My contention in this paper is that Wittgenstein does not 'deconstruct', as some critics have rather loosely suggested, because, as we shall see, the expunging of metaphysical use favoured by Wittgenstein does not amount to the deconstruction of (...) metaphysical appurtenance practised by Derrida. However, there are interesting parallels to be drawn between the two philosophers which I shall try to articulate in the course of this paper. Dans sa présentation de l’ouvrage, Michel Meyer, directeur de la collection «L’interrogation philosophique», décrit le «tour de force» que représente cette édition critique de La rhétorique ou l’art de parler de Bernard Lamy — travail jugé autrefois «impossible» par Geneviève Rodis-Lewis. Elle remplacera avantageusement les deux éditions en facsimilé, celle de 1969 par l’University of Sussex Library et celle de 1980, aux éditions Wilhelm Fink à Munich, seules disponibles jusqu’alors. Mais pour qui? Lamy nous le dit lui-même dans sa préface: (...) «Mon ouvrage [...] ne regarde pas seulement les orateurs, mais généralement tous ceux qui parlent et qui écrivent, les poètes, les historiens, les philosophes, les théologiens». De nos jours, cette nouvelle édition intéressera surtout les historiens des idées et les philosophes du langage. There are a good many insights in Schouls’s book, which is definitely not for first-time readers of the Meditations but for scholars who think they know it all. After reading Schouls’s essay, they will find, however, that where theirs was a vague, mostly negative notion of the understanding, gathered from the famous “wax example,” as the faculty which provides the information the senses can not, Schouls offers a detailed model of the faculty of the pure understanding. In this essay, Schouls (...) has wrought a delicate piece in which each element of the Cartesian clockwork kicks in at the right time to result in a system in which it is the human mind’s nature to bring about progress through science and in which the human essence, mind, ultimately expressed in the freedom of the will, is best realized in science. One drawback that can perhaps be pointed out already is that Schouls makes the Meditations sound like a transcendental argument in favour of the pursuit of science: scientific certainty exists, what does human nature have to be like for this to be possible?, etc. True, Descartes did mean the Meditations to be the foundation for science so that we can “make ourselves, as it were, the lords and masters of nature”, but it was not his intention to start from the premise that Science is possible. He thought he was establishing whether any certainty whatsoever could be achieved. (shrink)

Kim Sang Ong-Van-Cung se donne ici pour objet l’histoire du concept de la création—l’histoire de sa mutation de concept purement théologique chrétien en concept métaphysique avec Descartes. Fort juste cause: on sait à quel point la lecture non informée des Méditations offre matière à distorsion et à fausse interprétation; et tout ce qui replace un texte dans son contexte d’idées est à encourager. Toutefois, l’exposé historique et critique du concept de la création cède la place à la défense des thèses (...) multiples et complexes de l’auteure, qui se meut avec une érudition stupéfiante chez les anciens, les modernes et les postmodernes. Au fil des chapitres, les thèses sont reprises sous différents angles au lieu d’être mieux étayées. Cet ouvrage est frustrant et décevant, car on y devine à la fois des thèses originales et un objectif valable dans l’histoire des idées, mais les thèses ne parviennent pas à se communiquer et l’objectif n’est pas atteint. La passion indéniable que l’auteure exprime à chaque instant pour le sujet ainsi que les connaissances encyclopédiques impressionnantes qu’elle démontre à chaque page sont prometteuses de futurs travaux où un meilleur effort de vulgarisation mettra les idées à la portée d’un public mieux défini. The Cham Balamon people in Vietnam are an ethnic group with long religious and cultural traditions, who give a great importance to preserving their own cultural identity through generations. However, in recent years there are many economic, cultural and social changes in the life of the Cham Balamon community. One of the significant changes in the spiritual life of this community is the conversion of belief from Hinduism to Christianity. We think that this is an outstanding problem that needs to (...) be addressed by formal and comprehensive scientific research projects. We have dispatched several research groups to conduct field trips, deep interviews and sociological surveys on the spiritual life of the Cham Balamon community. This paper is the first step of those researches pointing out the problems and challenges to the Cham Balamon community in Ninh Thuan Province, Vietnam. These are cultural and belief conflicts among people in the community or even among family members. However, we would predict that the biggest challenge is the risk of losing cultural identities that the Cham Balamon community is facing today due to religious conversion. (shrink)

