude by highlighting seven aspects of the AIA where amendments (or simply clarifications) would be helpful. These include, above all, the need to translate vague concepts into verifiable criteria and to strengthen the institutional safeguards concerning conformity assessments based on internal checks. It is common in moral philosophy to test the validity of moral principles by proposing counter-examples in the form of cases where the application of the principle does not give the conclusion we intuitively find valid. These cases are often imaginary and sometimes rather ‘outlandish’, involving ray guns, non-existent creatures, etc. I discuss whether we can test moral principles with the help of outlandish cases, or if only realistic cases are admissible. I consider two types of argument against outlandish cases: (...) 1) Since moral principles are meant for guiding action in this world, cases drawn from other worlds are irrelevant. 2) We lack the capacity to apply our intuitive moral competence to outlandish cases. I argue that while the first approach is importantly flawed, the second approach is plausible, not because our moral competence per se is limited to cases from this world, but because we lack the capacity to imagine outlandish cases, and we cannot apply our moral competence to a case we fail to imagine properly. Lauritz Munch and Björn Lundgren have recently replied to a paper published by us in this journal. In our original paper, we defended a novel version of the so-called ‘control theory’ of the moral right to privacy. We argued that control theorists should define ‘control’ as what we coined ‘Negative Control’. Munch and Lundgren have recently provided a range of interesting and challenging objections to our view. Independently of each other, they give almost identical counterexamples to our definition of Negative (...) Control. In this comment, we show that while the counterexamples are genuine counterexamples, they do not force us to abandon the idea of Negative Control. Furthermore, we reply to two additional objections raised by Lundgren. One of these replies involves giving a new account of what the relation is between the concept of privacy and the right to privacy. (shrink)

Virtue ethics is traditionally a conservative project. It analyses the virtues that humanity has been relying on since antiquity. This conservatism unduly limits the potential of virtue ethics to contribute to moral progress. Instead, we should pay more attention to constructionist virtue ethics with the help of conceptual engineering. I will argue that revising and ameliorating the virtue concepts which a community uses directly and indirectly leads to a change of the virtues that exist in this community. In this paper, we sketch a programme for AI-driven social theory. We begin by defining what we mean by artificial intelligence (AI) in this context. We then lay out our specification for how AI-based models can draw on the growing availability of digital data to help test the validity of different social theories based on their predictive power. In doing so, we use the work of Randall Collins and his state breakdown model to exemplify that, already today, AI-based models can (...) help synthesise knowledge from a variety of sources, reason about the world, and apply what is known across a wide range of problems in a systematic way. However, we also find that AI-driven social theory remains subject to a range of practical, technical, and epistemological limitations. Most critically, existing AI-systems lack three essential capabilities needed to advance social theory in ways that are cumulative, holistic, open-ended, and purposeful. These are (1) semanticisation, i.e., the ability to develop and operationalize verbal concepts to represent machine-manipulable knowledge; (2) transferability, i.e., the ability to transfer what has been learned in one context to another; and (3) generativity, i.e., the ability to independently create and improve on concepts and models. We argue that if the gaps identified here are addressed by further research, there is no reason why, in the future, the most advanced programme in social theory should not be led by AI-driven cumulative advances. Predictive processing (PP) is now a prominent theoretical framework in the philosophy of mind and cognitive science. This review focuses on PP research with a relatively philosophical focus, taking stock of the framework and discussing new directions. The article discusses the use of algorithmic models in finance. Algo trading is widespread but also somewhat controversial in modern financial markets. It is a form of automated trading technology, which critics claim can, among other things, lead to market manipulation. Drawing on three cases, this article shows that manipulation also can happen in the reverse way, meaning that human traders attempt to make algorithms ‘make mistakes’ by ‘misleading’ them. These attempts to manipulate are very simple and immediately transparent to (...) humans. Nevertheless, financial regulators increasingly penalize such attempts to manipulate algos. The article explains this as an institutionalization of algo trading, a trading practice which is vulnerable enough to need regulatory protection. (shrink)

In this paper, we argue that there is at least a pro tanto reason to favor the control account of the right to privacy over the access account of the right to privacy. This conclusion is of interest due to its relevance for contemporary discussions related to surveillance policies. We discuss several ways in which the two accounts of the right to privacy can be improved significantly by making minor adjustments to their respective definitions. We then test the improved versions (...) of the two accounts on a test case, to see which account best explains the violation that occurs in the case. On the whole, the US Algorithmic Accountability Act of 2022 (US AAA) is a pragmatic approach to balancing the benefits and risks of automated decision systems. Yet there is still room for improvement. This commentary highlights how the US AAA can both inform and learn from the European Artificial Intelligence Act (EU AIA).
