Work on a computer program called SMILE + IBP (SMart Index Learner Plus Issue-Based Prediction) bridges case-based reasoning and extracting information from texts. The program addresses a technologically challenging task that is also very relevant from a legal viewpoint: to extract information from textual descriptions of the facts of decided cases and apply that information to predict the outcomes of new cases. The program attempts to automatically classify textual descriptions of the facts of legal problems in terms of (...) Factors, a set of classification concepts that capture stereotypical fact patterns that effect the strength of a legal claim, here trade secret misappropriation. Using these classifications, the program can evaluate and explain predictions about a problem’s outcome given a database of previously classified cases. This paper provides an extended example illustrating both functions, prediction by IBP and text classification by SMILE, and reports empirical evaluations of each. While IBP’s results are quite strong, and SMILE’s much weaker, SMILE + IBP still has some success predicting and explaining the outcomes of case scenarios input as texts. It marks the first time to our knowledge that a program can reason automatically about legal case texts. (shrink)

Scribal copying is investigated as a test case for the memetic and epidemiological models for explaining the distribution of cultural items. We may hypothesize that the incidence of errors could be low enough to allow two conditions for neo-Darwinian explanation to be fulfilled: first, that there be a rather reliable mechanism for heredity, and second that occasional mutations might produce a version more likely to survive and be propagated than the exemplar. Scriptorial conventions are reviewed. Textual criticism is investigated. (...) Finally, some attention is given to the psychology of language perception and production. In conclusion, it is argued that the memetic model for cultural transmission is not generally fecund while the epidemiological model is. (shrink)

Although wisdom might be considered a quaint concept in a post-industrialised, instrumental and secular world, it deserves serious consideration. This is done primarily from a philosophical perspective and is intended to encourage the reintroduction of wisdom into educational and developmental programmes, especially for managers and leaders. Mindful of the potential naïvete of transplanting systems of thinking from one epoch to another, we nonetheless examine the relevance of pre-modern thought to the post-modern condition. This is done by radically reinterpreting classical Greek (...) texts as Pierre Hadot has done to derive a meaning of "philosophy" and the place of wisdom in the ancient world. The concepts of wisdom, virtue and enacted ethics derived from this re-interpretation are then applied to an ethnographic case study involving a senior executive. This study suggests that a Stoical "wisdom of the moment" philosophy may characterize contemporary leadership practice. (shrink)

