Concepts as reasonable doubt, cognitive biases and emotions are now a theoretical problem for the practice of law, and the law understood as legal argumentation. From a theoretical point of view, the screenplay written by Reginald Rose, Twelve Angry Men, is an outstanding example to analyze some of these concepts, and its influence on procedural stage. Cognitive biases and informal fallacies are theoretical challenge to legal argumentation.

A Philosophy to Live By highlights Murdoch's distinctive conception of philosophy as a spiritual or existential practice and enlists the resources of her thought to explore a wide range of thinkers and debates at the intersections of moral philosophy, religion, art, and politics.

The book examines how Darwinism has been used to explain novelty and change in culture through the Darwinian approach to creativity and the theory of memes. The first claims that creativity is based on a Darwinian process of blind variation and selection, while the latter claims that culture is based on and explained by units - memes - that are similar to genes. Both theories try to describe and explain mind and culture by applying Darwinism by way of analogies. Kronfeldner (...) shows that the analogies involved in these theories lead to claims that give either wrong or at least no new descriptions or explanations of the phenomena at issue. Whereas the two approaches are usually defended or criticized on the basis that they are dangerous for our vision of ourselves, this book takes a different perspective: it questions the acuteness of these approaches. Darwinian theory is not like a dangerous wolf, hunting for our self image. In _Kazimierz Twardowski: A Grammar for Philosophy_ Maria van der Schaar shows the importance of Twardowski’s method, his philosophical grammar, for both the Lvov-Warsaw School, and analytic philosophy today.

Does responsible leadership matter when assembling an inclusive supply chain at the Base-of-the-Pyramid? Current literature implicitly assumes that it does not. BOP scholars initially focused on the importance of shaping innovative and disruptive offerings, with radically improved price–performance ratios. Subsequent studies tended to focus on barriers to implementation of large-scale ventures at the BOP. Their common characteristic was the fact that the attributes and roles of the individuals involved were deemed unimportant. If the opportunity was there, provided barriers were removed (...) and the right value proposition was offered, the inclusive venture should take off. We evaluate three cases of leaders who succeeded in building inclusive ventures at the BOP, in contexts marked by institutional voids—where formal markets were weakly structured or nonexistent. Building a viable business under those circumstances entailed two tasks: imagining what is possible and then turning that vision into a reality. We found that, in carrying out those tasks, individuals do matter. Sampled cases show that working with nontraditional partners in inclusive supply chains requires more than aligning material incentives. Our analysis suggests that responsible leadership with a strong ethical foundation can provide powerful leverage to ensure buy-in and commitment from the various actors involved. We show how RL can impact organizations and external stakeholders through positive upward spirals. Our analysis contributes to the literature on BOP and RL by confirming, extending, and challenging existing knowledge. We propose two novel attributes and argue that context matters, influencing how RL is operationalized and defined. Understanding the critical role of RL in the construction of inclusive supply chains adds a critical missing link that sheds light into the micro level of new business creation, development, and consolidation at the BOP. This chapter provides an analysis of the work of Rita Segato and María Lugones’s assessment of Segato’s approach to gender and questions of decoloniality. The chapter examines the concepts of “patriarchy” and “gender” from within several critical paradigms among communities of color, including, specifically, indigenous and Afro-descendant communities within Abya Yala (a Puna term for the geographic lands of the Americas). Lugones proposes that terms of analysis such as “patriarchy” and “gender” undermine the complexity of the relations of power constituted (...) in and through coloniality, including specifically the racialization of gendered terms. European women were racialized, but colonized females were not. Retaining the use of gender as a category of analysis thereby leaves decolonial activists and scholars working toward coalitional struggle with indigenous and Afro-descedent communities unable to sufficiently affirm the embodied, erotic, intersubjective, and otherwise distinct modes of communal relations not bound by dimorphic gender categories that continue to exist among these communities. The conclusion of the chapter then traces Lugones’s contributions to decolonial feminism, responding to the concerns she raises in the previous sections. (shrink)