Racism is a key driver of the social, political, and economic injustices that cause and maintain health inequities. Over centuries and across continents, racism has become deeply ingrained within societies. Therefore, we believe that it is our professional and ethical obligation as scientists, and public health scholars specifically, to address racism head on in order to ameliorate racialized health disparities. We argue that greater focus is needed on addressing racism rather than race and how race is described or defined. We (...) offer input from public health scholarship to help bioethicists and other scientists contribute to addressing racism. To do so effectively and comprehensively, public health scholars, bioethicists, and other scientists should work together to identify and implement equity-driven collaborations to eliminate the deleterious effects of racism on individuals, families, and communities. This paper proposes several recurrent neural network-based models for recognizing requisite and effectuation parts in Legal Texts. Firstly, we propose a modification of BiLSTM-CRF model that allows the use of external features to improve the performance of deep learning models in case large annotated corpora are not available. However, this model can only recognize RE parts which are not overlapped. Secondly, we propose two approaches for recognizing overlapping RE parts including the cascading approach which uses the sequence of BiLSTM-CRF models (...) and the unified model approach with the multilayer BiLSTM-CRF model and the multilayer BiLSTM-MLP-CRF model. Experimental results on two Japan law RRE datasets demonstrated advantages of our proposed models. For the Japanese National Pension Law dataset, our approaches obtained an \ score of 93.27% and exhibited a significant improvement compared to previous approaches. For the Japan Civil Code RRE dataset which is written in English, our approaches produced an \ score of 78.24% in recognizing RE parts that exhibited a significant improvement over strong baselines. In addition, using external features and in-domain pre-trained word embeddings also improved the performance of RRE systems. (shrink)

The implementation of inclusive policies is largely dependent on teachers´ willingness to accommodate students with special educational needs (SEN) in mainstream classrooms, which is affected by their perceived competence and attitudes. This study investigated attitudes of pre- and in-service teachers toward students with two types of SEN: challenging behavior and learning difficulties. The three components of attitude (affective, cognitive, and behavioral) were assessed using indirect and direct measures. Results revealed that teachers held negative implicit attitudes toward challenging behavior and learning (...) difficulties, however implicit attitudes did not vary as a function of the type of SEN. Ratings of the stereotypical dimensions warmth and competence and overall ratings of scholastic achievement were affected by professional status and type of SEN. Professional status, implicit attitudes and stereotypical knowledge together explained 52 and 43% of the variance in teachers´ ratings of academic proficiency for students with challenging behavior and learning difficulties, respectively. Results are interpreted within the theoretical framework and implications for teacher training are discussed. (shrink)

This Article takes the perspective of law and philosophy, integrating insights from computer science. First, I will argue that in the era of big data analytics we need an understanding of privacy that is capable of protecting what is uncountable, incalculable or incomputable about individual persons. To instigate this new dimension of the right to privacy, I expand previous work on the relational nature of privacy, and the productive indeterminacy of human identity it implies, into an ecological understanding of privacy, (...) taking into account the technological environment that mediates the constitution of human identity. Second, I will investigate how machine learning actually works, detecting a series of design choices that inform the accuracy of the outcome, each entailing trade-offs that determine the relevance, validity and reliability of the algorithm’s accuracy for real life problems. I argue that incomputability does not call for a rejection of machine learning per se but calls for a research design that enables those who will be affected by the algorithms to become involved and to learn how machines learn — resulting in a better understanding of their potential and limitations. A better understanding of the limitations that are inherent in machine learning will deflate some of the eschatological expectations, and provide for better decision-making about whether and if so how to implement machine learning in specific domains or contexts. I will highlight how a reliable research design aligns with purpose limitation as core to its methodological integrity. This Article, then, advocates a practice of “agonistic machine learning” that will contribute to responsible decisions about the integration of data-driven applications into our environments while simultaneously bringing them under the Rule of Law. This should also provide the best means to achieve effective protection against overdetermination of individuals by machine inferences. (shrink)