Decisions of regulatory government bodies and courts affect many aspects of citizens’ lives. These organizations and courts are expected to provide timely and coherent decisions, although they struggle to keep up with the increasing demand. The ability of machine learning (ML) models to predict such decisions based on past cases under similar circumstances was assessed in some recent works. The dominant conclusion is that the prediction goal is achievable with high accuracy. Nevertheless, most of those works do not consider important (...) aspects for ML models that can impact performance and affect real-world usefulness, such as consistency, out-of-sample applicability, generality, and explainability preservation. To our knowledge, none considered all those aspects, and no previous study addressed the joint use of metadata and text-extracted variables to predict administrative decisions. We propose a predictive model that addresses the abovementioned concerns based on a two-stage cascade classifier. The model employs a first-stage prediction based on textual features extracted from the original documents and a second-stage classifier that includes proceedings’ metadata. The study was conducted using time-based cross-validation, built on data available before the predicted judgment. It provides predictions as soon as the decision date is scheduled and only considers the first document in each proceeding, along with the metadata recorded when the infringement is first registered. Finally, the proposed model provides local explainability by preserving visibility on the textual features and employing the SHapley Additive exPlanations (SHAP). Our findings suggest that this cascade approach surpasses the standalone stages and achieves relatively high Precision and Recall when both text and metadata are available while preserving real-world usefulness. With a weighted F1 score of 0.900, the results outperform the text-only baseline by 1.24% and the metadata-only baseline by 5.63%, with better discriminative properties evaluated by the receiver operating characteristic and precision-recall curves. Legal professionals in Malawi rely on a limited number of textbooks, outdated law reports and inadequate library services. Most documents available are in image form, are un-structured, i.e. contain no useful legal meta-data, summaries, keynotes, and do not support a system of citation that is essential to legal research. While advances in document processing and machine learning have benefited many fields, legal research is still only marginally affected. In this interdisciplinary research, the authors build semi-automatic tools for creating a corpus (...) of Malawi criminal law decisions annotated with legal meta-data, case and law citations. We used this corpus to extract legal meta-data, including law and case citations as used in Malawi by employing machine learning tools, spaCy and Gensim LDA. We set the foundation for a new methodology for classifying Malawi criminal case law according to the recently introduced International Classification of Crime for Statistical Purposes (ICCS). The analysis will encompass the principles of deontic logic as well as the meaning of deontic modals in legal discourse at the time of speech delivery as those 14 points should be classified as a text belonging to legal genres. The aim of the paper is to present the historical background and the linguistic analysis in order to find out whether historical facts, interpretations and language used correspond with one another. This chapter discusses several possible reasons why works by women philosophers have traveled significantly less than those written by men, although women’s contributions go back to the start of European history of philosophy. Differentiating between geographic, linguistic, historic and philosophical travels, Tove Pettersen claims that gender is particularly significant with regard to historical and philosophical traveling. Alzheimer's Disease is a form of dementia that affects the memory, cognition, and motor skills of patients. Extensive research has been done to develop accessible, cost-effective, and non-invasive techniques for the automatic detection of AD. Previous research has shown that speech can be used to distinguish between healthy patients and afflicted patients. In this paper, the ADReSS dataset, a dataset balanced by gender and age, was used to automatically classify AD from spontaneous speech. The performance of five classifiers, as well (...) as a convolutional neural network and long short-term memory network, was compared when trained on audio features and text features. The same audio and text features were used to train five regression models to predict the Mini-Mental State Examination score for each patient, a score that has a maximum value of 30. The top-performing classification models were the support vector machine and random forest classifiers trained on BERT embeddings, which both achieved an accuracy of 85.4% on the test set. The best-performing regression model was the gradient boosting regression model trained on BERT embeddings and CLAN features, which had a root mean squared error of 4.56 on the test set. The performance on both tasks illustrates the feasibility of using speech to classify AD and predict neuropsychological scores. (shrink)

The case law of the Court of Justice of the European Union is shaped by the language in which it is drafted—i.e. French. However, because French is rarely the mother tongue of those drafting that case law, the texts produced are often stilted and awkward. In addition, those drafting such case law are constrained in their use of language and style of writing. These factors have led to the development of a ‘Court French’ which necessarily shapes (...) the case law produced and has implications for its development, particularly insofar as it inevitably leads to a type of precedent in that case law. That case law also undergoes many permutations of translation into and out of up to 23 different languages. The resultant texts that make up the case law are hybrid in nature—consisting of a blend of cultural and linguistic patterns, constrained by a rigid formulistic drafting style and put through many permutations of translation. The present paper investigates the production of the Court’s multilingual case law and considers whether the hybrid nature of that case law can actually aid the presentation of a ‘uniform’ EU case law. Along three measurements at the Large Hadron Collider (LHC), a high energy particle accelerator, we analyze procedures and consequences of exploratory experimentation (EE). While all of these measurements fulfill the requirements of EE: probing new parameter spaces, being void of a target theory and applying a broad range of experimental methods, we identify epistemic differences and suggest a classification of EE. We distinguish classes of EE according to their respective goals: the exploration where an established global theory cannot provide the (...) details of a local phenomenon, exploration of an astonishing discovery and exploration to find a new entity. We find that these classes also differ with respect to the existence of an identifiable target and their impact on the background theory. The characteristics distinguish EE from other kinds of experimentation, even though these different kinds have not yet been systematically studied. The formal rigor and precision of LHC physics facilitates to analyze concept formation in its early state. In particular we emphasize the importance for nil–results for conceptualization and argue that conceptualization can also be achieved from nil–results only. (shrink)

