The book contains essays in honor of Victor Raskin. The contributions are all directly related to some of the major areas of work in which Raskin's scholarship has spanned for decades. The obvious connecting idea is the encyclopedic script-based foundation of lexical meaning, which informs his pioneering work in semantics in the 1970s and 1980s. The first part of the book collects articles directly concerned with script-based semantics, which examine both the theoretical and methodological premises of the (...) idea and its applications. Script-based semantics is the foundation of both Raskin's ground-breaking work in humor research (addressed by the articles in part 2) and in Ontological semantics (addressed in part 3), the most recent development of script-based semantics. The fourth part is dedicated to a less-known, but equally important, strand of Raskin's research, the applications of linguistics to other fields, including writing, lexicography, and professional applications (e,g., tourism). Overall, the book provides and up-to-date, in-depth discussion of an influential strand of the discussion on semantics and its most recent developments and influence on other seemingly unrelated fields, such as Cognitive Linguistics. The paper is devoted to the study of humor as an important pragmatic phenomenon bearing on cognition, and, more specifically, as a cooperative mode of non-bona-fide communication. Several computational models of humor are presented in increasing order of complexity and shown to reveal important cognitive structures in jokes. On the basis of these limited implementations, the concept of a full-fledged computational model for the understanding and generation of humor is introduced and discussed in various aspects. The model draws upon the (...) authors ' General Theory of Verbal Humor, with its six knowledge resources informing a joke, and on SMEARR, a sophisticated semantic-network-based computational lexical environment. The relevance of the approach to the interpretation, generation, and cognitive structure of humor is discussed in the broader context of the nature of the cooperative non-bona-fide modes of communication. 'Ontological Semantics' introduces a comprehensive approach to the treatment of text meaning by computer, arguing that being able to use meaning is crucial to the success of natural language processing applications.

This book offers a critical examination of those theories and advances a new argument for punishment's justification, calling it the 'duty view'.

This project explored what constitutes “ethical practice of mathematics”. Thematic analysis of ethical practice standards from mathematics-adjacent disciplines (statistics and computing), were combined with two organizational codes of conduct and community input resulting in over 100 items. These analyses identified 29 of the 52 items in the 2018 American Statistical Association Ethical Guidelines for Statistical Practice, and 15 of the 24 additional (unique) items from the 2018 Association of Computing Machinery Code of Ethics for inclusion. Three of the 29 items (...) synthesized from the 2019 American Mathematical Society Code of Ethics, and zero of the Mathematical Association of America Code of Ethics, were identified as reflective of “ethical mathematical practice” beyond items already identified from the other two codes. The community contributed six unique items. Item stems were standardized to, “The ethical mathematics practitioner…”. Invitations to complete the 30-min online survey were shared nationally (US) via Mathematics organization listservs and other widespread emails and announcements. We received 142 individual responses to the national survey, 75% of whom endorsed 41/52 items, with 90–100% endorsing 20/52 items on the survey. Items from different sources were endorsed at both high and low rates. A final thematic analysis yielded 44 items, grouped into “General” (12 items), “Profession” (10 items) and “Scholarship” (11 items). Moreover, for the practitioner in a leader/mentor/supervisor/instructor role, there are an additional 11 items (4 General/7 Professional). These results suggest that the community perceives a much wider range of behaviors by mathematicians to be subject to ethical practice standards than had been previously included in professional organization codes. The results provide evidence against the argument that mathematics practitioners engaged in “pure” or “theoretical” work have minimal, small, or no ethical obligations. (shrink)

In his recent book, Killing in War, Jeff McMahan sets out a number of conditions for a person to be liable to attack, provided the attack is used to avert an objectively unjust threat: (1) The threat, if realized, will wrongfully harm another; (2) the person is responsible for creating the threat; (3) killing the person is necessary to avert the threat, and (4) killing the person is a proportionate response to the threat. The present article focuses on McMahan's second (...) condition, which links liability with responsibility. McMahan's use of the responsibility criterion, the article contends, is too restrictive as an account of liability in general and an account of liability to be killed in particular. In order to defend this claim, the article disambiguates the concept of liability and explores its role in the philosophical analysis of the permission to cause harm to others. (shrink)

