The past decade has seen a burgeoning of scholarly interest in conscientious objection in health care. Specifically, several commentators have discussed the implications that conscientious objection has for the delivery of timely, efficient, and nondiscriminatory medical care. In this paper, I discuss the main argument put forward by the most prominent critics of conscientious objection—what I call the Professional Duty Argument or PDA. According to proponents of PDA, doctors should place patients’ well-being and rights at the center of their professional (...) practice. Doctors should be prepared to set their personal moral or religious beliefs aside where these beliefs conflict with what is legal and considered good medical practice by relevant professional associations. Conscientious objection, on this account, should be heavily restricted, if even allowed at all. I discuss two powerful objections against PDA. The first objection, which I call the fallibility objection, notes that law and professional codes of conduct are fallible guides for ethical conduct and that conscientious objection has in the past and continues today to provide a check on aberrations in law and professional convention. The second, which I call the professional discretion objection, states that restrictions on conscientious objection undermine one of the cornerstones of good medical practice, namely, a practitioner’s right to independent professional judgment. I argue that these two objections give us reason to retain conscience clauses in professional codes of conduct. (shrink)

El texto de esas conferencias es el que ahora, forma este libro. En él analiza el momento dinámico de la realidad, lo que denomina su «dar de sí». Si en Sobre la esencia la realidad era definida como «de suyo», ahora se completaba esa definición afirmando que es, además un «dar de sí». De suyo, la realidad (...) da de sí. Tal podría ser el resumen más apretado de esta obra, que añade precisiones muy importantes a los libros ya publicados en esta misma colección. (shrink)

Organ transplant shortages are ubiquitous in healthcare systems around the world. In response, several commentators have argued for the adoption of an opt-out policy for organ transplantation, whereby individuals would by default be registered as organ donors unless they informed authorities of their desire to opt-out. This may potentially lead to an increase in donation rates. An opt-out system, however, presumes consent even when it is evident that a significant minority are resistant to organ donation. In this article, we defend (...) a mandated choice framework for consent to deceased organ donation. A mandated choice framework, coupled with good public education, would likely increase donation rates. More importantly, however, a mandated choice framework would respect the autonomous preferences of people who do not wish to donate. We focus in particular on the Australian healthcare context, and consider how a mandated choice system could function as an ethical means to increase the organ donation rate in Australia. We make the novel proposal that all individuals who vote at an Australian federal election be required to state their organ donation preferences when voting. (shrink)

Many ethicists argue that we should respect persons when we distribute resources. Yet it is unclear what this means in practice. For some, the idea of respect for persons is synonymous with the idea of respect for autonomy. Yet a principle of respect for autonomy provides limited guidance for how we should distribute scarce medical interventions. In this article, however, I sketch an alternative conception of respect for persons—one that is based on an ethic of mutual accountability. I draw in (...) particular upon Stephen Darwall’s writings on respect and the second-person standpoint. I consider the implications of this conception of respect for the distribution of scarce, lifesaving healthcare resources. A second-personal account of respect rules out aggregative approaches to distribution, and instead requires that we give individual consideration to the claims that persons in need make on the resources in our control. The principles that we use to govern our allocation of resources, furthermore, should be principles that are acceptable to all reasonable agents. Building on this insight, the final section of this paper considers how a principle of need can be used as a means to make decisions about the allocation of lifesaving resources. -/- . (shrink)

Friedrich Nietzsche, who sought to understand very deeply an inner tension of human feeling, brought up the "superman" as a proposal for the overcoming of man through a force derived from the individual himself, in order to transvalue the dichotomies, errors and prejudices that denied existence, for the sake of its own affirmation. The proposal of overcoming man, announced by Nietzsche in the second half of the nineteenth century, returns later, but no longer through the idea of a force derived (...) from the individual himself, but through his improvement by means of technological devices, promising to make man into a "superhuman". The following work intends to present two proposals for the overcoming of man, it is through Nietzsche and transhumanism philosophy. It is going to be shown that one of the two proposals comes by the idea that man must be overcome due to its decadence, seen by its denial of the world and its instincts, the other proposal is that man is not the final stage of evolution, therefore it must be overcome with tecnological enhacements. F.W.J. Schelling (1775-1854), le plus precoce de philosophes puis l'un des plus ages, a pati, de son vivant comme apres sa mort, de la proximite de Fichte et surtout de Hegel qui l'a supplante dans le jugement de la posterite. Mais il est en passe de combler son retard grace en particulier a l'impulsion donnee depuis un demi-siecle aux recherches sur l'idealisme allemand. Le premier volume de cet ouvrage se propose de presenter le devenir de Schelling sous le signe du (...) systeme vivant. La derniere philosophie de Schelling est analysee dans le second tome. Elle est presque tout entiere posthume, a l'exception de la Preface a Cousin (1834) et de quelques autres textes brefs. La dualite philosophique, enseignee a Berlin, est l'ultime avatar de ce qui etait de facon latente une philosophie en deux. L'auteur s'attache ici a expliquer en detail les motifs et les problemes de cette dichotomie tardive, mais fondee. (shrink)