In this contribution we will explore some of the implications of the vision of Ambient Intelligence (AmI) for law and legal philosophy. AmI creates an environment that monitors and anticipates human behaviour with the aim of customised adaptation of the environment to a person’s inferred preferences. Such an environment depends on distributed human and non-human intelligence that raises a host of unsettling questions around causality, subjectivity, agency and (criminal) liability. After discussing the vision of AmI we will present relevant research (...) in the field of philosophy of technology, inspired by the post-phenomenological position taken by Don Ihde and the constructivist realism of Bruno Latour. We will posit the need to conceptualise technological normativity in comparison with legal normativity, claiming that this is necessary to develop democratic accountability for the implications of emerging technologies like AmI. Lastly we will investigate to what extent technological devices and infrastructures can and should be used to achieve compliance with the criminal law, and we will discuss some of the implications of non-human distributed intelligence for criminal liability. Gilles de Corbeil figures as the initiator of the scientific teaching of medicine in Paris at a time when medicina became physica. He studied medicine at the famous school of Salerno, and his teaching was based upon Salernitan theories and practice. He showed himself very concerned with teaching methods and attached great importance to memorizing. This explains why he composed medical poetry so as to provide a mnemonic aid for his students. As a teacher, he took care of his students' (...) reading, offering them advise. He insisted on the importance of a personal relationship between teacher and student, evoking his own relationship with his Salernitan masters, but repeatedly criticized the students of his time. The contributions to this volume focus on the issue of privacy, which is often equated with data (...) privacy and data security, location privacy, anonymity, pseudonymity, unobservability, and unlinkability. Here, however, the extent to which predictive and other types of data analytics operate in ways that may or may not violate privacy is rigorously taken up, both technologically and legally, in order to open up new possibilities for considering, and contesting, how we are increasingly being correlated and categorizedin relationship with due process – the right to contest how the profiling systems are categorizing and deciding about us. The essays in Fanon and the Decolonization of Philosophy all trace different aspects of the mutually supporting histories of philosophical thought and colonial politics in order to suggest ways that we might decolonize our thinking. Euthanasia remains controversial in Canada and an issue of debate among physicians. Most studies have explored the opinion of health professionals regarding its legalization, but have not investigated their intentions when faced with performing euthanasia. These studies are also considered atheoretical. The purposes of the present study were to fill this gap in the literature by identifying the psychosocial determinants of physicians’ intention to practice euthanasia in palliative care and verifying whether respecting the patient’s autonomy is important for physicians.

In this contribution, I will argue that the image of a balance is often used to defend the idea of a trade-off. To understand the drawbacks of this line of thought, I will explore the relationship between online security technologies and fundamental rights, notably privacy, nondiscrimination, freedom of speech and due process. After discriminating between three types of online security technologies, I will trace the reconfiguration of the notion of privacy in the era of smart environments. This will lead to (...) an inquiry into the metaphor of the scale, building on the triple test regarding the justification of the limitation of fundamental rights such as privacy. The conclusion will be that in the case of a trade-off, infringing measures will have to be balanced by effective safeguards. No trade-off without balance. (shrink)

Nursing migration: global treasure hunt or disaster‐in‐the‐making?International nurse migration — moving from one country to another in the search of employment — is the focus of this article. The majority of member states of the World Health Organization report a shortage, maldistribution and misutilisation of nurses. International recruitment has been seen as a solution. The negative effects of international migration on the ‘supplier’ countries may be recognised today but are not effectively addressed.Nurse migration is motivated by the search for professional (...) development, better quality of life and personal safety. Pay and learning opportunities continue to be the most frequently reported incentives for nurse migration, especially by nurses from less‐developed countries. Career opportunities were considered key incentives for nurses emigrating from high‐income countries. Language was reported to be a significant barrier. The positive global economic/social/professional development resulting from international migration needs to be weighed against a substantial ‘brain and skills drain’ experienced by supplier countries. The vulnerable status of migrant nurses is also of concern in certain cases. The focus on short‐term solutions as opposed to resolving the problem of a worldwide shortage of nurses causes great concern. Recent initiatives attempt to curb or channel international recruitment. The delicate balance between recognising the right of individual nurses to migrate and a collective concern for the health of a nation’s population must be achieved. (shrink)