Three studies were conducted to examine the relation of spatial visualization to solving kinematics problems that involved either predicting the two‐dimensional motion of an object, translating from one frame of reference to another, or interpreting kinematics graphs. In Study 1, 60 physics‐naíve students were administered kinematics problems and spatial visualization ability tests. In Study 2, 17 (8 high‐ and 9 low‐spatial ability) additional students completed think‐aloud protocols while they solved the kinematics problems. In Study 3, the eye movements of fifteen (...) (9 high‐ and 6 low‐spatial ability) students were recorded while the students solved kinematics problems. In contrast to high‐spatial students, most low‐spatial students did not combine two motion vectors, were unable to switch frames of reference, and tended to interpret graphs literally. The results of the study suggest an important relationship between spatial visualization ability and solving kinematics problems with multiple spatial parameters. (shrink)

In this paper I want to leave behind the failed attempts to think about populism as ideology, strategy, style, or even discourse. I will focus on the ‘conceptual battles of politics’ and their potential to influence actors to pursue and effect specific ends. Reinhart Koselleck and his ideas about conceptual history will figure prominently in my discussion, as will his concept of asymmetrical combat-concept as a means of unleashing a theoretical and political war. The present study examined differences in moral behavior and judgment in sport and student life. Participants were students at a British university who responded to moral dilemmas pertaining to sport and student life. They indicated the likelihood that they would act antisocially or prosocially and provided judgment ratings of the behaviors described in the dilemmas. Likelihood to act antisocially was higher toward opponents in sport than other students at university, whereas likelihood to behave prosocially was lower toward opponents in sport (...) than other students at university. Finally, antisocial behavior was less likely toward teammates than other students. The sport–university difference in antisocial opponent/student behavior was fully mediated by moral judgment, whereas the difference in prosocial behavior was partially mediated by moral judgment. These findings reveal a more nuanced aspect to bracketed morality that considers in-group loyalty when understanding moral judgment and behavior in and outside of the sport context. (shrink)

The article with allusions on Nietzsche’s provocation about history lessons proposes an interdisciplinary approach to academic scholarship considered as a special cultural and organizational form of advanced studies aimed at professional development or skill exchange, which have influence on human being in contemporary societies involved in the process of globalization. The theoretical conceptualization of institutionalized forms of scholarships and internships is analyze in connection with its practical representation and economical allocation. Pathological representations of academic scholarship as an end in itself (...) are unveiled as a kind of conspicuous consumptions symbolizing the status position or exclusivity on the borders between academic community and mass-media. The purpose of this article is to explicate some representations of academic scholarship in the contexts of the academic capitalism searching the way of overcoming its utilitarian limitations with universal ethical imperatives. To realize such a purpose, phenomenological reduction is applied in combination with the biographical method. Assumptions made in the article are verified on biographical fragments of curriculum vitae of influential sociologists such as Ralf Dahrendorf and Niklas Luhmann, because the social and professional self-realization and revision of the life-priorities of them was due in many aspects to academic scholarship gained by different ways but with success, especially in the field of educational policy and in the case of establishing democracy in the process of post-totalitarian transformation in Germany. This experience can be useful for Ukraine as well. The phenomenon of the cultural shock and its influence on visiting scholars is explicated. The role of communication between epistemic cultures is emphasized on by overcoming epistemic injustice and establishing academic integrity. (shrink)

