Law as one sign system can be recorded and interpreted by another sign system—media. If each transaction in court is taken as a sign, it can be interpreted or transferred by different signs of media for the same purpose, though with different effects. This study focuses on the transformative effects of the semiotic revolution in media on law. The present research revealed that the evolution of media has driven the administration of justice to pay more attention to the process of (...) court proceedings. This research also discusses the semiotic conflict and compatibility between the sign subsystems within media upon interpreting the administration of justice. In addition, disequilibrium between different sign systems highlights the consequent need for intersemiotic translation, consciousness and evaluation as part of decision making on court domains. A social semiotic approach could be used to investigate the victim identity of the online romance scam from the aspects of the (re)construction and interpretation of discursive practices. Although legal terms are conventionally considered to have self-referential, self-closed meaning independent of context, a legal term only acquires its meaning within a given context. As long as the context varies, the meaning of the same legal term as a signifier may change correspondingly. Based on case studies by applying semiotics, we argue that a legal term is just a sign within its sign system; a legal term as an individual sign does not have any inherent meaning, and its meaning (...) can only exist in the relationship with other signs or sign systems. In other words, a legal term only denotes in a particular temporal and spatial context. Through this study, we conclude four propositions about a legal term as a sign: first, the connection of a legal term with a legal concept is relatively arbitrary; second, the meaning of a legal term exists in a sign system; third, a legal term can be subject to multiple interpretations; fourth, the defining of a legal term may be affected by other sign systems. By exploring the cultural discrepancies in Chinese legal texts and their English versions and to what extent legal and cultural discrepancies influence and constrain legal translation, the study argues that it is useful to consider cultural discrepancies within a semiotic framework. Language is a phenomenon and factor that links different cultures; the use of language is crucial to any legal system. Law, as a cultural product, is attended by cultural discrepancies when switched into other languages for the purpose of achieving (...) equivalence. After a brief overview of cultural differences in translation, legal translation in particular, the study is set to examine the role of translation in crossing through different legal cultures and backgrounds and investigate barriers in the process of translation. Investigating cultural discrepancies in legal translation within a semiotic framework allows us to focus on certain interpretations by acknowledging that legal texts are composed with systems of systems and interacting with other cultural aspects in a wider context. This study draws on a synergy of Corpus Linguistics and Critical Discourse Studies to scrutinize the portrayal of hackers in China Daily and The New York Times in the 21st century, primarily revolving around the main social actors and targets in hacking. This study demonstrates that both media share a positive transformation of the image-building of hackers in the 21st century. Besides, countries are salient social actors in hacker media discourse and the two media differ in their ways of constructing (...) them. The New York Times tends to have a negative other-representation and categorical otherness of specific countries through such discursive strategies as negative other-representation and group categorization, whereas China Daily is prone to insist on opposing the US hacking allegations in a defensive manner. Regarding major targets, China Daily highlights government websites whereas The New York Times emphasizes government websites, officials’ emails, large technology companies, and election infrastructure. The analysis shows that the two media’s different ways of framing hackers are underpinned by the ideologies behind them and the Chinese and US socio-political landscapes. This study can provide insights into how hacker discourse in media is represented in the 21st century and how national identities are constructed in the media representations of hackers. (shrink)

ABSTRACT In this paper we explore how a public national media outlet, the British BBC, represents an international legal case which has a highly political nature. The case is US versus Huawei/meng Wanzhou, which took place between 2018 and 2021. Accusations were that the Chinese technology company committed fraud, leading the global HSBC bank to breach US sanctions against Iran. The charges were made by the US using what is called an ‘extraterritorial law’, which, while rejected as law by governments (...) around the world, is policed by US economic powers and control over international finance. Using Critical Discourse Analysis we show that, while the BBC presents much detail of legal process, the actual nature of the law the US uses to bring criminal charges against international companies and banks, is neither considered nor questioned. Our interest is how such a law, which has a huge influence over global trade and politics, is presented to the public in this particular case. We contribute to the position that the nature of laws, how they are used and known, must always be understood within the prevailing discourses of the moment. (shrink)

Genre has been a critical issue in discourse analysis as well as in other disciplines. Based on a literature review of the concept of genre and taking judgments as one type of genre in legal settings, the present study provides a corpus-based insight into the nature of genre. The literature review per se reveals that genre has one typical feature of a sign, that is, being subject to multiple and alternative interpretations; in other words, genre as a sign may have (...) various interpretants. The present study unravels the actual generic structures, distinguishes different types of generic structures within the given genre, and then defines the dominant generic structure of judgments in Hong Kong, Taiwan, and Mainland China. This study also examines and contrasts the generic structure potential of judgments in each jurisdiction. In addition, the variation of Mainland China's judgments over time is briefly discussed. Comparing the generic structures of judgments among the three jurisdictions, as well as the structures of judgments in Mainland China over time, the paper argues that genre also has the essential features of a sign, that is, the characteristics of temporality and spatiality. In our research project, we will elaborate Charles Sanders Peirce’s three philosophical categories, and show how these categories operate at the levels of Protection, Regulation and Identity in the process of sign-meaning and sign-making within Cultural Heritage, Law and Discourse. The process of semiosis comprises a triadic dimension between signs, their functions and interpretations, operating on four axes within our special issue: Theoretical Cultural Heritage Issue, Cultural Heritage and Postcolonialism, Intertwined Notions of Heritage and Culture, and Protection of Cultural Heritage.