Law, Human Agency and Autonomic Computing interrogates the legal implications of the notion and experience of human agency implied by the emerging paradigm of autonomic computing, and the socio-technical infrastructures it supports. The development of autonomic computing and ambient intelligence âe" self-governing systems âe" challenge traditional philosophical conceptions of human self-constitution and agency, with significant consequences for the theory and practice of constitutional self-government. Ideas of identity, subjectivity, agency, personhood, intentionality, and embodiment are all central to the functioning of modern (...) legal systems. But once artificial entities become more autonomic, and less dependent on deliberate human intervention, criteria like agency, intentionality and self-determination, become too fragile to serve as defining criteria for human subjectivity, personality or identity, and for characterizing the processes through which individual citizens become moral and legal subjects. Are autonomic âe" yet artificial âe" systems shrinking the distance between (acting) subjects and (acted upon) objects? How âe~distinctively humanâe(tm) will agency be in a world of autonomic computing? Or, alternatively, does autonomic computing merely disclose that we were never, in this sense, âe~humanâe(tm) anyway? A dialogue between philosophers of technology and philosophers of law, this book addresses these questions, as it takes up the unprecedented opportunity that autonomic computing and ambient intelligence offer for a reassessment of the most basic concepts of law. This timely book tells the story of the smart technologies that reconstruct our world, by provoking their most salient functionality: the prediction and preemption of our day-to-day activities, preferences, health and credit risks, criminal intent and spending capacity. Mireille Hildebrandt claims that we are in transit between an information society and a data-driven society, which has far reaching consequences for the world we depend on. She highlights how the pervasive employment of machine-learning technologies that inform so-called ‘data-driven agency’ threaten (...) privacy, identity, autonomy, non-discrimination, due process and the presumption of innocence. The author argues how smart technologies undermine, reconfigure and overrule the ends of the law in a constitutional democracy, jeopardizing law as an instrument of justice, legal certainty and the public good. Finally, the book calls on lawyers, computer scientists and civil society not to reject smart technologies, explaining how further engaging these technologies may help to reinvent the effective protection of the rule of law. The COVID-19 pandemic introduced many restrictions to in-person interactions, and remote social interactions may be especially important for managing loneliness when such restrictions are in place. However, it is unclear how social interactions are related to loneliness when in-person interactions are limited. Data were collected between February 2021 and March 2022 from a sample of 581 university students. Participants reported their loneliness and participation in positive in-person or remote social interactions each day for 14 days. Results from dynamic structural equation (...) models showed that participants felt less lonely than they usually felt on the days they engaged in positive remote interactions at the within-person level. Moreover, participants generally felt less lonely when engaging more frequently in remote interactions, but only when in-person interactions were restricted (between-person level). Some of these results varied by changing COVID-19 restrictions. Finally, for participants who felt lonelier in general, the effect of positive in-person and remote interactions on loneliness was less strong. These findings suggest that social interactions may buffer loneliness but are not as impactful for those who experience greater loneliness. (shrink)

We emphasize the relevance to cognitive psychology of Feldman and Levin's theoretical position. Traditional views of motor control have failed to clearly separate “production control” at the level of motor command, based on task-independent CV (control variables), from intentional “product control” based on task-dependent parameters. Because F&L's approach concentrates on the first process (trajectory formation), it can distinguish the product control stage.

Ho Chi Minh City is a city which has received and accumulated many cultures and religions from around the world, from Oriental culture to Western civilization, from West Asian and East Asian cultures to South Asian and Southeast Asian cultures. The cultures of some African and Latin American countries have also arrived recently. Most world religions, regional religions, national religions and even new religions are present in the city. The characteristic of religions and cultural identities of Ho Chi Minh City (...) is in the process of transformation, receipt and selection of the cultural and religion elements of those cultures. Based on the research results of a scientific research on the topic, “Cultural and religion life in Ho Chi Minh City in the era of international integration”, we would like to share some opinions about the characteristics of culture and religions in the process of cultural exchange, acculturation and accumulation of Ho Chi Minh City from traditional to modern stage. There is a prominent phenomenon in the religious life of Vietnam, which is the emergence of “new religions”. These phenomena have not only made the religious space of the nation more complex and multi-dimensional but also challenged stability and sustainable development within the religious communities in this key economic region. Having studied the new religious phenomenon in recent years, we have noted its progress and widespread characteristics within the ethnic communities. While it may appear that "new religion" is a simple (...) and gentle concept and practice, it is in fact, intrinsically related to and has significant implications on the social life of the community members. However, there is a growing concern, considerable suspicion and anxiety with regards to its impacts on individuals, families, social and cultural traditions, beliefs and religions; many have opined that it is radically changing the peaceful cohabitation of diverse religious traditions, revealing a potential for conflicts across groups. Based on the religious reality of the Southern region of Vietnam, the Center for Religion Studies has implemented a project regarding new religions in Ho Chi Minh City and the problems faced by the religious policy in Vietnam. Les notions de «mort» et de «mourir», parfois utilisées sans distinctions dans la littérature, font référence à deux dimensions fort différentes pour la personne en fin de vie, de même que pour toutes les personnes appelées à en prendre soin . Alors que la personne malade voit venir la mort, elle doit vivre son mourir. La mort succède ainsi au mourir, dans le temps. Par ailleurs, une réflexion d’ordre philosophique permet de préciser que la mort s’avère une ordonnance de la (...) nature, elle est privation de la vie et un mystère. Et en tant que mystère, elle prendra forme selon les différentes croyances attribuées à l’immortalité de l’âme. Quant au mourir, il est l’épreuve par excellence d’une situation-limite. De plus, en dépit du caractère unique et individuel de cette expérience nouvelle pour tous, il assume différents visages. Si l’espoir de «connaître une belle mort» se conçoit aisément, le mourir n’en demeure pas moins le moment le plus tragique de l’existence humaine. (shrink)