The scientist Richard Lovell Edgeworth, educated at Trinity College, Dublin, and Oxford, was a Member of the Lunar Society of Birmingham, where he exchanged ideas with other scientists, including James Watt, and was known for his significant mechanical inventions. However, Edgeworth's real interest was education: in this 1788 two-volume work, written with his daughter, the poet Maria Edgeworth, he draws on his own experience of raising twenty children, from which the work derives its authority and innovative character. The work (...) was very influential, and led to his Essays on Professional Education. The two volumes discuss the theories of philosophers and educationalists, while in general arguing for the importance and formative character of early childhood experiences. Despite many attempts to achieve an adequate definition of living systems by means of a set of necessary and sufficient conditions, the opinion that such an enterprise is inexorably destined to fail is increasingly gaining support. However, we believe options do not just come down to either having faith in a future success or endorsing skepticism. In this paper, we aim to redirect the discussion of the problem by shifting the focus of attention from strict definitions towards a philosophical framework (...) that allows conceiving of living systems as a natural kind, but whereby natural kinds are not to be defined by fixed necessary and sufficient conditions. We argue for a property-cluster kind approach according to which living systems constitute a natural kind with vague boundaries, capable of changing, and whose members do not need to instantiate every property. We draw from Boyd’s homeostatic property-cluster theory and introduce two modifications, one regarding homeostatic mechanisms and another related to the scientific role of kinds. Thus, our view overcomes some difficulties of Boyd’s theory and we are able to account for the natural kindhood of living things. We also emphasize the most appealing features of our approach for specific research fields and address three objections to this sort of approach. (shrink)

This paper aims to stablishes the sense in which propositions included under the perceptual use of ‘seeing-as’, developed by Wittgenstein in the Second Part of Philosophical Investigations, are justifiable from an epistemic point of view. To do this, first, it will be clarified the internal link between ‘visual experience’ and ‘interpretation’ for the type of mentioned cases. Second, it will be shown how the ‘seeing-as’ respects the rule-following paradox’s solution, as long as it does not presuppose any intermediary or need (...) anyone to account for what is perceived, highlighting the notions of ‘practice’, ‘familiarity’ and ‘context’ common both in the aforementioned solution and in the ‘seeing-as’ cases. Third, the general distinction between certainties or ‘hinges’ and ‘epistemic propositions’ presented by Wittgenstein in On Certainty will be applied to cases of aspect perception as a possible field of application of the so called Hinge Epistemology, showing how, in specific cases, the perceptual certainties that shape our way of life and that are groundless, can be recontextualized and merit reasonable justification.Keywords: Wittgenstein, aspect perception, seeing-as, hinges, certainty, justification. His highly original and often provocative ideas have set the agenda for a variety of debates in philosophy of science, philosophy of mind and philosophy of language. His now famous philosophical thought experiments, such as the ‘Twin earth’ and ‘the brains in the vat’ have become part of the established canon in philosophy and cognitive science. _Reading Putnam_ is an outstanding overview and assessment of Hilary Putnam’s work by a team of (...) international contributors, and includes replies by Putnam himself. Divided into clear sections, it contains chapters on key aspects of Putnam’s large body of writing, including: Scientific realism and the changes that Putnam’s thought has undergone on this topic analyticity and ontology, including the important interconnections between the views of Putnam and Quine Putnam’s arguments concerning externalist views of meaning and reference, questions of conceptual relativity, and his preoccupation with ethics through a denial of the fact–value dichotomy Putnam’s developing views on perception. Asking students to generate a prediction before presenting the correct answer is a popular instructional strategy. This study tested whether a person’s degree of confidence in a prediction is related to their curiosity and surprise regarding the answer. For a series of questions about numerical facts, participants (N = 29) generated predictions and rated their confidence in the prediction before seeing the correct answer. The increase in pupil size before viewing the correct answer was used as a physiological marker of (...) curiosity, and the increase in pupil size after viewing the correct answer was used as a physiological marker of surprise. The results revealed that the pupillometric marker of curiosity was most pronounced if students were slightly more confident in their prediction than usual, and it was lower for predictions made with either very high or very low confidence. Furthermore, the results showed that high-confidence prediction errors and low-confidence correct responses yielded a pupillary surprise response, suggesting that highly unexpected results evoke surprise, independent of the correctness of the prediction. Together, results suggest that confidence in a prediction plays an important role in the occurrence of epistemic emotions such as curiosity and surprise. (shrink)

