This article examines the complex relationship between culture, values, and ethics in mental health care. Cultural competence is a practical, concrete demonstration of the ethical principles of respect for persons, beneficence (doing good), nonmaleficence (not doing harm), and justice (treating people fairly)—the cornerstones of modern ethical codes for the health professions. Five clinical cases are presented to illustrate the range of ethical issues faced by mental health clinicians working in a multicultural environment, including issues of therapeutic boundaries, diagnosis, treatment choice, (...) confidentiality and informed consent, and the just distribution of limited health care resources. Surrogate (proxy) decision makers must make research decisions for people with dementia who lack decision-making capacity. Proxies’ decision-making processes are minimally understood. We randomly assigned 82 proxies of AD patients to informed consent for one of three hypothetical protocols with differing levels of risk and benefit. Proxies answered questions about potential benefits of the described research to the patient and society, as well as about whether they would enroll their relative and why or why not. Proxies interested in enrolling their (...) relative cited the potential for direct benefit to their relative, altruism, and trust in researchers. Those declining cited risks, inconvenience, and stage of illness. Proxies weighed numerous factors, incorporating both substituted judgment and best interests standards in their decision-making processes. Although further empirical work is needed to understand the influences on and adequacy of proxies’ decision making regarding research, these findings can help inform policy regarding surrogate consent. Recent studies show that psychiatry residents express a relatively greater need for ethics curricula than their colleagues in other specialties. Such studies have been limited in their generalizability because they were conducted at one site. This study of 151 psychiatry residents at seven U.S. psychiatry programs aims to address that limitation. Residents were surveyed on issues pertaining to ethics and professionalism education. Participants were found to support such curricula during training and to value its relevance to the practice of psychiatry. (...) Motivated by aspects of reasoning in theories of physics, Robin Giles defined a characterization of infinite valued Łukasiewicz logic in terms of a game that combines Lorenzen-style dialogue rules for logical connectives with a scheme for betting on results of dispersive experiments for evaluating atomic propositions. We analyze this game and provide conditions on payoff functions that allow us to extract many-valued truth functions from dialogue rules of a quite general form. Besides finite and infinite valued Łukasiewicz logics, also Meyer (...) and Slaney’s Abelian logic and Cancellative Hoop Logic turn out to be characterizable in this manner. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Criminal Law, Pain Relief, and Physician Aid in DyingFaye Girsh, Ed.D., Executive DirectorMadam:The article by Cantor and Thomas on “Pain Relief, Acceleration of Death, and Criminal Law” (KIEJ, June 1996) was a tortured attempt to develop criteria for the humane and compassionate physician who tries to serve the needs of a patient in unremitting pain. There are three areas that merit comment.The authors dealt with pain medications that might (...) have the undesirable side effect of causing death. They did not mention tolerance, which usually occurs in a patient with chronic pain and which would require exceedingly high doses to be effective. They did not mention barbiturates, which are preferable to opiates in causing death and which are used increasingly by compassionate physicians to answer the pleas of their suffering patients, but for which there is no excuse about alleviating pain. Would the criminal law just call the prescription of a lethal dose of barbiturates a reckless act and require conviction? Fortunately, juries, as the authors point out, do not balance these formulas on the head of a pin. When they see the circumstances under which these doctors do help their patients, they choose to nullify the law and would ignore the suggestions made in this article.The authors refer to the “consent” of the patient. They do not mention that these doctors are operating with more than consent; they are administering these medications because suffering patients are begging them to put them out of their pain and the indignities of the dying process. The article discusses the process as though it were the same as consent to elective surgery. These patients—with AIDS, cancer, and hopeless neurological degeneration—are not simply agreeing to a procedure; they are desperately seeking a way out. If the criminal law were to develop criteria for physician aid in dying, certainly one of them should be the active, witnessed, repeated request of such a patient for a certain, quick, painless, gentle death.The third point is that physicians do not face prosecution when administering no treatment to a patient whose life could be saved with treatment but who chooses not to receive it. This has been upheld by the U.S. Supreme Court; no criteria for suffering, alternatives, terminality, justifiability, or unbearability are required. The doctor can stand by while the patient dies what may be a protracted, difficult death, but it is within the law. What matters in this situation is the decision of the patient to refuse treatment, and that is absolute. How ironic that the patient who cannot refuse treatment must, with his or her doctor, jump through all these hoops to achieve a peaceful death.One worries that the physician who must balance the risk of “risky pain relief” against the accusation of recklessness will err in the direction of allowing [End Page 103] the patient to bear the pain rather than help with a dose of analgesics that might be considered beyond the stipulated “risk.”Why don’t we just be honest about it? Allow dying or hopelessly ill patients to make the decision about what they want by passing a carefully defined law allowing euthanasia rather than balancing the risk and trying to determine the “purpose” of the physician’s ministrations. We protect some patients from themselves while allowing others almost complete autonomy to make the choice of ending their lives. In recent discussions in this journal, Moti Mizrahi defends the claim that knowledge equals epistemic certainty. Howard Sankey finds Mizrahi’s argument to be problematic, since, as he reads it, this would entail that justification must guarantee truth. In this article, I suggest that an account of the normativity of justification is able to bridge the gap between Mizrahi’s proposal and Sankey’s objections.