Comme ses Cinq méditations sur la beauté, ce texte de François Cheng est né d'échanges avec ses amis, auxquels le lecteur est invité à devenir partie prenante. Il entendra ainsi le poète, au soir de sa vie, s'exprimer sur un sujet que beaucoup préfèrent éviter. Il n'a pas la prétention de délivrer un "message" sur l'après-vie, ni d'élaborer un (...) discours dogmatique, mais il témoigne d'une vision de la "vie ouverte". Une vision en mouvement ascendant qui renverse notre perception de l'existence humaine, et nous invite à envisager la vie à la lumière de notre propre mort. Would it be possible to have an alternative to the physicalist world-view? If any type of dualism is not an option, I am tempted to consider an integrational world view, which was first claimed by Confucius under the notion of cheng. I would propose an integrational thesis that cheng of an entity is a power to realize the embedded objective of it in the context where it interacts with all others. The notion of compassion may be said to (...) be both dispositional and mental. Then, this notion is one candidate to shed lights on the integrational thesis. The thesis doesn't exclude roles the causal notion has to play in the integrational system. Rather it allows the causal notion in its proper place, not having to exclude other relational notions in the system. What it denies is that the causal relation is all there is among what is there. The notion of compassion is essentialist in two senses. The first is the sense in which Mencius said that compassion is necessary for one to be a human. The second is the sense that compassion is an essentialist disposition. "Compassion" does neither refer to a mental state nor reflect a human relation, but it denotes an abstract property, or a theoretical notion, which can be singled out by a Ramsey sentence. There are many challenges for the integrational thesis to meet. Some of them are how the integrational thesis could allow an essentialism of a kind?, Is there a way for the integrational view of language to meet the requirements of modal semantics?, and so on. The present paper may not able to explain all of these questions but it will try to suggest how to approach toward the task. (shrink)

Colloquially, episodic memory is described as “the memory of personally experienced events”. Even though episodic memory has been studied in psychology and neuroscience for about six decades, there is still great uncertainty as to what episodic memory is. Here we ask how episodic memory should be characterized in order to be validated as a natural kind. We propose to conceive of episodic memory as a knowledge-like state that is identified with an experientially based mnemonic representation of an episode that allows (...) for a mnemonic simulation thereof. We call our analysis the Sequence Analysis of Episodic Memory since episodes will be analyzed in terms of sequences of events. Our philosophical analysis of episodic memory is driven and supported by experimental results from psychology and neuroscience. We discuss selected experimental results that provide exemplary evidence for uniform causal mechanisms underlying the properties of episodic memory and argue that episodic memory is a natural kind. The argumentation proceeds along three cornerstones: First, psychological evidence suggests that a violation of any of the proposed conditions for episodic memory amounts to a deficiency of episodic memory and no form of memory or cognitive process but episodic memory fulfills them. Second, empirical results support a claim that the principal anatomical substrate of episodic memory is the hippocampus. Finally, we can pin down causal mechanisms onto neural activities in the hippocampus to explain the psychological states and processes constituting episodic memory. (shrink)

In this paper, we introduce and defend the recurrent model for understanding bodily spatial phenomenology. While Longo, Azañón and Haggard (2010) propose a bottom-up model, Bermúdez (2017) emphasizes the top-down aspect of the information processing loop. We argue that both are only half of the story. Section 1 intro- duces what the issues are. Section 2 starts by explaining why the top- down, descending direction is necessary with the illustration from the ‘body-based tactile rescaling’ paradigm (de Vignemont, Ehrsson and Haggard, (...) 2005). It then argues that the bottom-up, ascending direction is also necessary, and substantiates this view with recent research on skin space and tactile field (Haggard et al., 2017). Section 3 discusses the model’s application to body ownership and bodily self-representation. Implications also extend to topics such as sense modality individuation (Macpherson, 2011), the constancy- based view of perception (Burge, 2010), and the perception/cognition divide (Firestone and Scholl, 2016). Drawing on social exchange theory, we argue that family-supportive supervisor behavior (FSSB) inhibits employees’ unethical pro-family behavior (UPFB) via the mediation of felt obligation. We further propose that employees’ positive reciprocity beliefs strengthen the hypothesized relationships. Using a sample consisting of 345 full-time employees from an Internet service company located in China, we found that felt obligation partially mediated the negative relationship between FSSB and UPFB and that the FSSB-felt obligation relationship and the mediation relationship were stronger for employees with (...) higher positive reciprocity beliefs.
