Knowledge systems theory, in our view, tends to obscure rather than illuminate an understanding of the fundamentals of knowledge processes in society. This tendency occurs primarily because both the theory, and the methodologies that are derived from it, fail to recognize that knowledge processes are social processes, and thereby that knowledge itself has to be envisaged as a social construction. As a result of this omission, knowledge systems theory and methodology can only deal poorly with issues of power and social (...) conflict, and, at the same time, tend to make use of several inappropriate teleological and reifying notions. According to our view, the understanding of knowledge processes will benefit greatly from a more actor-oriented perspective. In such an approach, emphasis is accorded to human agency and the concept of multiple knowledge networks. Central purposes of actor-oriented methodologies then, are to clarify how actors attempt to create space for their own ‘projects’ and to determine which elements contribute to or impede the successful creation of such space for maneuver. This book seeks to show how Karl Marx’s vision of communism was a continuation of Aristotle’s classical humanist philosophy. Challenging the Engelsian distortion of Marx, it presents a negation of previous interpretations of Marx which present him in materialist terms. Engels proposed a picture of the highest stage of communist society as an economic egalitarianism, a vision which became an axiom of Leninist-Stalinist-Soviet Communism. By contrast, here it is shown that Marx embraced the Aristotelian concept of “distributive justice”, of proportionate (...) equality. Spanning the works of Marx, from his university education and doctoral dissertation on the differences between the Democritean and Epicurean philosophy of the atom, to the study of his Rheinische Zeitung period and the persistence of classical humanism in Marx’s defense of the freedom of the press, Levine skillfully reveals the gravitational pull between Marx and Aristotle. Schopenhauer's notion of philosophy itself. This perspective enables Head to paint a more sympathetic picture of Schopenhauer than is often the case—more coherent in his systematic pretensions, more consistent in his philosophical project over the long course of his writings, and (perhaps most surprisingly) more solicitous for the welfare of his readers.Head's thesis is that Schopenhauer analyzed ('diagnosed' might be a better word) the human need for metaphysics and constructed his own philosophy carefully to address this need. "The need for metaphysics," Head explains, "is a natural desire that all human beings have for explanation and consolation, in the face of the recognition of pessimistic truths regarding the world we live in" (xiv), specifically recognition of the "wrongness of the world" (51) and "the illusory nature of the principle of individuation" (70). Several quite specific metaphilosophical insights and methods arise from this seemingly straightforward statement. But he argues for this dual functionality by tracing the notion of "better consciousness" from Schopenhauer's earliest writings to its evolution into a "denial of the will," a form of consciousness with directly salvific consequences (interestingly, according to Head, not just for the individual but intergenerationally), now rooted in a metaphysics of will.The second and more philosophically fruitful peculiarity about Schopenhauer's diagnosis of the human "need for metaphysics" is the manner in which it arises from "the recognition of pessimistic truths" (xiv). There is a lot packed into the notion of recognition here. Schopenhauer has a distinctive philosophical method that grounds philosophical thinking in intuitive apprehension of basic truths. And, as Head argues, while this intuition functions as the ground for truth-seeking, it also hampers philosophy as a discursive discipline, since the concepts in which truth claims are presented cannot capture or communicate the unique proximity to truth characteristic of intuition. Thus, philosophical truths cannot be communicated directly, and the function of philosophical texts is to inspire an intuitive insight on the part of the readers so that they are able to see for themselves what the philosophy purports to say. (Stoicism, for instance, is for Schopenhauer an admirable but ultimately limited philosophical perspective in that it develops a system that relies exclusively on reason without promoting a grounding intuition.) Head argues that insight into the basic nature of the will is the intuition that Schopenhauer spins his philosophy around.This has both metaphysical and metaphilosophical implications. As for the former, it means that metaphysics is possible as a discipline, even in the wake of (and while by and large respecting) the limits Kant imposed on epistemology. Metaphysics has an empirical aspect, relying on empirical cognitive sources to provide a worldview for which it provides a key. Head emphasizes the irreducibility of this "objective" perspective, for offering both