Science and technology studies scholars have turned their attention to the materiality of objects and buildings in order to examine what they make users do in practice. Taking a close look at a therapeutic community in a psychiatric day care center for teenagers, this paper joins these discussions by exploring the materiality of “spaces of care” as part of the center’s everyday practice. The analysis incorporates the concepts of scripts and dispositifs to describe the conditions of possibility in which caregivers (...) and youths may position themselves in relation to others and to the space itself. This paper describes how spaces of care offer open, enticing, and variable conditions for fostering a dynamic of personal and relational responses as part of the care work. In this sense, the material environment entails potentialities in ways that are unpredictable but nonetheless consequential. Rather than arguing that material arrangements and things act, this paper draws attention to their impact via their potential within dispositifs of care that request participants’ attentiveness and responsiveness. Describing these potentialities brings out the subtler requirements of material environments in care practices that aim at circumventing the coercion of disciplinary spaces and their impersonal classifications. ABSTRACTWe report the findings of an experimental study that tested the contributions of semiotic and critical discourse studies on immigration. Two-way analyses of variance were conducted to examine the effects of immigration terminology on measures of attribution and empathy. Our experiment revealed a statistically significant difference in attribution. Participants who received a narrative prompt with the term ‘illegal immigrant’ evaluated the character's situation with internal attribution, and thus deserving of any negative outcomes, such as racial profiling, deportation, and separation from (...) one's family. This finding is consistent with studies that have reported the concrete effects of immigrant labels on public opinion and policy, as migrants become scapegoats for macro-structural forces. Our experiment did not reveal an effect on empathy, demonstrating the complicated symbolic and material effects produced by immigration discourse. (shrink)

Did modern American social thought take a wrong turn when it followed John Dewey and William James? In this searching history of early twentieth-century political theory, James Hoopes suggests that, contrary to conventional wisdom, these pragmatic philosophers did not provide the basis for a socially-minded political theory. Dewey and James did not provide intellectual safeguards against the amoral acceptance of realpolitik and managerial elitism that has given liberalism a bad name. Hoopes finds a more substantial basis for liberal political theory (...) in the communitarian-based pragmatism of Charles Sanders Peirce. Had modern social thought been influenced by Peirce, argues Hoopes, society could be seen as a set of interpretive relationships rather than a collection of discrete interests to be managed from the top down by elitist experts. Hoopes traces the influence of James and Dewey in the thought of Walter Lippman, Reinhold Niebuhr, and Mary Parker Follett. He concludes with a critical examination of contemporary thinkers, most notably Richard Rorty, who believe that James and Dewey offered the most socially useful philosophy within the pragmatic tradition. Combining philosophy, political theory, history, and close textual analysis in original ways, Community Denied offers a bold departure from previous studies of the subject and demonstrates the damage done to liberalism by reliance on a philosophy with no way of truly conceptualizing community. This will become particularly clear in the context of incomplete expressions. Our approach takes as a point of departure total freedom ofinterpretation in combination with the parallel application (...) of soft constraints on possible interpretations. These constraints can be contextual, intonational or syntactic in nature. The integration of pragmatic andsyntactic/semantic information in a system of ranked constraints is proposed to correctly derive the optimal interpretations in cases of nominal anaphorization, determiner quantification and elliptical comparatives.
