The parents of Charlie Gard, who was born August 4, 2016, with an exceedingly rare and incurable disease called mitochondrial DNA depletion syndrome, fought a prolonged and heated legal battle to allow him access to experimental treatment that they hoped would prolong his life and to prevent his doctors from withdrawing life-sustaining care. Charlie's clinicians at the Great Ormond Street Hospital in London believed that the brain damage Charlie had suffered as a result of frequent epileptic seizures, along with many (...) other severe disabilities, would render any innovative therapy futile, and they disagreed with his parents’ wishes to use an experimental therapy. They felt it in Charlie's best interest that he be allowed to die. A battle ensued among Charlie's parents, his doctors, and a guardian who had been appointed to represent him that drew the attention of politicians and prominent persons from all over the world. The case was much in the news over the past year, but it has also been frequently misunderstood. (shrink)

As more young people feel safe to outwardly identify as transgender or gender expansive (TGE), meaning that their gender identity does not align with the sex they were assigned at birth, an increasing number of youth who identify as TGE seek gender-affirming medical care (GAMC). GAMC raises a number of ethical questions, such as the capacity of a minor to assent or consent, the role of parents or legal guardians in decisions about treatment, and implications for equitable access to care (...) when differing parental or custodial viewpoints are present. These questions are further complicated by the difficulties in explaining the limits of long-term research in GAMC, with regard to the preservation of fertility, for example. We present two de-identified composite case studies to highlight dilemmas that may arise and offer recommendations to better support patient- and family-centered decision making for GAMC. These include employing a multidisciplinUniverary shared decision-making approach, disentangling informed consent and assent from chronological age, developing a consistent approach to the assessment of decisional capacity, and developing age-appropriate informational materials. Recent political turmoil has focused international attention on Egypt, yet there is little awareness of the country’s stateless populations—those who lack legal nationality to any state—or the challenges they face. Individuals in situations of protracted statelessness are denied their right to a nationality, resulting in an array of additional rights violations. Such violations include denied freedom of movement, equality before the law, and access to economic and social rights. Drawing from two years’ of fieldwork data, this study highlights the plight (...) of those who are unable to achieve legal status in a country with harsh punishments for illegal presence, entry, and exit. It also evaluates potential solutions for eliminating statelessness in Egypt and protecting the rights of stateless populations. As Egypt seeks to move beyond revolution, it is vital that the government addresses the pervasive and systemic inequalities that deny individuals their right to a nationality. (shrink)

Evolving practice requires peer review of clinical ethics (CE) consultation for quality assessment and improvement. Many institutions have identified the chart note as the basis for this process, but to our knowledge, electronic health record (EHR) systems are not necessarily designed to easily include CE consultation notes. This article provides a framework for the inclusion of CE consultation notes into the formal EHR, describing a developed system in the Epic EHR that allows for the elaborated electronic notation of the CE (...) chart note. The implementation of the “meaningful use” criteria for EHR, mandated by the Health Information Technology for Economic and Clinical Health (HITECH) Act of 2009, requires that health professionals meet certain standards for quality, efficiency, and safety, all of which overlap with the goals of standardization, peer review, and quality improvement within CE consultation. Hegel introduced the Phenomenology of Mind as a work on the problem of knowledge. In the first chapter, entitled “Sense Certainty, or the This and Meaning,” he concluded that knowledge cannot consist of an immediate awareness of particulars ). The tradition discusses sense certainty in terms of this failure of immediate knowledge without, however, specifically addressing the problem of reference. Yet reference is distinct from knowledge in the sense that while there can be no knowledge of objects without reference, there (...) may be reference without knowledge. If that is the case, then the failure of immediate knowledge does not entitle us to conclude anything about the success or failure of reference. It is not surprising, then, that a few scholars have begun to examine sense certainty primarily as a thesis about reference. (shrink)