understanding as well as consolation (namely, knowledge that we have cognitive resources that other creatures do not). But Head argues that Schopenhauer gives primacy to the (compatible and complementary) subjective standpoint, and in particular our (quasi-speculative) intuition into the thing-in-itself via insight into our own basic essence as will. Socratic philosophy represents a long-standing tradition within philosophy that understands the journey to truth in terms of the traveler's innate capacity. Anamnesis, maieutics, and elenchus each confirm that truth is not utterly foreign but is instead always within my possession or grasp. Other people, to the extent that they participate in my philosophical exploration, serve only to enable my capabilities or potential. They are not teachers to me. Nor would I need them, since I am always already in the (...) neighborhood of truth. ;Emmanuel Levinas's description of the "face to face" encounter between people challenges the adequacy of this model. Another person is not simply a midwife who leads me to a recovery of truth that was always within me or within my domain. Rather, the Other comes to me from a dimension of height or transcendence and teaches me. By this teaching Levinas means that I, as one who might claim truth for myself, find myself put into question. Before the Other I discover that my claims to knowledge are inadequate, even unjust, insofar as the Other exceeds, and thereby resists, my comprehensive claim on the world. The Other, in other words, reveals the naivete and the dogmatism characteristic of my familiar world, and puts me on a new and unforseen path to truth. ;This dissertation, by way of an explication of the category of transcendence, examines how the autonomous world of Socratic maieutics is transformed by the teaching encounter with another person into a heteronomous world. Heteronomy suggests my answerability to an order beyond the resources of anamnesis. The policy changes governing the relations between the pharmaceutical, medical device and service industries and academic clinical research physicians, recommended by the Institute of Medicine,1 the American Academy of Medical Colleges,2 and much discussed in the media and on our campuses, aim to create some protective ethical firewalls. However, some potentially critical consequences of these steps are missed if we do not acknowledge what else is on the table, and who is sitting at it. By only reacting defensively to the (...) juggernaut of righteous indignation over the loss of purity in a faculty physician's approach to medical problem solving, we are allowing the process to blind us to the difficulties in establishing fair and equitable management of all of the potential conflicts of commitment and conflicts of interest we incur, not only as faculty members, but also as departments and academic medical centres . Critically, this involves all sources of revenue—private, commercial and public—that support our professional and institutional commitments as well as our personal finances.i To counter the present crackdown on inappropriate financial relationships effectively, we will need to reframe the questions, and convince all stakeholders to the process that there is more to this crisis than can be resolved through our public confessions of commercial largesse obliged. The Phrma Code guidelines3 have resulted in what is believed to be a defensible, if as yet legally untested, compartmentalisation of the commercial sector's marketing, medical education and research sponsorship activities. We at the AMC are a long way from understanding how those same missions, as they emanate from our multifarious commitments, can be isolated and individually managed. George Santayana was one of the leading philosophers of his era. His range of interests was wide; in addition to books and essays on philosophical subjects, he wrote literary criticism of the first rank, cultural criticism that remained fresh and valid up to the time of this book's publication in 1968, and autobiographical works which reveal a man of great charm with a deep interest and affection for his acquaintances. This two-volume selection of Santayana's writing is exceptionally comprehensive; the editor (...) has been careful to provide passages which adequately illustrate Santayana's views on a wide variety of subjects and his selection includes essays and excerpts from books that had long been unavailable. Volume 1 contains essays on literature and the theory of art, and character studies of Santayana's family and some of his most famous acquaintances, and a substantial introduction by Norman Henfrey. The nature of fantasy has been little discussed, despite its importance in the arts. Its significance is brought out here in relation to the long‐standing debate on the alleged paradox of fiction—that we respond emotionally to characters and events known to be unreal. Examination of the paradox shows it to be ill founded once the nature of fantasy is appreciated. Moreover, a detailed consideration of fantasy shows that it can itself provide a plausible account of our emotional reactions to (...) creative literature, an account that, after a review of some possible objections, is then contrasted with the leading contemporary theories. _William of Sherwood's Introduction to Logic _ was first published in 1966. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. The _Introduction to Logic _ by William of Sherwood, of which this is the first English translation, is the oldest surviving treatise which contains a treatment of the most distinctive and interesting medieval contributions to logic and semantics. Sherwood was a master at (...) Oxford and Paris in the thirteenth century and the author of several logical treatises. Besides presenting material of interest in its own right, this volume is useful as an introduction to the study of those aspects of medieval philosophy that are most pertinent to the interests of contemporary philosophers. Professor Kretzmann has provided biographical, bibliographical, and philosophical backgrounds on Sherwood and an analytical table of contents. (shrink)

The rise of Canadian national identity in the 1960s contributed to a flourishing small press movement across the country. One of the most impressive, long-standing and influential presses of this era was Coach House Press, located near the University of Toronto. Book design, creative forms of editing, collaborative and community-oriented work all became a focus of idealism in the Coach House context, as its founders borrowed from earlier international models, but relied, too, on the Canadian moment to devise new (...) ways to disseminate and create literary culture. More recently, a similar idealistic model in publishing and press work has appeared in Nova Scotia at Kentville’s Gaspereau Press. Gaspereau’s founders, like those at Coach House, have searched for an alternative plan and method- through an in-house dedication to the craft of design and bookmaking- that is unlike that applied by mainstream publishers. One could argue that the two outfits represent a counter-tradition in Canadian cultural life, a dedication to artisanal work, as well as to forms of collaborative editing and design. With the publishing and bookselling industry under great pressure in Canada from shifts in technology and government support, counter-traditional models like Gaspereau Press present the possibility of unique forms of cultural output and marketing. Behind such efforts we recognize philosophies and notions of cultural community that run counter to major trends. This paper examines the history of both presses, specific publications, and the impact of such work on the broader Canadian literary scene. (shrink)

: The "dead donor rule" is increasingly under attack for several reasons. First, there has long been disagreement about whether there is a correct or coherent definition of "death." Second, it has long been clear that the concept and ascertainment of "brain death" is medically flawed. Third, the requirement stands in the way of improving organ supply by prohibiting organ removal from patients who have little to lose—e.g., infants with anencephaly—and from patients who ardently want to donate while (...) still alive—e.g., patients in a permanent vegetative state. One argument against abandoning the dead donor rule has been that the rule is important to the general public. There is now data suggesting that this assumption also may be flawed. These findings add additional weight to proposals to abandon the dead donor rule so that organ supply can be expanded in a way that is consistent with traditional notions of ethics, law, public policy, and public opinion. Here is the final volume of Norman O. Brown's trilogy on civilization and its discontents, on humanity's long struggle to master its instincts and the perils that attend that denial of human nature. Following on his famous books _Life Against Death_ and _Love's Body_, this collection of eleven essays brings Brown's thinking up to 1990 and the fall of Communism in Eastern Europe. Brown writes that "the prophetic tradition is an attempt to give direction to the social structure (...) precipitated by the urban revolution; to resolve its inherent contradictions; to put an end to its injustice, inequality, anomie, the state of war... that has been its history from start to finish." Affiliating himself with prophets from Muhammad to Blake and Emerson, Brown offers further meditations on what's wrong with Western civilization and what we might do about it. Thus the duality in his title: crisis and the hope for change. In pieces both poetic and philosophical, Brown's attention ranges over Greek mythology, Islam, Spinoza, and _Finnegan's Wake_. The collection includes an autobiographical essay musing on Brown's own intellectual development. The final piece, "Dionysus in 1990," draws on Freud and the work of Georges Bataille to link the recent changes in the world's economies with mankind's primordial drive to accumulation, waste, and death. We argue for a procedural approach to ethical critique in CDA based upon the ‘argumentative turn’ in CDA advocated in our recent