Meses después publicó la última de esas lecciones bajo el título de La dimensión histórica del ser humano. El presente volumen recoge el texto de las tres conferencias, más la versión escrita de la última de ellas. La tesis que Zubiri desarrolla en estas lecciones es que el ser humano es (...) a la vez y necesariamente individual, social e histórico, y que estas dimensiones vienen exigidas por su propia realidad específica, que es pluralizante, continuante y prospectiva. In this work, Xavier Lakshmanan argues for a textual linguistic approach to Christian theology. The book takes its shape in conversation with Paul Ricoeur’s philosophical thought, demonstrating how Ricoeur’s hermeneutic philosophy can inform the way Christians interpret and appropriate biblical narratives without delimiting the potential of the text or eroding the distinctiveness of its language. The text can be appropriated in ways that address the fundamental questions of life. New meanings are constantly generated from the same text in order (...) to describe and redescribe existence, and form human identity. The self is linked inseparably with narrative; every interpretation of narrative is at the same time a reinterpretation of the self and of its possibilities. In such interpretative processes, the reader interprets the text and the text interprets the reader at the same time through an interactive reading. Accordingly, the aim of interpreting the narratives is to open up the world of the text in front of the text and in front of the reader. Here what the text uncovers is the «textual» structure of existence itself. The reality that unfolds through language discloses the possibilities of existence, and in this way the text creates a future. A revised identity emerges against the horizon of that future to give a coherent and dynamic account of the self against a horizon of hope. (shrink)

It is shown that axiomatic extensions of intuitionistic propositional calculus defining univocally new connectives, including those proposed by Gabbay, are strongly complete with respect to valuations in Heyting algebras with additional operations. In all cases, the double negation of such a connective is equivalent to a formula of intuitionistic calculus. Thus, under the excluded third law it collapses to a classical formula, showing that this condition in Gabbay's definition is redundant. Moreover, such connectives can not be interpreted in all Heyting (...) algebras, unless they are already equivalent to a formula of intuitionistic calculus. These facts relativize to connectives over intermediate logics. In particular, the intermediate logic with values in the chain of length n may be "completed" conservatively by adding a single unary connective, so that the expanded system does not allow further axiomatic extensions by new connectives. This article examines the British colonial theft of Indigenous sovereignty and the particular obstacles that it presents to establishing just social relations between the colonizer and the colonized in settler states. In the first half, I argue that the particular nature of the crime of sovereign theft makes apologies and reparations unsuitable policy tools for reconciliation because Settler societies owe their very existence to the abrogation of Indigenous sovereignties. Instead, Settler states ought to return sovereignty to the land’s Indigenous peoples. (...) In the second half of this paper, I take up some of the practical questions of how this might be done and anticipate a number of objections. Giving up sovereignty would not mean dispossessing the millions of colonists who currently reside in these countries of their homes and property – but it does mean rethinking the constitutional makeup of a country and how that serves to benefit the different peoples who make their homes there. In this paper we present a new framework of idealization in biology. We characterize idealizations as a network of counterfactual and hypothetical conditionals that can exhibit different “degrees of contingency”. We use this idea to say that, in departing more or less from the actual world, idealizations can serve numerous epistemic, methodological or heuristic purposes within scientific research. We defend that, in part, this structure explains why idealizations, despite being deformations of reality, are so successful in scientific practice. In this article we defend the inferential view of scientific models and idealisation. Models are seen as “inferential prostheses” (instruments for surrogative reasoning) construed by means of an idealisation-concretisation process, which we essentially understand as a kind of counterfactual deformation procedure (also analysed in inferential terms). The value of scientific representation is understood in terms not only of the success of the inferential outcomes arrived at with its help, but also of the heuristic power of representation and their capacity to (...) correct and improve our models. This provides us with an argument against Sugden’s account of credible models: the likelihood or realisticness (their “credibility”) is not always a good measure of their acceptability. As opposed to “credibility” we propose the notion of “enlightening”, which is the capacity of giving us understanding in the sense of an inferential ability. (shrink)