Alternative food networks are emerging in opposition to industrial food systems, but are criticized as being exclusive, since customers’ ability to patronize these market spaces is premised upon their ability to pay higher prices for what are considered the healthiest, freshest foods. In response, there is growing interest in widening the demographic profile given access to these alternative foods. This research asks: what barriers do alternative food businesses face in providing access and inclusion for low income consumers? Surveys and interviews (...) with 45 alternative food businesses in British Columbia, Canada uncovered five key barriers. The findings indicate that the barriers are symptomatic of structural issues in the Canadian food and social welfare systems. Although opportunities exist for business operators to widen access for low income shoppers, these alone cannot meaningfully ameliorate food-access inequality. Rather, these barriers underscore issues of income-disparity, poverty, and food-access inequality more broadly, and require structural and societal change to rectify. (shrink)

I certainly find it easier to recognize the deep continuities within Wittgenstein's thought, than the real nature of the contrasts: one only comes to recognize these for what they are after prolonged engagement with the two works.Heather Gert has offered a reading of Investigations §§ 46-50. Her attention devolves primarily on the notorious standard meter paragraph of § 50. Important to her reading is her conviction about what it is from the Tractatus that is being criticized and about how it (...) is being criticized.I believe Gert's reading of the passage is mistaken. Gert fails to get fully into focus what is happening in the distance, in the Tractatus, and she fails to get into focus what is happening nearby, in .. (shrink)

Peter Kivy investigates the unity of form and content in the arts, particularly in poetry. While Kivy says much with which I happily agree, I sadly disagree with him about the impossibility of form–content identities. Kivy's arguments fail to compel: there are other ways of understanding form–content identities and the need for them that has been felt by artists and critics. Abstract: In this article I contest a reading of Wittgenstein's Philosophical Investigations —a reading of it as debunking philosophy. I concede that such a reading is not groundless, but I show why it is nonetheless mistaken. To do so, I distinguish two different ways of viewing Philosophical Investigations and its concern with philosophical problems, an External View and an Internal View. On the External View, readers of the book are taken to know ahead of time what philosophical problems are. On (...) the Internal View, readers are not taken to know this ahead of time: the task of the book is to disclose what philosophical problems are, to show them coming into being. One thing disclosed is our participatory role in philosophical problems coming to be. Learning about the nature of philosophical problems is thus learning about our own nature; metaphilosophical knowledge is in part self-knowledge. If the Internal View is correct (as I believe it is), then Philosophical Investigations does not debunk philosophy but provides a different conception of philosophy and the philosopher's task. In this essay, I respond to A. W. Moore’s instructive chapter on Frege. I respond by asking various questions, and I question particularly Moore’s claim that Frege, in reacting to Benno Kerry, falls into Hegelian excess. I toy with responding to my question by regarding Frege as anticipating a Wittgensteinian-Heideggerian exaction. It remains unclear whether this constitutes (much) progress.

Marking a major new reassessment of Camus' writing, this book investigates the nature and philosophical origins of Camus' thinking on "authenticity" and "the absurd" as these motions are expressed in "The Myth of Sisyphus" and "The Outsider", showing these books to be the product not only of a literary figure, but of a genuine philosopher as well. Moreover, the author provides a complete English-language translation of Camus' "Metaphysique Chretienne et Neoplatonisme" and underlines the importance of this study for the understanding (...) of the early Camus. The book also contains analyses of the influence of St Augustine and Nietzsche on Camus. (shrink)