Según la doctrina del “discurso del odio”, todo mensaje calificable como tal supondrá por definición un abuso del derecho fundamental a la libertad de expresión. Esta doctrina, elaborada en distintas etapas por el TEDH a lo largo de las últimas décadas, ha sido seguida por la jurisprudencia española como pauta interpretativa de los llamados “delitos apologéticos”. En atención a esta linea, la ratio legis de este grupo de delitos consistiría, simplemente, en la prohibición del discurso del odio. La vaguedad de (...) esta idea ha llevado a un sector doctrinal a abandonar el paradigma del bien jurídico, para defender como alternativa la distinción entre daño y ofensa. En el presente trabajo se expondrán y valorarán críticamente los presupuestos y efectos de la “doctrina del odio” y se relativizará la eficacia práctica del binomio “daño-ofensa”, para llegar a una conclusión común: ambas concepciones son tautológicas. Recent work in cerebral neurology should be used to fashion a new synthesis with anthropological studies. Beginning with Paul D. Madean's model of the triune brain, we explore Ralph Wendell Burhoe's question whether creative processes result from a coadaptation, perhaps in ritual itself, of genetic and cultural information. Then we examine the division of labor between right and left cerebral hemispheres and its implications for the notions of play and “ludic recombination.” Intimately related to ritual, play may function in the (...) social construction of reality analogous to mutation and variation in organic evolution. Finally, we consider how our picture of brain functioning accords with some distinctive features of the religious systems dominant in human cultures. (shrink)

One of the most interesting questions raised in Cecile Fabre’s Cosmopolitan War concerns war for the sake of resources. Fabre argues that it is sometimes permissible to go to war for the sake of resources that the poor are entitled to. I agree with this, but I think it is true only in very restricted circumstances. I consider a number of arguments in favour of resource wars, showing many of them to fail. The most promising argument, I suggest, is that (...) those who possess resources that have unjustly been secured are complicit in posing future threats by contributing to a market for unjustly secured resources. Whilst this argument has some promise, even it, I suggest, is in no way decisive. (shrink)

I further defend the Duty View of punishment outlined in the book, responding to criticisms of that view. I also challenge the plausibility of retributivist accounts offered in response to the challenges to that view developed in The Ends of Harm.

This article clarifies and further defends the view that the right to be presumed innocent until proven guilty, protected by Article 6(2) of the European Convention of Human Rights has implications for the substantive law. It is shown that a ‘purely procedural’ conception of the presumption of innocence has absurd implications for the nature of the right. Objections to the moderate substantive view defended are considered, including the acceptability of male prohibits offences, the difficulty of ascertaining intentions of legislatures and (...) the proper role of prosecutorial discretion. Dans ce monumental ouvrage devenu un classique du commentaire, Victor Goldschmidt, fidele a sa methode structurale et combattant l'idee selon laquelle la pensee de Rousseau ne serait pas organisee, demontre qu'il est possible d'expliciter les principes du systeme de Rousseau. Denoncant l'opposition recue entre la genese et la structure, l'auteur procede a un examen minutieux de la constitution de ces principes, en s'appuyant sur les deux Discours et l'Emile - Rousseau lui-meme disait que son systeme y etait formule -, (...) mais surtout sur le Discours sur l'inegalite, dont le present travail etudie le contenu et les prolongements. Prenant le temps de considerer ce texte comme une oeuvre proprement philosophique et d'etablir la these des interlocuteurs du philosophe pour mieux determiner sa pensee, Victor Goldschmidt montre comment s'elabore et progresse cette pensee et en restitue ainsi le sens, la coherence, en un mot l'unite substantielle. The Next Release Problem (NRP) is a combinatorial optimization problem that aims to find a subset of software requirements to be delivered in the next software release, which maximize the satisfaction of a list of clients and minimize the effort required by developers to implement them. Previous studies have applied various metaheuristics, mostly genetic algorithms. Estimation of Distribution Algorithms (EDA), based on probabilistic modelling, have been proved to obtain good results in problems where genetic algorithms struggle. In this paper we (...) propose to adapt three EDAs to tackle the multi-objective NRP in a fast and effective way. Results show that EDAs can be applicable to solve the NRP with rather good quality of solutions. Furthermore, we prove that their execution time can be significantly reduced using a per-iteration solution subset selection method while maintaining the overall quality of the solutions obtained, and they perform the best when limiting the search time as in an interactive tool that requires fast responsiveness. The experimental framework, code and datasets have been made public in a code repository. (shrink)