Although perceptual grouping has been widely studied, its mechanisms remain poorly understood. We propose a neural model of grouping that, through top-down control of its circuits, implements a grouping strategy involving both a connection strategy (which elements to connect) and a selection strategy (that defines spatiotemporal properties of a selection signal to segment target elements and facilitate identification). We apply the model to a letter discrimination task that investigated relationships among uniform connectedness and the grouping principles of proximity and shape (...) similarity. Participants reported whether small circles formed a global letter E or H, and these circles could be connected by a line or be embedded in a matrix of squares. In the model, a good grouping strategy for this task consists of a connection strategy that connects circles but not squares for all conditions and a selection strategy that uses a selection signal of varying size, depending on whether squares were present. Consistent with empirical results, which were verified in two replication studies, model performance is worse with distractor squares, and line connectors improve performance only in the condition with squares. Rather than relying on abstract grouping principles, we show how the empirical results can be explained in terms of observers implementing a task-dependent grouping strategy that promotes overall performance. Probability is the subject of considerable attention by Nagel, who devoted to it several writings. In the 1930s, Nagel put forward his “truth frequency” view of probability intended as a variant of the frequency theory minus the flaws to which this latter was susceptible. This paper illustrates how, according to Nagel, the issue of the meaning of probability should be addressed; Nagel’s criticism of the major interpretations of probability advanced in the literature, and the main traits of his “truth-frequency” theory.

The placenta’s role as a mediating passage between bodies has been a conceptual resource for feminist theorists and philosophers interested in developing more nuanced explanations of the maternal–fetal relation, a relation that has tended to be identified with maternal and fetal bodies rather than with the placenta between them. I draw on efforts by philosopher Luce Irigaray and her readers to theorise placental relations as a model for the negotiation of differences. In her more recent work, Irigaray figures the placenta (...) as an enveloping space of metaphorical enclosure. The placental relation in Irigaray’s work thus offers insights into the temporal structure of her theory of becoming and can inform a more ‘materialist’ account of pregnancy. I then consider how placental relations are conceptual resources for re-imagining relations of self–other in pregnancy, and for addressing emergent ethical concerns over the transformation of the placenta into a scientific object. Se examina el "trauma" que, según la autora, se manifiesta como "rayones", lo que hace difícil traducirlo o interpretarlo, porque solo se percibe a través de la escucha. Se estudia lo que M. Heidegger exploró como "ser-ahí" y "ser-en-el-mundo", esto es, el estar lanzados al mundo en un de terminado contexto donde construimos nuestra subjetividad y aprendemos a (...) vivir, para entenderlo mediante estas experiencias femeninas singulares. ABSTRACT The text explores the experience lived during the period known as The Violence in Colombia by women now over 80. It examines the "trauma" that, according to the author, manifests itself in the form of "scratches", thus making it difficult to translate and interpret given that it is only perceptible through listening. The article discusses M. Heidegger's notions of Dasein and being-in-the-world, that is, our thrownness into the world in a specific context in which we construct our subjectivity and learn how to live, in order to understand them through these singular feminine experiences. My text is written to answer the questions asked at the APA Meeting's presentation of the book Moral Textures: Feminist Narratives in the Public Sphere by professors María Lugones and Eduardo Mendieta. The answer seeks to clarify that Lugones's infrapolitics position is not so distant from mine. I also address Mendieta's question directed more to the aesthetic domain. There, I seek to show how my position could be taken as a creative effort to extend some of Habermas's early work on (...) the public sphere, and to develop the thesis of the important relations between the aesthetic and the moral realms. Corruption within the private sector has often not been dealt with in Brazil. Organizations may find corrupt acts in its operations or practices, but specific concepts and programs to avoid them are neither concrete nor clear. Some Brazilian stockholders have become aware of the risks involved in unethical procedures and are adopting the Best Practices of Corporate Governance initiative. International agencies have intensively supported organizations and governments in an effort to define policies that inhibit illegal or corrupt cultural habits throughout (...) the world, but Brazilian practitioners show insufficient response. Skepticism may indicate a lack of understanding about how an ethical leadership can guide employees, setting high standards for the organizational culture and climate, clearly defining limits of correct behavior, and creating appropriate codes of ethics. Transparency still has to be discovered as a significant tool to encourage professionalism in performance and reporting of data in Brazilian companies. In this article, we analyze the ethical behavior of the purchasing department of a multinational company in its host country, Brazil. It focuses specifically on the supplier–buyer relationship. The results indicate that despite the negative reputation Brazilians have in business ethics, a company can still develop a positive and ethical relationship with its stakeholders. Communication, transparency, compliance with the company’s code of conduct as well as the supplier’s awareness of the buyer’s code of conduct are the factors which influence the supplier–buyer relationship. Transparency can be used as a tool to reduce corruption, thereby increasing ethical behavior and company image. Good ethical behavior can help to build up a company’s image. (shrink)