publications. This is not a matter of abandoning substantive critique, or abandoning the long-standing commitment of our version of CDA to critique of domination and of ideology, but of integrating them into a deliberative procedure for critical questioning, from an impartial and unbiased standpoint. The advantage of this position is that it enables us to accentuate ethical criticism (...) and critique in CDA, rather than advocacy and partisanship. The task of critical discourse analysts is to subject argumentation, including their own argumentation, to systematic critical questioning in the spirit of open debate, with no ideological parti-pris. This review essay examines three important new contributions to the water governance literature, which provide important overviews of the changing water governance structures over time, and advance the call for a new water ethic. Furthering this work, I suggest that the need for a water ethic is globally important, but it is particularly urgent for indigenous communities. Settler expansion, fixed political boundaries, and subsequent colonial framings of land and water ownership have affected indigenous communities throughout the world and have led (...) to severe environmental and social justice disparities. Although the books under consideration provide examples of indigenous rights associated with water protection, the theme is largely underdeveloped. Thus, I suggest that insights from indigenous communities’ more holistic and long-term relationship with water could help define and move forward the adoption of a new global water ethic. These insights are gleaned from work with indigenous communities throughout North America, particularly those in the Salish Sea and the Great Lakes regions. A new water ethic could incorporate three precepts: (1) treat water as sacred; (2) consider rights and responsibilities together; and (3) practice hydrophilia (love and know your waterways). In his book on Liberalism against Populism , William Riker argued that Lincoln's success in the 1860 election was the culmination of a long progression of strategic attempts by the Whig coalition of commercial interests to defeat the `Jeffersonian-Jacksonian' Democratic coalition of agrarian populism. Riker adduced Lincoln's success to his `heresthetic' maneuver to force his competitor, Douglas, in the 1858 Illinois Senate race, to appear anti-slavery, thus splitting the Democratic Party in 1860. Riker also suggested that electoral preferences in (...) 1860 exhibited an underlying `chaotic' preference cycle. However, these accounts do not explain why the slavery question became paramount in 1858-60. I suggest here that US politics, from 1800 to 1858, can be interpreted in terms of a single land-capital axis that sustained the pre-eminence of an agrarian coalition, first created by Jefferson, of both slave interests and free labor. Lincoln's strategy in 1858-60 was to persuade free labor in the northern and western states that they were threatened by the consequences of the Dred Scott decision by the Supreme Court in 1857. Lincoln argued that although the decision applied to the territories, it was indicative of the intention of the South to extend slavery to the free states. Lincoln's speeches in 1858-60 made this threat credible to the North, and initiated a belief cascade among the electorate. For southern voters, the North consequently appeared to be a `tyrannical' majority, whose creation violated the constitutional logic of Union, and legitimated secession. I argue that this second `civil rights dimension, created in the election of 1860, is necessary for understanding critical elections that have occurred at irregular intervals in US political history. Thomas Harriot was the finest English mathematician before Isaac Newton, but his work on the coinage of his country is almost unknown, unlike Newton’s. In the early 1600s Harriot studied several aspects of the gold and silver coins of his time. He investigated the ratio between the values of gold and silver, using data derived from the official weights of the coins; he used hydrostatic weighing to determine the composition of the coins; and he studied the methods used to calculate (...) how metals should be combined in order to produce the required standard of purity. This work required not only arithmetical skill, but also great insight into the relationships between the various quantities, and here his ‘greate invention of algebra’ played its part. The gold and silver coins were critically important in the national economy at that time, because they had intrinsic value and represented the country’s store of wealth. In his lifetime Harriot was supported by the patronage of Henry Percy, the Earl of Northumberland, who was a member of the Privy Council in 1604 when great changes to the English coinage were being made. After Harriot’s death his papers remained under the control of one of his executors, Sir Thomas Aylesbury, who became Master of the Tower Mint in 1635. These facts suggest that his work on the coins was considered to be important for practical reasons, not just academic ones. In this article the interplay between the scholarly work and its application to matters of national significance will be analysed in depth. The conclusions also throw some light on the long-standing mystery surrounding the fate of Harriot’s papers. (shrink)