Amsterdam: John Benjamins; Sanchez-Curry 2020. “Interpretivism and Norms.” Philosophical Studies 177 (4): 905– 930.; Mölder 2021. “Interpretivism Without Judgement- Dependence.” Philosophia 49 (2): 611–615.; Slors 2015. "Interpretivism and the Meaning of Mental State Ascriptions." Studia Philosophica Estonica, 10 (2): 18–27.]. Part of the (...) virtue of interpretivism lies in its ability to provide an answer to elminativist arguments without falling into the assumptions and problems of intentional realism. However, some recent developments in semantic expressivism applied to normative expressions could help to build an alternative theory to interpretivism that would enjoy the same virtues. The aim of this paper is to present and defend an expressivist approach to the status of folk psychological ascriptions. According to this view, mental states ascriptions are evaluative and non-descriptive statement that express or reflect certain normative standards or values of the attributor. After presenting the view and contrasting it with interpretivist positions, with which expressivism shares important motivations and claims, I present two arguments to favor the expressivist analysis. In line with the first argument, expressivism can account for fundamental aspects of disagreements regarding mental attributions while the second highlights the capacity of the view to explain the widespread justificatory and exculpatory uses of mental states ascriptions. Este artigo tem como objetivo abordar uma intervenção realizada nas turmas do primeiro ano do ensino médio de uma escola localizada na cidade de Ipu-Ceará no ano de 2018, na disciplina de filosofia, com o tema ''Mito da caverna de Platão''. Assim, foram feitas leituras em sala de aula de alguns trechos do livro A República de Platão que aborda o tema, juntamente com o livro didático Filosofando: Introdução à filosofia das autoras Maria Lúcia de Arruda Aranha e Maria Helena (...) Pires Martins com o intuito de referenciar as cavernas contemporâneas. Deste modo, foi utilizado o método de ensino cuja intenção era a de apresentar livros e recursos audiovisuais para fins educacionais. Com a compreensão do mito da caverna de Platão, portanto, conseguimos vinculá-lo a um assunto da realidade dos alunos: a indústria da beleza que padroniza uma determinada forma de comportamento nos indivíduos, causando-lhes sérios problemas físicos e psicológicos. Para sustentar essa ideia, trabalhou-se com dois videoclipes das cantoras Beyoncé (Pretty Hurts) e Colbie Caillat (Try) na tentativa de despertar a reflexão da necessidade de autovalorização e aceitação física, em um distanciamento das cavernas patriarcais. Enfim, esse artigo manifesta uma enorme contribuição para os jovens do ensino médio, especialmente, na sua autoaceitação e formação identitária na medida em que compreendem os padrões como formas de aprisionamentos. Assim, conclui-se que estas discussões são relevantes por despertarem temas caros e reais aos jovens, tanto que promovem adoecimentos psicológicos. O propósito é o de expandir a discussão de tal forma que eles mesmos possam dialogar sobre o assunto. (shrink)

