What is the logical form of judgments, if they have one? This question remains an enigma for any transcendental approach to logical thought. The paper addresses the matter by following the debate between Edmund Husserl and Christoph Sigwart from 1890 to 1904. It shows the pivotal role that the problem of judgment played in this discussion. Since judgments were thought to be both refined mental acts and fundamental logical elements, the related issue was a thumbnail version of the (...) broader conflict between psychology and logic. The paper argues that Husserl, far from overcoming Sigwart’s “Kantian-psychologistic” approach, ends up integrating it into the later stages of his phenomenological work; and that this approach does in fact pose an unavoidable transcendental-genetic problem for Husserl’s phenomenology of logic. The argument intends to contribute to a possible integration of the study of the factual “nature” of men within the horizon of the philosophical logic of knowledge. (shrink)

The article comments on the foregoing article by Christophe Sigwart on concepts of number and compares Sigwart's text to the "intuitionistic" mathematical work developed by Dutch logician and philosopher L. E. J. Brouwer. The two men's positions are compared on such concepts as the intersubjective validity of mathematics, inner time consciousness, and infinite numbers.

Both the current research literature and a tradition stemming from Husserl himself agree that it was Brentano’s notion of intentionality which „gave rise“ to Husserl’s phenomenology. I rely on extensive primary materials, including unpublished sources from four archives, to revisit this thesis. Already a survey of the historical circumstances of Brentano’s second decade in Vienna, when Husserl studied under him, hints at possible discrepancies in the reception of Brentano’s thought, which are further deepened by the editing policy employed by his (...) orthodox students. I analyze an unpublished lecture manuscript of Brentano to find three different notions of intentionality, including a strikingly a-phenomenological one, which I then relate to the discussion by modern scholarship and try to identify those notions of intentionality which were encountered by Husserl as a student of Brentano. Given this heterogeneous matrix of influences, it is far from surprising that a closer look at Husserl’s philosophical juvenilia shows that he misunderstood Brentano’s notion of intentionality and attempted to employ it in a different theoretical context (maybe motivated by an idiosyncratic notion of inner perception). Finally, the notion of intentionality Husserl later attributed to Brentano was probably mitigated to him by indirect sources, including lecture manuscripts copied by the extravagant and less-know student of Brentano, Hans Schmidkunz, and a debate between a contemporary logician Christoph Sigwart and Brentano’s orthodox disciples. The analysis of these transmission mechanisms could reveal a distinct transformation which proved to be instrumental in the development of Husserl’s transcendental phenomenology. The allegedly decisive influence of Brentano’s notion of intentionality at Husserl thus seems to consist in a productive misunderstanding (which apparently corresponds to Brentano’s surprisingly dismissive evaluation of Husserl after Husserl’s departure from Vienna). Intuitions play a relevant role in the acquisition of knowledge. Among those who believe that this is the case, some base their claim on the peculiar phenomenology of intuitions. These theorists often adopt a perceptualist and seeming-based model for their phenomenological description. Deeming intuitions as essentially private phenomena, however, seeming-based descriptions end up supporting a dogmatic view of intuitions as a source of epistemic justifications. I argue that this is because the seeming-based model is incomplete in that it does not (...) consider some virtue-related aspects of the plasticity of intuitions in social contexts. Then, I propose a way of integrating an explanation of these aspects in it through a Neo-Kantian reinterpretation of some of the concepts involved. I will draw from the work of Christoph Sigwart on the so-called Evidenzgefühl that characterizes the phenomenology of intuitions, showing the ties between this feeling and the linguistic, communicative, and social dimension of scientific research. The broader aim is to suggest that it is possible to make an open-minded use of intuitions even when basing their epistemic relevance on their peculiar phenomenology. (shrink)

The immediate purpose of this paper is to expound C. S. Peirce's conception of reasoning as he refined it in his mature reflection on the normative sciences and their hierarchical relations (the dependence of logic on ethics and, in turn, that of ethics on esthetics). In order to clarify adequately Peirce's position, however, it is helpful to consider his rejection of Christoph Sigwart's attempt to ground logical soundness in subjective feeling. What is at stake in this debate is (...) nothing less than Peirce's endeavor to articulate a thoroughly pragmatic understanding of truth, not simply his commitment to argue against subjective approaches to logical questions. Accordingly, the ultimate purpose of this paper is to shed light on the problem of objectivity. From a pragmatist perspective, there is an essential relation between an affectively involved agent and a deliberately conducted, successful inquiry. This alone secures the possibility of objectivity in the only form in which finite, fallible agents can hope to attain or, at least, approximate this ideal. (shrink)