The sciences are too important to be left exclusively to scientists, and indeed they have not been. The structure of scientific knowledge, the role of the sciences in society, the appropriate social contexts for the pursuit of scientific inquiry, have long been matters for reflection and debate about the sciences carried on both within academe and outside it. Even within the universities this reflection has not been the property of any single discipline. Philosophy might have been first in the (...) field, but history and the social sciences have also entered the fray. For the latter, new problems came to the fore, since reflection on the sciences is, in the case of the social sciences, necessarily also reflection on themselves as sciences. Reflection on the natural sciences and self-reflection by the social sciences came to be dominated in the 1960s by the term 'positivism'. At the time when this word had been invented, the sciences were flourishing; their social and material environment had become increasingly favourable to scientific progress, and the sciences were pointing the way to an optimistic future. In the later twentieth century, however, 'positivism' came to be a word used more frequently by those less sure of nineteenth century certainties. In both sociology and philosophy, 'positivism' was now something to be rejected, and, symbolizing the collapse of an earlier consensus, it became itself the shibboleth of a new dissensus, as different groups of reflective thinkers, in rejecting 'positivism', rejected something different, and often rejected each other. In April 1939, G. E. Moore read a paper to the Cambridge University Moral Science Club entitled ‘Certainty’. In it, amongst other things, Moore made the claims that: the phrase ‘it is certain’ could be used with sense-experience-statements, such as ‘I have a pain’, to make statements such as ‘It is certain that I have a pain’; and that sense-experience-statements can be said to be certain in the same sense as some material-thing-statements can be — namely in the sense that (...) they can be safely counted on. When Moore later read his paper to Wittgenstein, Wittgenstein took violent exception to it, and the two entered into a heated exchange. The only known notes of this exchange are a previously unpublished verbatim record of part of it, taken by Norman Malcolm. This paper is an edition of Malcolm’s notes. These notes are valuable for both philosophical and scholarly reasons. They give us a glimpse of a sustained exchange between Wittgenstein and a real-life interlocutor; they contain a defence by Wittgenstein of the idea that a word’s use can illuminate its meaning; and they provide evidence of Wittgenstein’s philosophical engagement with the topic of certainty, and with Moore’s thought on it, long before he began to write the notes which make up On Certainty, in 1949. _William of Sherwood's Treatise on Syncategorematic Words _was first published in 1968. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. This is the first translation of an important medieval work in philosophy, an advanced treatise by the thirteenth-century English logician William of Sherwood. The treatise draws on doctrines developed in Sherwood's _Introduction to Logic_,which has also been translated by Professor Kretzmann. William of (...) Sherwood is an important figure in the development of the _logica moderna_,the distinctively medieval contribution to logic and semantics. As Professor Kretzmann explains, the _logica moderna _ may have originally aimed only ad providing _ad hoc _rules regarding inferences that involve problematic locutions of ordinary discourse. But its principal aim soon became the development of a more or less general account of the ways in which words are used to stand for things or to affect the meanings of other words. In Sherwood's time the _logica moderna _ seems to have been thought of as having two branches, an account of the "properties of terms" and an account of the signification and function of "syncategorematic words." Sherwood deals with the first branch in his _Introduction to Logic _ and with the second branch in the treatise presented here. The translation is copiously annotated to supply the kind of explanatory material a twentieth-century reader may need for an understanding of a thirteenth-century discussion. As Professor Kretzmann points out, many of the problems dealt with in this treatise closely resemble the problems of twentieth-century philosophical logic and philosophy of language. (shrink)

