Current methods of obtaining consent for emergency neonatal research are flawed. They risk aggravating the distress of parents of preterm and other sick neonates. This distress, and the inevitable time constraints, compromise understanding and voluntariness, essential components of adequately informed consent. Current practice may be unjust in over-representing babies of more vulnerable and deprived parents. The research findings may thus not be generalisable. Informing parents antenatally about the possible need for emergency neonatal research, with presumed consent and scope for opting (...) out, would address these problems. It would spare parents of sick neonates, already terrified by their baby's illness, further distress. Experience with opting out suggests that recruitment might increase, thus generating earlier results, without compromising parental understanding of the nature and purpose of the research. (shrink)

An anencephalic infant, who came to be known as Baby K, was born at Fairfax Hospial in Falls Church, Virginia, on October 13, 1992. From, the moment of birth and repeatedly thereafter, the baby's mother insisted that aggressive measures be pursued, including cardiopulmonary resuscitation and ventilator support, to keep the baby alive as long as possible. The physicians complied. However, following the baby's second admission for respiratory failure, the hospital sought declaratory relief from the court permitting (...) it to forgo emergency life support on the grounds that “a requirement to provide respiratory assistance would exceed the prevailing standard of medical care,” and that “because any treatment of their condition is futile, the prevailing standard of medical care for infants with anencephaly is to provide warmth, nutrition, and hydration.” The United States Court of Appeals for the Fourth Circuit ruled in favor of the baby's mother, citing the federal Emergency Medical Treatment and Active Labor Act , which contained no “standard of care” exception to the requirement to provide “treatment necessary to prevent the material deterioration of the individual's condition.” An appeal to the United States Supreme Court was rejected. The baby died some two and one-half years later of cardiac arrest during her sixth visit to the emergency department of Fairfax Hospital for respiratory failure. (shrink)

This paper argues that the proliferation of the new term ‘baby man’ has an impact on reconstructing established gender relationships and resisting China's authoritarian political power in a highly-censored online environment. This study employs feminist critical discourse analysis to investigate how Chinese feminism adopts the discursive construction of ‘baby man’ and how they echo the complex historical and sociocultural backgrounds through a case study of 43 posts containing ‘baby man’ on Chinese social media. The finding suggests that (...) the term ‘baby man’ is employed in discursive strategies, namely, double irony, the blunt resistance against both gender and power relationships that deconstruct the heteropatriarchal gender norm through the mother – son female gaze and contempt for the nation's past and current population policy. It argues that despite perennial censorship, these three discursive strategies help reconstruct the extant gender hierarchy backed by conservative Confucianist ethics and represent a grassroots challenge to the political authoritarianism indoctrinated by the state. Since the 1980s, a number of medical researchers have suggested that in the future it might be possible for men to become pregnant. Given the role played by the right to reproductive liberty in other debates about reproductive technologies, it will be extremely difficult to deny that this right extends to include male pregnancy. However, this constitutes a reductio ad absurdum of the idea of reproductive liberty. The Brisbane Supreme Court has denied an Australian woman’s request to harvest and freeze her dead fiancé’s sperm for future impregnation. After she was denied access to the sperm, the woman learnt that her fiancé may have been a sperm donor and she began checking to find out if his sperm was still available. Given what we know, there is a good ethical argument that the woman should have access to the sperm and should be allowed to have her dead (...) fiancé’s child.Another aspect of this case is that it illustrates the way in which ethics, law, and personal opinion can differ. The nineteenth century theologian, author and poet Charles Kingsley was a notable populariser of Darwinian evolution. He championed Darwin’s cause and that of honesty in science for more than a decade from 1859 to 1871. Kingsley’s interpretation of evolution shaped his theology, his politics and his views on race. The relationship between men and apes set the context for Kingsley’s consideration of these issues. Having defended Darwin for a decade in 1871 Kingsley was dismayed to read Darwin’s account of the (...) evolution of morals in Descent of Man. He subsequently distanced himself from Darwin’s conclusions even though he remained an ardent evolutionist until his death in 1875. (shrink)

Historians of antiquity are trained to be suspicious of accounts that may retroject onto the early years of figures, who were later dominant, positive traits that plausibly were exhibited only later, in essence the creation of a mythology. In the case of the Emperor Augustus, who exercised a firm control on the Roman world for over forty years after the defeat of his rival M. Antonius and introduced a new form of government, the probability that the years of his ascent (...) to supreme power were subjected to careful recasting is very high. Here I examine an argument that was presented in 2004 on the very beginning of Octavian's public life, which, if correct, reveals a stuttering start by a young man inexperienced in the realities of Roman politics at a tumultuous moment in Roman history. This article offers three reflections on the nature of the metaphysical ‘wall’ erected between the ‘Included’ and the ‘Excluded/Other’ by the concept of private property and its implementation in a state’s legal apparatus. The first reflection explores the reality of the concept of private property, using Louis Althusser’s conception of ideology, in order to demonstrate that the liberal conception of private property masks power operating on two levels: the formal, repressive state apparatus, and the deeper, the personal, the real, the (...) actual level, which allows the Included to act upon ego in ways that negatively affect the Excluded/Other found in the ideological state apparatus. The second argues that the masked power that is private property permits war to be waged by the Included as against the Excluded/Other at two levels: intra-state and inter-state. This reveals a paradox in the distinction between Included and Excluded/Other: while the distinction demonstrates the allocation of power over resources, the reality is that every individual on earth is both Included and Excluded/Other. The final reflection briefly considers what could replace private property as a means of allocating goods and resources within a society. (shrink)