Our linguistic communication often takes the form of creating texts. In this paper, we propose that creating texts or ‘texting’ is a form of joint action. We examine the nature and evolution of this joint action. We argue that creating texts ushers in a special type of joint action, which, while lacking some central features of normal, everyday joint actions such as spatio-temporal collocation of agency and embodiment, nonetheless results in an authentic, strong, and unique type of (...) joint action agency. This special type of agency is already present in creating texts in general and is further augmented in creating texts through digital media. We propose that such a unique type of joint action agency has a transformative effect on the experience of our sense of agency and subjectivity. We conclude with the implications of the proposal for social cognition and social agency. The paper combines research in philosophy of mind with the emerging fields of digital humanities and text technology. (shrink)

Through a series of texts and phone calls, Michelle Carter encouraged her boyfriend Conrad Roy to act on his suicidal thoughts, and after Roy killed himself, Carter was convicted of involuntary manslaughter. The case has received widespread attention, generating reactions ranging from rage at Ms. Carter to disbelief that she was convicted. An issue emphasized up to now is what it might mean for the First Amendment right of free speech if we hold that words can kill. In (...) presenting the case against punishing Ms. Carter, I show how the free speech issue intertwines with several others: Should the intimate exchanges between Carter and Roy have remained private? While privacy is valuable, it should not be a shield for harmful conduct, but did Ms. Carter, through her words, cause harm? If she believed that suicide would relieve Conrad of unbearable suffering, did she even act badly? And should the fact that society judges an individual’s actions to be immoral mean that the individual should be legally punished? The case serves as a touchstone for addressing fundamental issues of political, moral and legal theory with implications broader than whether Ms. Carter goes to prison. (shrink)

The Sārasaṅgaha is a Pāli text of XIIth–XIIIth century by the Sinhalese monk Siddhattha Thera. Its themes include the aspiration to become a Buddha, shrines, meditation, theories on rain, wind, gender and more. The main body consists of citations from the Nikāyas, the Jātakas, the Visuddhimagga and above all, from commentarial literature. By analysing the way the Sārasaṅgaha refers to and establishes a dialogue with the quoted works, this paper promotes a new assessment of the cultural and textual tendencies that (...) influenced the development of Buddhist literature especially in the Middle Ages. In particular, the analysis of this text and the quotations of which it is composed reveals the importance of commentarial literature, a literary genre that only recently has attracted the attention of Pāli scholars. The influence and reputation of Pierre Menard, Author of the Quixote, is easily comparable to the impact of groundbreaking theoretical texts. Numerous philosophers, aestheticians and theorists of literature, music, or visual arts have been induced by this short story by J.L. Borges to reconsider the status of the literary work of art, to rethink the relationship between work and text. The essays collected here move from analyses of the identity of the literary work of art, as it is explicitly (...) established by Borges? narrator, to arguments that simply employ the Menard case as an opportunity for discussing broader issues of literary studies and the philosophy of literature. An examination of some of the writings in the medical and mineralogical texts of Persia in the Middle Ages, written in the Arabic language during the caliphate period, revealed an inconsistency concerning the modern chemical identity of the substance called zinjafr, which was recognized as a medication for wounds, burns, mange, and cavities. Although some of the literature identified it as the important ore cinnabar sulfide), some questioned that identification or even ambiguously described it as a substance produced from (...) lead. A modern chemical study was conducted and identified the latter substance as minium. The reason for the medieval authors not distinguishing between those two compounds is discussed and the fact that the dictionaries of modern written Arabic commonly have the words zinjafr and cinnabar listed as equivalents is also explored. The use of ensemble learning, deep learning, and effective document representation methods is currently some of the most common trends to improve the overall accuracy of a text classification/categorization system. Ensemble learning is an approach to raise the overall accuracy of a classification system by utilizing multiple classifiers. Deep learning-based methods provide better results in many applications when compared with the other conventional machine learning algorithms. Word embeddings enable representation of words learned from a corpus as vectors that provide a (...) mapping of words with similar meaning to have similar representation. In this study, we use different document representations with the benefit of word embeddings and an ensemble of base classifiers for text classification. The ensemble of base classifiers includes traditional machine learning algorithms such as naïve Bayes, support vector machine, and random forest and a deep learning-based conventional network classifier. We analysed the classification accuracy of different document representations by employing an ensemble of classifiers on eight different datasets. Experimental results demonstrate that the usage of heterogeneous ensembles together with deep learning methods and word embeddings enhances the classification performance of texts. (shrink)