: This paper considers whether a physician is criminally liable for administering a dose of painkillers that hastens a patient's death. The common wisdom is that a version of the doctrine of double effect legally protects the physician. That is, a physician is supposedly acting lawfully so long as the physician's primary purpose is to relieve suffering. This paper suggests that the criminal liability issue is more complex than that. Physician culpability can be based on recklessness, and recklessness hinges (...) on whether a physician has taken an unjustifiable risk of hastening death. The authors identify three conditions of justifiability. Their analysis helps to explain the distinction between euthanasia, which is legally banned, and the use of risky analgesics, which is permitted in limited circumstances. (shrink)

There is a long tradition of fruitful interaction between logic and social choice theory. In recent years, much of this interaction has focused on computer-aided methods such as SAT solving and interactive theorem proving. In this paper, we report on the development of a framework for formalizing voting theory in the Lean theorem prover, which we have applied to verify properties of a recently studied voting method. While previous applications of interactive theorem proving to social choice have focused on (...) the verification of impossibility theorems, we aim to cover a variety of results ranging from impossibility theorems to the verification of properties of specific voting methods. In order to formalize voting theoretic axioms concerning adding or removing candidates and voters, we work in a variable-election setting whose formalization makes use of dependent types in Lean. The structure of traditional fiction is essentially linear or serial. No matter how complex a given work may be, it presents information to its reader successively, one element at a time, in a sequence determined by its author. By contrast, interactive fiction is parallel in structure or, more accurately, dendritic or tree-shaped. Not one, but several possible courses of action are open to the reader. Further, which one actually happens depends largely, though not exclusively, upon the reader’s own choices. To (...) be sure, the author is still in overall control, since it is she who has set up the particular nexus of events, but the route up the narrative tree, the actual sequence of events, is generally affected, if not completely determined, by the reader’s responses to that particular reader’s specific situation. In an adventure, the sequence of action frequently depends upon the reader’s decision to go in one geographical direction rather than another. In the eliza sample, the content of the “story” depends on such particulars as whether this reader has a brother or not, whether she fears her father, and why she has consulted the terminal. In general, the text presented to the eliza-reader depends on what that reader has already said and how the computer has interpreted and stored it, and this is generally true of interactive fiction.Further, interactive fiction is, in principle , open-ended—infinite. A conversation with eliza could go on for as long as one with Woody Allen’s psychoanalyst—in principle, forever. It has no necessary terminus. The program will go one writing texts and answers on the screen as long as the reader or player chooses to supply responses. Further, the computer can act as a metafictional narrator like John Barth or Thomas Pynchon who can create a story within a story or a story that generates another story within itself which generates another story within itself and so on, fictions dizzying and dazzling. One senses one’s essential humanity wobbling in the midst of the infinite paradoxes of existence and meaning. Anthony J. Hovering in the background of investigations into human physiology is the promise or threat, depending upon how one looks at the matter that human beings are complete physical-chemical systems and that all events taking place within their bodies and all movements of their bodies could be accounted for by physical causes if we but knew enough. In this paper I consider the important question whether our coming to believe that this "mechanistic" hypothesis is true would warrant our relinquishing our conception (...) of ourselves as beings who are capable of acting for reasons to achieve ends of our own choosing. This pessimistic thesis has been vigorously defended by Norman Malcolm in his "Conceivability of Mechanism" in The Philosophical Review, Jan. 1968. (shrink)

This book reassesses the contribution to international thought of some of the most important thinkers of the inter-war period. It takes as its starting point E.H. Carr's famous critique which, more than any other work, established the reputation of the period as the "utopian" or "idealist" phase of international relations theorizing. This characterization of inter-war thought is scrutinized through ten detailed studies of such writers as Norman Angell, J.A. Hobson, J.M. Keynes, David Mitrany, and Alfred Zimmern. The studies demonstrate (...) the diversity of perspectives within so-called "idealism" and call into question the descriptive and analytical value of the entire notion. It is concluded that "idealism" is an overly general term, useful for scoring debating points rather than providing a helpful category for analysis. (shrink)

