In this article, we suggest an alternate approach to interpreting the US Constitution, using founding-era translations. We demonstrate how both symmetries and asymmetries in structure and vocabulary of the languages involved can help in deciding nowadays’ problems of constitutional interpretation. We select seven controversial passages of the US constitution to illustrate our approach: Art. I, § 8, cl. 3 ; Art. II, § 1, cl. 5 ; Art. II, § 2, cl. 3 ; Art. I, § 6, cl. 1/Art. I, (...) § 8, cl. 10/Art. IV, § 2 ; and Art. IV, § 2, cl. 1. Since these passages have recently been debated by constitutional scholars, reassessing them using our method can establish the additional value of our approach to constitutional practice. The manuscripts on which it draws form the texts of unpublished works, namely a set of ‘Three Essays on the Poor Laws’, which were completed by Bentham, and ‘Pauper Systems Compared’, which remains in a comparatively unfinished state. In the ‘Essays’, Bentham considers first the question of whether the relief of indigence should be a public responsibility, and, having concluded that it (...) should, moves on to consider what conditions should be attached to that relief. ABSTRACTThe goal of this paper is to locate indirect legislation within Bentham’s art of legislation, and to distinguish it, as far as possible, from direct legislation. Along the way, some parallels are drawn between indirect legislation on the one hand, and the Nudge theory of Thaler and Sunstein on the other. It will be argued that many expedients categorized by Bentham as indirect legislation are simultaneously exercises of direct legislation. Another set of indirect expedients act on knowledge, and involve efforts (...) to eliminate asymmetries of information between potential offender and potential victim by providing official standards and disseminating a plethora of factual information. Other forms of indirect legislation threaten the coherence of Bentham’s theory of law, firstly by regarding all government actions as exercises in legislation, and secondly by turning the formers of public opinion into legislators. Insofar as some forms of indirect legislation operate by sleight of hand, they conflict with Bentham’s commitment to transparency in the exercise of public power, reflecting a tension between reality and appearance which runs through his thought. With the blossoming of research on corporate social performance, the data produced by Kinder, Lydenberg, Domini have become the standard to measure firms’ social and stakeholder actions. However, to date, only a few studies have focused on examining the data directly, and have done so largely in terms of validating the concepts and methods in the data set’s construction. The present study seeks to complement these efforts by contributing knowledge about what the KLD data report on firms’ actions toward primary (...) and secondary stakeholders, and the dimensions of CSP that firms generally engage in, together or sequentially. With data on 3,073 firms over the period 2000-2010, results show that firms expend more resources on garnering strengths in primary stakeholder dimensions, although this trend is sharply deteriorating to the benefit of secondary stakeholders—notably the natural environment. Results also show that firms generally approach CSP with a mixed behavior, with strengths and concerns in the same dimensions, especially as it pertains to secondary stakeholders. These are the same dimensions in which firms show the longer, more intrinsic commitments, suggesting that secondary stakeholder strengths and concerns may be structural in nature. However, there is also evidence of relationships across dimensions, indicating that firms’ involvement in CSP can generate momentum. The rich implications of these findings are discussed. (shrink)

In this chapter, Michael Quinn argues that although Bentham’s only works on international trade were discussions on “the balance of trade” and “colonial trade,” these works reveal several new aspects of Bentham’s broader political economy. Like Smith, Bentham considered international trade to be mutually beneficial and strongly criticized mercantilist fallacies concerning balance of trade and the fetishization of precious metals. However, Bentham’s views differ from Smith’s on the issues of paper money and inflation. The concept of a "breed" of domestic cattle is predominantly a social construct. The late eighteenth century development of intensive selective breeding of livestock produced breeds that were visually distinguishable from each other. The adoption of breed standards was facilitated in part through paintings and drawings of idealized animals. These "ideal types" or "standards of perfection" further served as targets for breeders who attempted to achieve the artist's conception of the perfect animal. This volume opens with the marginal contents corresponding to Bentham's first sustained discussions, now lost, of political economy and public finance, written in French, probably in 1786, for Projet Matière; three related appendices follow. Defence of Usury was published in 1787, and was well received and quickly translated. In preparing a second edition in 1790, Bentham drafted considerable additional material which is reproduced in five appendices. Also in 1790 Bentham began an introductory handbook Manual of Political Economy, the surviving text (...) of which is supplemented by seven appendices containing preparatory materials. A Protest against Law Taxes, Bentham's trenchant denunciation of the denial of justice to the poor, written in 1793, published in 1795, and extended in 1816, closes the volume. (shrink)