This article examines the embeddedness of corporate social responsibility (CSR) communications in strategic planning. By drawing on the idea that talk and texts about CSR are an essential part of responsibility practices, I study how CSR aspirations—responsibility-related organizational self-descriptions, goals, and ideals that the organization cannot yet live up to or that the organizational constituents deem necessary to maintain—are intertwined with strategy texts and strategic episodes. Conducting a qualitative case study on a series of biennial strategy processes (...) over a 20-year period, I show how CSR aspirations are established in authoritative strategy documents during stakeholder interactions, elaborated in consecutive strategic episodes, extended to new business areas, and evaluated in subsequent communications. These findings contribute to the CSR and strategy literature by showing how (a) aspirational talk can be established and perpetuated through recurrent communicative processes, (b) stakeholder engagement in CSR issues can influence strategy texts and how strategy texts become a part of intertextual organizational communications, and (c) strategic context can be conducive to progressive performativity. Business ethics is understood in a comprehensive and differentiated sense, as in recent years it has evolved under the influence of globalization. The present book examines inclusive growth, which includes more than just poverty alleviation and seeks to address the problem of equity through the enhancement of opportunities for all parties. This conforms to the fundamental task of business ethics, which is to enhance the ethical quality of decision-making and actions taken at all levels of business, id est, at the (...) personal (micro-), organizational (meso-), and systemic (macro-) levels and thus extending the narrow notion of business ethics as a niche for managers with good intentions. In the real world of competition and coordination, various situations produce various tradeoffs that the three pillars of the economy - Business, Government and Society - have to pursue for their survival and sustenance. In this book, we look into many such case studies in which the strength of one component leads to a benefit for one of the other components and a detriment for the other, thus causing an imbalance between the three pillars. The study considers the topic of linguistic register by examining how schoolchildren, adolescents, and adults vary the texts that they construct across the dimensions of modality and genre . Although register variation is presumably universal, it is realized in language-specific ways, and so our analysis focuses on Israeli Hebrew, a language that evolved under peculiar socio-historical circumstances. An original procedure for characterizing register — as low, neutral, or high — was applied to four text types produced by the same (...) speaker-writers. We found that across all age groups, “neutral“ items constituted the bulk of the material, and that the lexicon accounted for some 80% of variation. Developmentally, we found that acquisition of fully flexible register variation continues beyond adolescence. Finally, we observed that text types range on a cline from everyday colloquial usage in oral narratives to more formal, high-level language in written expository essays. These results are discussed in light of their implications for the nature of register variation, later language development, and the sociolinguistics of contemporary Hebrew. (shrink)

This gives rise to a rich degree structure. In this paper, we lift the study of c-degrees to the \ case. In doing so, we rely on the Ershov hierarchy. Though whistleblowing is quickly becoming an accepted means of addressing wrongdoing, whistleblower protection laws and the relevant case law are either awkwardly silent, unclear or mutually inconsistent concerning public disclosures of classified government information. I remedy this problem by first arguing that such disclosures constitute a pro tanto wrong as they violate (1) promissory obligations, (2) role obligations and (3) the obligation to respect the democratic allocation of power. However, they may be justified if (1) the information disclosed concerns (...) grave government wrongdoing, (2) alternative channels of disclosure are first exhausted and (3) steps are taken to minimize harm. Among the most complicated issues in the law of delict, in the case of multiple debtors, is to determine the scope of each co-debtor’s liability. The rule of proportional liability clearly favours debtors more than the aggrieved party. And, on the contrary, the solidary liability best suits the interests of the aggrieved party as the risk of co-debtor’s insolvency is transferred to the debtors. Furthermore, in the latter case, the debtors who attempt to allocate the scope of their (...) liability among themselves and fail to reach an agreement have to undergo two legal procedures: the first concerning the compensation to the creditor, and the second concerning the determination of the scope of their liability among themselves. Adequate balancing of the interests of the two parties (the debtor and the creditor) lies among the major tasks of tort law. Therefore, he law should seek specific rules instrumental in determining the scope of the co-debtor’s liability in the case of multiple debtors. The application of the rule of solidary liability is based on the assumption that individuals whose joint actions inflicted damage must compensate it together. (shrink)