In this article, a little-studied problem of the critical analysis of the philosophical and logical position of the representative of German philosophical tradition Christoph Sigwart in the university philosophy, especially in the work of a Kharkiv private-docent Isidor Prodan is presented. At first, the main periods of the scientific and creative career of Isidor Prodan, including his studying at the Czernowitz Gymnasium and the philosophical faculty at the University of Vienna are considered. His teacher in Vienna was a (...) very famous German and Austrian professor Franz Brentano, the author of the work “Psychology from an Empirical Standpoint” and the founder of “descriptive psychology” and intentionalism. Then his teaching of logic and philosophy at the Gymnasiums of Kishinev, Izmail, Riga, Tartu, and Moscow from 1876 till 1900 is emphasized. Then the features of the teaching and the publications of Isidor Prodan in his “Kharkiv period” are pointed out, during which he was a private-docent at the department of philosophy. Isidor Prodan’s works at this time comprise three areas: 1) History of logic, 2) philosophy of common sense, 3) critique of Kant and Neo-Kantianism. In the last group, his work “The Truth about Kant ” was of great importance. His very important work was the monograph “The Cognition and its Object ”. The positions of well-known philosophers and less-known authors were here analyzed. Isidor Prodan’s critical interpretation of the logical viewpoint of Christoph Sigwart in his two-volume work “Logic” occupies an important place in this analysis. In turn, Isidor Prodan’s important achievement was the popularization of the ideas of this German logician and philosopher, in particular, because of his translation of extracts from the work “Logic”. A regularity theory of causation analyses type-level causation in terms of Boolean difference-making. The essential ingredient that helps this theoretical framework overcome the problems of Hume’s and Mill’s classical accounts is a principle of non-redundancy: only Boolean dependency structures from which no elements can be eliminated track causation. The first part of this article argues that the recent regularity-theoretic literature has not consistently implemented this principle, for it disregarded an important type of redundancies: structural redundancies. Moreover, it is shown that (...) a regularity theory needs to be underwritten by a hitherto neglected metaphysical background assumption stipulating that the world’s causal makeup is not ambiguous. Against that background, the second part then develops a new regularity theory that does justice to all types of redundancies and, thereby, provides the first all-inclusive notion of Boolean difference-making. The question of the holistic structure of an organism is a recurring theme in the philosophy of biology and has been increasingly discussed again in recent years. Organisms have recently been described as complex systems that autonomously create, maintain and reproduce themselves while constantly interacting with their environment. Key focal points include their autopoiesis, autonomy, agency and teleological structure. This perspective marks a significant advancement from the 20th-century viewpoint, which predominantly saw organisms as genetically programmed, randomly generated and blindly selected (...) survival-machines. However, crucial questions about the shape and development of organisms still lack answers. Shape and development are deeply interconnected and seem to require a holistic approach. Here, I will briefly outline a phenomenological perspective which could provide a framework for seeking answers to these fundamental questions. In particular, I propose a common four-fold phenomenal structure of the developing organism and the cognising consciousness, which makes it possible to observe the agential and teleological structure of the organism "from within". This fourfold structure also describes the molecular level and thus provides a general organismic concept. It furthermore corresponds to the four Aristotelian "causes" (conditions). (shrink)

"The overall aim of this book is to understand the character of moral progress, so that making moral progress may become more systematic and secure, less chancy and less bloody. Drawing on three historical examples - the abolition of chattel slavery, the expansion of opportunities for women, and the increasing acceptance of same-sex love - it asks how those changes were brought about, and seeks a methodology for streamlining the kinds of developments that occurred. Moral progress is conceived as pragmatic (...) progress, progress from rather than progress to, achieved by overcoming the problems and limits of the current situation. Two kinds of problems are distinguished: problems of exclusion, found when the complaints of some people are ignored; and problems of false consciousness, present when the oppressed adopt judgments from the ambient society and do not protest their condition. The proposed methodology advocates procedures for listening to voiced complaints and for systematically reviewing the way in which particular self-conceptions, ideals and identities are taken to be appropriate for various groups of people. Through outlining a picture of moral practice, at both the individual and the societal levels, the book seeks to orient moral philosophy away from metaethical questions of realism and towards moral methodology"--. The literature on the nature of understanding can be divided into two broad camps. Explanationists believe that it is knowledge of explanations that is key to understanding. In contrast, their manipulationist rivals maintain that understanding essentially involves an ability to manipulate certain representations. The aim of this paper is to provide a novel knowledge based account of understanding. More specifically, it proposes an account of maximal understanding of a given phenomenon in terms of fully comprehensive and maximally well-connected knowledge of (...) it and of degrees of understanding in terms of approximations to such knowledge. It is completed by a contextualist semantics for outright attributions of understanding according to which an attribution of understanding is true of one just in case one knows enough about it to perform some contextually determined task. This paper aims to develop a novel account of the normativity of assertion. Its core thesis is that assertion has an etiological epistemic function, viz. to generate knowledge in hearers. In conjunction with a general account of etiological functions and their normative import, it is argued that an assertion is epistemically good if and only if it has the disposition to generate knowledge in hearers. In addition, reason is provided to believe that it makes sense to regulate the practice of (...) assertion by a speaker rule—and, more specifically, by a knowledge rule—as so regulating assertion contributes to ensuring that assertion fulfils its etiological function reliably. This handbook article gives a critical overview of recent discussions of epistemic authority. It favors an account that brings into balance the dictates of rational deference with the ideals of intellectual self-governance. A plausible starting point is the conjecture that neither should rational deference to authorities collapse into total epistemic submission, nor the ideal of mature intellectual self-governance be conflated with (illusions of) epistemic autarky.