The author has surveyed a quarter of the accredited undergraduate computer science programs in the United States. More than half of these programs offer a “social and ethical implications of computing” course taught by a computer science faculty member, and there appears to be a trend toward teaching ethics classes within computer science departments. Although the decision to create an “in house” computer ethics course may sometimes be a pragmatic response to pressure from the accreditation agency, this paper argues that (...) teaching ethics within a computer science department can provide students and faculty members with numerous benefits. The paper lists topics that can be covered in a computer ethics course and offers some practical suggestions for making the course successful. (shrink)

All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

The papers cover a broad range of topics and may, for present purposes, be divided three ways, as variously concerning problems of metaethics, of the rationality of morality, and of substantive or practical ethics. I will not discuss Quinn’s great papers on abortion, punishment, double effect, and the distinction between killing and letting die—except to remark that they are united by an underlying anticonsequentialist program. In The Right to Threaten and the Right to Punish, Warren Quinn justifies punishment on the ground that it can be derived from the rights of persons to protect themselves against crime. Quinn, however, denies that a right of self-protection justifies the punishment of an aggressor solely on the ground that such punishment deters others from harming the victim of that aggression or others. He believes that punishment so justified would constitute a morally objectionable instance of using the (...) punished individual as a means. Contrary to Quinn, I argue that (1) an individual can, on the very ground of a right to self-protection that Quinn ultimately relies upon to justify punishment, justify the punishment of an individual as a means of deterring others from committing crimes; and that (2) an individual or individuals (including state officials) can, on the ground of vindicating the right of protection that others possess, justify the punishment of an individual as a means of deterring others from committing crimes. We’ve all heard the familiar saying, “ignorance is bliss.” It may also be true that “ignorance is intolerant.” But it seems to be at least sometimes true that intolerance is produced by something else: overconfidence in the truthfulness of one’s own opinions. Awareness of and avoidance of such overconfidence may be a path towards tolerating those with whom one disagrees. And this could be true in religion as well as in other areas of belief. In his 2005 article “On Religious (...) Diversity and Tolerance,” Philip L. Quinn argues that awareness of religious diversity, coupled with various other considerations, leads to a degree of modesty about the truth claims of one’s religion, and that such modesty leads to tolerance of other religions. However, in his 2007 paper “Is Uncertainty a Sound Foundation for Religious Tolerance,” William Lane Craig takes issue with Quinn’s position, arguing that Quinn’s “radical skepticism” about religious beliefs is not warranted and that “doubt” is not a sound foundation for tolerance. In this paper I contend that cognitive humility is warranted, that it is not a form of skepticism, that it does not entail doubt, and that it may contribute significantly to religious tolerance. I defend Quinn’s thesis by offering a version that is based on certain epistemic considerations that help the reader to see Quinn’s argument in a new and strengthened light. I then argue that Quinn’s approach to tolerance has at least one significant advantage over the approach proposed by Craig: acceptability to all religious traditions. (shrink)

Among the most influential and well-known experiments of the 19th century was the generation and detection of electromagnetic radiation by Heinrich Hertz in 1887–1888, work that bears favorable comparison for experimental ingenuity and influence with that by Michael Faraday in the 1830s and 1840s. In what follows, we pursue issues raised by what Hertz did in his experimental space to produce and to detect what proved to be an extraordinarily subtle effect. Though he did provide evidence for the existence (...) of such radiation that other investigators found compelling, nevertheless Hertz’s data and the conclusions he drew from it ran counter to the claim of Maxwell’s electrodynamics that electric waves in air and wires travel at the same speed. Since subsequent experiments eventually suggested otherwise, the question arises of just what took place in Hertz’s. The difficulties attendant on designing, deploying, and interpreting novel apparatus go far in explaining his results, which were nevertheless sufficiently convincing that other investigators, and Hertz himself, soon took up the challenge of further investigation based on his initial designs.