Pendant les premiers siècles de l'Eglise, la croyance eucharistique est restée une possession immuable et réaliste. Au Moyen Age, Bérenger de Tours le premier a mis en doute la présence réelle, la réalité de la présence du Christ - son âme, son corps, sa divinité - dans les hosties consacrées. D'où la réplique des théologiens dogmatiques sous la forme d'une physique accentuant le réalisme de la présence eucharistique souvent en termes excessifs. Descartes a mis fin à la physique eucharistique et (...) l'a remplacée par une véritable philosophie eucharistique qui montre l'adaptation de son système et de sa " théologie blanche " à la présence réelle et au sort miraculeux des espèces. Désormais, les philosophies eucharistiques se préoccupent surtout du sort des espèces. Elles sont l'enjeu et le fil rouge des théories eucharistiques, dont la plus célèbre, la plus fouillée, est celle de Leibniz, en correspondance avec Bossuet, puis en discussion serrée avec le jésuite Des Bosses. De la controverse a surgi l'idée de lien substantiel, que Blondel devait reprendre deux siècles plus tard. Il faut considérer comme des intermèdes les querelles protestantes, qui ne font guère avancer l'énigme et la solution ; de même, du côté catholique, la tentative théosophique de Franz Baader ne scrute pas le fond de la question, conversion du pain et du vin en corps et sang, transfert et non adduction - permanence des espèces. Toutefois, le XVIIe siècle, malgré la rigueur janséniste, mais sous la pression de Pascal, de l'Ecole française et de la dévotion au Sacré-Cœur voit s'infléchir la théologie sacramentelle et engendre la dévotion au saint sacrement de l'autel. C'est ensuite la belle et émouvante spiritualité christique du XIXe siècle qui retentit sur la théologie de l'eucharistie et permet à Maurice Blondel, lecteur du P. Faber et de Mgr Gay, d'ébaucher une philosophie eucharistique qui est comme le canevas et le modèle de sa " métaphysique de la charité ". Neste artigo, submetendo a breve análise a digressáo sobre a maiêutica “socrática”, tentamos demonstrar em que medida a escolha dos personagens do Teeteto de Platáo determina a natureza do debate desenvolvido ali. Inspirados pelo critério hermenêutico da escola de Tübingen-Miláo , julgamos que a recomposiçáo dos perfis dramático-biográficos daqueles personagens, em plena harmonia com a teoria do escrito-jogo de Platáo apresentada na parte conclusiva do Fedro e completada, em seu aspecto dramático-compositivo pelo livro III da República , seja elemento central (...) para um correto ajuste de perspectiva a partir da qual deve-se ler o diálogo. Nesta sede, recorremos também a alguns passos do tratado matemático exposto no VII livro da República de Platáo, texto fundamental para a reconstruçáo dramática dos personagens do Teeteto e, por via de consequência, para uma correta justificaçáo da leitura que propomos. Diz Cornford que o diálogo Parmênides inicia “a série das obras nas quais Platão pela primeira vez confronta a sua própria doutrina com os principais sistemas dos predecessores e a submete a um exame crítico”. Sim, mas é ainda mais: a reconstrução do diálogo à luz do método hermenêutico de Tübingen-Milão nos leva a colher a estrutura na qual se entrecruzam as visões ontológicas em três níveis, do mundo físico às Ideias e das Ideias aos Princípios primeiros. O elemento-chave do (...) desenvolvimento estrutural não apenas teorético, mas também dramático, é o vínculo que se interpõe entre as duas partes do diálogo. Apenas a unidade entre as duas partes torna plausível e justificável o percurso dialético registrado no texto, como tentar-se-á evidenciar. A primeira parte do Parmênides traz a teoria das Ideias, mas abre mão de uma protologia. Não obstante isso, uma visão completa do texto põe em jogo o Uno e o/s Outro/Outros, fundamentos dos Princípios supremos. Buscar-se-á trazer à luz aqui os nexos estruturais da argumentação que nos leva a uma visão totalizante da realidade em Platão. (shrink)