This review essay contains four parts. The first briefly recounts the contours of Rafe Blaufarb’s thesis in The Great Demarcation: The French Revolution and the Invention of Modern Property. The review is not intended to be a full assessment of the book; rather, Blaufarb’s work sets the stage for the focus of my reflections, which begin in Part 3. Using Louis Althusser’s understanding of law, we can see how the demarcation identified by Blaufarb made possible a further deployment of bourgeois (...) law, which perpetuates the dominant ideology ensuring the concentration of resources in a small number of people, seemingly without obligation to the great majority who hold no power in relation to any resources. Part 4 explains the true inequity which this demarcation has wrought, establishing and perpetuating deep divisions between those who hold the ‘social function’ inherent in property—the power unilaterally to alter social relationships—and those who do not—those who suffer the alteration of social relationships to their detriment. In short, property itself is an ideology of power, the legacy of which is not equality, but exploitation. Part 5 concludes that the great demarcation, which Blaufarb so skilfully explicates, turns out to be nothing in which humankind ought to take any pride. Rather, it has served and serves the purposes of the few to work untold misery and hardship upon the many. (shrink)

Woman and Authority in Ian McEwan's "Conversation with a Cupboard Man" and Its Film Adaptation The paper analyzes Ian McEwan's short story "Conversation with a Cup-board Man" and its film adaptation made in Poland by director Mariusz Grzegorzek in 1993. In many works McEwan shows women in more positive light than men. This short story, however, deals with a mother's total domination of her son's life. The text is in the form of first-person narration of the son but it is (...) the figure of the mother that is of utmost importance.The protagonist describes his life from his childhood. His mother wanted him to remain a baby as long as possible, depriving him of free will and leaving him totally dependent on her. Her attitude changed when she found a partner. The protagonist, now seventeen, had rapidly to grow up from a baby into an adult. Childhood and total passivity remain for him ideals to be pursued, and a cramped cupboard becomes his favourite environment. The influence of his upbringing remains with him for ever. After analyzing the short story the paper explores parallels to other works by McEwan and other writers. The importance of the use of the indeterminate article in the title is discussed. Attention is given to the issue of defamiliarization. And the ambivalent attitude of the protagonist towards his mother is examined.The second part of the paper deals with the film adaptation. Grzegorzek has imaginatively developed the short story into a full-blown feature film. It preserves most of the important elements of the short story, at the same time providing new material largely in keeping with the original's tone. The director not only extrapolates, inventing new scenes to fill in the short story's unspoken gaps but also skilfully changes the narrator's comments into scenes, and this is not purely a change from telling into showing. The paper discusses the imagery of the movie, especially Oedipal motifs, references to Christ, and the impression of blood-red lips. It stresses the stronger role of the teacher from the home and his influence on the only independent action of the protagonist—the revenge on Pus-face. It is also important that the film omits any verbal expression of the protagonist's hatred towards his mother. (shrink)

Behavioural welfare economics has lately been challenged on account of its use of the satisfaction of true preferences as a normative criterion. The critique contests what is taken to be an implicit assumption in the literature, namely that true preferences are context-independent. This assumption is considered not only unjustified in the behavioural welfare economics literature but unjustifiable – true preferences are argued to be, at least sometimes, context-dependent. This article explores the implications of this ‘critique of the inner rational agent’. (...) I argue that the critique does not support a wholesale shift away from the use of true preferences as an evaluative standard in normative economics; instead, the critique implies that behavioural welfare economists need to inquire into and establish the ‘source’ of particular context-dependent choices in individuals’ decision-making. The source determines the permissibility of correcting individuals’ context-dependent choices and can, in some situations, support decisive welfare judgements. (shrink)

Finally, our argument suggests that the relationship and the distinction between literature and philosophy cannot be made in terms of a distinction between aesthetic and epistemological categories. All philosophy is condemned, to the extent that it is dependent upon figuration, to be literary and, as the depository of this very problem, all literature is to some extent philosophical. The apparent symmetry of these statements is not as reassuring as it sounds since what seems to bring literature and philosophy together is, (...) as in Condillac's argument about mind and object, a shared lack of identity or specificity. Contrary to common belief, literature is not the place where the unstable epistemology of metaphor is suspended by aesthetic pleasure, although this attempt is a constitutive moment of its system. It is rather the place where the possible convergence of rigor and pleasure is shown to be a delusion. The consequences of this lead to the difficult question whether the entire semantic, semiological, and performative field of language can be said to be covered by tropological models, a question which can only be raised after the proliferating and disruptive power of figural language has been fully recognized.