Comment penser une philosophie du droit chez Epicure, sans le trahir? Comment degager des principes politiques dans l'oeuvre de celui dont la maxime etait de vivre cache, loin des affaires administratives concernant la Cite? Le defi peut paraitre ambitieux, c'est pourtant celui que releve Victor Goldschmidt dans cet ouvrage. Et il puise a la source meme, au coeur des dernieres sentences des Maximes Capitales, grace auxquelles il thematie et structure une pensee politique s'inscrivant parfaitement au sein de la logique (...) de la doctrine epicurienne. En effet, pour vivre bien, il est necessaire de penser le vivre ensemble avec des lois pour toile de fonds. La pensee epicurienne se deploie autour des concepts directeurs que sont l'interet, la reciprocite, la securite, le juste se definissant en reference a l'utile. Le droit epicurien veut s'imposer comme une realite et depasser le simple statut de doctrine du droit. C'est dire toute la portee de cette etude, et la place qu'on doit accorder a la pensee epicurienne dans la philosophie politique. (shrink)

I argue that same-sex divorce presents a different kind of potential constraint to the agency of persons pursuing the dissolution of their marriage; a constraint upon one’s counterstory and the reconstitution of one’s personal identity. The dialectic within the paper mirrors the movements that I have had to make as I have sought to constitute and reconstitute myself throughout my divorce process. Beginning from a juridical perspective, I examine how the constraints on same-sex divorce present constraints on one’s agency that (...) are antithetical to the spirit of a liberal democratic conception of freedom of movement. I then explore the role of narrative in my self-(re)constitution, as well as the limits of the narrative and counterstories, when the institutional framework of the State fails to acknowledge the change in my State-sanctioned personal relationship. I end by arguing that this view from the law ignores the ways in which we relationally constitute ourselves, and in so doing covers over the harms done to persons that find themselves in a married-yet-not state of limbo. The article discusses some of the fundamental conceptual and theoretical aspects of rational choice and moral order. A distinction is drawn between constitutional interests and compliance interests, and it is argued that a viable moral order requires that the two interests somehow be brought into congruence. It is shown that with regard to the prospects for a spontaneous emergence of such congruence, a distinction between two kinds of moral rules which we call trust-rules and solidarity-rules is of crucial importance.

This article is a defence of a differentiated offence of rape. A differentiated offence is an offence which can be completed in a number of different ways that cannot be captured in a simple definition. It is argued that such an offence would meet several concerns that have been expressed in the feminist literature about the law of rape. It would assist certainty, it would reduce the extent to which the offence focuses on the conduct of the complainant, it would (...) allow the law to express that violence is central to the offence of rape where violence is present, but it would also allow convictions of rape where there is no violence. The argument is developed through critical engagement with the law of rape as set out in the Sexual Offences Act 2003. The Sexual Offences Act, it is argued, fails adequately to meet the concerns outlined above. (shrink)

Conhecimento e sorte parecem dois conceitos excludentes, isto é, em ordem de atribuirmos conhecimento a alguém, tal sucesso cognitivo deve excluir elementos de sorte da aquisição intelectual. Entretanto, desde o artigo de Edmund Gettier “Is Justified True Belief Knowledge?” (1963), tem se reconhecido cada vez mais a envergadura que elementos de sorte assume no conhecimento, a ponto de chegarmos a uma conclusão cética no campo epistemológico. A questão que fica, então, é como solucionar a atribuição de conhecimento, com fatores de (...) sorte praticamente onipresentes. Dito isso, o objetivo do trabalho será dois: (i) primeiro, irei expor os desdobramentos do debate da sorte epistêmica, ou seja, mostrar sua amplitude, classificações, conceituação e algumas respostas ao problema. Após (ii) pretendo argumentar sobre as vantagens de se abordar a sorte epistêmica fora do campo proposicional a partir de uma abordagem da epistemologia das virtudes que foque em outros bens epistêmicos além da crença verdadeira. From Fodor and Pylyshyn’s celebrated 1988 systematicity argument in favour of a language of thought , a challenge to connectionist models arises in the form of a dilemma: either these models do not explain systematicity or they are implementations of LOT. From consideration of this challenge and of systematicity in domains other than language, defenders of connectionism have mounted a parallel systematicity argument against LOT which results in a new self-defeating dilemma, what I call here the systematicity challenge challenge : (...) either LOT does not explain nonlinguistic systematicity, or it is in no better position than its rivals to explain any systematicity, even linguistic systematicity. In this paper, first, I critically examine the SCC and some considerations that seem to support it. Second, I offer a response to the SCC by: showing that LOT was never meant to be a cognitive model restricted only to linguistic systematicity, and formulating a new argument in favour of LOT from nonlinguistic systematicity. Third, I argue that there is a central assumption underlying the SCC and maintain that it is mistaken. I conclude that the classical systematicity challenge continues to be fully valid for linguistic and nonlinguistic domains. (shrink)