INTELIGENCIA Y LOGOS es el segundo volumen de la trilogía que sobre el tema general de LA INTELECCION HUMANA publica el filósofo XAVIER ZUBIRI (San Sebastián, 1898). Este volumen es continuación del primero (INTELIGENCIA SENTIENTE) y se completa con el tercero y último, INTELIGENCIA Y RAZÓN. La obra completa analiza, entre otros muchos, los temas y problemas fundamentales de la disciplina filosófica conocida con los nombres de Teoría del conocimiento, Epistemología y Crítica, replanteando en una dimensión hasta ahora inédita (...) cuestiones tales como las de la intelección, el juicio, el conocimiento, la razón, el saber, la comprensión, la verdad, la ciencia, etc. No hay duda de que el enfoque que Zubiri da a estas cuestiones es profundamente original. Desde los tiempos de Parménides la filosofía ha solido resolver el problema de las relaciones entre la inteligencia y la realidad en el punto que constituye el tema central de este volumen, el «logos», cuya expresión más clásica es el «juicio». Zubiri se opone frontalmente a esta tradición, que según él conduce a un logicismo formalista que desvirtúa el papel de la inteligencia e impide el acceso a la realidad. Afirmar que el logos es la estructura fundamental de la intelección supone logificar la inteligencia, es decir, hacer de ella una facultad puramente formal y conceptiva. El resultado de esto es el conceptismo y el idealismo, los males seculares de la filosofía. Frente a esto, Zubiri afirma la preeminencia de la intelección sobre el logos. La inteligencia, como quedó expuesto en el volumen anterior, meramente actualiza las cosas en tanto que «reales». El logos es un modo ulterior de la intelección que permite expresar lo que esas cosas reales son «en realidad». El desarrollo de esta idea central constituye el argumento del presente libro. Este nuevo volumen de las obras de Xavier Zubiri recoge de forma íntegra tres cursos, que hasta ahora se encontraban inéditos, o de los que sólo se conocían algunos fragmentos. Se trata de los cursos que Zubiri impartió sobre “El problema filosófico de la historia de las religiones” (Madrid, 1965), “El problema de Dios en la historia de las religiones” (Barcelona, 1965), y “El hombre y el problema de Dios” (Madrid, 1968). Las religiones y su historia constituyen uno de (...) los grandes intereses de Xavier Zubiri como filósofo. A diferencia de otros planteamientos, que abordan lo religioso a partir de la vivencia de lo sagrado, o del discurso sobre lo divino, Zubiri entendió que el tratamiento filosófico de la religión debe partir de un hecho más elemental, que él llamaba “religación”. La religación sería un dato básico e ineludible, inseparable de la aprehensión primordial de la realidad, que nos constituye como humanos. Para Zubiri, las religiones, su diversidad, y su historia, serían más bien la plasmación ulterior de ese hecho radical. Al análisis de ese hecho, y al estudio de su despliegue histórico, incluyendo el cristianismo, están dedicados estos tres importantes cursos. This book introduces profound reflections of Xavier Zubiri on the history of philosophy to English-speaking audiences. The book discusses the transcendental in Western philosophy and how a firm grasp of it reveals underlying unity, but also fundamental problems that Zubiri believed require a complete rethinking of certain theories.

