This article integrates previously missing components of government quality into the governance-piracy nexus in exploring governance mechanisms by which global obligations for the treatment of IPRs are effectively transmitted from international to the national level in the battle against piracy. It assesses the best governance tools in the fight against piracy and upholding of intellectual property rights (IPRs). The instrumentality of IPR laws (treaties) in tackling piracy through good governance mechanisms is also examined. Findings demonstrate that: (1) while all governance (...) tools under consideration significantly decrease the incidence of piracy, corruption-control is the most effective weapon; (2) but for voice and accountability, political stability and democracy, IPR laws (treaties) are instrumental in tackling piracy through government quality dynamics of rule of law, regulation quality, government effectiveness, corruption-control, and press freedom. Hence, the need for a policy approach most conducive to expanding development is to implement an integrated system of both IPRs and corollary good governance policies. Moreover, our findings support the relevance of good governance measures in developing countries wishing to complement their emerging IPR regimes. (shrink)

This is a critical assessment of today presentations of Jesus of Nazareth’ Kingdom of God in so-called historical-exegetical books. Three of them are selected for a minute criticism. It follows a brief exegesis of all then important Gospel texts about the Kingdom of God as a «future event» or as «present» and «already come» in Jesus ministry. After a close scrutiny, only one Gospel passage (Luke 17:20-21) can be used with some doubts for sustaining that Jesus has proclaimed a Kingdom (...) of God already present. The article concludes with a brief exposition of the conceptions of the historical Jesus view about the Kingdom, and some consequences for the modern transpositions of his view. (shrink)

We shall begin with the presentation of the map of the disputations on causation in that work (I), then will refer to the position of Fonseca on the definition of cause (II), the relation between cause and principle (III) and, finally, his defense of the Aristotelian four causes (IV).

Antônio de Castro Alves was born on 1 March 1847 on the Fazenda das Cabaceiras (Cabaceiras Farm) in the state of Bahia, and died in July 1871 in Salvador, the state capital. For this short twenty-four year span of his life he represented, as no one else in Brazil did, the myth of the Romantic poet and hero.His literary vocation became clear very early on. Coming from a well-to-do family, he studied law in Recife (the capital of Pernambuco), Salvador and (...) São Paulo. He fell in love with a Portuguese actress, Eugênia Câmara, ten years older than himself, and had the deep experience of a love affair with her that shocked the moral provincialism of contemporary Catholic monarchist Brazil. Like many writers of the period he wrote plays, and had great success with the drama Gonzaga, or the Minas Revolution, about the (abortive) attempt to free Brazil from the Portuguese yoke, which had been made in Minas Gerais in the eighteenth century. But it was in poetry – Espumas flutuantes (‘Floating Foam’, 1870) as well as the posthumous A cachoeira de Paulo Alfonso (‘Paulo Alfonso's Waterfall’, 1876) and Os escravos (‘The Slaves’, 1883) – that Castro Alves stood out on the country's literary scene. Recent neuro-psychoanalytic literature has emphasized the view that our subjective identity rests on ancient subcortical neuro-psychic processes expressing unthinking forms of experience, which are “affectively intense without being known” (Solms and Panksepp, 2012). Devoid of internal representations, the emotional states of our “core-Self” (Panksepp, 1998b) are entirely “projected” towards the external world and tend to be discharged through instinctual action-patterns. However, due to the close connections between the subcortical and the cortical midline brain, the emotional drives may also find a (...) way to be reflected within an intrinsic self-referential processing, evident when the organism is not actively engaged with the external world. Thanks to such endogenous functioning, the core-Self emotional dispositions are not overtly executed, but they are organized within coherent dynamic mental structures, called “feeling-toned complexes” by C.G. Jung and “unconscious phantasies” by Melanie Klein. The intrinsic self-referential dynamism of the ‘brainmind’ originated from REM sleep arousal and then evolved in the resting-state activity of a complex of cortico-limbic midline brain structures (CMS), also called Default Mode Network (DMN). From our neuro-ethological perspective, it is sustained by an “introverted” SEEKING activity leading to the subjective exploration of internally constructed virtual scenarios. This “mind wandering” function, implicated in dreaming, fantasy processing, remembering and thinking, is the essence of the imaginative function and constitutes the first form of reflection, where intentions and drives gain a primordial form of conscious (but not self-conscious) representation. During postnatal development, this original (“archetypal”) imaginative function is slowly attuned in a relational “transitional” space and may be expressed first in non-verbal and eventually in abstract-verbal social communicative patterns. Our view has noticeable implications for psychotherapy. Instead of trying to directly modify interpersonal, extrinsic relationships (a top-down approach), dysfunctional emotional-relational patterns may be modified by a process in which the patient is helped to let-go of the perceived feeling-objects in favor of an immersion, via the actual feeling, from the superficial level of perception towards a void feeling-state, empty of images. Only starting from this “anoetic” feeling-state, the deep imaginal creative and re-structuring self-referential activity may be reactivated by a process of spontaneous imagination. (shrink)