In the past decade, the Norwegian government has emphasized user participation as an important goal in the care of mentally ill patients, through governmental strategic plans. At the same time, the governmental documents request normalization of psychiatric patients, including the re‐socialization of psychiatric patients back into society outside the psychiatric hospital. Milieu therapy is a therapeutic tool to ensure user participation and re‐socialization. Based on an ethnographic study in a long‐term psychiatric ward in a psychiatric hospital, we identified how (...) staff tried to implement user participation in their milieu‐oriented therapy work. We have identified three major tensions and challenges in implementing user participation in milieu‐therapeutic work. First, it is difficult to implement individual‐based user participation and at the same time take collective house rules and codes of conduct into consideration. Second, user participation proved a difficulty when patients’ viewpoints challenged staff judgements on proper conduct and goals for which patients might aim. Third, user participation becomes a challenge when trying to establish relationships based on equality when using milieu therapy in a biomedical hierarchical hospital structure. These tensions and challenges are seen in light of paradoxical political frames and demands on one side, and milieu therapy as a complex tradition anchored in different ideologies on the other. In this article, we report the results of a survey of North American adults conducted between March 24 and 30, 2020 at the onset of the COVID-19 pandemic. Respondents completed the COVID-TIS and the 21-item Depression, Anxiety, and Stress Scale, indicated their level of COVID-infection concern for themselves and close others, and provided demographic information. The results indicated: during its early stage, the pandemic produced only moderate levels of material and psychological change; the pandemic produced mild to moderate levels of (...) psychological distress; respondents who lost their jobs as a result of the pandemic experienced more change and more psychological distress than those who did not, and younger respondents and less well-educated ones experienced more psychological distress than older respondents. Unexpectedly, respondents indicated that they were more concerned that friends and family members would become infected with COVID-19 than that they would be. We conclude by speculating that these results are driven less by the immediate changes brought about by the pandemic and more by uncertainty concerning its long-term economic and social impact. We are printing, by kind permission of the Law Commission, two sections of the report of the Law Commission on injuries to unborn children. This report was the result of a request to the Law Commission by the Lord Chancellor at the time (Lord Hailsham of Saint Marylebone) to advise on `what the nature and extent of civil liability for antenatal injury should be'. The Law Commission followed its usual practice in such circumstances of consulting various bodies and obtaining expert (...) advice on the subject and then embodying the results in a working paper (Working Paper No. 47 - injuries to unborn children) published on 19 January 1973, which preceded their report (Cmnd 5709). Meanwhile a Royal Commission is considering much wider issues of civil liability for injury (including antenatal injury) but the terms of reference for the Law Commission were much narrower and confined to the position of children injured before birth. In the section relating to the present law the report makes it clear that it is probable that liability under the common law already exists. The Scottish Law Commission has also issued a report (Cmnd 5371). They were given different terms of reference and came to somewhat different conclusions. We are printing from this long report the paragraphs discussing the medical background and the summary of recommendations. As will be evident on reading the paragraphs on the medical background to injuries to the unborn child, events are moving very rapidly, particularly in the study of congenital defects and the effects of drugs but the problems of proof present great difficulty. Other causes of injury to the unborn child are better known to the general public: for example, those following the illness, infection and disease of the mother during pregnancy, injury caused in attempted termination of pregnancy and the risks resulting from the mother's condition. The summary of the recommendations sets out very clearly the legal position of the unborn child, as the Law Commission sees it, arising from injury before birth, the final conclusion being that `legislation is desirable'. These extracts from the report, apart from their intrinsic interest, lead on to the paper by Mr Kennedy and Dr Edwards in which they set out their criticisms of it, and provide quick references to the original document. Aworkshop was held August 26–28, 2015, by the Earth- Life Science Institute (ELSI) Origins