The Statesman is a difficult and puzzling Platonic dialogue. In A Stranger's Knowledge Marquez argues that Plato abandons here the classic idea, prominent in the Republic, that the philosopher, qua philosopher, is qualified to rule. Instead, the dialogue presents the statesman as different from the philosopher, the possessor of a specialist expertise that cannot be reduced to philosophy. The expertise is of how to make a city resilient against internal and external conflict in light of the imperfect sociality of human (...) beings and the poverty of their reason. This expertise, however, cannot be produced on demand: one cannot train statesmen like one might train carpenters. Worse, it cannot be made acceptable to the citizens, or operate in ways that are not deeply destructive to the city's stability. Even as the political community requires his knowledge for its preservation, the genuine statesman must remain a stranger to the city. Marquez shows how this impasse is the key to understanding the ambiguous reevaluation of the rule of law that is the most striking feature of the political philosophy of the Statesman. The law appears here as a mere approximation of the expertise of the inevitably absent statesman, dim images and static snapshots of the clear and dynamic expertise required to steer the ship of state across the storms of the political world. Yet such laws, even when they are not created by genuine statesmen, can often provide the city with a limited form of cognitive capital that enables it to preserve itself in the long run, so long as citizens, and especially leaders, retain a “philosophical” attitude towards them. It is only when rulers know that they do not know better than the laws what is just or good (and yet want to know what is just and good) that the city can be preserved. The dialogue is thus, in a sense, the vindication of the philosopher-king in the absence of genuine political knowledge. (shrink)

The past decade has seen a burgeoning of scholarly interest in conscientious objection in healthcare. While the literature to date has focused primarily on individual healthcare practitioners who object to participation in morally controversial procedures, in this article we consider a different albeit related issue, namely, whether publicly funded healthcare institutions should be required to provide morally controversial services such as abortions, emergency contraception, voluntary sterilizations, and voluntary euthanasia. Substantive debates about institutional responsibility have remained largely at the level of (...) first-order ethical debate over medical practices which institutions have refused to offer; in this article, we argue that more fundamental questions about the metaphysics of institutions provide a neglected avenue for understanding the basis of institutional conscientious objection. To do so, we articulate a metaphysical model of institutional conscience, and consider three well-known arguments for undermining institutional conscientious objection in light of this model. We show how our metaphysical analysis of institutions creates difficulties for justifying sanctions on institutions that conscientiously object. Thus, we argue, questions about the metaphysics of institutions are deserving of serious attention from both critics and defenders of institutional conscientious objection. (shrink)

Xavier Landes | : Happiness has become a central theme in public debates. Happiness indicators illustrate this importance. This article offers a typology of the main challenges conveyed by the elaboration of happiness indicators, where happiness can be understood as hedonia, subjective well-being, or eudaimonia. The typology is structured around four questions: what to measure?—i.e., the difficulties linked to the choice of a particular understanding of happiness for building an indicator; whom to include?—i.e., the limits of the community monitored (...) by such an indicator; how to collect the data?—i.e., the difficulties stemming from objective and subjective reporting; what to do?—i.e., the concerns about the use of happiness indicators in public policy. The major points of normative contention are discussed for each of these dimensions. The purpose of this article is to contribute in a constructive manner to happiness research by offering an overview of some major philosophical and political challenges of building happiness indicators. The conclusion underlines the importance of the strategy of diversification- hybridization, which consists in setting a variety of indicators or composite indicators that articulate different understandings of happiness. It is stressed that happiness indicators raise democratic and institutional issues with which normative thinkers should deal. | : Le bonheur est devenu un thème central dans les débats publics. Les indicateurs de bonheur illustrent cette importance. Cet article offre une typologie des principaux enjeux contenus dans le travail d’élaboration d’indicateurs de bonheur quand ce dernier est compris comme hedonia, bien-être subjectif ou eudaimonia. La typologie est structurée autour de quatre questions : 1) que mesurer?, où sont en jeu les difficultés liées au choix d’une compréhension particulière du bonheur pour construire un indicateur; 2) qui inclure?, c’est-à-dire comment tracer les limites de la communauté morale qui est l’objet d’un tel indicateur; 3) comment collecter les données?, où on interroge les difficultés propres aux techniques subjectives et objectives de collecte de données; 4) que faire?, où on soulève l’enjeu des craintes quant à l’usage d’indicateurs de bonheur dans les politiques publiques. Les points majeurs de dispute normative sont discutés pour chaque dimension. Nous espérons ainsi contribuer de manière constructive à la recherche sur le bonheur en offrant un aperçu de quelques défis philosophiques et politiques majeurs relatifs à la construction d’indicateurs de bonheur. Nous concluons en soulignant l’importance de la stratégie de diversification-hybridation qui consiste à mettre en place des indicateurs variés ou composites articulant différentes compréhensions du bonheur.