In this article we aim to reconstruct some aspects of Davidson's idea of triangulation, and against this reconstruction, ask whether the idea is viciously circular. We begin by looking at the claim that without a triangularn setting, there is no saying what the cause of a being's responses is. In the first section we discuss the notion of relevant similarity, and what difference the presence of a second non‐linguistic being could make for the individuation of a common focus of attention. (...) In the second section we look at the role of a second person in language‐acquisition. It is important that being corrected to ‘go on as others do’ does not yet presuppose thought, and similarity standards can be applied to a learner's reactions even before she is aware of these standards. We also show why Davidson is not committed to any consensus view of correctness. In the last section we discern three charges of circularity that can be levelled against the idea of triangulation. We argue that Davidson can respond to the first two charges, and point to a way of answering the third. But the response we propound raises a new question, namely, why does the second being have to be a speaker or thinker even before the learner is aware of the three points of the triangle? (shrink)

The article is devoted to the study of the phenomenon of ideology in the context of its normative and regulatory function. The author's contribution to the further knowledge of the ideology was the following main conclusions. The emergence of ideology as a regulatory mechanism was primarily due to the transition from a traditional society to a modern one. Ideology is an attribute of modern society, since it acts as an intermediary between a person and social reality, determining and regulating the (...) activities of all people and relations between them in any sphere of society. In the XIX – first half of the XX centuries political ideology in its theoretical form dominated. As a regulatory mechanism, it functioned alongside religion, morality, and law, complementing them. In the second half of the XX – XXI centuries, as a result of the third STR, ideology in an ordinary and practical form became widespread. It began to replace the traditional regulatory mechanisms, surpassing them in the degree of influence on public consciousness and becoming the main mechanism of social regulation. (shrink)

In this paper, I examine the role played by the emotion of admiration in formulating moral judgments. First, I discuss whether and when admiration is a reliable source of moral knowledge, or, on the contrary, it misleads the subject, leaving her prey to forms of uncritical devotion to unworthy objects of admiration. To do so, I try to elucidate which underlying theory of emotions best allows one to characterize admiration as a reliable source of moral knowledge. Second, I introduce the (...) notion of transformative moral experience, understood as a subclass of transformative experiences, and I argue that it is precisely admiration that ensures the rationality of the choices made in such experiences. Finally, in light of this analysis, I show how admiration—together with the constellation of positive and negative emotions connected to the perception of moral exemplarity—acts as a central element for the maintenance of moral integrity. I defend, in particular, the idea that integrity should not be understood as mere coherence, nor as a static maintenance of the moral status quo, but as being firmly rooted in one’s own identity yet open to novelty and especially to the novelty represented by transformative moral experiences. In this paper, I develop the notion of the experiential workspace, or the phenomenal setting generated by the coupling between the enactive body and its affordance-laden environment, in order to carry out a fine-grained analysis of enactive experiential phenomena, in particular those of ordinary lived experience. My purpose is to shed light on some of the ways that empirical methodologies are intrinsically limited in their ability to capture the native phenomena of enactive, embodied experience. Drawing on the work of Merleau-Ponty, (...) I argue that the experiential workspace is characterized by dynamic mutability, emergent norms, and epistemic openness - characteristics that are transphenomenal in nature and thus resistant to empirical measurement. Using concepts from the work of developmental psychologist Lev Vygotsky and feminist philosopher Iris Marion Young, I will show how our embeddedness in an intersubjective world makes the experiential workspace a mercurial, labile phenomenon, characterized by inherently transphenomenal features that are resistant to naturalistic analysis or modelling.