What is it to read Wittgenstein resolutely? In this essay, I make a suggestion about how to answer that question. I backtrack in time to a debate about Philosophical Investigations between O. K. Bouwsma and Gilbert Ryle. I selectively reconstruct that debate, highlighting features of it that I take to be interesting in their own right and in relation to debates about PI, but also interesting in analogy with debates about resolute and standard readings of Tractatus logico-philosophicus. As will be (...) clear, my sympathies are with Bouwsma against Ryle, and with resolute readers against standard readers. But I do not vindicate Bouwsma; I will, in fact, be critical, carefully or guardedly critical of him.Nor do I vindicate resolute reading of TLP. I suggest a way of seeing resolute reading that makes clearer what it is and how it contrasts with standard reading, and, in so doing, that makes clearer what some of the difficulties of the debate between the readings really are, whether about TLP or about PI. In this essay I investigate the unity of Emerson's sentences. I begin by describing the phenomenology of reading Emerson and use that phenomenology to orient the investigation. I propose to understand the unity of Emerson's sentences by using a variation of Frege's strategy for understanding the unity of sentences generally. I then address how the unity of the Emerson sentence serves to create the unity of the Emerson paragraph and even of the Emerson essay. Along the way I compare Emerson's (...) essays to Lancelot Andrewes’ sermons. I finish by using the results of the investigation and comparisons to provide a partial reading of “Experience” in which I shed light on the nature of Emerson's encounter with the problematic of skepticism. In this essay, we focus primarily on Moore’s “Proof of an External World” and Kant’s “Refutation of Idealism.” We are not exactly commenting on Clarke’s “The Legacy of Skepticism,” interpreting it, although what we do involves us in (some of) that. Instead of directly commenting on it, we do things with Legacy; we read Moore’s Proof and Kant’s Refutation with Clarke in mind. And by way of doing this, we bring onto the stage a post-Legacy Moore, and a post-Legacy Kant. (...) We do not claim to present Moore and Kant per se (to use Clarke’s term); we do not portray Moore and Kant as they are independently of “The Legacy of Skepticism.” We propose instead Moore and Kant as we read them after Legacy, i.e., in light of the pure/plain distinction. This empirical work attends to the tensions and contradictions medical students articulate when they discuss their objection to industry’s influence in medicine. Findings are based on 50 semi-structured interviews with medical students who are critical of the pharmaceutical industry’s influence in medical education in the United States and Canada. These students advocate evidence-based medicine as one solution to the problems with industry influence in medicine; namely industry bias in medical research. This investigation is an effort to understand why EBM is (...) posed as a solution to industry bias in light of the literature demonstrating the ways that what is considered ‘evidence-based’ is influenced by industry. Participants articulate a struggle to find the ‘best’ evidence in a context where industry interests are integral in the production of medical knowledge. (shrink)

Previous research has demonstrated that reversing the contrast of the eye region, which includes the eyebrows, affects the N170 ERP. To selectively assess the impact of just the eyes, the present study evaluated the N170 in response to reversing contrast polarity of just the iris and sclera in upright and inverted face stimuli. Contrast reversal of the eyes increased the amplitude of the N170 for upright faces, but not for inverted faces, suggesting that the contrast of eyes is an important (...) contributor to the N170 ERP. Then I want to consider a specific, recent counter‐challenge (...) to Dretske's challenge to (Closure) mounted by John Hawthorne, and to defend Dretske's challenge from Hawthorne's counter‐challenge. The issue that I wish to address is, why protest and criticize the increasing hegemony of what has been called the “culture of consumerism”? This “why not?” objection encompasses three distinct sets of questions. First, is not resistance to it akin to playing the role of King Canute by the sea? Second, is not acceptance of it dictated by the current liberal philosophical consensus that acknowledges and endorses an inevitable diversity in different individuals’ conceptions of what is good, and must (...) not this consensus itself be taken as a given by all who are opposed to political and religious totalitarianisms? Third, does not cosmopolitanism, regarded as a value-orientation favorable to the dissolution or at least minimization of national boundaries and the practices of exclusivity associated therewith, make common cause in the present historical conjuncture with this same trend? Collective Dreams looks at ideals of community, frequently embraced as the basis for reform across the political spectrum, as the predominant form of political imagination in America today.