The storage problem is the problem of explaining how concepts could be stored in the mind if the mind is something material. David Oderberg has defended the immateriality of the human intellect on the basis of the storage problem. The general idea of the argument is that concepts possess features that make them categorially incapable of being stored in any material locus. Yet, they are stored in the mind. Hence, the mind is immaterial. In this paper I propose that Oderberg’s (...) argument cannot be accepted. First, I argue that on one reading the argument leads to absurdity and is inconsistent with Oderberg’s Thomism. Secondly, I argue that even on another, weaker reading of the argument, Oderberg has no plausible and adequate grounds for accepting it, and the grounds he does provide in favor of the argument seem in tension with Thomism. A menudo considerada como oración por influencia de la colonialización intelectual, diversos trabajos actuales han puesto en duda esta definición. Este trabajo pretende mostrar esta práctica desde una perspectiva estética, etnoescenológica y semiótica con el fin de resaltar otros elementos antropológicos de la performance como las transferencias energéticas, la vinculación con la naturaleza o el uso profundo de los sentidos.

This paper argues that though Derrida is correct to bring to the fore the undecidability that is contained in his political notion of the democracy to come, his account does not extend the aporia of undecidable politics far enough. Derrida himself makes evident this gap. Though politics may be structured with undecidability, there are times when direct, decisive and definitive political interventions are required. In his campaign against capital punishment, the blitzing campaigns in Bosnia and Iraq, and in his call (...) for les villes-refuges, Derrida makes decisive appeals which somehow seem to contradict the undecidability he sees as arch-structuring. Alain Badiou’s thinking about time as a subjective, decisive intervention executed within his ontological framework of undecidability and multiplicity can serve to extend the aporia of undecidability inherent in politics, ultimately giving an account for both the undecidability that structures politics and the decisive timely interventions that would seem to contradict Derridean undecidability. ABSTRACT I present a new model of the self-regulation of virtue that integrates perspectives on emotion, cognition, and motivation. Across three vignette-based studies in US/uk (N = 1,540), I developed through exploratory and confirmatory factor analysis a multi-item measure of broadening and defensive responses, the Self-Regulation of Virtue Inventory (SRVI). I applied that measurement model to two new scenarios portraying prototypical moral exemplars (selected from a set of 12) and fitted structural models that identify key antecedents: motivational dispositions (regulatory focus (...) and hedonic orientation) and moral comparisons (opinion- and ability-based). The findings were consistent with network analysis, providing initial evidence of their robustness. By integrating literatures on motivation, emotion, social cognition and comparison within a self-regulation framework, I provide initial evidence to advance theory on moral self-regulation and moral education, with practical implications on how to maximise the upsides of virtue while mitigating or channelling its possible drawbacks. It is common to assume of an “objectivist” stage of Zubiri, prior to his meeting with Heidegger in Freiburg. However, if we analyze Zubiri’s philosophy before his stay in Freiburg, we already find a “metaphysical” orientation, and not merely an objectivist one. This orientation is intrinsically related to the early appearance of the notion of “reality” in his courses. The appearance of his concept of reality is at least partially motivated by Zubiri’s early reading of Heidegger’s habilitation thesis on Duns (...) Scotus. Zubiri discovered in Heidegger the possibility of trying to carry out a phenomenological characterization of reality, which took him beyond the conception, basically idealistic, of being as a “position” or as a “belief.” With Heidegger, Zubiri was able to sustain that reality is not something extra animam. However, Zubiri could not follow Heidegger in his conceptualization of reality based on human existence, and with this he began his own path in philosophy. A path that, in a certain sense, breaks with all phenomenology, because reality is located at a moment prior to the meaning of things for a subject or for a human existent. And yet, a path that continues the phenomenological claim of a descriptive fidelity to the things themselves. (shrink)

The article investigates one of the positions of Zubiri with respect to the problem ofGod, which the author terms the “cosmic way” to distinguish it from the better-known “wayof relegation”. In his “cosmic way,” Zubiri elaborates an argument for the existence of Godstarting from the data of the physics of his time, in particular, the cosmology of the “BigBang.” Undoubtedly, the “way of relegation” is the most characteristic of Zubiri’s philosophy, and the one which is in best agreement with the (...) whole corpus of his work. And theadvantages of the “way of relegation” stand out especially when it is compared to the “cosmic way”. But this does not mean that the “cosmic way” cannot be considered criticallyfrom the point of view of its own merits.El artículo investiga uno de los planteamientos de Zubiri en torno al problema de Dios,y que el autor denomina “vía cósmica” para distinguirla de la más conocida “vía de la religación”. En su vía cósmica, Zubiri elaboraba un argumento sobre la existencia de Dios apartir de los datos de la física de su tiempo, especialmente a partir de la cosmología del “BigBang”. Sin embargo, la vía de la religación es la más característica de la filosofía de Zubiri,y la más acorde con el conjunto de su filosofía. Las ventajas de la vía de la religación destacan especialmente cuando se la compara con la vía cósmica. Ello no obsta para que la víacósmica de Zubiri pueda ser considerada críticamente desde el punto de vista de sus propios méritos. (shrink)

Antonio Rosmini-Serbati was one of the first natural law scholars to bring natural law thinking into a conversation with the market economic order that was beginning to emerge in Europe in the 19th century. His reflections on matters such as the origin, nature, and limits of private property, the role of the state, and the nature of human reason show him to be a unique, innovative thinker who nonetheless was determined to work within the parameters of Catholic doctrine.