Network (EON, see Appendix I) at the Tokyo Institute of Technology. This meeting gathered a diverse group of around 40 scholars researching the origins of life (OoL) from various perspectives with the intent to find common ground, identify key questions and investigations for progress, and guide EON by suggesting a roadmap of activities. Specific challenges that the attendees were encouraged to address included the following: What key (...) questions, ideas, and investigations should the OoL research community address in the near and long term? How can this community better organize itself and prioritize its efforts? What roles can particular subfields play, and what can ELSI and EON do to facilitate research progress? (See also Appendix II.) The present document is a product of that workshop; a white paper that serves as a record of the discussion that took place and a guide and stimulus to the solution of the most urgent and important issues in the study of the OoL. This paper is not intended to be comprehensive or a balanced representation of the opinions of the entire OoL research community. It is intended to present a number of important position statements that contain many aspirational goals and suggestions as to how progress can be made in understanding the OoL. The key role played in the field by current societies and recurring meetings over the past many decades is fully acknowledged, including the International Society for the Study of the Origin of Life (ISSOL) and its official journal Origins of Life and Evolution of Biospheres, as well as the International Society for Artificial Life (ISAL). Pp. vi i+ 291. $49.95 Although medieval philosophy generally hasn't received much attention from Anglo-American philosophers in the last few centuries, the philosophy of Thomas Aquinas has long been the exception to that rule. (...) In one sense, then, the collection of essays in Aquinas's Moral Theory fits into a long-standing and rich tradition of critical analysis and thoughtful reconstruction. In another sense, however, the book treads ground that is, if not entirely new, then at least not well worn. Most treatments of Aquinas's ethics discuss it in separation from the rest of his work. Aquinas himself, however, sees his moral theory as intrinsically tied up with other aspects of his philosophical system, such as his metaphysics and his philosophical theology. Aquinas's Moral Theory argues that fully understanding Aquinas's ethics, then, requires attention to the way in which "his interests in moral issues often flow into and inform and shape his work in other areas, just as his moral reflections are shaped and grounded by them" (3).MacDonald and Stump have drawn together a group of ten essays by respected scholars in medieval philosophy—essays written with the explicit intent of examining Aquinas's moral theory both in its own right and in light of Aquinas's broader philosophical system. In particular, the papers in the section devoted to moral theory in philosophy of language and metaphysics raise more questions than they answer; the reader is left wondering what further consequences the provocative claims made there have for Aquinas's ethics.Still, this represents not as much a flaw in the book itself as it does a conscious call to further scholarship. Healthcare (including public health) is special because it protects normal functioning, which in turn protects the range of opportunities open to individuals. I extend this account in two ways. First, since the distribution of goods other than healthcare affect population health and its distribution, I claim that Rawls's principles of justice describe a fair distribution of the social determinants of health, giving a partial account of when health inequalities are unjust. Second, I supplement a principled account of justice for health (...) and healthcare with an account of fair process for setting limits or rationing care. Ludwig Wittgenstein, who died in Cambridge in 1951, is one of the most powerful influences on contemporary philosophy, yet he shunned publicity and was essentially a private man. His friend Norman Malcolm (himself an eminent philosopher) wrote this remarkably vivid personal memoir ofWittgenstein, which was published in 1958 and was immediately recognized as a moving and truthful portrait of this gifted, difficult man.This edition includes also the complete text of the fifty-seven letters which Wittgenstein wrote to Malcolm over a (...) period of eleven years. Apart from the quotations in the Memoir these letters are previously unpublished. They reveal how much friendships mattered to Wittgenstein, and how concerned hewas for the health and well-being of his friends. His human qualities become evident; he advises, warns, jokes. and is grateful and affectionate.The volume also features a concise biographical sketch by another leading philosopher who was a friend of Wittgenstein, Georg Henrik von Wright.Much has been published about Wittgenstein since his death, but nothing brings us closer to the man himself than this modest classic of philosophical biography.