This paper theorizes two dialectic moments in which art is situated. The hypothetical dialectic is based on Hal Foster’s explication of the relationship between the neo-avant-garde and the historical avant-garde which forms the thesis of his text The Return of the Real. This dialect is comprised of an initial moment that delineates the terms of our enunciative and perceptive condition followed by a second that “comprehends,” not completes, the first. I forward Slavoj Žižek’s notion of the stain to characterize this (...) first moment. By looking at the stain, we see the make-up of the whole field of symbolic relations attempting—but ultimately failing—seamlessly to incorporate it. I give Diane Arbus’s use of the stain as a subject as an illustration of this first moment. Further, I posit Žižek’s notion of the act as a method to redialecticize art stuck in this initial moment and made stagnant through cynicism. Acts are moments of absolute freedom, that “[temporarily suspend] the field of ideological meaning” (Enjoy Your Symptom 35). However, I qualify the act in art as a “spectre” of the real: “The Real which returns [as]… an image, a semblance, an ‘effect,’ which, at the same time, [delivers] ‘the thing itself’” (Welcome to the Desert of the Real 18). I use recent collage paintings by Albert Oehlen as illustrations to stage the latter part of my argument. (shrink)

Theoretisch befanden sich die falschen Linien in der Theorie der liberalen Demokratie schon immer an mindestens zwei wichtigen Stellen: im Prozess oder Prozedere und im Resultat. Was das Erste betrifft, so bestand das Problem darin, dass versucht wurde sicherzustellen, dass der „Wille des Volkes“ – oder zumindest der der relevanten Menschen, der wählbaren Wähler – durch anschauliche, praktische Mechanismen zum Ausdruck kommt. Entsprechend dem Konsens der bedeutendsten Theoretiker der liberalen Demokratie in der neueren Vergangenheit gelten als solche Mechanismen die Wahlen (...) für Repräsentativorgane und die nachfolgenden Stimmen der Wahlsieger. Doch auf jedem Schritt stoßen wir auf Instanzen der gewählten Regierungen, die die Mehrheitsansichten desselben Personenkreises, von dem sie ursprünglich gewählt worden waren, preisgeben. Die Theorie der liberalen Demokratie besagt, dass solange angebrachte Verfahren zum Ausdruck des Willens der Mehrheit angewandt werden im Hinblick darauf, wer sie vertreten soll, die Vertreter berechtigt sind, gegen den manifesten Willen des Volkes zu stimmen. Doch dies ist natürlich ein offensichtlicher Widerspruch. Was die Frage der Resultate betrifft, so hat sich die neueste Theorie der liberalen Demokratie eine noch tiefere Grube gegraben, da sie sich vom Begriff des Allgemeinwohls abgewandt hat, zu dem zumindest einige frühere Theoretiker in dieser Tradition standen. Die Theorie der liberalen Demokratie hat sich letztlich selbst jegliche kritische Funktion in Bezug auf die Resultate abgesprochen. Statt dessen ist sie gezwungen, jedes Ergebnis zu ratifizieren, ohne Rücksicht darauf, wie offensichtlich es irreführend oder sogar tragisch sein mag, solange es das Erzeugnis einer akzeptierten autoritativen Bündels von Verfahren und Institutionen ist. Eine neue theoretische Richtung wird sicherlich gegen alle Elemente ankämpfen müssen, die größtenteils im Rawlsschen Ansatz und den Schriften der meisten seiner liberaldemokratischen Mitläufer fehlen: mit Macht, Gewalt, Domination, Ideologie, Entschlüssen, Deutungen, politischem Ausdruck, Revolution, Geschichte, Ökonomie, Biopolitik. Der Text beschäftigt sich in seinem ersten Teil mit dem offiziellen Verhältnis der USA zur internationalen Gesetzgebung, des Weiteren mit der Institution des Präsidentenamtes und seiner Macht sowie mit der Rolle des Obersten Gerichtshofes der USA. I propose to offer a novel analysis of such statements. In brief, such statements will be analysed as wide-scope normative conditionals.