This article attempts to re-establish the importance of Foucault's work for an understanding of the way in which modern law operates. This argument has two stages. Firstly, there is a critique of the interpretation of Foucault's work by legal and sociological thinkers. It is argued that by reading the term ‘juridical’ as synonymous with the term ‘law’ in Foucault, people miss the substance of Foucault's argument. The term juridical describes an arrangement and a representation of power rather than the law. (...) This is made clear through a critique of J. S. Mill's On Liberty which is shown to make a juridical distinction between power and a free space of action which is unsustainable. Secondly, Foucault's genealogy of power relations is recast from the perspective of a legal theoretician. Foucault's history of power relations is constructed from historical differences in the mode of operation of power and discourse. By analysing these differences and their relationship to the mode of operation of law, an account of the place of modern law in Foucault's genealogy is established. Modern law operates between Foucault's concepts of government and discipline. It provides a key way in which government decisions can adjust the relationships between disciplinary institutions. This introduces the idea that law begins to operate in the perspective of the complete lives of individuals rather than just to prevent certain actions. Law, then, operates in accordance with what Foucault calls ‘bio-power’. (shrink)

I am extremely grateful to Daniel Farrell, Hamish Stewart, Kasper Lippert-Rasmussen and Suzanne Uniacke for their careful, imaginative and probing responses to The Ends of Harm: The Moral Foundations of Criminal Law in this special issue of Criminal Law and Philosophy. It is especially gratifying that philosophers of this calibre, not all of whom have worked directly on the philosophy of punishment and the philosophy of criminal law, have engaged with Ends in this way.One of my ambitions in writing Ends (...) was to connect the philosophy of punishment more directly with a set of broader issues in normative ethics than is common in the philosophy of punishment. I hoped this would encourage others to see the justification of punishment as a small part of a more general normative theory of permissible harm. Le présent article offre une nouvelle interprétation du concept aristotélicien d' « imagination » ou phantasia par les moyens d'une lecture attentive du Traité de l'âme, III, 3, tout particulièrement de son début. Aristote soutient que ses prédécesseurs ne peuvent expliquer comment l'erreur se produit. Mais c'est également une difficulté pour sa propre explication des formes de base de la perception et de la pensée, et Aristote introduit la phantasia précisément pour répondre à cette question. Il soutient qu'elle ne peut (...) être réduite aux autres états mentaux et offre donc une nouvelle explication causale du contenu, laquelle explique comment un état mental peut être aussi bien vrai que faux. The present article offers a new interpretation of Aristotle's concept of « imagination » or phantasia through a close reading of On the Soul, 3. 3, with special attention to the chapter's opening. Aristotle argues that his predecessors cannot explain how error can ever occur. But it is equally a difficulty for his own account of the most basic types of perception and thought, and Aristotle introduces phantasia precisely to answer this problem. He argues that it cannot be reduced to other mental states and then offers a new causal account of content which explains how a mental state can be either true or false. (shrink)

Adherents as well as detractors of the normativity of mental content agree that its assessment crucially depends on the assessment of a principle for believing what is true. In this paper, I present an alternative principle, which is based on possession conditions for pure thinking or mere entertaining. I argue that the alternative approach has not been sufficiently emphasised in the literature and has two important merits. First, it yields a direct analysis of the normativity of mental content, which is, (...) furthermore, independent of arguably non-normative notions such as truth. Second, the approach suggests new and challenging lines of response to central non-normativist objections. (shrink)