In this paper, we develop a general normative framework for criticisability, blamelessness and blameworthiness in action. We then turn to the debate on norms of assertion. We show that an application of this framework enables champions of the so-called knowledge rule of assertion to offer a theoretically motivated response to a number of putative counterexamples in terms of blamelessness. Finally, we argue that, on closer inspection, the putative counterexamples serve to confirm the knowledge rule and disconfirm rival views.

This essay examines Nietzsche’s musical ontology and situates it within the naturalist and anti-metaphysical framework evident throughout his corpus. Nietzsche often associated this position with the figure of Dionysus, which plays a leading role in The Birth of Tragedy, his most sustained consideration of music and musical ontology. The essay returns to The Birth of Tragedy in an effort to recover Nietzsche’s musical ontology and its relationship with ontology more generally. Heeding Nietzsche’s own remarks, I read this text in light (...) of his mature philosophy. My analysis draws on the work of the late twentieth-century Nietzschean, Gilles Deleuze, whose distinction between “the virtual” and “the actual” enables us to see what is really at issue in The Birth of Tragedy. This paper develops a novel, bifocal account of trustworthiness according to which both trustworthinesssimpliciter(as in ‘Ann is trustworthy’) and trustworthiness tophi(as in ‘Ann is trustworthy when it comes to keeping your secrets’) are analysed in terms of dispositions to fulfil one's obligations. We also offer a systematic account of the relation between the two types of trustworthiness, an account of degrees of trustworthiness and comparative trustworthiness, as well as a view of permissible trustworthiness attribution.

Judges in multiple US states, such as New York, Pennsylvania, Wisconsin, California, and Florida, receive a prediction of defendants’ recidivism risk, generated by the COMPAS algorithm. If judges act on these predictions, they implicitly delegate normative decisions to proprietary software, even beyond the previously documented race and age biases. Using the ProPublica dataset, we demonstrate that COMPAS predictions favor jailing over release. COMPAS is biased against defendants. We show that this bias can largely be removed. Our proposed correction increases overall (...) accuracy, and attenuates anti-black and anti-young bias. However, it also slightly increases the risk that defendants are released who commit a new crime before tried. We argue that this normative decision should not be buried in the code. The tradeoff between the interests of innocent defendants and of future victims should not only be made transparent. The algorithm should be changed such that the legislator and the courts do make this choice. (shrink)

An epistemic agent A is a false epistemic authority for others iff they falsely believe A to be in a position to help them accomplish their epistemic ends. A major divide exists between what I call "epistemic quacks", who falsely believe themselves to be relevantly competent, and "epistemic charlatans", i.e., false authorities who believe or even know that they are incompetent. Both types of false authority do not cover what Lackey (2021) calls "predatory experts": experts who systematically misuse their social-epistemic (...) status as a cover for predatory behavior. Qua experts, predatory experts are competent and thus could (and maybe sometimes do) help their clients. But should we count them as genuine epistemic authorities? No, I argue, they are false epistemic authorities because, in addition to their practical and moral misconduct, such experts systematically deceive their clients, thereby thwarting the clients’ epistemic ends. This paper considers challenges resulting from the use of advanced artificial judicial intelligence (AAJI). We argue that these challenges should be considered through the lens of value alignment. Instead of discussing why specific goals and values, such as fairness and nondiscrimination, ought to be implemented, we consider the question of how AAJI can be aligned with goals and values more generally, in order to be reliably integrated into legal and judicial systems. This value alignment framing draws on AI safety and (...) alignment literature to introduce two otherwise neglected considerations for AAJI safety: specification and assurance. We outline diverse research directions and suggest the adoption of assurance and specification mechanisms as the use of AI in the judiciary progresses. While we focus on specification and assurance to illustrate the value of the AI safety and alignment literature, we encourage researchers in law and philosophy to consider what other lessons may be drawn.
